The war crimes cases registered against former army commander General Jagath Jayasuriya in five South American countries would alert the government that it needs to take remedial action without further delay. It seems that General Jayasuriya was fortunate that the cases were only registered after he left Brazil where he was Sri Lanka’s ambassador for the last two years. Although the former army commander had diplomatic immunity, international law also states that those accused of war crimes are subject to universal jurisdiction. This means that any country that subscribes to the Rome Statute that set up the International Criminal Court can detain a suspect in a war crime case.
General Jayasuriya has refuted media reports that he fled Brazil. The close proximity of dates on which he left Brazil and the war crimes cases were registered suggests a connection between the two. The former army commander has also strongly denied that one of the army camps he was in overall charge of was also a place where torture of LTTE prisoners took place. In his defense, he has said that was not in charge of offensive military operations but only of defensive ones. This is unlikely to convince those who accuse him as those in charge of defense would be obliged to elicit information from prisoners about the future plans of the LTTE.
Recently US President Donald Trump has been making statements that seem to justify the use of torture in extreme cases such as when terrorists or those suspected of such activities and who attack the United States are apprehended. This has caused great consternation worldwide as this open defiance of international norms will be a setback to the development of international human rights and humanitarian law related to war. It has been said that the worst peace is better than the best war. This is because in war, where life is at stake, the desire for self-preservation will invariably come first, and rules that protect prisoners with information from being tortured are likely to be broken.
Foreign Courts
The allegations of war crimes against General Jayasuriya have become more complicated because his superior officer during the war, Field Marshal Sarath Fonseka has publicly stated that General Jayasuriya was under a cloud during the time of war. The Field Marshal has bitter memories about the shabby way he was treated by the former government when he was the army commander and was succeeded by General Jayasuriya. He said that there were allegations of offenses against those held in captivity against General Jayasuriya which he had wished to investigate before he was relieved of his post. Field Marshal Fonseka has also said that he is prepared to come forward and give evidence to this effect if a properly constituted war crimes court is set up.
The possibility now exists that the cases registered against General Jayasuriya, and the international publicity it has generated, will encourage human rights activists and Diaspora groups to also take action in foreign courts against members of the Sri Lankan state who were engaged in the military operations against the LTTE. This could include not only military personnel, but also political leaders and public service officials who had significant roles to play in the war. The international law on war crimes has the concept of “command responsibility” that can used to target anyone in the chain of command, even if they were far from the actual theatre of action. As ranking officers, they can be held liable to be punished under international law for war crimes committed by troops on the ground.
However, there is a way forward for Sri Lanka. The Geneva resolution that was co-sponsored by the government in October 2015 states that the government will setup four special mechanisms to deal with the aftermath of the war. These are a truth commission, office of missing persons, office of reparations and special court for accountability purposes. Although the government’s initial promise was to set these up in full or at least in part by March 2017, it failed to do so. As a result the government requested a further two year extension which it obtained. None of the four mechanisms has been established in full or in part. Only the Office of Missing Persons has been legislated, but has still not been established.
Implement Nationally
Those who are working within the government’s reconciliation process have unofficially confirmed that the legislation for all four reconciliation mechanisms to which the government committed itself have been prepared. The lack of progress in establishing them may be attributed to apprehension within the government that these mechanisms will start to generate information that can be used as evidence in future cases of war crimes. The level of apprehension is increased by the fact that the international community will also be keenly observing how these four mechanisms will operate. Therefore the level of independence of the reconciliation mechanisms from partisan political control is also likely to be high.
If it is the desire to keep the truth about the past submerged that has led to the continuing delay in implementing the four mechanisms to which the government committed itself in Geneva, then the cases registered in South America show that Sri Lankans who have been involved in the war effort can become vulnerable to international legal processes. International law comes into operation when the national (or domestic) law is not properly implemented. This suggests that instead of continuing to delay setting up the four mechanisms promised to the world in Geneva, the government should start operationalising them.
It is in the national interest to establish mechanisms, including a special court, that is under Sri Lankan jurisdiction rather than leave Sri Lankans to be vulnerable to sudden arrest by foreign courts in distant countries. Those who once blamed the government for agreeing to co-sponsor the UNHRC resolutions in Geneva may now see that radical decision from another perspective. It is the Geneva process that shows the way forward to Sri Lanka. If the Sri Lankan government is able to show that it has a credible domestic legal process underway in the special court and accountability mechanism it sets up, the requirement of international legal processes will diminish. This is the message that government leaders need to communicate to the Sri Lankan people and begin to implement instead of procrastinating any further.

