The Absence Of Fear Does Not Necessarily Mean The Presence Of Courage Or Bravery, I Saw My Mother In Her True Form – CJ’s Son

By Colombo Telegraph

“I will always remember my 22nd birthday as the day I saw my mother in her true form. As an individual who lives up to what she has taught and instilled in me for the past 22 years. The absence of fear does not necessarily mean the presence of courage or bravery. However, today I saw that the absence of fear does constitute the presence of integrity in the face of adversity. If I am to celebrate, I do so in celebration of that integrity. Thank you all for your kind thoughts and wishes. Veni, Vidi,…..!” says Shaveen Bandaranayake Kariyawasam, the Chief Justice’s son.

He posted above remarks in his Facebook;

It is unfortunate that your mother ate the bribe offered by MahindaR with jobs to your father. It was no different from the bribes he gave to UNP MPs to get their vote, which I also supported then to keep the parliament majority.

But now your mother is caught in a trap and she cannot come out. By taking verbatim the list prepared by Paikiasoothy, your mother left room for politicians to brand her as a CBK-sponsored separatist/federalist.

Will there be any justice for those who offered the bribes?

Well said son. Can you get the priest Sobitha to initiate a petition against the impeachment and get the JVP to take it to the villages and get people to sign it . I am sure you can get almost the whole Of Sri Lanka to sign it. We are not interested in Politics. Those are a lot of idiotic thieves. But we do love our country.

Will the Black Coat gentry including those who sit at benches, stand up to Justice or bend backwards for the crumbs from the table? What a Sevile Nation? It is in the blood of many. First they were led by the Royalty from India. Then the Coastal areas under the Dutch and the Portuguese followed by the whole country under the British. I believe such servility has been ingrained in many and this society will only survive and prosper under such dictate.

Your mother has the courage that few men have shown. Very easily she could have bowed down her head before the executive and done his bidding but she chose to uphold the scales of justice.

Whatever people may say or the outcome, history will record that she stood alone against the machinations of the govt to usurp the constitution. All right thinking and patriotic citizens will stand alongside her in her stand for justice.

I don’t understand how stupid people like you come around to trust the ordinary people who put the clan where they are now.

What did make you to think that the stupid people (20 Millions )of the islanders will make the difference when they in the past consistently failed to make the right choices?

For that matter did the people have any choices in the first place?

      You say:

“Lets go public all out. People are waiting if someone lead.”

That is precisely the problem. These stupid people have to learn to avoid so called leaders and think for themselves. Only free will and free thinking can liberate them from the clutches of these leaders. People have to lead the leaders not the other way around.

All leaders irrespective of their race, class, religion, region in the past and present led to self destruction.

      Enough is enough.

Yesterday I heard a News release, how Judge Ranarajah has prevented the UNP from expelling Mohan Lal Grero while sitting as a UNPer in Parliament voting with the govt., when the UNP has taken a decision to vote against the 2012 Budget, saying that it infringes on Grero’s Soverignity. Whose Soverignity Grero is upholding? Is it Grero’s or the Masses who voted him to represent the masses? What a Mockery of Justice? Kicking the Constitution aside? Law is an Ass indeed and those who sit as Judges are Donkeys merely following their peers who have wronged this society. No initiative and character on their to decide and they prefer the crumbs thrown from the Table. Disgraceful Veysa Balligey Puthas having bo back bone!

      gamini,
      You are quite correct.
If a parliamentarian chooses to leave his party,it is no concern of the judiciary.
If that party wishes to expel him, this is also no concern of the judiciary.
Any MP who betrays his party and those who voted for him, does not deserve to be in parliament.
This judge does not deserve to be a judge.

        justice says:

“Any MP who betrays his party and those who voted for him, does not deserve to be in parliament.”

Betrayal is a loaded term which is used variously by those who fear of loosing their vested interests.

MPs are elected by the people hence their foremost duty is to serve the people not the party nor its leadership.

Duty towards people is paramount than loyalty towards their paramount leaders.

