With a single pronouncement, President Mahinda Rajapaksa has cleared the air of all false hopes, unreasonable expectations and rational imaginings. In his reply to the begging-letter by Ministers Tissa Witarana, DEW Gunasekera and Vasudeva Nanayakkara, the President has stated that the impeachment will go ahead, the Daily News reported on Christmas day. There will be no compromise or détente; not one step back or even aside. The impeachment will move forward inexorably, profaning everything in its path, spewing venom in its wake.

The state media and the Rajapaksa shock-troops (notably Ministers Wimal Weerawansa, Rajitha Senaratne and Mervyn Silva) are spending the holiday season in full combat-mode. Insults are being hurled not only at the Chief Justice but also at the judiciary and the Bar Association, plus anyone or anything seen as an impediment to the impeachment.

Let’s assume for a moment that the state’s derogatory cacophony is factual and that Shirani Bandaranayake, the chief justice handpicked by President Rajapaksa, is a seasoned criminal seeped in depravity. If so, it is not only Shirani Bandaranayake who should be impeached; Mahinda Rajapaksa, the man who elevated her to the august position of chief justice and the Fourth Citizen of the land, too must be impeached, for criminal insanity.

Only a man of unsound mind would have picked a woman of criminal persuasions to be the country’s chief justice.

If the President’s handpicked chief justice is a hardened criminal that is proof enough of the President’s unsoundness of mind and thus unfitness to govern. If the CJ’s rightful place is Welikada, the President who appointed her belongs in Angoda.

So, if the wild accusations of the state media and the UPFA ministers are accurate, only one conclusion is logically possible: not only the ‘criminal chief justice’ but also the ‘insane president’ must be impeached.

If Shirani Bandaranayake is removed but the president who appointed her remains, and appoints another chief justice, what guarantee do we have that the whole unseemly spectacle will not be repeated a few months from now? Unless the new chief justice is a Rajapaksa serf, not conjuncturally but structurally, a tool willing to do Rajapaksa bidding unreservedly, all the time (like the former AG Mohan Peiris who lied to the whole world, in Geneva, to save his masters) the regime will develop issues with him/her sooner rather than later. And another impeachment travesty will commence.

According to media reports, the President has asked all parties to come up with proposals for constitutional reforms. The rest of the script is easy to imagine. The Rajapaksas will pick those suggestions which will enhance their powers (while debasing the judiciary and the legislature still further) and ram the resultant constitutional changes through a compliant judiciary and a servile parliament. But before that Shirani Bandaranayake, that handpicked tool who developed a conscience and a backbone unexpectedly, must be got rid of and a new chief justice, who will give all the despotic constitutional changes the freest passage, put in her place.

The impeachment is the second ‘humanitarian operation’, for the advancement of the Rajapaksa-agenda. It too will be fought no-holds-barred, sans restraint. And if the President did not listen to the four Mahanayakes, he is unlikely to listen to the whining of ministers who owe their political existence to his charity. If anything can make the Rajapaksas rethink, it will be a boycott-threat of their Hambantota Commonwealth.

The President’s inflexible stance reveals why the regime is acting like a maddened rhino in a bone-china shop, from North to South. The real reason is not unmannerly ministers or bad advisers (though both types are ubiquitous); the real reason is the President and his Siblings. Mervyn Silva, Wimal Weerawansa and Rajitha Senarathne are not the disease but its symptoms. The real disease is the Rajapaksas, and their fanatical pursuit of total power.

Vellupillai Pirapaharan’s pathological maximalism rendered a political solution to the ethnic problem or a negotiated end to the war impossible. Not only did he want a Tiger Eelam under his sole suzerainty; he also wanted to win it on the battlefield, so that he could become the modern day equivalent of the great Tamil empire-builders of yore. The Rajapaksas have a hunger for power and a greed for glory equal to their vanquished opponent. They too are becoming increasingly hostile to reason, inimical to good sense and blind to enlightened self-interest. They too are becoming merchants of chaos, pushing the country from crisis to crisis to promote their political project and wreak vengeance on their opponents.

