Sri Lanka’s Presidency At Risk: The Blurred Line Between Public Duty & Private Life

A President of a country cannot separate his private life from public life. The moment one assumes the office of Head of State, he ceases to be a private individual. His security, movements, and even his day-to-day engagements are under the control of the State.

The Presidential Security Division (PSD) is duty-bound to accompany him at all times, whether he is attending a state meeting, a private function, or even traveling abroad. A specific budget is allocated for this purpose, and his security detail has no discretion to abandon him simply because he is engaged in a personal activity.

Even if a President attends a private wedding, funeral, or visits a sick relative, the PSD must accompany him. His official vehicle too is part of the security protocol. Therefore, in practice, there is no clear distinction between public and private life for a sitting President.

This brings us to the case of former President Ranil Wickremesinghe.

After completing an official tour in the United States, he stopped over in London to attend his wife’s graduation. The expenses incurred for the days spent in London including the tickets of the security personnel who were constitutionally required to protect him as Head of State were later treated as misuse of public funds, and he was remanded under the Public Property Act.

If that is the yardstick, then the same principle must apply to President Anura Kumara Dissanayake (AKD).
👉He has, on multiple occasions, used his official vehicle and security detail for activities that are not strictly state-related. For instance, he has visited his mother in his official vehicle with his security team in attendance.
👉During the local government elections, he attended NPP political meetings using his official vehicle, state-provided fuel, and presidential security to safeguard him.

If the argument is that Ranil Wickremesinghe misused public funds because his security detail accompanied him to a private function, then by the same reasoning, President AKD too has committed misuse of state resources. His so-called “private” or “political” activities have been conducted with the full use of state property and personnel.

Therefore, if one President can be prosecuted under the Public Property Act for such actions, then justice demands that the same standard must apply to President AKD once his term ends. Selective accountability undermines the rule of law. Either the law applies equally to all, or it is reduced to a political weapon.

👉This is not optional; it is considered a state duty because the President represents the sovereignty of the people.

What this has ultimately done is set a dangerous precedent for the office of the President in Sri Lanka. By criminalizing the unavoidable overlap between public and private life inherent in the presidency, future leaders will constantly face the risk of prosecution for performing even the most ordinary personal functions while in office. This undermines the dignity of the highest office in the land and reduces it to a position perpetually vulnerable to political reprisals.

    The parallel that the author draws between RW’s visit to the UK and AKD’s visit to his mother is, I think, on point. If one is wrong, so is the other.

    I think what is really objectionable about RW’s visit in question is certain unnecessary and extravagant aspects of it as reported in the media. If RW had kept the expenses incurred for the private part of the travel to the minimum, this mightn’t have been an issue.

              Leonard…..It is a time-honored courtesy that is given worldwide to the victorious leader, and was probably part of the election funds of the JVP. Cannot be compared to gross abuses of power done when a leader smirks at the suffering masses and utilizes money off the exchequer for his personal celebrations, and one that was 500× the amount of what the current president used that was given as present to him by his party (about $100, but up to $1,000 would have been allowed for him….would have given the other $900 to poor people).

            Ranil cannot be sued for violating a law which didn’t exist when he was President.

                  Now if Ranil had used $1,000 of the public money only one time as his post-election victory present, that could have been allowed. Instead, he used $55,000! And all the money went outside the country.

    If RW’s arrest was solely as the author relates, it is sheer vindictiveness & the real question is who was behind it. If ‘misuse’ of his security detail was the reason, I wonder why none of, at least, the past Presidents & their families were never prosecuted. Seems to me that the govt. failing to prosecute any of the big fish for mega corruption & misuse of power as promised, is trying to deflect growing criticism of their failures on a sensational ‘victory’ by arresting a former President, which will be thrown out by the courts just for the reason outlined by the author. Surely, are our prosecutors that dumb or is the average voter so gullible not to see through this charade?

        Impossible for National Workers’ Union to have not known that Wasantha Samarasinghe was lessee. They may have changed their political or financial leanings now, but weren’t they were part of the JVP network then? Anyway, he diligently used the money for the needs of the Union, and not for personal expenditure.

            OC…….both were/are left-leaning. So, Samarasingha being lessee was legal and accepted by the trustees. Magistrate is being transferred because she was working for the opposing political parties and going above the law.

    This writer’s argument is laughable. In the prevailing system a president does attend all kinds of private functions and political activities with the full use of state property and personnel. That’s how it should be. But that doesn’t mean he is entitled to the same privileges when making a private trip to a foreign country solely to attend a family matter.