Your Mom not only stands the integrity and independence and dignity of the judiciary alone, she also stands for the collective dignity of the citizenry of her people. She is what she is today, thanks to the taxpayer-maintained public education system of our island home and as a citizen, I am proud to see her paying back to the country. I sincerely wish her courage. Ask her to go doggedly ahead and defend the nation’s dignity and self-respect. We can’t afford to go from democracy to to feudalism. As a citizen and not a vassal of Lanka, I do admire your Mom.

Shaveen is doing a great disservice to his mother’s integrity by making lot of noise.

Justice is suppose to be blind. It doesn’t matter whether CJ is innocent or guilty if the constitution has a provision for impeachment and is sufficiently vague as to the required “proof”, then there is little CJ can do to prevent the government from doing what they want. For that is the law and it is immaterial whether that is democratic, desirable etc.

Shaveen should keep quiet and let other people take on the government in this regard. Judges dabbling in politics is as worst as military men doing the same, while in office or even in retirement.

CJ should face the “charges” framed against her and leave office gracefully. Rather than using her Son to make her case (so it seems to be), she should let people decide whether what the government did was right/wrong when the next election comes.

    • 0
      0

      Navin advises:

“she should let people decide whether what the government did was right/wrong when the next election comes.”

When did the people make informed choices in the past?

Since the people themselves are irredeemably stupid they cannot see beyond their noses.

You are expecting stupid people to elect stupid people to form a stupid government to rule a stupid state.

There are lot of things wrong with the structure of state and its governance. The impeachment issue is one symptom and not the root cause.

Without the wholesale restructuring of the state you will see the disease manifesting in other ways too. Find the root cause and deal with it.

    As her son you can say;
I saw my mother in her true form.

but masses in sri lanka [ WANDER LAND OF UNIVERSE] WERE LOOKING AT A HER IN DIFFERENT ANGLES AND NOW ALSO.

BECAUSE SHE WAS HANDLING THE JUDICIARY IN DIFFERENT WAYS,
LIKE THAT SARATH NANDA SILVA,[A SHAME TO THE BUDDHISTS].

    Shaveen Putha
Your mother knew about the sort of people she was in the midst of.
She was aware of the closeness and the unsavoury dealings that the ex CJ’s who she had succeded had with the one holding the highest office in the country and should not have tolerated any compromise of her position,if she wanted to deal with matters according to law in the pursuit of justice.
Give her all the encouragement to stand her ground and face the impeachment charge with courage. She has the support of all right thinking people in the country and the world.

The integrity and courage of your mother is to be admired. But the very judiciary that’s being threatened today under the stewardship of a former CJ who finds himself in the dustbin of history made it possible for a government to muster a 2/3 majority through fraudulent means in baiting opposition parliamentarians. This very move has robbed the country and its people their right of vote and representation through the political party of their choice. The 2/3 majority of the government in reality is not a true representation of public support as expressed by voters at the last general election. Is it democracy to legitimize the whims and fancies of deceitful individual crossover parliamentarians engineered through despicable means by the government in power to their advantage in total disregard of the will of the voter who find themselves aghast at seeing their vote being snatched away by a government of not their choice. This is the biggest robbery of election votes surpassing all that can happen on the election day by a thousand fold.

    Dear Shaveen ,

i have noticed few courageous individuals in recent past , and those are the ones who had back bones to stand up against this incessant gross injustice, lawlessness and madness. Each individual on his/her own way made a huge impact in our social fabric and those are none other than
    1) General Sarath Fonseka
    2) judge waraweva
    3) Final year law student Thushara Jayaratne
    4)CJ Dr shirani Bandaranayake

by no means , they are perfect ,of course they have their own short comings but their extraordinary courage and fearlessness and willingness to stand against all the odds made them stand tall among the pseudo heroes whom we often praise. we have seen the real picture and the true characters of Actors, singers, Sports personals , celebrities, religious leaders and intellectuals . shaveen , whatever the out come of this kangaroo court ,your mother will always remember as an individual who did not cow down to intimidations and threats, and indeed you can be really proud of your mother, so do we!

