Thajudeen – Not The First & Not The Last

They bit my breast and my thighs. It was still dark when I was brought back to the police station the next day. The official who raped me first warned me not to tell anybody about this. They told me they would kill my husband. I started bleeding very heavily. The Sri Lankan media is so much obsessed with unravelling details of the former ruggerite Wasim Thajudeen’s murder. They even cite the undisclosed sources to graphically illustrate the final moments of the ruggerite. As per the Sri Lankan popular English and Sinhala language based media, Thajudeen had been abducted by a vehicle belonged to Red Cross, but used by “Siriliya Saviya” a NGO run by Former first lady Ms. Shiranthi Rajapaksa. It is reported that his teeth and pelvic bones had been broken, his ribs had been fractured, his neck had been pierced with a sharp instrument and the muscles in his legs had been cut with a piece of broken glass. His body showed that he had been assaulted by blunt instrument.

Why the police department didn’t disclose this in 2012? Why didn’t it take legal action based on these findings? And now why they shamelessly tell us that there was a cover up? And why they have not taken any action against the officers who covered this up? Is this the only criminal case which had been “covered up” or any more cases meted out the same fate? If so, how many cases the department has re-opened for investigation? How long will it take to arrest the perpetrators? How long will it take those alleged perpetrators to get the bail? And will our legal system deliver the verdict with in our lifetime? And finally, will the perpetrators be punished or would be released citing lack of evidence? And once they are released, will they say the entire legal action is an international conspiracy and eat kiribath or they will simply have a “bottle party” to celebrate their “Nidaahasa”? And to whom should I ask this question? To the IGP? Defence Secretary? Prime Minister? Or the President of Yahapalanaya? Well! I have some more questions to ask and I feel it is better to ask them at the end of this article.

Suppose Wasim Thajudeen had been subjected to brutal torture at the hands of his assailants; my dear fellow Sri Lankans, he was not the first one and definitely not the last one to meet this agony.

The report “We Will Teach You a Lesson, Sexual violence against Tamils by Sri Lankan Security Forces, released by Human Rights Watch clearly depicts that the torture and sexual violence on Tamils by the state’s security forces is not a summation of the isolated incidents by some rogue soldiers or officers, but it is a clearly drafted state policy and implemented by the glorified security forces of the country against Tamils, its own citizens. The security establishments kept it an open secret and a routine practice so that even the women members of the security forces assisted the rape and torture of Tamil detainees. [ii]

Though large number of minority Tamils were subjected to, the culture of torture and sexual violence and the impunity to the perpetrators in Sri Lanka started with the crackdown of the 1971 JVP rebellion. Still we hear the story of Premawathi Mannamperi who was tortured and murdered by the soldiers from 3rd Gemunu watch, Ceylon Army. Again, she was not the only one. The numbers are unknown. After four decades, Sri Lanka was in the headlines of global news media for the rape, torture and murder of Isai Priya, by its security forces. However, the same popular Sri Lankan news media, who still carry the story of Mannamperi, has shun away from informing the public about the gruesome fate meted out by this LTTE news anchor, probably due the “Smart Patriotism”.

The latest report by the UK based NGO Freedom from Torture (FFT) published this month, reveals that the practice of torture by the Sri Lankan security forces continues even to date (that means even in ‘Yahapalanaya’) and the political leadership is well aware of it.[iii]

In this last forty years of our country’s history, we have heard so many. Batalanda, Sooriyakanda, 4th floor of CID headquarters in Colombo, Matale mass grave site, Josep camp in Vavunia, Dehiwela, Kotahena,Chettikulam police stations, Veppankulam, Omanthai, Nelukulam army camps and countless accounts of the torture victims. However we have heard none of the members of the security forces brought into justice.

The key reason why the state uses torture and sexual violence on its own people is that state is well afraid of its own citizens. Take the Weliweriya massacres in August 2013. Why the military was deployed when the people agitating for the clean drinking water took it to the streets? Because the political leadership knows that masses can rise against the prevalent political culture of corruption and deceit. Despite the fact, that citizens are paying 11% (earlier 12%) of the value of most of the goods and service they purchase as tax, the state offers little. One such example is this article by Prof. Lasantha Pethiyagoda[iv]. The state is obliged to deliver the social welfare services to the masses. However the quality of public service is gone to the rock bottom and the common man (who is obviously poor) is frustrated by the service received from all the government institutions. Weliweriya is such example. When the common man of Weliweriya was denied of clean drinking water, he took the issue to the streets demanding his right for. The then Rajapaksa government considered it as another mode of terrorism and sent its ‘Heroes’ and who in turn killed two school children and an innocent family man who had nothing to do with the protest.

