The Commission of Inquiry appointed by President Maithripala Sirisena to inquire into serious acts of fraud, corruption and abuse of power, state resources and privileges, better known by its acronym ‘PRECIFAC’ has recommended legal action on 34 cases where the parties named include former President Mahinda Rajapaksa and his brothers Basil and Gotabaya.
PRECIFAC has recoomended that Mahind Rajapaksa be stripped of his civic rights over losses caused to ITN by getting the television station to telecast advertisements free of charge.
Gotabhaya Rajapaksa has been named in the case regarding Rathna (RAKNA?) Lanka Ltd an Avant Garde Maritime Services Ltd. in which the Commission recommends legal action as per the Bribery Act. Legal action has also been recommended against Basil Rajapaksa over ‘ Misuse of state funds, assets and other benefits.’
PRECIFAC has also recommended further investigation of a payment amounting to Rs 260m by Namal Rajapaksa and his brother Yoshitha ‘under the President’s Office.’

Strip the fellow of his civic rights? Lets do it, but How? It is much easier like during his time to send a white van and make him disappear rather than legally taking away his civic rights. The reality is a Commission of Inquiry appointed under the Commission of Inquiry act can only provide findings and particularly after being a Republic it is just that. If that was the target then A special Presidential Commission of Inquiry should have been appointed in terms of that Act, which requires all Commissioners be a judge of at least District Court Level. Then after its findings with a two thirds majority of Parliament a resolution can be passed to deprive rights prescribed in that act. One may ask me what about the Thalgodapitiya Commission? That was in the 1960’s when the Sovereignty was vested with Queen Elizabeth of Ceylon. Her Majesty’s Royal Commissioners made a finding and based on that finding a special provisions act was passed with an appropriate order in council. No such mechanism is possible now with this Commission of Inquiry.
