By Colombo Telegraph –
“A situation has arisen where there is a danger to the security of all of us and our families beginning from the person holding the highest position in the judicial system,” Judicial Service Commission (JSC) Secretary Manjula Tillekaratne said yesterday.
Manjula Tillekaratne said yesterday there was a danger to the security of all of them and their families beginning from the person holding the highest position in the judicial system.
“I absolutely reject the malicious and baseless allegations levelled against me and the Judicial Services Commission these days. We see the only reason for this malicious mudslinging campaign was the media statement issued by me on the directions of the Judicial Services Commission,” Manjula Tillekaratne said.
In the Cabinet meeting on Wednesday President Mahinda Rajapaksa had discussed the possibility of initiating disciplinary action against the JSC Secretary over a complaint .
Meanwhile, the Lawyers Association attached to the Colombo Chief Magistrate’s Court yesterday staged a protest at Hulftsdorp over the mudslinging campaign against the JSC secretary.
A large number of lawyers who participated in the protest urged the authorities not to interfere in the judiciary saying it could lead to the end of democracy in Sri Lanka.

Just like various civil organizations, learned individuals, political parties, trade unions and most importantly the people of this country supported the just call to save education in this country by rallying around FUTA, it is time for us to rally around the JSC. This is no time to be silent. Enough is enough!

While war against terrorism is being waged, many a so called civil organisations, learned, bankrupt politicians and et al complained that Sri Lanka is a failed state and the ‘International community’ must intervene and protect our human rights, democracy and etc. And Westerners threatened to use their lopsided R2P. For our fortune, Rajapakse managed to keep them out.
But some Arab countries couldn’t do the same. An incident in Tunisia against the dictatorial regime had spread to other Arab countries. Western nations jumped to disseminate it as the Arab spring but in reality high jacked it to change regimes they had not liked. And today, all those Arab countries that expected a joyful spring are having a real winter, a bitter one at that. If not for Russia and China, Syria would have joined the queue that is controlled by extremists.
Average man in the streets of Sri Lanka knows that Mahinda Rajapakse has not just ended the 30 year vicious war but brought about a real spring for Sri Lanka. To do that, he had to defeat not just the terrorists but also various types of anarchists as well. Today, none of them talk about ‘failed state’, ‘R2P’ and etc but war crimes. Why?
Sure Rajapakses have their short comings; but what is the alternative? Are we to get IC snakes inside our pants? If election results are any indication, I think IC has no chance here and those that they fund like FUTA is doomed as well.
Here is my question about Dons for the man in the street and not the learned: University Dons wants 6% of GDP for education; in real terms, 6% of GDP means ‘one quarter’ of all government spending not its collection. Most people complain that even that collection or current taxation is too high for them to bear.
If the government is to allocate 6% just for education one need not be a pundit to understand that it must either charge more tax or axe ongoing development programs, vital subsides, health, and etc. Else the Government must resort to print money. Only the un-realists and stupid would say 6% can be allocated by eradicating wastage.
Those that said war is unwinnable or tried to scuttle it by various means say; war had ended but there is no development. They do not see that ordinary folks have improved their living standard tremendously since. They just cannot fathom why they keep losing election after election. (paper pushers)
Needless to say, if allocated 6% as FUTA demands, their product (graduates) that are incapable to find a job or engage in self-employment but look up for government to dole them jobs will increase substantially. It certainly will fill the pockets of lazy Dons who had made very little contribution to improve the economy in any sector. Just compare their published research papers etc in any field with that of their counterparts the world over. If Peradeniya has climbed down to 2400th place in world university ledge, do we have to give more illustration?
Allocating 6% for education or paying more and more money to selfish Dons would only get us in to a deeper rot. Their salary increases should be aligned to accomplishment and performances. For that we have to allow the entire education system to realign itself to suit the current need of the country just like the countries that progressed. That’s the only way to get out of this mess and go forward. This is the best opportunity.

Defence – armed forces – are allocated 27% of GDP, and education, only 1.7% – the bogey of “LTTE resurgence” and imaginary threats from neighbouring countries are cited to justify this.
SL is the ONLY country where this happens.
The Decision Makers have their children studying abroad – why?
What is good for children of the common man, should be good enough for them too.
Is a peacetime army doing nothing more important than education?
What “accomplishments and performances” are required now of the armed forces, with LTTE decimated?
Transfer of 5% from armed forces’ budget,to education budget, will enable good education for all & for future generations.

