Sri Lankan General To Be Arrested In South Africa For Crimes Against Humanity

A retired Sri Lankan army general allegedly responsible for a spate of extrajudicial killings in the Tamil dominated Northern Province in the mid-1990’s has come under the scrutiny of activists and international lawyers in South Africa, Colombo Telegraph reliably learns.

Gen. Srilal Weerasooriya

Gen. Srilal Weerasooriya

General Srilal Weerasooriya is believed to have arrived in South Africa on November 30, 2014 to attend a conference hosted by the Association of Military Christian Fellowships, in which Weerasooriya is leading organiser.

Lawyers and activists are particularly concerned over Weerasooriya’s involvement in the Chemmani mass graves – a mass grave in which victims of a spate of killings by the military targeting Tamil civilians were dumped.

A recent decision by the Constitutional Court of South Africa affirmed the responsibility of the state in prosecuting crimes against humanity in Zimbabwe, under South Africa’s universal jurisdiction laws. A team of lawyers and activists are believed to be pressing for the arrest and trial of Weerasooriya in South Africa for alleged crimes against humanity. The move comes in the aftermath of an informal fact-finding process that lasted over two years, in which evidence linking Weerasooriya to the Chemmani mass murders was systematically documented by activists and lawyers.

NEWS RELEASE: ZIMBABWE TORTURE CASE-VICTORY IN THE CONSTITUTIONAL COURT

30 October, 2014

Johannesburg – In a ground-breaking judgment, the South African Constitutional Court has unanimously ruled that the South African Police Service (SAPS) must investigate crimes against humanity perpetrated in Zimbabwe in 2007.

The so-called ‘Zimbabwe torture case’ was brought by the Southern Africa Litigation Centre (SALC) and the Zimbabwean Exiles Forum (ZEF) to compel South Africa to abide by its domestic and international legal obligations to investigate and prosecute high level Zimbabwean officials accused of crimes against humanity.

“South Africa’s highest court has set an important precedent: South Africa will not be a safe haven for perpetrators of the world’s worst crimes” said Nicole Fritz, SALC’s executive director. “The judgment represents a clear appreciation for the role of international criminal law and its importance to our domestic justice system.”

In 2008, ZEF and SALC submitted a dossier of evidence to the South African National Prosecuting Authority (NPA) and SAPS, which detailed state-sanctioned torture in Zimbabwe. SALC and ZEF hoped the authorities would initiate investigations but turned to the courts after SAPS and the NPA refused to investigate.

In May 2012, the North Gauteng High Court set aside the decision of the NPA and the SAPS not to initiate an investigation into state-sanctioned torture in Zimbabwe. The High Court ruled that the South African authorities had not acted in compliance with their obligations and held that the decision was unlawful and unconstitutional.

On appeal, at the Supreme Court of Appeal in November 2013, the Court agreed with SALC and ZEF and ordered the authorities to investigate the crimes against humanity detailed in the dossier. SAPS alone launched an appeal at the Constitutional Court which ruled that investigations must be initiated.

“After eight years of legal wrangling, we are thrilled that victims of torture in Zimbabwe now have some prospect of seeing justice served,” said Gabriel Shumba, ZEF Chairperson, “But the case doesn’t just hold out promise for victims of torture in Zimbabwe. Should it be reasonable and practicable for South African authorities to investigate international crimes committed elsewhere – for instance, the Democratic Republic of Congo – potentially the victims of those crimes might approach South Africa’s investigating authorities for assistance.”

Having exhausted all legal appeals, all eyes will turn to the SAPS who have been ordered to commence investigations.

SALC and ZEF were represented by Lawyers for Human Rights (LHR), Wim Trengove, Gilbert Marcus and Max du Plessis.

The only country that is safe for the mass murderers appears to be Sri Lanka, the blessed land of the triple gem.

How does this man go to church with so many people’s blood on his hands? Is he hoping that God will forgive him? He is an insult to Christianity.

    Is he an Anglican Vellala?

Aren’t you going to do something to stop this man from gallows, particularly a South African one?

Allow the South African businessmen to invest in casinos and import more coal than necessary.

Or ask him to confess to the South African Truth and Reconciliation Commission and get Anglican Desmond Tutu to pardon him.

By the way is Desmond Tutu a Vellala?