The Patriotic Lie and the Racist Slip

Since the Rajapaksas equate themselves with the nation/state, they regard all those who oppose them, however democratically and peacefully, as traitors. Thus the regime’s repeated references to a ‘Hulftsdorf coup’; according to Minister Keheliya Rambukwella, “Local and foreign conspiratory forces are attempting to use the Supreme Court Complex in Hulftsdorf to achieve the objectives which the LTTE failed to achieve through military means… the anti-national forces once used the former Army Commander as a tool to gain their objectives and currently they are using the CJ’s Impeachment issue to attain their ulterior motives” (Daily News – 18.12.2012).

If the judges and lawyers protecting judicial independence are traitors, then any attack on them is ‘patriotic’. As ‘patriotic’ as attacking and arresting Jaffna university students and forcing some of them into ‘rehabilitation’, while mollycoddling Tiger finance-cum-procurement chief KP; as ‘patriotic’ as planning to do to the 13th Amendment what was done to the 17th Amendment. Because under Rajapaksa rule, only a Rajapaksa serf can be a true patriot, while any Rajapaksa opponent is a traitor, ipso facto.

Deplorable as this fallacious equation is, something even uglier, more toxic and more deadly is emerging from under the Rajapaksa mantle, as the impeachment heats up. UPFA ministers and state media have begun to use racism in their attack on the CJ and the judiciary. For instance, some of the state media outlets castigated the CJ for picking a ‘Tamil law firm’ to defend her. They argued that the CJ’s failure to pick a ‘Sinhala law firm’ exposes her as a Tiger stooge. In an article to the Sri Lanka Guardian, academic Thrishantha Nanayakkara pointed out that Minister Wimal Weerawansa “mentioned the ethnic background of the three judges in the Appeals Court that examined the defence of the Chief Justice…. Two of the judges being Tamil and the other being a Muslim (the ITN interviewer assisted here) was used as part of his argument that the defence action on the part of the Chief Justice was a coup with possible international links” (quoted in Ceylon Today). These abhorrent attacks are not anomalies; they are an inevitable function of the Sinhala-racism which lurks just beneath the surface in Mahinda Chinthanaya.

The Rajapaksas are proving to the North and the South that democracy is a sham, and that any protest however peaceful, any dissent however legal will be regarded as a crime. That is not the way to peace or stability in a land which had suffered through one long war and two short albeit brutal insurgencies.

You identified the source of the rot from the very beginning and have never stopped attacking it since then. Many agree with you but few would dare come out so brazenly. The truth is beginning to sink in now. The responses in the Daily Mirror today to the President’s Christmas message is indicative of this. I hope the tide will turn and your efforts will have not been in vain.

    I think we are paying the price of our own failure to act when we should have act upon with due care on growing racism in Sri Lanka. This has gone to an extent to say that religious extremist racial initiatives are democratic and the regime cannot make any effort to mitigate the same.

    We let all the powerful entities to oppress the weaker even with delays in providing justice to them.

    Now we are paying the price grossly.

    Let’s see where this will end at last.

    Despite good articulation and forceful sentiments, the writer falters when she attempts to form a nexus between the person who “appointed” an alleged criminal and his own capacity to decide, when the issues at stake are complex, serious and need sensible analysis.

      One of the definition for a genius is the ability to see a connection where others fail to see but here you don’t need to be a genius to see it when your tongue- in- cheek veiled responses mostly betray your ideological and other indebted status of you sub-conscious that is not recognised to be intervening or controlling your expressions most of the time even as you and some others like you are observed here to have not realised that one cannot touch your own right or left elbow with your own very right or left hand.

    I remember once seeing a Cavin & Hobbes cartoon that shows Calvin having hammered a dozen or so nails into a probably expensive coffee table at his home. A freaked out mother screams asking him what he has done. The final frame shows a nonplussed Calvin asking his mother. “Is this a trick question, or what?”. As far as Calvin was concerned, what he had done was so plainly evident that he couldn’t understand the logic of his mother’s questioning! You should see the cartoon itself, it is so hilarious, but I am not sure if you will get the punch line:-(

    Does anybody know that how MR started his active political carrier on two foundations. They are….