What is R2P?
you say:
” Are we to get IC snakes inside our pants?”
When did the IC leave your pants?
They have been there all the time.
You say:
“I think IC has no chance here and those that they fund like FUTA is doomed as well.”
The IC invites your representatives to their respective capitals, shut the door and kick them from top to bottom.
Few weeks ago GL was invited to Capital Hill and Hilary squeezed his b..ls. Manmohan met with MR and off the record, kicked him on his back, front, and from top to bottom.
Whoever passes by the island always gropes invited or uninvited. By the way groping has been going on for centuries.
The idea that ” Average man in the streets of Sri Lanka knows that Mahinda Rajapakse has not just ended the 30 year vicious war”
Oh please you don’t have to prove your stupidity once again.

Native Vedda,
True, IC keep playing its usual game alright. So do Rajapakses, and that’s our only consolation, and recent election results show that the vast majority in Sri Lanka wanted to keep it that way.
I am glad IC was never in to our (ordinary people) pants. It was inside Chandrika’s thing. Had they manage to get in to our pants, not only the tiger flag with two guns and blood drips be flying high in our N & E by now, entire country would have become a true failed state like Afghanistan, Iraq, Somaliya, Libya, Egypt and et al.
We profusely thank President Rajapakse for keeping the snke out and holding country at peace while improving living standard of the ordinary man at a rate way above the world average.
I thought Hilary learned what men like best from Monica Lewinsky. Now you are telling me that she likes what men don’t. Or are you trying telling me that she never learns?

im a bit confused. you start by saying that there is a war being waged against terrorism, and then talk about MR finishing off a 30 year war.
Do you think the war is over or not?
If it is over then why does a govt need to allocate more than one fourth of its expenditure on defense?
If it is not over why do the likes of you and the MR regime keep on harping about it being over?

It is unlikely bodily harm from State actors will befall members of the JSC. I believe we have not reached those dangerous depths although various kinds of vermin have been tolerated far too much – insulting the intelligence of the thinking part of the nation. But I could well be proven wrong.
As to dangers to the highest official in the judiciary one might be reminded, somewhat uncharitably it can be argued, of the Sinhala saying when you go to the wedding of the bat you have to do your eating from a hanging position. There is no such things as honour among thieves or space for sympathy to those who willingly come forward to bend purely for opportunistic goals.

It will be an uphill task getting rid of this corrupt family clan, their cronies and henchmen. But, kick them out Sri Lanka must, for our future generations.
Their disgraceful exit from power has already begun.
Sri Lankans must rally around a united opposition. To face the brutal oppression we can expect from the Rajapakse regime in the face of defeat. United we can handle it better and win.

Keep the Rajapakses for much longer so that the Sinhalese also can taste the Paradise…. Then there could be more senses driven into their head.
FUTA is just a start, when the University Dons are feeling the pinch. They all kept silent when the MOD kept increasing their budget from $600 Million dollars to the current $2.4 Billion dollars, whereas the exports are stagnant and the revenues are lower…..
After the end of war, the budget has gone up every years and over 25% than during the war.
FUTA is not talking about filling all the Teachers Vacancies in the North and East which will provide more jobs for the Tamils and Muslims. The damaged schools have not been repaired and supplies such as books and uniforms, mid day meals etc that is available in other provinces are not given in the NE…
Tamils cannot expect Devananda, Karuna and Pillayan to speak on their behalf. ????

The estate schools have been neglected for decades!!!!! and are substandard denying those children of good education for decades….

Most teachers were from Jaffna, who dedicated their life to getting paid and not educating the children.