The state was and is unbiased in enforcing its policy of torture and sexual violence own citizens regardless of the ethnicities. Yet, the Sri Lankan society has never raised its voice against it.

Why?

The political leadership of the country has raised the status of the security forces from soldiers to semi-gods. The Mahinda Rajapaksa regime was so keen in marketing the war victory to use it as a base to remain in the power for decades. The regime did everything in its capacity to constantly remind the masses outside the north and east about the ‘second freedom’. It had been done through erecting war monuments, large hoardings, telecasting victory songs and above all the million rupee exhibition “Dayata Kirula”. The underlying concept of these efforts were to improve the image of the soldiers as ‘liberators’ and, through that the Mahinda Rajapaksa family as epic reincarnations of the legendary kings.

Because of this, any ‘smart patriot’ will never dare to raise his/her voice against the atrocities committed by these ‘semi-gods’ since he/she would be branded as a traitor and a terrorist. Therefore, I do not have any hope that the state’s policy of torture and sexual violence against its own citizens will cease in the near future, unless otherwise the Sri Lankan society wake up from its deep patriotic intoxication.

Now I ask my final questions.

Will the Police department find out the perpetrators of ‘White Van’ abductions? Will they say what happened to those ‘disappeared”? Will they arrest the assailants of Lassantha Wickrematunge? Will they arrest the abductors of Prageeth Ekneligoda? Will they find the murderers of Raviraj & Maheswaran? Again, Will the CID arrest those members of PSD who are alleged to commit the murder of Wasim Thajudeen? And finally, suppose those PSD members are sentenced by the court, Will our ‘Smart Patriots’ start a campaign to free those “War Heroes”?

      This is the reason why the Citizen’s need to have a Parallel Justice System, where any citizen can punish criminals if they are not brought to justice. So, the Legal System will know that, if the Police will not do it, the Peoples Justice System will do it for them. A kid of Peoples Mafia Police.

      Q1. Who wanted Thajudeen killed? Why?

      Q2. Who wanted Thajudeen tortured? Why?

      Q3. Who carried out and participated in the torturing? Who gave them the instructions?

      Q4. Who carried out and participated in the killing? Who gave them the instructions?

      Q5. Who carried out and participated in removing the body, putting in a car, and setting it on fire? Who gave them the instructions?

      Need to get to the bottom of it, and a clear message need to be sent, that you can run, but can’t hide.

      Yes, this is Not The First & Not The Last, but many will be caught and punished.

      The LTTE was responsible for many atrocities and war crimes (including its ‘take no prisoners’ policy) but its widely acknowledged even by its detractors that it did not ever indulge in rape (see book by Francis Harrison ‘Still counting the Dead’)

      Your response simply shows that either you are ignorant -which is excusable but most probably someone who is happy to not let facts stand in the way of your own prejudices.

    Why were the Sinhala soldiers of the SLA, as a body, the only batch that was caught raping young girls in Haiti in the Caribbean where they were sent as part of an U.N. PEACE-KEEPING MISSION? Why were there
    so many incidents of rape and molestation of a savage nature of Tamil girls/women in the hands of savage armed forces men almost as a matter of course for decades – the perpetrators being mostly from the army. One reason is most young Sinhala soldiers consider Tamils as their traditional “enemies” and therefore whatever they do is considered legitimate and in the service of the Buddhist Sinhala cause. The Army high command and the system is collutionist as they virtually keep silent in most reported cases. I have heard it mentioned elsewhere this may be because the Sinhalese are possessed of Rakshaka genes (the Kuveni factor?) and that there remains still remnants of the beast in many Sinhalese. I share this comment with due respect to the many decent and civilised Sinhalese who abhor these crimes as much as the Tamils.

    Thajudeen dropped Jeya Prakaash at his home at 11.45 pm. He then dropped Mohamed Sakeer. The 119 call came at 12.45pm. (Darshanie) Sakeer would have been dropped off around 12.15pm.