    A)MR stole Tsunami Helping Hambantota Fund…
    B)MR used some of that money to Bribe VP to stop N and E voters voting for UNP RW and also hoodwinked both JVP and LSSP parties for MR’s side….and as a result RW lost the 2005 presidential election.

    After Bribing VP, President Rajapakse learnt the value of BRIBES.

    2)Therefore MR started to bribe all opposition parliament members and as a result over 100 crossed over to his side.

    3)Then he Bribed Buddhist Clergy…giving them super luxury cars and SUV’s, land, building Viharas, Pansals, Buddha statues, foreign tours, well fed with food and meals, media and TV coverage spending immensely.

    4)MR also made sure that all corporates and businesses who supported UNP and other opposition parties does not financially fund them anymore….and if they did so they will have to face his wrath.
    MR Frauduntly collapsed Golden key empire since Hon.Lalith Kotalawela was a UNP Financial supporter, Also acquisition of Sugar plantation and the factory which was under Mr. Jayawardena, acquisition Daya gamage sugar plantation, acquisition many UNP and opposition supporters Hotels, Businesses, and others through stock market etc..are mainly to Financially deprive and weaken the opposition parties.

    Do you know that in order to contest only for PROVINCIAL COUNCIL ELECTION, a candidate has to spend over 60 million rupees…..leave alone for general election. Just a coloured single off set poster could cost around rupees 400.00 each.

    Do you know that for MR last birthday…. paper ads alone he spent over Rs.750 Million…..Listen to UNP MP.Dayasiri Jayasekera talk about it in Parliament.

    So this is how MR suppress all opposition parties……either acq1uisition of their supporters businesses or bringing false litigation on fradulent charges.

    5)Also MR acquired all opposition Media institutes such as…Press, Radio, TV, foreign ministry personnel, media personnel and reporters and artists, bribing them with laptop computers and car loans etc. under his control and started bashing all opposition parties, and used them for his propaganda machine….a sign of absolute dictatorship.

    Also MR.used white vans, police, thugs and hired killers to intimidate opposition party supporters, activists and reporters.

    6)MR also replaced both Ex CJ’s…once with Sarath Silva and again with Asoka Silva….and made sure they get all the full benefits when they retire for the help they did for him to get out of Tsunami Scandal, bribed opp.MP’s to cross, obtained 2/3 majority in the parliament and brought in draconian 18th Amendment.

    7) Also MR gave high post to current CJ’s husband Mr.Kariyawasam as Chairman NSB, and took photos with her during Namal Rajapakse’s Law Graduation to get outside attention and favours from her…..but due to her strong ethical standings, he couldn’t convince her….and then MR applied his “Condom Theory” on her. That is what this CJ impeachment is all about.

    8)Also MR changed and sent all the Best Servicemen who are affiliated with opposition parties on early retirement and replaced them with his goons.

    9)When you here and see Daily Mirror Yapa – Rohitha Bogalagama Video clip…you see that yapa say he brought the 16 witnesses to clarify the validity of documents….and by this we note that the documents were collected only after the CJ trial began…. which say that the 117 who signed the motion without knowing the charges. Also CJ’s lawyers confirmed this.

    10) Therefore since MR made sure to weak opposition to such an extent, that no opposition will challange him for next few generations…he want to make sure this last CJ barrier also to be wiped out for good so he could have his total absolute dictatorial regime for ever…….MEDAMULANA MAHARAJANO….THE NEXT KING DUTUGEMUNU OF SRI LANKA ON THE PREDICTIONS OF HIS NOBLE ASTROLOGER……or could end up in another Hambantota Nanthikandal lagoon #2……….SA..U …SAAA..U. SSSSSSAAAAA……….UUUUUU

    11)MR made sure that no Foreign Ministry personnel should contribute to find a lasting solution to minority issues and tamil grievences, and to drag the issue without solving as long as possible.
    UNHR and CW requests to solved these issues are kept aside with inactive Foreign Ministry on MR’s instructions.

