According to reports a 37 year old British nurse who arrived in Sri Lanka this Monday (21st April 2014) was taken by a taxi driver to a nearby police station where, according to her, she was harassed by policemen who demanded money from her. She had arrived at the Airport and the immigration authorities had allowed her to enter the country. She had earlier visited Sri Lanka and several other Buddhist countries and followed meditation under the guidance of Buddhist monks.

Naomi Coleman, 37, was arrested at Bandaranaike International Airport in Sri Lanka for ‘hurting religious feelings’ with her sleeve depicting Buddha on a lotus flower
When the police were unable to extract bribes from her she had been produced before a Magistrate who according to her did not provide to her any opportunity to speak and then made an order to immediately deport her from Sri Lanka. Subsequently she was deported to New Delhi, from where she has arrived earlier.
One straightforward question that arises from this incident is as to under which law did the Magistrate make an order for deportation. In any case no person can be deported without giving an opportunity to have the charges explained and having the opportunity to answer the charges. This tourist had a right to object to the deportation order and it was the duty of the Magistrate to provide that opportunity. Further, after listening to her objections it was his duty to have an inquiry into alleged grounds on which the request for a deportation was sought. It was also the duty of the Magistrate to provide her the opportunity to retain a lawyer or provide one, by way of assignment by the Court. It does not appear from the reports that the Magistrate had followed any of these procedures.
The allegation, as it appears is, that the tattoo she had on her upper arm depicting Lord Buddha on a lotus flower could have created a public commotion and that alone was the grounds on which the police had sought a deportation order to have her removed from the country. There is no indication that there had been any complaint by any person, to the effect that the reverential exhibition of the Buddha’s image on a lotus flower could cause a commotion amongst the public. Thus, the police have brought on the allegations on their making and initiative. It was the duty of the Magistrate to question the police about the basis of the allegations and to inquire whether there were any grounds at all, to expect such a commotion to take place. If there was any possibility of such a commotion without any legitimate basis, it was the duty of the police and the Magistrate to take all steps necessary to protect her.
It seems quite clear that there appears to be a link between this taxi driver from the airport and the police for extraction of bribes from tourists arriving in Sri Lanka. It is quite possible that there had been other victims of such exercise of harassment.
It was when this attempt failed that the police proceeded to make this ludicrous allegation that the exhibition of such an image could cause a public commotion in Sri Lanka. It appears quite probable that after having found no grounds to cause some fear in the tourist, and thereby to demand bribes failed, the police found flimsy grounds to charge her with, on the basis of the tattoo she had exhibited on her upper arm.
What should in fact cause a commotion is the manner in which an unscrupulous taxi driver connived with the police so as to manipulate the law for harassment and thereby used that for the purposes of extracting bribes. It is this state of lawlessness that should alarm everyone. Equally the manner in which this Magistrate has acted should also be a reason for expressions of public anger. The duty of a Magistrate is to protect all who comes before him, and not to be a pawn at the hands of the police for machinations for extracting bribes.
The Magistrate and the policeman involved in this incident including the officer in charge of the relevant police station should be immediately suspended from their positions and brought to an inquiry. That is what would have happened in any country where there is some respect for the rights persons including those who are visiting as strangers to the land. To deny hospitality to a tourist and to behave in this ugly manner should not go unpunished.
However an even more serious issue is the right for the respect of religious expression of any person of whichever religion it may be. It is the general and usual practice amongst many persons to make some public expression of their religious beliefs by way of various methods. Wearing ornaments with some religious symbols is quite a common practice of many persons. These are matters of private beliefs and every person deserves to have their private expressions of faith and love to be respected. This is not an area where any government has any jurisdiction. This is an area of inviolable rights of individual persons.
As this particular image has now been publicized by international media we have had the opportunity to having a look at the particular image that is depicted on the said tattoo. It is a beautiful Buddhist image and by no stretch of imagination could any reasonable person say that such an image could manifest any kind of irreverence to Lord Buddha. In fact, it manifests that the bearer of the image carries a deep respect for Buddhism.
The action of the police and the Magistrate would without doubt bring tremendous disrespect to Sri Lanka. It is not unreasonable for any person to think that a country where lawful authorities could behave in the manner the in which police and the Magistrate has done, and on behalf of the Government of Sri Lanka is weird and crazy.
Of course all this happens in a political environment where impunity is guaranteed to all violators of human rights. It would not be a surprise if this magistrate and policemen escape without any kind of punishment for the manner in which they have violated the law and brought disrepute to the people of Sri Lanka.
Today’s papers also carry pictures of a commuter being severely assaulted by the police at the Colombo railway station; his face filled with wounds, his shirt stained with blood. This picture is now available to the public thanks to the efforts of the journalists. The police who have come to remove some obstacles put on the railway tracks by some workers who are making certain demands have assaulted this innocent commuter who has just arrived at the station to travel back home. If the police came to remove the obstacles put on the railway tracts, they should have done so and returned as there was no resistance for such removal. But that is not the style of the Sri Lanka police these days. There has to be some persons to be brutally assaulted and some blood to be shed, if they are to be satisfied. It is these matters that should be worrying the Magistrates and others concerned with the law, and not tourists and their tattoos.