However what did she do in the Fonseka’s case. We need to fight this war criminals especailly Gota and MaRa. But sorry shaveen your mother is not Saint nor Brave. Now what she is doing is for her own survival. Had she done this in the Fonseka’s case, it would have been bravery. There are thousnad of Tamils living in intermant camps. If she has done anything for them, it would have been bravery. Integrity, she has nothing Has she not accepted the appointment of your father, it would have been. If your father has resited the The Finance deal and resigned it would have been a bravery. Your parents danced with the devil and now they are in trouble. You have been haunted by the evils that your parents did along with the devils. People are with your family not because your family is onnocent or brave but she is being impeached for the wrong reason by the wrong people to do more evils for the country

        Raja ,

Your race card is quite unwarranted, don’t bring this up now , For your information there are millions of decent Sinhalese in SL who did/don’t approve the slaughter of innocent Tamil civilians and continue to fight to protect the Tamils legitimate rights to live peacefully .
Try to understand , this junta regime is not just attacking Shirani Bandaranayake but the most prestigious position of CJ , of course she has made no of mistakes , we are fully aware of those misdeeds , but the fact of the matter is , she is wise enough to know where to draw the line , compare with the former CJ, he did/does not know where to stop ,even after his retirement still bidding for this junta regime. Just go through the no of damages he has done to SL democracy , in fact he is the root cause of this mayhem what we are witnessing , whereas current CJ knows her actions & decisions have far reaching consequences generations to come , that’s why she put a full stop for this madness.
So Raja this is not the right time and right place for your loathed views , Shaveen is seeking moral support from the general public during this difficult times , it is not ethically, morally right to attack his parents at this juncture.

“For your information there are millions of decent Sinhalese in SL who did/don’t approve the slaughter of innocent Tamil civilians and continue to fight to protect the Tamils legitimate rights to live peacefully .”

Where were these decent Sinhalese people who did/don’t approve the slaughter of innocent Tamil civilians yet did nothing to prevent it.

Not only they remained conveniently silent during the slaughter but happily rewarded the clan with successive election victories. Demela bashing was/is a vote winner in the past, present and will be in the future. The regime was riding on a Sinhala/Buddhists nationalist tide during and after the war. The decent Sinhalese people rewarded MR with his election victories.

What did the decent Sinhalese do to stop the UNP killing Sinhalese youth between 1987 and 1991 when an estimated 130,000 innocent people lost their lives?

Did the decent Sinhalese people bring the killers to justice in the past 21 years?

Decency is a word which has no relevance nor meaning among the Tamils and Sinhalese.

M.J….Better you do your research before commenting in this blog.

      1) Do you know who are the biggest share holders in the stock market….

      2) Do you know who instigated to take overt Shell Gas…what is the transacted amount…where the money went in foreign currency…

      3) Who is responsible for Golden Key catestrophe…what was the reason behind it….

      4) Why profit making Daya Gamage sugar factory was appropriated overnight..

      5) Where Rs: 800 million spent on Advertising CW Games came from…

6)Where are the Bids and tender procedures for all major Govt. construction projects…..Were they passed in the parliament…

      7) Who are the biggest Drug Cartels in Sri Lanka now.

      8) Why Govt. planning to open an embassy in Monaco ….where only 35,000 people live……and near Italy where we alread have an embassy.

You are wasting time hitting the wrong tail where the snake head looms somewhere. Mr.Kariyawasam was deceived, forced and instigated as a pawn for the snake to get it’s prey, without him getting a single penny for himself from this deal……and when it got exposed by Dr. harsha de Silva in the parliament….Mr. Kariyawasam became the sacrifical Lamb to cover up the whole thing….
Who is funding now closer to two years (2) in Singapore Hospital….the famous “I can’t Remember” Joker….and where that money coming from…
      I could write a history.

Please don’t think people don’t have Ba..s. but are wating correct time to expose.

    Actually,

I like if Dr.Shirani fails this, I like if the government wins it.

It’s absolutely injustice for Dr.Shiranie, but if the government wins, international pressure will pile up.

