Sri Lanka: Is It Good Bye To ‘Good Governance’?

People who overwhelmingly voted the President Maithripala Sirisena-Prime Minister Ranil Wickremesinghe alliance to power expecting it to fulfill their promise of yahapalana (good governance) have been shocked by President Sirisena’s strident comments questioning the integrity of the agencies carrying out investigations into cases of corruption, bribery, criminal and financial misconduct.

The President speaking at a function at the Sri Lanka Foundation Institute warned that he would take action against Criminal Investigation Department (CID), Financial Crimes Investigation Division (FCID) and the Commission to Investigate Allegations of Bribery or Corruption (CIABOC) for working to political agendas at the cost of justice. The President seems to have been irked at the agencies giving cause to the opposition to accuse him of political witch hunt; obviously, this referred to the large number of corruption and criminal investigations now going against politicians and armed forces officers. According to the Island newspaper, the President also said that hauling up the former naval chiefs and former defence secretary Gotabaya Rajapaksa before the court in connection with the arms storage company Avant Garde Maritime Services (AGMS) case.

He accused those in charge of investigations of misleading him. Referring to the indefinite custody of members of the Directorate of Military Intelligence (DMI) held in connection with the disappearance of cartoonist Ekneligoda and the killing of Sunday Leader editor Lasantha Wickrematunga, the President said the courts should be moved to get them released or given bail pending court proceedings. It is significant that soon after the President’s tirade, the court released on bail Udalagam
a, an army intelligence officer accused of assassinating Lasantha Wickrematunge.

President Sirisena’s reference to cases connected with armed forces was perhaps made to reaffirm his support to the armed forces which have been perturbed ever since Sri Lanka agreed to conduct a judicial probe into alleged war crimes committed during the Eelam war. The issue war crimes issue would again come up at the UN Human Rights Council meeting in March 2017.

In a stinging attack on “certain media organizations, journalists and NGOs” and “traitorous forces,” President Sirisena reaffirmed his confidence in armed forces “no matter how much they criticize, oppose or attack me, I will never lose confidence in the armed forces and will always be committed to do the utmost for the welfare, honour and dignity of the three armed forces and our heroic soldiers.” He added that “he was not ready to compromise national security in order to please NGOs.”

The President said though the government had successfully promoted reconciliation between the communities to create an environment that strengthens inter-communal harmony during the last one and half years, certain groups and organizations ideologically in favour of separatism have not been destroyed. And they were waiting for an opportunity to create trouble for Sri Lanka and people must be on guard.

Reacting strongly to President Sirisena’s stinging criticism, the CIABOC Director General Dilrukshi Wickramasinghe tendered her resignation. In an interview, she denied the Commission was politicized. She said there were 90 politicians under investigation and none of the case files have been closed as alleged by some politicians. She added that she did not select any investigation or interfered with the investigations.

President Sirisena’s statement was in direct contradiction of his own stand in the past on corruption and financial misappropriation; other leaders of the ruling alliance including Prime Minister Ranil Wickremesinghe have been plugging the line of corruption free governance. The civil society and anti-Rajapaksa leaders have already been peeved at the slow progress in bringing to book scam-tainted leaders who thrived during the previous regime. They see the President’s strident statement as an effort to cover up his cronies in SLFP involved in scams. This could also test durability of the cohabitation rule of the SLFP and the UNP unity government. Serious doubts have been raised about the government sincerity in cleaning up governance where corruption has become part of life, in keeping with what seems to be South Asian tradition.

Going on a damage control mode, the cabinet spokesman and Health Minister Rajitha Senaratne said President Sirisena never raised objections to Gotabaya Rajapaksa or former military chiefs being questioned on fraud or corruption. He accused the media of misreporting it and asked them to correct it. He further said the President was not happy at some of the serious allegations of corruptions being ignored.

Perhaps as yet another damage control measure, the government tabled the report of the Committee on Public Enterprises (COPE) report on the alleged scam in the Central Bank Treasury Bond issue in February 2015 to fulfill a long standing political and civil society demand. PM Wickremesinghe had been accused of shielding the former Central Bank governor Arjuna Mahendran’s, considered the PM’s protégé, suspected of involvement in the scam. The investigation report ruled that Arjuna Mahendran was “directly responsible for the transaction” which allowed a company linked to his son-in-law to rake in large profits from the auction. The PM has assured further action would be taken on the advice of the Attorney General.