What are you talking about ? As if a child who was born yesterday ?
The civil war in SL was not started shortly before YOUR HE became the president, it lasted for the last three decades, if I may remind you. YOUR BELOVED leader was almost marching for four decades in lanken politics bearing high ranking positions in each cabinet. Since the war begann in 83,depending on the circumstances that each of the elected govt made their efforts to bring solutions – however each of them stood on their way – being unable to draw the Ltters to discussion tables or discussions were not successful in many sessions as expected tobe. Defeating them millitarily was not THE FOCUS of any previous govts because they respected the human values and the numbers that could loose their lives. To that time, even Your HE reiterated that the sustainable peace can ONLY be reached through negotiations.
Please listen to the following video…
http://www.youtube.com/watch?v=235ykgDoaeM&feature=relmfu
In between tamil refugees that got well recognized their cause in rich countries enormousely supported spending collosal amounts to make them the strongest gurillias in the world. Their millions earned thorugh drug trafficking, human smuggling and other fradulent deals brought their hands in the course of years. TO my knowledge, there are lots of tamils are spending jail sessions in Germany France, Beligium, Denmark and other european countries. Earlier, there were money collectors every corner of Germany, France, England and several other countries where they got their asylum. This I myself have experienced by seeing and talking to some of them in Europe. However, within the diasphora there were various factions with varied views. This is common to us among the sinhalese too in SL. So these fractions later ended up with a internal crisis with the tamil diasphora itself. So in that way, this internal crisis paralized their political wing too. That then caused become them weakened rapidly. To that time, their political leader Anton was also dead by a cancer. Several other leaders showed no strength as had been before. All these converged to become weakend their organisation. To that time, there was a cease fire agreement between the ruling govt (to that time) and the LTTERS.This indeed saved the lives of both parties. – ALL THESE FACTORS EQUALLY AFFECTED ON DEFEATING THEM MILLITARILY.
If the masses would bear the view as you guys do, so why has MR been unable to peace among sinhalese today. The same leader as Amila thera pointed out – has failed to give leadership to his ministers to function properly (Health, Education, Justice and Buddhasasana .. and serverl more fail to do their portfolios properly today)
My question: If so called HE ´s wisdom was instrumental in defeating the LTTERs, why cant he give the leadership to restructure the society today?

Dear Andre,
The answer to your question is – corruption, nepotism, megalomania -all part of the dictatership becoming slowly entrenched thanks to the 18th amendment ( passed in a hurry with noone aware, not even the Speaker,of its contents ).
All citizens are learning the truth too late, only now.

Tactics appropriate for dealing with JVP and LTTE insurrections are quite different from appropriate methods of governing civil society. An independent judiciary is critical to any democracy. This means non interference in the constitutional separation of powers, of checks and balances as we say in the US, rather than a Chinese style dictatorship where the state yields unchallenged power over the judiciary as well as all other branches of government.
But where are the witnesses to these alleged threats by the executive? There is more here than meets the naked eye. You can smell the spin even across the seas.

All those who shout against the Rajapakses among the Sinhalese have no alternate plans or leaders they support or want….
Now the majority of the people are beginning to suffer with the tyranny and State Terrorism. Ha ha ha…

A section of the Judiciary in recent times was subservient to the corrupt executive. May be now they feel that they too have some self-respect and dignity and are attempting to follow the right path and, therefore, they are under threat. This is good example for all those who barter their conscience for perks and privileges extended to them by corrupt politics that once they become subservient in turning back they will have to face hard problems.

He said “There are two kinds of judges – those who know the law and those who know the Law Minister,”
He also said “Even though there is a retirement age, judges are not willing to retire. Pre-retirement judgements are influenced by post-retirement jobs.”
When will the stupid South Asian learn about the importance of independent judiciary.

“entire country would have become a true failed state like Afghanistan, Iraq, Somaliya, Libya, Egypt and et al.”
It was India which persuaded Chandrika to take on the LTTE beginning of 2005, provided all military support including training,….etc. India also provided all necessary diplomatic cover for Sri Lanka to indulge in its slaughter of innocent people. India roped in USA, UK, and other countries. There were millions of things India did to bring the LTTE to an end.
Leela should be not only reading but also reading between the lines.
AS a stupid Sri Lanky I do not expect you to understand the complexities of geopolitics.
Even MR, GR and others said without India they would not have won the war.
Please thank India for their important part in war crimes and crime against humanity committed by MR, GR and their armed forces.
Also note India’s part in culling the JVP terrorism in 1971 and between 1987 an 1991.

People expect judiciary to be absolutely upright and independent and to be the watchdog of the people. Do the people of Sri Lanka have such a judiciary. They should not forget what made MR to appoint Asoka De Silva as CJ over Shirani Bandaranayake. He clearly had a mission to perform for MR, who never asked for a mandate from the people for the 3rd term. The constitutional amendment to facilitate MR for a third term was simply approved the Supreme Court headed by Asoka De Silva and for the ‘job well done’ he was duly rewarded by MR appointing him as one of his advisers. In fact what the Asoka De Silva should have done was to direct MR to go before people and ask for a clear mandate which he never did. Instead he simply betray the judicial power of the people for private gain. This is the kind of judiciary we have in this country. However, this does not mean all judges of the Supreme Court are rubbish, but the number is extremely low.