This government will thrive only until the Chinese economic boom prevails, don’t forget that the western powress is coming back.

I’m among the many who like an end to this Rajapaksha government. This is why I liked by then to hear CBK announce Kadirgamar as prime minister. Unfortunately the villains killed him.

Truth is, if we don’t like another bloodshed, we’ll have to wait…

Unfortunately the Rajapaksha family is making us wait..

I think SUPREME COURT SHOULD IMMEDIATELY (WITHOUT DELAY) APPOINT A BENCH OF SENIOR JUDGES AND START HEARING THE CJ IMPEACHMENT TRIAL WITHOUT WAITING FOR THE NEXT PSC HEARING.

Since people have no faith in unqualified and biased PSC the only way to bring justice to CJ is by bringing her in front of a qualified, experienced and honest bench of SENIOR JUDGES.

SINCE THE 14 CHARGES ARE ALREADY KNOWN CJ COULD ANSWER THEM IN FRONT OF THESE SENIOR JUDGES.

The trial also should be open to PUBLIC and should be broadcast on RADIO/ TV so public could witness the trial.

THIS IS A MUST AND IMMEDIATE AND THE FAIR TRIAL WILL GIVE JUSTICE TO ALL.

    God bless to all,
Waiting to hear others comments….on this.

Jayantha, we should understand supremacy of parliament. There was a case in UK, Burmah oil v Lord Advocate which British gov. Had held liable for refunds to companies which had destroyed by their property at the gov. request. But parliament pass the war damages act 1965 and which said gov. not liable for such damages!!!
As common people we are expecting trueness and honesty from all judges. One rare case judge mr. Chitrasiri was appointed for fonseka case who refuse to sit on the bench, also he was appointed as director gen. for inland rev. who resigned after one month.
We should not surprised if DIG arrest tomorrow and put him in jail for narcotic case!!! They aren’t mango people in banana republic!!!

Shaveen, we vehemently oppose the impeachment not because she is your mother ,but because we respect her office as the chief justice. She too is to blame for pandering MR at the beginning as she gave several judgements in his favor. Her biggest mistake was allowing your father to accept thepost of the Chairman of the NSB which appears to me as accepting a bribe. Remember that as a CJ her conduct has to be impeccable.
How ever we are all behind her during this difficult period and will support any civil protest to show our solidarity.

Whatever the pros and cons of the impeachment issue is, and whatever the son says about his mother, from her appearance in the photos it could be noticed that Shirani is undisturbed, steady and assertive. Perhaps she is getting moulded as a future challenger to the established corrupt political system.

    Dear Shaveen,

We are proud of your mother…our CJ and the policies she stand behind.

I know with her knowledge and experience she will teach MR an unthinkable lesson in life who was looking for the wrong prey.

MR the snake who brought it’s venom from Weeraketiya the notorious THUG colony to Colombo which previously was relatively a peaceful place now started to spread the venom all over Sri Lanka and anybody could see them now.

My father always tell never to trust even a blind cat from that area and his words have proved now.

Anyway with your mother’s impeachment by MR the woodpecker pecked the the wrong tree.

My only advise to your mother is to teach this Kelawed-a a lesson which he will never forget for his whole life.

I know surely with her knowledge and experience I don’t have to tell her what to do, but please remember that there are 22 million Sri Lankans behind her and with our sincear support, send this Kelawad-a and his family goons back to the dungeon where they came from….or to another nanthikandal lagoon.

Also make him lick your mothers feet for ever….and I know she is very capable of doing that specially to this uneducated thug.

Make him tired until drop dead with this impeachment.

All our prayers and blessings on your family.

I wish things would end up best her to be able to help the nation further. Unlike the current leaders, she is an educated person – who has the potential even to become the leader the of the nation. This problems can help the masses that rally round to go with current president be aware, how he really is. If we achieve that, things can turn its way better for the folks who have been waiting to see a change soon.