    No implementation of LLRC, permenant settlements, employment opportunities or any other issues are solved to a satisfactory level although three years are lapsed after winning the war.

    Therefore we as citizens have only this last opportunity to safeguard our Liberty, rights and deomcracy only by protecting CJ from impeachment and also the opposition should think deep on the gravity on this issue.

    Come January 3rd…we could see if Govt. and the opposition PSC 11 go in front of Court of Appeal…and see the outcome.

    Come Jan. 9th Parliament CJ hearing begins and we all request Govt. to broadcast the Debate LIVE on Radio, TV and Internet.

    Also we could witness who are the Parliament “Betrayers” of people who want to sell their pride respect and conscious for a dictatorial MR regime SANTHOSAM.

But what cannot be appreciated is the degree of corruption that is seen here. Mahinda Rajapaksha is one of the most corrupted leaders in the world. Where were these big mouthed freedom fighters then? Mahinda should sack the entire Supreme and Appeals Court Judges and appoint fresh members to the judiciary. The Government in power should not allow some crooks to run the justice system in the country.

    I wonder why some h=guys object to punish the person who appointed the chief justice if the CJ is a criminal.why always in Sri Lanka politicians can make mistakes but walk out freely.why is he not responsible?It is the same in the government service too.Government servant can make any mistake but they are not punished.I think we must start punishing those politicians who appoint useless people to responsible places so they will either stop doing so or they will stop pushing the blame to others.Dominique can nto see the logic cause he doesn’t understand the logic.It is very logical for the writer to high light that.If a person is criminal how can he be appointed as CJ and why didn’t he see it for so long?It is like golden Key drams.Now only the government knows that the ruling was wrong and it looks like government where the president is the Finance Minister had not known that there was a Golden Key depositors till this issue of CJ come in to light.They want now to use those poor depositors for their benefits too. .They use every thing and any thing as long as they achieve their objectives.I do not think these people who go after them are GK depositors.If they are where were they so long?

    THE CHIEF JUSTICE PICKED UP THE TAMIL LAW FIRM TO DEFEND HER BECAUSE SHE KNEW THEY WERE ALL VERY WELL EDUCATED. THE OTHER LAWYERS IN THE APPEAL COURT WERE ALSO WELL EDUCATED TAMIL LAWYERS.     The truth is bizarre. Our President acts on the advise of astrologers, witch doctors and illiterate racist thugs. He clutches a golden charm in his right hand when he speaks. He leaves the country every time there is a problem. He has no qualms about fixing cases, victimising people who disagree, abducting those who dissent, removing people who dont carry out his orders etc.

    The outcome is irrational, criminal and the monstrous. Appointing ones brothers to control 70% of the economy of the country and the main organs, the military, economy and parliment? Indicates a man who doesnt trust anyone outside the family. Remaining silent on abductions, arbitrary arrests, fixing the national budget so his son can import racing cars duty free? Appointing his wifes relatives to important positions like chairman of BOC etc? We have a chaotic condition and no one can predict where the country is going to end up.

    will this columnist concede that similar ‘insane’ appointments of ‘criminals’ to high posts occurred in the as murderous Premadasa regime so enthusiastically supported by her – a then government-appointed consultant in a state bank?

    as one comment earlier noted, it is not enough to grandstand with flamboyant epithets. Doing merely this is good for one’s readership ratings, certainly. What we need is to place the behaviour of the president alongside the behaviour of the current CJ amid the larger context of a decayed State system and a populace increasingly disillusioned with the system and resorting to spontaneous social violence. This systemic decay was initiated by the Centre-LEft regime of 1970-77 to serve Left ideological ‘revolutionary’ intentions and then radically advanced under the subsequent UNP regimes with the second republican constitution laying the solid framework now exploited to the hilt by this set of mediocre adventurer-plunderers.