    That leaves just half an hour for the assassin to intercept the car, torture and kill him, put him back in the car and engineer an “accident”. This does not sound probable at all.

    Thajudeen was highly intoxicated with an estimated 450 cc of alcohol in in system. (Sumanasekera). With this level of alcohol one can barely walk let alone drive.

    After dropping Sakeer at his home Thajudeen dozed off on the wheel. The car veered to the left and hit a wall. The side frontal impact was severe enough to cause the injuries mentioned herein.

    Someone at the scene pick-pockets Thajudeen while he is knocked out. He/she takes the wallet and reports the crash to the Police.

    This is not reporting bro. This is what we call story telling. In a story some facts are true, and other interesting things are wrapped around to get the attention. How interesting and successful the story is purely dependent on the authors ability to misguide the readers mind. Here from the start of his article he have set the mind of the reader to getting into a prejudgment using the first paragraph – the quoted one – which don’t know if it’s a legitimate one or not ———–(personally feels like a event copied from a movie or something because its so straight forward, don’t you think so? . We normally see this kind of stuff all the time in movies – Directed story).——– Reader will start to continue through the story with a hateful mind and judgement already carrying inside and filling the gaps along the road. At the end reader comes to a conclusion, thinks he’s / she’s right and even don’t know his/her mind is already set to accept the authors idea. After reading this my point of view is author is a clearly a hater. Quoting – “It is reported that his teeth and pelvic bones had been broken, his ribs had been fractured, his neck had been pierced with a sharp instrument and the muscles in his legs had been cut with a piece of broken glass” – End of quote. This is something common in a car accident. And also can happen if someone forcibly done this. So no judgments can made since these are points / facts and to get into a clear idea more is needed. But author tries to lead this into a something he believe or need others to believe. So no-reporting there rather story telling.

    Answers to your last questions remains to be “seen”; because all depend on the outcome of the election of 17th August, 2015. If “Yahapalanaya” continues, then we can expect some relief. If not, the waiting results cannot be that comfortable. It has been already reported one “STRONG” contender to enter Parliament saying: “We will throw the court decision to the dust bin when we are in power”. Did you and the people of the country get this “MESSAGE” loud and clear?

    It’s election time so the government has to come up with something extra ordinary to land a final and decisive blow to the knock Rajapakse out of the ring. They dig Thajudeen out of his grave to prove the inhuman atrocities committed by the former president’s family. Had they exhumed the body of Isaipriya or others it wouldn’t have created this much of media coverage and sympathy amongst the public.Thajudeen death is tragic and it’s an act of sadism. The government should not let go the perpetrator it should make sure that he get’s the maximum punishment through a legal procedure and the government should look into all the atrocities mentioned in the article and make sure the culprits if they are proven guilty get’s the maximum punishment for their horrible acts.

    If proper punishments were given to criminals and the ‘heroic’ armed forces, this kind of crimes against humanity wouldn’t have occurred.
    Armed forces are always free to do any crime, especially against minority Tamils suspected or not suspected as LTTE. Just being Tamil is enough to do anything they want. and that was how Prabakaran was created by the racist state…
    Racism will not disappear so long as Sinhala Buddhism is groomed by all eveil politicians for their selfish reasons.

    Kanthiya should also mention about the atrocities perpetrated by Prabhakaran, dashing children on ground and killing them ; cutting children and infants alive and the massacres of hundreds of innocent civilians storming border villages of north and east of Srilanka hacking all the inmates brutally. He killed all these unarmed innocent people. He also killed hundreds of Buddhist priest at Aranthalawa. He went to the extent of storming mosques and the sacred Bo tree and killing innocent Muslims and Buddhidts of Srilanka. Bombed Sacred Dalada Maligawa. He did ethnic cleansing of North.

    Looks like Mr Kanthiya was born after all these atrocities happened. Lawlessness and gruesome brutality against innocent civilians was introduced by Prabhakaran. Why didn’t he protest against Karuna a brutal killer of Prabhakaran when he was appointed a Minister of Rajapaksa for brutalities he has done against mankind.