When Jehan PhD was visiting last year to preach to UOJ students that playing Nathsuram is immoral, he had forcefully had the Tamil students sit down and listen to him. The Sinhala students got immunity; missing Tamil missing students were threatened with action.
Further he took Bold Heads to North-East to preach Sinhala Buddhism in the name religious reconciliation.
He missed the Southerners in all these his educational and reconciliation services. But now he wants the Lankaweyan to be educated by the Appe Aanduwa. Jehan PhD’s definition of Lanakweyens is flexible or floating. If he has to preach his reconciliation or not to challenge, protest or dissent with Appe Aanduwa, Lankaweyans are North-Easterners. If Development or modernization or protection, or any government programs, the Lankaweyans are southerners.
Now he is writing to have a Special Court to save Jagath. He is signing here his resolution 30/1 to hoodwink IC until Appe Aanduwa can have the frictions with China sorted out.
Jehan PhD knows New King has openly Challenged the whole world by saying “Touch on one of my war criminal Commanders if you can?” at 66th SLFP annual conference. Jehan is providing escort for him by not criticizing him but suppling ideas.
If Jahan PhD is saying the Special court is going to provide justice for Tamils, why Jagath should not be investigated in Brazil? Why Jehan PhD is not recommending to Appa Aanduwa to extradite him to Brazil to clear his name? If Jehan PhD is an honest person in any human rights and reconciliations, he would have been the ITJP contact in Lankawe, Isn’t he?

It looks like the current regime is simply afraid of losing Sinhalese nationalist voters at the next general elections, and therefore will try to keep postponing the issue until after Sirisena and RW try to secure a second term. While such political considerations may dictate the government’s actions, the victims and their advocates are being given the runaround and being stonewalled, and that shouldn’t be tolerated.
So I encourage and support more cases like the ones in Brazil and Colombia internationally, including in the US, UK, Australia, Singapore and Malaysia, where active and retired war criminals from Sri Lanka like to travel. I like the fact a Spanish lawyer with experience in these issues , and a South African HR activist are involved.

There are stories that Jagath couldn’t have had a two year contract. If that is correct then

M/S Sooka has said he was tipped off so, ran out of Brazil. There is suggestion as the case was filed in 5 countries and these countries have mechanisms for them not caught in between ICC and an aligned country, they tip the criminal to escape. If no other way is proved that seems to be a possible explanation. But Jagath has said he filed for release in June 10th to FM. Though wording are confusing and we have not seen the letter Jagath wrote, we can interpret the tipping might have taken place before case was filed. Jagath seems to be have been ready to run, but without case filing date. If FM produces any proper documents for Jagath requesting release by June 10, it suggests possible Appe Aanduwa involvement in that spying. Could somebody have a way to connect that kind of early info causing Mangala’s demotion too?
If we discount all Jagath lies, then way 2:
Jagath has broken his contractual term. He had left his job not properly terminated in. (There is no replacement from June 10 has been fixed). By this Foreign Affairs Ministry and Jagath has done another Central Bank looting. Some legal activist has to bring a lawsuit on FM and Jagath for getting involved in corrupted dealing and Jagath has to pay the government for the additional expenses incurred by his breach of contract. Jagath is covered by diplomatic immunity. There is no explanation why the FM can give Jagath an early release. As per Jagath he was not in command. If he loses the case, still it is not for FM’ to cancel a government contract to protect a criminal.

It is shocking that statements are being put out by elected leaders the likes of MS, RW Mangala and many others who are supposed to uphold not only the National Law but more importantly International Law that they will not abide by International Law . MS recently stated that he will protect people who are charged with war Crimes. We know that he is protecting THUGS ( Mahintha) , CRIMINALS( Gotha) and THIEVES ( Basil) but he has gone further to say that he will protect his extended family. No doubt the UN now realises that it was a folly to let Sri Lanka off the hook at the last meeting. This will almost certainly be an important issue at the next meeting and we will force the UN to impose tougher conditions to comply and bring those GUILTY of GENOCIDE to justice starting the Hambanthota THUG.