In another shocking incident, the President’s claim of good governance and successfully promoting ethnic reconciliation to strengthens inter-communal harmony has come under serious threat after the police shot and killed two Jaffna youth undergraduates riding a motorcycle in Kokkuvil (Jaffna peninsula). According to the police, they opened fire when the youth did not obey their order to stop. The incident triggered protests not only in Northern Province, but in the whole nation which has been living with police excesses for long. University students all over the island protested in solidarity with Jaffna university students who went on a strike, indicating the issue was beyond the ethnic divide. Though the five policemen involved in the incident were remanded to custody, the crude police attempts initially to cover up the criminal act indicated that police reforms are still a work in progress. PM Wickremesinghe has promised an impartial inquiry would be carried out. Unless the government swiftly takes follow up action the incident could provide yet another opportunity for separatist elements to build up their support among Tamils.

President Sirisena as a shrewd politician had probably made his statement with a lot of deliberation to reinforce his constituency within the Sri Lanka Freedom Party (SLFP) and to retain the support of some of the political leaders targeted in various investigations. He also appears to be on the move to rebuild his fractured relations with the army, which had been under stress for some time. In a bid to put at rest speculations about the survival of the cohabitation government, Prime Minister Wickremesinghe reiterated its importance to complete the reforms process as agreed upon by the leaders.

In any case, the SLFP and UNP – the two major cohabitation partners – have internal as well as external compulsions to maintain their cohabitation. Any crack could provide an opening for former president Mahinda Rajapaksa to stage a political comeback. Unity would also help Sri Lanka’s cause to face the international community with confidence at the UNHRC. It could also enable the European Union to favourably consider Sri Lanka’s request now under consideration for restoration of the Generalised Scheme of Preferences (GSP+) scheme for duty waiver to Sri Lankan exports. The EU had cancelled the GSP+ concession to Sri Lanka for aberrations in governance during the Rajapaksa regime.

      The President has turned out to be Traitor. He is now referred to as Gon Sirisena Gamarala, because he is in cahoots with the crooks and killers, and interfering with the independent commissions and the judiciary.

        It is becoming clear that in reality, the last government has not been cremated: only put in the freezer for a short while. The New Government would be a Good Bye if they do not pull their finger out and do those things that they promised: i,e to clean up the government and adminstrative infrastructure, as well as state sponsored corruption at high places. We know that instead of cleaning, the new government has been lately indulging on the same corruption as in the past. Therefore the chance of making any step-change in such a short time remaining, is unlikely.

        People’s government next? I hope you are not referring to a reincarnation of the last MR regime. If the last government and the new government are not going to be the people government, may I ask, who or what is the people’s government next? JVP or JHU are too extremists, and we have had bad experience with JVP in the 70s and late 80s, no one would trust them to govern a country. JHU still lives in Dutugemunu era mentally so won’t be considered by minority groups as a balanced body for governance. Similar argument follows for the TNA or muslim political parties, too extremist views togetehr with ambitions to carve up the land among them; no way acceptable to the majority.

        People with balanced views and intelligence are not in politics, preferring to mind their business and professions, and to survive. The exceptions are the Cabraals, Mahendrans and Jayasundaras that are ready to cowtow to the rulers and show them all the clever techniques on how to fleece the country, so that they could also harvest the riches while they are at it.

        I could foresee the right level of people in the Army capable of bringing the back the country in some sort order and discipline, say as it was in Pakistan, but do not think they want to take over the government through illegitimate methods. SF could have done it, if he wanted it,when he had all the power in his hands, but he was too straight and disciplined soldier, and so chose to follow the honest and democractic method. Unfortunately we lost that chance too as he fell victim to the most corrupt and extremist ruler that abused and manipulated the seemingly democractic process to his advantge. So I wonder, where are we going to find this People’s Government?

    President Sirisena’s commnets as well as action, Prime minister Ranil Wicramasinghe’s behind the sceans actions and most members of the yahapalana govt says, it is the same people still governing.