Yet another instance where the Buddhist administrators have misunderstood the meaning of the Buddha statue.
The Buddha never ever approved of His followers worshiping his body, human form or materials used by him. His advice to Bhikku Vakkali was that he would have given him the highest respect if the Bhikku, enchanted by the Buddha’s body and was admiring it unceasingly, followed the path shown by Him.
This was the practice for about four to five hundred years after the Buddha’s Parinirvana. The followers of the Buddha followed the path and didn’t use him as an icon of worship. But in India in other faiths, there were idols which helped the followers to seek refuge of the religion and the absence of similar idol among the Buddhists came under criticism and objections.
To answer this, after about five hundred years of the Buddha’s Parinirvana, the Buddha form was sculpted in North-West India, today a part of Pakistan, by using Gandhara art and sculptural traditions which had been influenced by Greek art and sculptural traditions. The artists created a Buddha statue, not of the Great Master who lived five hundred years ago, but of a Greek Prince in essential features. The artists had this freedom because the objective was not to produce a replica of the Buddha but to represent what he endowed the world. That is the enlightenment he attained and the path to which he showed to the rest of the people. The beauty of the Buddha statue in this Gandhara form is the ever present smile, a symbol of enlightenment, wisdom and inner peace, which a person can see from any angle he would observe the statue.
Today, the Buddha statue is a universal symbol of enlightenment, wisdom and inner peace. To help people cultivate these qualities, Sri Lankans have the cultural tradition of erecting the Buddha statues at every corner of streets. For instance, from Town Hall to Kottawa, there are 28 statues and the number will go up further depending on the Buddhists’ desire to have more.
The Westerners have gone a step further having used this symbol in body art. They have tattooed it on the body in a visible part to serve two purposes: to remind them of the need for following the Master to attain what He had attained; to help the others too to follow the path.
It is unfortunate the Buddhist in Sri Lanka have failed to realize this. In Thailand where about 95% of the population are Theravada Buddhists, people have the habit of wearing Buddha images around the neck as a protection from evil forces and bring them material benefits. It is similar to our wearing Pirith Nuul, again a representation of the Great Master, around the wrist for the same purpose.
So by objecting to people having the Buddha statue in body art, we are throwing away the message it is conveying to us.
These cultural practices cannot destroy the Buddhism; instead, they will enrich it. Buddhism cannot be destroyed from outside as long as the followers stick to the path. If they don’t, it will be destroyed from within.
This is what the learned Buddhist priests who have been responsible for protecting the Dhamma in the past should realize and advise the laymen who may not be able to see it.

This particular incident epitomise the sheer lawlessness that has besiege this country. In any other sensible country, the first questions that should be answered is which law has she contravened. The second question – is there a specific set of prohibitions that will deny entry to the country? Are we going to strip search all visitors to the country at the airport to check whether they have sacrilegious motifs that insult Buddhism? The third question is who have given tax drivers the powers to take visitors to locations other than those they are contracted for? Whenever, taxi driver accept a fare to take someone to a particular destination, than that is a contract. Are they allowed to breach this contact on a whim and a fancy? Or are we now employing an army of taxi drivers to check exposed body parts of visitors to see whether they have offending body art? Assuming that this taxi driver and the police officers involved are just pond scum, I am totally perplexed by conduct of the magistrate who believed that this poor lady and a case to answer. She was never informed what law she was breaking only a vague that some people take umbrage to see this tattoo in a public place. This is a country where every imaginable crime is committed against Buddhism including bellicose conduct by Buddhist priests, child rape and murder, attacks on other religions and general lawlessness. We are yet to witness a social upheaval due to any of these issues, yet this woman seen in a public place with this respectful and peaceful tattoo could have created a public commotion.
One final question. Who gave us the property rights to Buddha? As far as I am aware we don’t own the rights to images of Buddha.