    There is a big difference between President RW going to his wife’s graduation and President AKD going to see his mother, both accompanied by a security detail.
    One is no longer President, and can be prosecuted. The other is still in office and can’t be prosecuted. But he will eventually be out of office and no longer untouchable. One should not throw stones while residing in a glass house.
    This may go down well with those who have already forgotten the gas and petrol queues, but these very same people could turn on those they worship today.

      2. The one who used $100 used it in-country, and so the money did not drain out of the country and the people ate. The other used the money on an expensive Western land thus draining the money that was much needed for the hungry people.

      3. One used what was remaining of election campaign money, and was graciously given to the victor. The other dipped into country coffers of the hardworking-suffering-Lankan-Masses as to show ultimate power of brain-education over them.

        In case you don’t know, that’s a fallacious argument. Did AKD walk to Anuradhapura with his security guys? Did the policemen lining his route (yes they do.; unlike you I live here and have seen it) walk to their stations? Where did the fuel for their vehicles come from? Does Saudi Arabia accept Rupees?

    I wonder if this is the type of corruption that the people elected the NPP into power was hoping to uncover ? Corruption over carrom boards or a trip to is family occaction,

    Where are the pots of gold that they were supposed to find in Rajapakse compound ? or the bribles paid for Mig deals ? We were led to believe that that alone could have helped get the country out of debt ?

    I doubt if the charges will be thrown out by the Courts.
    First, denying bail for a so-called ‘offence’ committed two years ago is questionable.
    Is it likely that the former P will ‘interfere’ with witnesses or other evidence? This drama has been on the stage for months. The Presidential Secretariat holds comprehensive documentation and two key support officers have recorded statements.
    The denial of bail is a farce, done on ‘instructions’ to create a public show to prove ‘credentials’.
    As Lihini said, the public and private lives of leaders (politicians) merge while in office.
    As a taxpayer, I have no concerns over a HoS visiting his mother in hospital with supporting State resources. I have no worries over State resources being used for a couple of days to participate in the celebration of academic achievements.
    A former President visited India to receive blessings of the deities and then to Singapore for shopping for an offspring’s wedding while the Nation was under a serious terrorist threat; was this a ‘private’ visit?
    Another HoS recently went to Germany to shake hands with a figurehead Head of State; the HoS visited the Maldives to celebrate 60 years of diplomatic relations with apparently no outcome beneficial to the nation . There are other HoS visits overseas with nothing but a bunch of MOUs which remain in the archives, gathering dust.
    As a taxpayer, I have serious concerns about the use of taxes that I pay from my earnings through sweat and tears.

    Politics is gateway to corruption to enrich themselves.. not just in Sri Lanka but all over the world. , whether it’s the office of the President or a Minister or MP. or council member.

    If Ranil is guilty of misusing state fund so is every member of the Sri Lankan parliament including AKD.

    I am not defending Ranil, lets put all of them behind the bars.
    well done AKD but you may have dug your own grave too.

    Time is what matters …… if someone gets 20 years for Carrum boards …… the state is spared the time, effort, funds and the need to pursue difficult greater/bigger crimes. ……. They got Al Capone for tax evasion.

    Ye will get all this ………. if ye are impartial and come here to seek the truth ……

          so that anything above can be considered as corruption, wasting of public funds, graft, embezzlement . . . . . . . to prosecute.
          All the discussion here is on what Ranil said, not much on two close aides of Ranil, providing evidence after their arrest.

          Total Euro 137, 400, in LKR 25, 080, 680.
          Shiranthi and Daisy not only hired Luxury vehicles but stayed in a super luxury hotel, which some of British Royal Family members avid staying due to exorbitant prices.
          Shiranthi went as First Lady, what was the role of Demented Daisy.
          So Einstein , Please tell us is this tip or the bottom of an iceberg .

    What an immature argument by an amateur who does not appear to be gifted with the power of reason.
    To figure this out, one needs to analyze the entire paper trail. The misappropriation has been a poorly planned act with documents altered with malicious intent to deceive audits.

    If the case is as argued by the author and some of the commentators, why has there been this fuss without declaring so at the get-go?

    He may be only responsible for Rs. 13M, excluding the PSD expenses?

    I witnessd that the Gay Pride parade in Ottawa has been cancelled. A thought ran through my mind: if the organizers of the Parade invited Ranil and Sagala, could he use public funds to attend the parade, accepting the invitation?