    Sresi’s focus is his next term and the treasure for the generations to come. The PM’s focus is next PM with the his party men in strength in the Parliament. Until then .     In one of my previous comments I raised this concern and which has now materialized as indicated by this post. Many more unpleasant incidents are in the pipeline. Sirisena the moda gamarala set this whole breakdown in motion starting with his cyanide story, Dilrukshi resignation, bailing out laboriously encircled murders who worked directly under Rajapakshas, Jaffna shooting, bond fiasco which is more a mud slinging campaign at RW aimed at impeaching him rather than based on sound legal culpability. The whole anti-corruption, criminal investigation and yahapalana endeavours has been dealt a massive blow by the moda gamarala. The noise of the blow was so raucous it traversed across continents and reflections and boomerang effects are now coming after us. These gasgembos together with overt encouragement from Sira and covert support from Mara punctured the yahapalanaya incurring such a massive fold cost that it took only one dimwit police constable to shoot down two students and now we the tax payers are being demanded to pay Rs. 20M as compensation for the deaths! This is exactly why our elders said “wandurata dalipihiya dunna wage kiyala”

    ‘good governance’ started off with a bang by appointing ‘people’s representatives’ who had been rejected by the people at the ballot.good governance phew.Then the CJ who was appointed by the president said that it was not in the public interest.In otherwords public are not fit to vote cos they are modayas,so it is none of their business and not of any interest to them,who goes into parliament to represent them.

    The Old King’s and Sonia’s acolyte would say anything without any regard for anybody. “Poonaikku Vilaiyaddu Sundelikku seevan pookuthu”. (It is a game for the cat, but for the mouse, pain of death). I know colonel Hariharan is dragging the undergrads’ death for his political game because he had served in Indian army and he has no feeling for pain. He says police accused the undergrads as ran on the check point. These guys wrote Sampanthar, who cannot walk properly these days, had broken and entered the military brigade. He is not telling about the police statements at the hospital was it was an accident killed the undergrads. It is the JMOs found the bullet wounds. He was hiding it only to reestablish his boss’s old point that there is no minorities in Lankawe. So he said that the protest carried outside of Jaffna is a solid and concrete evidence of it is only a police brutality, nothing to do with anything of racial disharmony. I don’t think he had chance to read what Thero de Silva said about what ICUF should be doing. Had he come to know, kaunal might have concluded that it is not even police brutality, but all over the world that students are just being corny with police. The is Kaunal Hariharan’s corny view.

    Ranil is going to China.
    There were news pieces that China issued challenges that it would relocate the Nuraicholai factory to Bangladesh. Nuraicholai is the only white elephant project which has potential to turn it around. (It may work if China fires the CEB engineers and bring some more prisoners, but it cannot run properly with CEB engineers who are too smart to dodge them make the factory to run. I would not doubt about the Chinese’s intention on that as it was said those old machineries of that factory were relocated from an abandoned factory to Nuraicholai. China would well do it again to the Bangladeshi Modayas too. Factory was closed for last two-three weeks. Neither PM nor Old King opened their mouth this time. Last time they challenged the CEB engineers and threw handful dollars on German and Japanese Engineers to investigate the transformers blast. That money was in addition to the blast off transformers repair costs. This time New King has praised the CEB engineers. Isn’t he the one praising the criminal, rapist army as the heroes?

    Last time when Ranil went and came back, he brought couple of stories. There is nothing he has not included in his somersaults in the Chinese issues. He expanded the Port City land and renamed it to sound like an international finance center. But the Hambantota projects are not that easy to hide under the carpet as the excruciating pain of paying the loans interest that has already fallen due is not that small pumpkin to hide in a plate of rice. So he said that India has given China 10,000 acres so he too would give 1,000 acres in Hambantota to China. But the truth is not like that. China is not ready to take a long term (99 years or so) of lease 1,000 acres and let go the loan. It wants all the projects it did and land more than 1,000 acres. So now Ranil is going back.