    It should also be mentioned here that all these atrocities were the start of an era of lawlessness and brutality in Srilanka. But this does not permit the subsequent regimes to do same or worst things on the cover of ethnicity or religion. We need ethnic secularism established in Srilanka to avoid another episode of ethnic disharmony in Srilanka. It may be another LTTE or ISIS if we are not careful. We should be happy that the current Yahapalanaya is bringing back the long lost justice and fair play into our systems and trying to curb corruption and lawlessness. We should be happy that the current regime is trying at least to gather evidence and bring the perpetrators to book. This is not an easy task to regain lost evidence. It may be difficult to prove but we should appreciate the gesture of the government to bring in a new culture of justice and FairPlay and get the people to fall in line. It will also bring discipline into the police force.

    We have seen how the social fabric was deterioratingg during Mara regime. We saw lawlessness, corruption ,crime, murder, and rape – with rape committed by politicians and political stooges bringing disrepute and shame to our nation. There was no policing by police. Police were indulging in politics, stooging the corrupt politicos. There were times when police officers were intimidated in the police stations and assaulted by politicians and their goons.     We saw how Shirani Bandaranayaka was harassed and the Judiciary was interfered and pressurised to do what Mara wanted. We saw how the bureaucracy was going down with politicization and getting riddled with corruption. We hear that the high officials in trouble for the corrupt practices done under the past regime for which they are charged and remanded are stating that those irregular things were done due to political pressure for their survival. Apparently they have not expected the regime to change for a while.

    We are tired and disgusted of this crooked system. Enough is enough. We need a change for the better. Let’s try to put and end to this nonsense. Let’s be vocal and be responsible citizens. Our people are literate and intelligent and cannot be fooled all the time. Yes we appreciate Mahinda for getting rid of terrorism. That’s why we gave him a second term which apparently became a tyranny. Another North Korea. The taste in our mouths are so sour. That’s the signal our people gave on January 8th. We need to proceed on this path and bring good governance back in place. Let us encourage the current regime to revive our system

    Trying those who were corrupt and criminal to bring to book is an attempt itself to show the world that there is justice brought to the system. This will be a deterrent to others in power to breach justice and take law unto their own hands in the future. We expect the system to be cleaned of corruption and lawlessness. We should not expect that the suspects would be convicted or jailed. Let the judicial system deal with it. But let that be an eye opener. If YAHPALNYA fails lets teach them also with our ballot in a worse way!!

    Kanthiya should also mention about the atrocities perpetrated by Prabhakaran, dashing children on ground and killing them ; cutting children and infants alive and the massacres of hundreds of innocent civilians storming border villages of north and east of Srilanka hacking all the inmates brutally. He killed all these unarmed innocent people. He also killed hundreds of Buddhist priest at Aranthalawa. He went to the extent of storming mosques and the sacred Bo tree and killing innocent Muslims and Buddhidts of Srilanka. Bombed Sacred Dalada Maligawa. He did ethnic cleansing of North.

    Looks like Mr Kanthiya was born after all these atrocities happened. Lawlessness and gruesome brutality against innocent civilians was introduced by Prabhakaran. Why didn’t he protest against Karuna a brutal killer of Prabhakaran when he was appointed a Minister of Rajapaksa for brutalities he has done against mankind.

    It should also be mentioned here that all these atrocities were the start of an era of lawlessness and brutality in Srilanka. But this does not permit the subsequent regimes to do same or worst things on the cover of ethnicity or religiokn. We need ethnic secularism established in Srilanka to avoid another episode of ethnic disharmony in Srilanka. It may be another LTTE or ISIS if we are not careful. We should be happy that the current Yahapalanaya is bringing back the long lost justice and fair play into our systems and trying to curb corruption and lawlessness. We should be happy that the current regime is trying at least to gather evidence and bring the perpetrators to book. This is not an easy task to regain lost evidence. It may be difficult to prove but we should appreciate the gesture of the government to bring in a new culture of justice and FairPlay and get the people to fall in line. It will also bring discipline into the police force.

    People keep asking why the police did not report their suspicions or request an autopsy at the time of Thajudeen’s falsified accident. One has to be ultra naive to think that anyone questioning the activities of the Rajapakses will remain alive for too long. They were untouchable as they controlled the judiciary, the Security forces and the accident investigators and the mainstream press, except for the courageous publishers like Lasantha Wickrematunge and of course Colombo Telegraph who did get hurt.