Normally when a person takes a neutral name like vaddha it is because he wants to stay neutral and look at things objectively. So anyone looking at this Aswer’s name ‘Native Vaddha’ would think he is a neutral fellow.

But what he is doing is a different thing. While hiding behind a neutral name he brings out the same tamil tribalism. He seems to say ‘you both go out of my land’ but has a soft corner or slap in the wrist approach when it comes to LTTE and Tamil tribalism…..

Vaddhas are a noble community, i will say most noble in SL.

Dont hide your tribalism behind such a people’s name. Come out with your real ethnicity and allegiance, at least sinhalese here dont do that.

This is good news if in fact something should eventuate. I am sure the Sri Lankan Govt will go all out to get their prized General out of South Africa. One such way is to issue Gen Weerasooriya with a Diplomatic Passport and claim diplomatic immunity. There are so many ways to get out of criminal liability if you are in the higher echelons.

You are talking about a Janaka Perera who was not alive even during the whole eelam 4 war. The abuses that you allege janaka Perera did belong to wars conducted in 95-96 in liberating Jaffna. So in other words koheda yanna malle pol.

Serious Doubts On The Inquiries Into The Mass Graves At Matale: Gota The Suspected Perpetrator
      May 21, 2013

      Excerpt:

What is even more worrying is the security of the remains themselves. Earlier inquiries into the alleged mass graves at Chemmani left many unanswered questions about the possible tampering of evidence including the alleged removal of the remains from the site. Given the present utterly disorganised state of affairs in Sri Lanka it is not difficult to tamper with the identified remains at the Matale mass grave. Given also the increasingly degenerating situation of the administration of justice in the country such concerns about the remains found at Matale cannot be treated as an exaggeration.

Hey Sach, you would only ask me to include Rudrakumaran in the list if I support the LTTE or TE. These LTTE buggers have murdered more Tamils than the wonderful racist governments of SL, I am not talking about number of people murdered. The LTTE have specifically targeted and murdered innocent Tamils who opposed them, most intellects have been killed by these buggers. The wonderful SL Army murdered whoever happened to be there regardless. So if you have any issues with Rudrakumaran, then state it as it is. Do not include me in there as I do not condone their behaviour and they are a creation of successive oppressive racist government of SL. To make it simple for a person with a simple mind such as you, I will not ask someone who opposes MaRa to include MaRa in the list as that person and I share the same feelings towards MaRa. Have I simplified it for you? If it is still difficult to understand, please let me know and I will ask a 5 year old child to respond to you, maybe that will make it clearer for you.

Hey Sach, you donkey. I am not sure why Sinhala racists always talk about LTTE, Rudrakumaran, TE, VP and all other rubbish to people who have no interest in those. You would only shove this down someone’s throat if that person supports the above mentioned, not people who oppose it. You do this because you have nothing to defend the racist actions of the racist Sinhala Buddhists? My problem is with the army killing innocent civilians? So stick to that argument. I do not want to hear about Rudra, VP, TE and all other rubbish you talk of. Go and tell those things to people who defend them.

Hey Jim Softy, your comment in regards to the Americans bombing wedding parties is an acceptance indirectly of war crimes in SL by you. Now don’t run back here and recant what you said. Also if Americans are not punished for their crimes against humanity, does that justify war crimes should not be investigated and punished in Sri Lanka? So according to your explanation, if you murder someone in SL and at the same time someone else murders someone in America and goes unpunished, you also automatically impunity from justice? Brilliant, what law school did you go to? School for numb sculls? Are you teaching there now?

    • 4
      7

before asking which law school they went, think which school you went. Just because someone points at American war crimes does not make him or his country guilty of war crimes.

      • 5
        1

Hey Sach, I know what school I went to. Do you know where you went or did you go at all? Do you think these fellows did not commit war crimes? We do not need the Americans to tell us what happened in SL, we know what happened in SL. Innocent people were slaughtered mainly in 2009. Do you deny that?

        • 1
          2

what happened in SL was LTTE terrorists were slaughtered.

Yes Innocent people too died because
          1. LTTE hid behind civilians taking the civilians as a human shield
          2. LTTE shot at fleeing civilians

There are video evidences for both. I dont deny some have died as a result of army shelling. But that is mostly because LTTE crept inside civilians and fired at the army. So SLA naturally retaliated.