    Dear,Shaveen,
    1. We as law abiding citizens vehemently condemn the way that your mother is impeached.
    2. However, your mother should not forget the fact that her appointment to the supreme court by Chandrika Kumaranatunga was it self a political appointment. Did she possess any court experience either in the official bar or in the unofficial bar at the time of his appointment?
    3. Could not she realize when your father though he did not possess required qualifications was offered key posts in the commercial sector by the government that she would be required to dance according to the tune of the government
    4. Did not you questioned or at least raised the issue of her integrity when she shook hand with Namal Rajapaksha and posed for a photograph with him during his admission to the Bar. Has she extended the same courtesy to the other newly admitted lawyers?
    5. All the SC judges know how Manjula Thilekaratne became your mother’s tale carrier against Sarath Silva and what made her to appoint him as the secretary JSC overlooking some 30 senior judicial officers.
    6. Knowing that your father is going to be prosecuted, your mother created a situation to show that the executive was trying to influence the judiciary.
    7. Did not your mother go to Temple Trees and meet the President on several occasions and make complains against Sarath Silva?
    8. We never say that your mother is a rouge or a dishonest woman but she is an opportunist.
Please comment on these issues before you publish your next article in support of your mother.
    Good luck

These are reasonable questions. However, it must be appreciated that Shirani at least at some point changed her approach and resisted the illegal demands of the political powerful and now she is courageously facing all the onslaught aimed at her. Only hope that she will maintain this position till the end and set an example to all those in responsible positions will not surrender their legitimate rights to the communal, corrupt and violent politicians who, once coming to power after making false promises, resort to taking the whole country to ransom.

      h.Fernando:
Let me give you some heads up to some of the questions you have raised although I could write in more detail…I give brief answers in this blog.
For your Q#2 when you look at the history from JRJ to MR all the CJ’s were political appointees. At least current CJ has basic qualifications with Masters degree in Law from a university of London, and a law professor for 14 some years at the university of Colombo. Also being a law frofessor, she was exposed to some kind of practicle procedures and contacts with the supreme court and Bar Asso.
How can you justify this with a mere book-keeper/accountant holding the governor’s job at Central Bank or a planter becomming the Chairman of Sri Lankan Airline or a tea salesman as the Ambessador in a well reputed western country or president’s other 300 odd unqualified, unfit family members holding top Govt. jobs……
Q#3/4 mostly same as above and also this is the way President get his dirty work done. Read news about stock market, who are the main share holders, stock brokers, funders, inside traders,Bank and corporation heads etc…CJ husband was used as another pawn SM deal that got exposed and subsequently he has to resign for doing big thief dirty work.
It is MR PR stunts he use to get attention from public to get photographs with dignitaries. He has a camera crew of 20 odd where ever he travels,,like in Russia where he got the Hon.degree and published in all papers.Meanwhile do you know that MR spent 750 million rupees for his last birthday advertisements alone( Read srilankaxnews.com)MP Dayasiri Jayasekera revealed this. So CJ was induced to take the photos by MR and not because she liked it.
Meanwhile people are still questioning how the one and only Namal Rajapakse Law scholar got 98 marks ever in Sri Lanka history writing alone in an A/C room with a computer beside. They want to know who corrected his test paper and demand to show it to public.
Q#5 It is not only by CJ who appointed MT..but by the JSC bench, and he had sufficient qualifications to be the secretary.
Q6# It is the President who presurred CJ to get his dirty jobs passed through Judiciary and came to a climex where she had to say STOP..enough is enough.
Q#7/8 Yes ex CJ S.N, Silve is the root cause for all these problems that the Judiciary and the country facing today. He created the Chief Executive monster…a kelawedda given a crown and now running all over like a crazy horse with horns destroying the country.
Yes She had to go to Temple trees to fight and struggle with crazy serpent MARA to keep liberty, justice, democracy and peace in the country, thanks to her unbowing self, otherwise by now could have been a living hell.

So please change your attitude and negative thinking and praise and respect the people who deserve them and not the double faced dirty crooks who alway try to deceive people like the serpent.
I could write you more if you need further clarifications.

      Let me have your comments…