    In the meantime, before he goes to China he wanted to have the EU business finished. Last time EU refused to accept the fishes until Chinese ships plundering the open sea near to Lankawe on Lankan flags to be curbed. So Ranil might have preferred to finish the EU business before he leaves to China. But the timing went wrong. When the EU observes were here, they saw the rapist army’s Aava Kuzhu’s rampages, police shooting of students and cover up, Army commanders release from prison by New King, Dilrukshi’s resignation, CBG Mahendran saga, Hindunetti resignation…. So the EU observes appears to have not that convinced. EU is not happy with Yahapalanaya. China is not happy. Indian ETCA not yet signed. Only helping hand they have is American GSP+. Unlike Sec.Kerry’s time, if Hillary comes, It may turn out to be a bargain chip for Americans rather than a free ride for Lankawe.
    This is where the Marriage lock chain between Ranil and New King is going to face the test of its strength.

    Sorry, but this President has LOST the respect and admiration of a lot of good, respectable and law abiding citizens, ever since his infamous speech AND the fact that he did NOTHING to rein in his maverick son.

    The son got off scot free. Can that happen to any other son for the same crime?

    Moralising must start at home. In the case of the President, it clearly doesn’t. Sirisena, a man who promised the best that was possible, has let us all down. Sadly, he wont be remembered as a great leader; just a very ordinary one.

    those who have skeleton inside their cupboard will try their utmost to disrupt the on going investigations;
    There must be a code of conduct for those who are nominated to contest election.
    It seems scams after scams are emerging each and every day where the poor taxpayers irrespective of race, religion, language are seeing stars.
    This plundered monies will be covered by implementing more taxes and the people have no say on these matters.

      What a lot of nonsense from a Sinhalese extremist. It was Sinhalese majoritarian politics, Buddhist extremism and racism, based on the Mahavamsa fairy tale, against the island’s Tamils, who have the same right or more to the island as the Sinhalese that caused all this problem and is still causing. Not the Indians, the USA, the BJP or anyone else. They only made use of the situation that was largely created by Sinhalese racists like you.
      The LTTE is a child of Sinhalese racism and Indian opportunism. The Tamils supported the LTTE as they had no other choice, as thanks to the British the Sinhalese were using their majority to deny them any rights. For your information there was no TNA and it was only formed recently. Keep on blaming everyone else for the problems caused by Sinhalese racism, that spawned a horrible racist genocidal war criminal like Rajapakse.
      The irony is you Sinhalese hate us Tamils but most Sinhalese are descended from indigenous and Indian Tamil immigrants from ancient medieval and modern times, who converted to Buddhism and Catholicism.

    Nobody is saying the entire armed forces committed war crimes. The UN resolution calls for investigation only against those who did not play by the rules during the war. The lower rungs of the army personnel can always claim that they simply carried out the orders of their superiors. So those whose hands are clean need not fear and independent investigation into war crimes committed by the government armed forces and the LTTE.

    Hey Hariaran, I am no fan of this gamaya Sirisena bugger but I know what you and your goon squad in military uniform did to the northern people during the occupation of this beautiful country. Raped, murdered and robbed the entire province. While this was all happening, did you question anything or you joined the goons and carried out what you dirty filthy Indians do best?       How many innocent young girls were pulled to the streets and raped, how many medical staff were shot in cold blood, how many innocent men were wiped out. I personally knew at least of 15 people (many older women in their sixties) were shot at point blank range by these monsters from India’s Punjabi regiment. These stinking coolies saw Jaffna and thought it was Switzerland. Dumb bastards, enough is enough. Never ever allow these Indian rascals into the country. Keep them out. Tamils and Sinhalese may fight with each other, but we should resolve our own problems. Never allow these pariahs to step into the country.

        You are correct most of the Indian elite and their Brahmins, even if they are Tamil like the author of this article are anti Tamil and very anti Sri Lankan Tamil. Just go to all their new sites and you will see them giving a free reign to all the anti Tamils. Indian, Pakistani Sri Lankan to post venom/abuse and untruths against the Tamils but will immediately moderate and delete the replies of the Tamils even if the relies did not contain anything abusive or false. I will never trust any Indian especially their establishment. We all remember the IPKF and the great India contribution/support to the Eelam Tamil genocide in 2009