If ever Lankawe is ever going to investigate war crime, the first is to introduce a statute recognizing the needed Geneva conventions. Ranil blocked simply singing to the Rome Treaty. Creating a statue for it or ratifying it in parliament is different story. What he now saying is, he is maneuvering and cooking up the election process so that no party will get 2/3 in the future. His uncle did the same in 1978 and that is why the country is now in this state. His uncle’s election process brought 8th graders to Parliament without them having answering responsibility to voters. Why there is in every Lankawe election a wave sweeps and wipes out the incumbent with 2/3? That is a question the past governments from 1948 didn’t like to answer. It is because of the extreme corruption progressively building up in the ruling parties from 1948. People wants the incumbents wiped out. It is the people wish. That is the democratic process. How the Sinhala governments disenfranchised Tamil by deporting them or colonized their ancestral homes that the same now has to be done to the Modaya crowed too. What is Ranil saying is what Ramanathan said in 1933. Universal Franchising is not suitable to Sinhala Mahajan. They don’t have the capacity to use it properly. Now Ranil is trying to minimize the bad effect Universal Franchising is creating. What Ranil saying to the Modaya crowd is “you vote the way you want, but you won’t get the result you want”. That is how he is aiming at Rome Treaty and beyond it.

The main change needed in the election process is the method the parties campaigning. They have to educate people with real choices, but not dope them to blind with Sinhala Chauvinism after they had run a full term corrupted government. In each electorate the party candidates must have at least two debates in front of public so the public can compare the candidates and act properly. This will discourage the candidates buying the people with Biriyani and arrack. That will eliminate the completion to saw bigotry, bias & Chauvinism. The party that gets 2/3 under that process will turn the Lankawe into the real miracle of Asia. There is no debate even at the presidential level election.
Jehan PhD knows which path the constitutional amendments are going. So he want to use the delay tactics on IC until Yahapalanaya has finished it maneuvering secularly.
Publicly consulting that any Foreign Court investigation cannot be easily bribed so “you fools start another Sinhala Jury Verdict case” is not in national interest, but destruction to the national Interest. Lankawe does not have the constitutional provisions to investigate war crimes as per the agreement signed at Geneva. Passing a provision to satisfy the resolution 30/1 is not possible in Parliament. The War Criminal President has vowed to block any investigation. It can be to save himself from a genuine investigation, or just to ensure the continuity of his seat by provoking Sinhala Chauvinism. Ignoring those realities, Jehan PhD is advising the Yahapalanaya to pretend like shooting a movie without a movie camera, as he thinks the actors will be caring only about their acting so that they won’t look for a camera. How can a war criminal court function without the parliament providing it with necessary authority to come into existence?

JD is like LLB because in the US you do pre-law and then apply for JD degree. There is no research and no dissertation just a certificate to become a lawyer or attorney at law in the USA.

From the day the Kallathonis from South Hindia landed in Sri Lanka they have become a pain in the neck of Sinhalese. Although some might disagree with me, I think best thing is to give them a separate State. There are about 20% Tamil speaking people. Let’s be generous and give 25% of the land in the North to Tamil speaking people and draw the boundary as a straight line from east to west. Provincial boundaries drawn by British bastards have nothing to do with ethnicity. All the Tamil speaking people (Tamil and Muslim) should be asked to leave Sri Lanka. That will be the solution to the problem faced by Sinhalese.

Your suggestion is not a practical one. Pakistan and Bangladesh were created for all the South Asian (Indian subcontinent) Muslims, and keep Muslims separated for good. According to the agreement, all the Muslims from Sri Lanka, India, Nepal, Bhutan, and Myanmar were supposed to settle in Pakistan and Bangladesh, but still there are 4 million Muslims in Sri Lanka and 172 Muslims in India remaining. Most of the non-Muslims who lived in Pakistan and Bangladesh were chased out, and the lives of non-Muslims are made hell on a daily basis.

The absolute truth is Muslims and Tamils don’t have the sophistication to survive by themselves, they depend on Sinhalese, if they are left for them selves, they will definitely kill each other to the extinction. [On second thought, Muslims and Tamils should be put together and let them govern their own affairs :) ]