No one on this planet could certify that the tattoo depicts the ‘Buddha’. No one has seen a ‘Buddha’ for 2600 years. Buddhism has become a business tool for the govt. & majority of Sinhalese population. Fortunately, more and more westerners practicing the teachings of the ‘Enlightened One’ with a genuine interest of reaching the ultimate goal,’Nibbana’. I am an ex Sri Lankan, (stil a buddhist) living in the west and extremely ashamed of the Sri Lankan authorities ignorance towards the visitors to this island .

It appears that people in this country is clueless about the administration of justice.
During the Court vacation, the customs is that the Magistrate attend parties (usually dinner with drinks) organised by the police and also by the lawyers.
In return Magistrate tolerate any thing and everything done by these people.
The law require the Magistrate to examine the suspects produced before him when an application is made seeking their remand custody.
What happen in practice is completely the opposite. The suspect is kept in the police jeep (in most cases with injuries inflicted by brutal treatment in the hands of the police) and get the Magistrate’s signature on the paper permitting 14 days remand custody.
This is wonder of Asia of which we are very proud of.

There is no law to deport on a tattoo. These are powers with the immigration authorities if they allow the Magistrate cannot deport even if an offence is committed.(there is no offence mentioned or charged) Deportation is not a thing court order. If ordered it was an illegal order.

Man what nunsance are u talking ? Do you think that diplomatic missions sit in the airport to control each country´s passengers. I mean it was not a good thing that the lady had to travel back, but who would bear the cost of the flight in such cases ? Do the tourist board have made awarness programs about the issue ?I dont think so. Normally passengers would check all legalities in terms of a country. At the time, my chocolate containing sweets were removed from Australian authorities, that annoyed me, becuase I did not know that European travellers arrive in Australia are not allowed bring their sweets with.
Anyway, the passenger could have been given a warning before being sent back. They the lanken authorities seen unncessarily strict with these issues but not considering even hundred weights of drugs being not given the same treatments. That is what I cant get in Rajapakshe adminstration. They dont have a law that would act equally to every kind of categories. May be the buggers have only biased laws to reveng own and foreigners that go against them.

The first thing that should be done is some order at the airport.In other airports the taxis wait in order and you jump into the first one in the queue.In srilanka privileged guys are allowed to get at you within the airport itself and channel you to their waiting cars.It is a big mistake to allow such practices.The taxi drivers waiting outside are too scared to make a fuss and have to wait patiently till these guys have exhausted their vehicles.In this climate of fear and corruption and lack of ethics,naturally the taxi driver will take the woman to the police station so that they can get bribes.
The second thing that should be done is the OIC of the police station she was taken to should be sacked from the police force.Those who aske d for the bribed too should be sacked.If we are going to show the world as soon as they set their first step into this island that we are one of the most corrupt countries in the world and their is no order at the airport,then we are telling the world that we will always be forever a third world country.How do 21 million srilankans like that image.Don’t we have something called pride and self respect.What is the point of talking about our grand 2000 year old civilisation and reconciling ourselves to be a third world country in habits,culture and economy.

Personally, I don’t like tattoos, regardless of what they depict, be they declarations of undying love to someone, the head of a Red Indian or whatever. I simply don’t care about people permanently disfiguring parts of their bodies in this fashion.
It is indeed unfortunate, however, that this woman was deported because, as has been said, she had the image tattooed NOT to ridicule or mock the Buddha but because of this woman’s respect and admiration for him.

You know there are guys that have tatoos of Jesus on their upper arms, chest all over the body. They do so just because they love them a lot. Even this lady would have thought at the time she got it tatooed, that she found buddhism is the greatest philosphy. Just because not studying them to punish those tourists coming from long away to the island – is no means acceptable. I am a born buddhist, but I really dont think that this kind of tourists shold be banned to enter the country.
There are goons of all kinds roaming in Hambantota and colombo, they do more harm to our buddhist nation today than any of this kind of innocient tourists coming from western countries.
The worst insult to buddha is- the misbehaviour of buddhist people not respecting buddha´s teachings; today from President of the country to all level of people abuse buddhism publicly.
President go and see Mahanayakes in order to get their blessings, but on his return, he again goes on the same usual mode he is used to manipulating the gaping masses. So is there buddhism at all in the country today ? Under Rajapakshe, only violationism is above all any other philosophies.