    JR did say, in advocating the free trade zones, “let the robber barons come”. He probably did not really care (given his class-based role as the top political representative of the capitalists) that his rhetoric would come true in the future under the system he so well established. And not by foreign/outsider robber barons but by our own petty adventurer-plunderers! The robber barons were here all along and have well and truly ‘come’.

      You have brought up a very valid point, but Tisaranee being the same old Tisaranee with a tunnel vision sees only one side of Mahinda and is passing judgement on him as being the sole person responsible for all the ills and evils of Sri Lanka.This is the darker side of journalism where political and hidden agendas take the place of fair and balanced reporting of matters and being of true service to the country.MR being the shrewed politician he is, can and is likely to use one of several escape routes to get over this ugly issue.He should not allow his enemies and in particular the Tamil Diaspora to raise its ugly head by using this type of tactics to push people to fall in line, which these interested parties can use as a spring board. We never want that era of 30 years of blood shed to come back which some of the writers to this forum seem to have conveniently forgotten.

    Prabakaran once said that the Sinhalese people have very short memories. Have you ever come across a Tamil who publicly condemns the Tiger terrorists even if they had killed their own family members and fellow Tamils? Answer is no. Look at all the Singhala traitors and big mouthed Pundits who continuously attack our great leader Mahinda. It is the Singhalese way. These Singhalese traitors were very quiet when LTTE and JVP were killing the Singhalese. Now they have come out of the woodwork and abuse Mahinda and his government who saved the Country. The UNP were willing to handover one third of SriLanka to the Sun God Prabakaran and also were willing to make him the Chief Minister of the North and East. Why worry about an impeachment of a dodgy Chief Justice? She was appointed by Mahinda but she was found to be of questionable character. So what Mahinda could not tell before hand the CJ was going to be like that? He appointed CJ in good faith and why blame him for that. Once Mahinda leaves the Presidency the spineless UNP and the extremist JVP will ruin this country and the Tigers will be back and will take over the country.     when,sriyani came to supreme court from back door ,where were these guys?when all the way when she was writing many wrong judgments,where were these guys?when corrupted and criminal husband doing all such thinks,where were these guys?look here it is not so call bar association or judiciary members who safe guard the judiciary ,they all just money making black kakko,only cry for innocent people’s money when they have court case, many time positioned to make money.some time they do lot of dirty thinks in the legal society ,compared to professional job most worst and dirty people in the legal system in sri lanka. now these guys area cring due to loss of full credibility of the attorneys. when these guys are doing all such thinks to protect wrong doing chief justice and her husband,do you all know how many Innocent people was suffered due to the wrong judgment and due process in legal system in he country? so time has come so call bar association and corrupted judges must accepted this time they loss bid time.this is the country ,never had so call independence judiciary

    we need to appoint Dr. Mavin Silava for next chief justice and WIMAL weeerawansa for member of supreme court.please do not forget to keep one seat in the supreme court for duminda silava ,who has full capability to hear cases related to murders, dungs and rapes.so who nice to be next supreme court of sri lanka.

    JR”s constitution paves way to this type of dictatorship,only if a power hungry fool comes to power.It has become worst with the 18th ammendment,which he got passed with the support of the misled,corrupted,money and wealth greedy so called unp deffectors.See who are the spoke3smen for this power greedy ruler,Rajithe,other UNP deffectors and Wimal.Sri Lankans voted this man to power if at all he was voted in to power,and not circused in to it, because there was no body to contest him properly.Our people will regret definetely when they have to live in a country ruled by a total dictator who wants to be the “Maharaja”

    When the humanitarian operation 1 was finished,There were serious allegations of war crimes and crimes against humanity .None of the so called intellectuals and columnists of Sri Lanka raised their voice for the innocent fellow citizens due to the very obvious reason ethnicity.They all convinced that asking for an independent impartial inquiry itself is a most treacherous act .

    Not a single notable person even suggested that holding an independent inquiry is an easy way to clear the false allegations raised against the government and forces.Their selective dumbness and deafness paved the way to the current crises.Enjoy yourself
