Sri Lankan General To Be Arrested In South Africa For Crimes Against Humanity

A retired Sri Lankan army general allegedly responsible for a spate of extrajudicial killings in the Tamil dominated Northern Province in the mid-1990’s has come under the scrutiny of activists and international lawyers in South Africa, Colombo Telegraph reliably learns.

General Srilal Weerasooriya is believed to have arrived in South Africa on November 30, 2014 to attend a conference hosted by the Association of Military Christian Fellowships, in which Weerasooriya is leading organiser.

Lawyers and activists are particularly concerned over Weerasooriya’s involvement in the Chemmani mass graves – a mass grave in which victims of a spate of killings by the military targeting Tamil civilians were dumped.

A recent decision by the Constitutional Court of South Africa affirmed the responsibility of the state in prosecuting crimes against humanity in Zimbabwe, under South Africa’s universal jurisdiction laws. A team of lawyers and activists are believed to be pressing for the arrest and trial of Weerasooriya in South Africa for alleged crimes against humanity. The move comes in the aftermath of an informal fact-finding process that lasted over two years, in which evidence linking Weerasooriya to the Chemmani mass murders was systematically documented by activists and lawyers.

Johannesburg – In a ground-breaking judgment, the South African Constitutional Court has unanimously ruled that the South African Police Service (SAPS) must investigate crimes against humanity perpetrated in Zimbabwe in 2007.

The so-called ‘Zimbabwe torture case’ was brought by the Southern Africa Litigation Centre (SALC) and the Zimbabwean Exiles Forum (ZEF) to compel South Africa to abide by its domestic and international legal obligations to investigate and prosecute high level Zimbabwean officials accused of crimes against humanity.

“South Africa’s highest court has set an important precedent: South Africa will not be a safe haven for perpetrators of the world’s worst crimes” said Nicole Fritz, SALC’s executive director. “The judgment represents a clear appreciation for the role of international criminal law and its importance to our domestic justice system.”

In 2008, ZEF and SALC submitted a dossier of evidence to the South African National Prosecuting Authority (NPA) and SAPS, which detailed state-sanctioned torture in Zimbabwe. SALC and ZEF hoped the authorities would initiate investigations but turned to the courts after SAPS and the NPA refused to investigate.

In May 2012, the North Gauteng High Court set aside the decision of the NPA and the SAPS not to initiate an investigation into state-sanctioned torture in Zimbabwe. The High Court ruled that the South African authorities had not acted in compliance with their obligations and held that the decision was unlawful and unconstitutional.

On appeal, at the Supreme Court of Appeal in November 2013, the Court agreed with SALC and ZEF and ordered the authorities to investigate the crimes against humanity detailed in the dossier. SAPS alone launched an appeal at the Constitutional Court which ruled that investigations must be initiated.

“After eight years of legal wrangling, we are thrilled that victims of torture in Zimbabwe now have some prospect of seeing justice served,” said Gabriel Shumba, ZEF Chairperson, “But the case doesn’t just hold out promise for victims of torture in Zimbabwe. Should it be reasonable and practicable for South African authorities to investigate international crimes committed elsewhere – for instance, the Democratic Republic of Congo – potentially the victims of those crimes might approach South Africa’s investigating authorities for assistance.”

Having exhausted all legal appeals, all eyes will turn to the SAPS who have been ordered to commence investigations.

SALC and ZEF were represented by Lawyers for Human Rights (LHR), Wim Trengove, Gilbert Marcus and Max du Plessis.

    This is good news if in fact something should eventuate. I am sure the Sri Lankan Govt will go all out to get their prized General out of South Africa. One such way is to issue Gen Weerasooriya with a Diplomatic Passport and claim diplomatic immunity. There are so many ways to get out of criminal liability if you are in the higher echelons.

    the Chemmani graves were investigated to a great extent unlike other grave later on on in 2009,CBK made sure many perpetrators were hauled up and sent t jail

    Though I hate the SLankan regime and its military, I do not know much about Gen. S Weerassoriya. But the stories I have heard of this man have been quite positive. Too bad, other war criminals are still living a high life while this man pays the price for their crimes.

    There was no evidence of Gen.Weerasooriya’s involvement in Chenmani or any massacre. He was considered a decent officer and was army commander. If this is true then you have to haul up Collin Powell and all the US and UK Commanders for every act committed by their troops. This type of stupid action is counter productive and will only lead to this dictatorial regime marketing this at the elections.

        You are missing the point. The top brass is not responsible for every mad and indecent things the small fellows do. If they did then the big boss of Kataragama too should have been hauled for the Premawathie Manamperi Beauty Queen murder in 1971 insurgency. In that instant those really involved were hauled up before courts and convicted. during that trial the accused tried to implicate the top brass but of no avail. Similarly, the Chenmani murders. Those involved in the rape and murder of Krishanthi Kumaraswamy were dealt with and those found guilty started pointing fingers at others.

        In the same manner Collin Powell and other US and UK commanders cannot be held responsible for every unacceptable thing the juniors did when their respective armies engaged in various territories.

            Because Aswer if SL military leaders are to be hauled up in ICC as you suggest then US military commanders too would have to be given the same treatment. Other wise it is unfair and not democratic.

            And aswer just because one is accusing another, one cannot take another to court. There should be a case and evidences. As almost every case targeting SL military and politicians are motivated by taking vengeance other than so called justice i really dont think you will understand.

    As someone who has heard and known close friends of Gen. Weerasooriya this is nothing but a plan of the current regime to oust all honest and gentlemanly officers and those not in agreement with the Rajapaksas.
    He is one who would not have initiated any of the killings. Even among the ranks he is considered high above the rest. As someone who has even faced personal tragedy in the death of his own son, it is hard to believe such a report.

    I don’t know anything about General Srilal Weerasooriya but the Rajapakses are on form for getting rid of their Army Generals who have had the audacity to claim they helped to win the war and not the Rajapakses alone. The fate of Gen. Sarath Fonseka and the late Gen. Janaka Perera (died of natural causes but his funeral was thrashed and denied the accolade the war hero deserved) are well known. This might even be a blessing in disguise because if he is charged, he may with a clear conscience tell the court of the atrocities he might have have been ordered to do and by whom.

    First of all Terrorist is a relative term, one call terrorist and the other call freedom fighters or group came forward to save civilians from government and no-government thugs/communal violance.     Gen Weerasooriya,Majors Susantha mendis,Larry Gunaratne,Rokwood and many others whose names I cant remember were very decent gentleman officers and some of them unfortunately paid for with their lives in duty for the country,I salute them.

    I personally know Gen. Weerasooriya – he was and is an officer and a gentleman – there would be hundreds of people, Tamils and Sinhalese who can vouch for his non involvement in Chemmani or any other such crime. This kind of action is just to tar all SL Army officers with the tar brush and is not right. Gen Weerasooriya has always stood by his Christian convictions and will, I am sure, rise above this kind of things. Time will tell.