Its just shocking to know how murderers like MR, Gota, SF and the likes are let off the hook and noble men like Weerasooriya get caught. This man is a good man and should not be implicated for anything his subordinates might have done.

  • 8
    5

There was no evidence of Gen.Weerasooriya’s involvement in Chenmani or any massacre. He was considered a decent officer and was army commander. If this is true then you have to haul up Collin Powell and all the US and UK Commanders for every act committed by their troops. This type of stupid action is counter productive and will only lead to this dictatorial regime marketing this at the elections.

        3

You are missing the point. The top brass is not responsible for every mad and indecent things the small fellows do. If they did then the big boss of Kataragama too should have been hauled for the Premawathie Manamperi Beauty Queen murder in 1971 insurgency. In that instant those really involved were hauled up before courts and convicted. during that trial the accused tried to implicate the top brass but of no avail. Similarly, the Chenmani murders. Those involved in the rape and murder of Krishanthi Kumaraswamy were dealt with and those found guilty started pointing fingers at others.

In the same manner Collin Powell and other US and UK commanders cannot be held responsible for every unacceptable thing the juniors did when their respective armies engaged in various territories.

Because Aswer if SL military leaders are to be hauled up in ICC as you suggest then US military commanders too would have to be given the same treatment. Other wise it is unfair and not democratic.

And aswer just because one is accusing another, one cannot take another to court. There should be a case and evidences. As almost every case targeting SL military and politicians are motivated by taking vengeance other than so called justice i really dont think you will understand.

The adage Beggars cannot Be Choosers.- is amply used in western and Lankian life.

eg. The sihala Cardinal never bothered when is poor flock is being persecuted or murdered. However when Nonis the DPL and his powerful, rich family were shaken up the Cardinal was prompt and stopped your loving thug Vas from stepping Rome.

eg. Mara and his Drug cartel can choose to assault the army or murder party general sec or set up accident (Sooriarachi) or let loose terrorist tatte motte bette BBS.

As someone who has heard and known close friends of Gen. Weerasooriya this is nothing but a plan of the current regime to oust all honest and gentlemanly officers and those not in agreement with the Rajapaksas.
He is one who would not have initiated any of the killings. Even among the ranks he is considered high above the rest. As someone who has even faced personal tragedy in the death of his own son, it is hard to believe such a report.

another scapegoat by the Gota – Maara dynasty !

Absolutely right Sangakkara, Gen Weerasooriya is an officer and a gentleman whom I know personally. He is a good Christian and would never harm innocents leave aside getting involved in War Crimes. I am certain there is some mistake in this report or someone is up to some gimmick.
Lets get the facts straight first before jumping to conclusions.

    3

I don’t know anything about General Srilal Weerasooriya but the Rajapakses are on form for getting rid of their Army Generals who have had the audacity to claim they helped to win the war and not the Rajapakses alone. The fate of Gen. Sarath Fonseka and the late Gen. Janaka Perera (died of natural causes but his funeral was thrashed and denied the accolade the war hero deserved) are well known. This might even be a blessing in disguise because if he is charged, he may with a clear conscience tell the court of the atrocities he might have have been ordered to do and by whom.

    • 2

Yep right on target let him speak up of the orders he executed,

First of all Terrorist is a relative term, one call terrorist and the other call freedom fighters or group came forward to save civilians from government and no-government thugs/communal violance. One day Nelson Mandela was a terrorist and then a greate leader. In the past in Europ LTTE was a terrorist group but now it is not. In UK LTTE is a banned group but their flag is not, may not be a terrorist group in the future. To my mind they are a greate lot but for survival they could have made many wrong moves like supporting MR to win his election- He never showed his gratitude for that. MR is gathering more and more Karma for his many generation.

Take your case of a teenager accused of letting the baby in her care die in Saudi- Did the King of Saudi even hear your king cry No because he is just another mercenary from across the straits supported by Hindian who dont send their women for menial household work and sex on demand.

Only the victims can forgive you no one else-

I personally know Gen. This kind of action is just to tar all SL Army officers with the tar brush and is not right. Gen Weerasooriya has always stood by his Christian convictions and will, I am sure, rise above this kind of things. Time will tell.
