UNHRC Is Trying To Set Up A Branch Of ICC In Sri Lanka: Weerawansa

National Freedom Front (NFF) Leader Wimal Weerawansa MP today handed over a letter to the Speaker requesting an urgent Parliamentary debate on the UNHRC proposal to establish a Hybrid Court in Sri Lanka, to try those accused of war crimes.

Wimal WeerawansaWeerawansa says that the UNHRC is trying to set up a branch of the International Criminal Court within Sri Lanka in the guise of a so-called Hybrid Court.

Weerawansa in his letter has urged the Speaker to take up the matter when the parliament reconvenes on September 22.

An English translation of Weerawansa’s letter is printed below.

I appeal to you to take the proposal mentioned below for a debate in parliament on a future date

Proposal

A report released on 2015.09.16 by the United Nations Human Rights Council on Sri Lanka contains a number of serious accusations against the country’s security forces. Based on this report the UNHRC has proposed to set up a branch of the International Criminal Court within Sri Lanka in the guise of a Hybrid Court. Foreign Minister Mangala Samaraweera has endorsed the idea of setting up of a special court in his speech at the UNHRC’s 30th sessions.

This shows that the government has already agreed to this move. This is a very serious issue. Such a court with foreign Judges can only be established in a country which is under colonial rule. So I propose to this council that the setting up of a sub-branch of the International Criminal Court within Sri Lanka, slated to materialize in the guise of a Hybrid Court should be opposed.

        I believe those who joined the current consesual govt from UPFA can make Buruwanse very clear about that his kind of theories are the history for the nation. Now the people would not like to hear them again.
        Can any good professors from the local Unis please interview the guy on the issues broadly to convince the nation that Buruwanse et al are exclusively misguiding the nation – his knowledge based on external affairs are far from the realities. That can then bring the peace process forward in the country for sure.

          His actions of visiting Air Force camps in the North and inciting the soldiers to take such actions were reported in the newspapers during the war, and can be found in the archives of these newspapers.

          Punitive actions against instigators and inciters were taken after the genocide of Tutsies in Rwanda.

        UN doing what is right, unless we cease to be a member. Not Weerawanse, any way. We have just gone through 3 decades of local war and cannot afford to face sanctions and isolation of Sri Lanka by the international community,and not again. Armed forces played their game fairly in the war against Ltte and let those who gave orders for rape,murder and maiming of the civilians
        face the music as this UNHRC report is all about ill treatment of the civilians at the last stages of the war where orders came from civilian authority.One cannot enjoy extra judiciary killing & rape of the innocents and at the same time, expect protection from the state as well. This is wrong and hope the president and PM do not play to the gallery in this case and put the people into jeopardy, facing sanctions.
        Even mighty Iran & Russia suffered immensely due to sanctions in
        their own countries. Let the Govt. handle this matter diploma-
        tically,with utmost care as Weerawanse & clan may say ‘let’s face it to teach’ the western powers, a lesson.

        Illegal interference into the legal system is not only by some politicians and the so called high-ranking government officials and rich people that performed any kind of criminal activities but also by some members of Police Service, Henchmen of major politicians, Thugs, rapists, murderers drug/ethanol importers and wholesalers and distributors, dealers, thieves and robbers, et. al. In lanken context, I still question as to why the people voted for Buruwanse even after made him very clear that he would only be entwined with most abusive rulers.       Had my grossvater (Grand father) lived today, he would have asked authorities to punish the men like Buruwanse with a balu waligen (a dog tail) for the single reason as to why he has been making every effort to turn in favour of misguiding the nation. People should be so stupid to listen this man Modawanse – whose wealth became 1000 times more alone within the second term of Rajapakshe. People should raise the question at the time, he entered so called politics, he di dnot have even a single pair of sleepers to wear, nor had he a push cycle for his own, but today, him and the et al to own houses and properties valued millions – where has he collected them ?     My response:

    Exactly, that is why this court should be in a foreign country with independent foreign judges. More reasons can be cited.

    Further, Sri Lanka has proved beyond all doubts we are totally incapable delivering justice. As for few examples the unsolved cases of the murder of the school students in Trincomalee by the security forces along the beach front when clear witnesses were available as to the identity of the perpetrators of this heinous crime and in another instance the 2006 Trincomalee Massacre of 17 NGO Workers by the security forces and no one so far prosecuted. The so called Greece men who harassed the people of Jaffna and the few who were cornered and chased ran into the army camps and so everyone knows who they are and who sent them.

    Sri Lanka is totally incapable and does not have the will or the talent to solve these crimes. Ample chances were given but the then Government mistook their signals for their lethargy but did not realize they only gave a long rope to hang.

    When people like Sarath Nanda Silva and Mohan Pieris being the Chief Justice the world knows standards of our justice system! They are a damn disgrace. I know it is wrong to drag the judiciary to the streets but it is they who dragged them to the streets, and for shameless Sarath Silva to publicly announce his wrong judgment against Mahinda Rajapakse and later to join him in the same election platform to support his election campaign is really disgusting.

    What is more disgusting and startling is the legal council or whatever disciplinary body governing the legal fraternity has taken no action what so ever to inquire Sarath Silva’s public admission. He should have got his name erased from the register debarring from practicing law (even though now is retired). Not even an admonishment was served to this fool. Their disciplinary body should have issued a public statement following Sarath Silva’s admission of biased judgment. That shows how the rest of the judges and lawyers are, no different to Sarath Silva or Mohan Pieris. How can now anyone accept verdicts of such a court? We the public have lost total confidence in the justice Department in Sri Lanka right from the top and the whole lot has no right to inquire and punish people, bloody shameless people. Give up.

    So with all these facts lets have foreign judges and heard in a foreign country, so the victims and also Wimal Weerawansa will be happy.

      is appropriate to state that their judgements were greatly
      influenced by interference by political heads in the last two
      decades or so and some of them were like parrots repeating
      judgments already decided by the Govt.political head.

      We also should not forget that we had great judges and among
      them, there was Justice Gratien and few others who were inter
      -nationally recognized.

        Thanks so much for responding to my comment. We do not speak of individuals and we speak of the system in general. The name you mentioned Justice Gratien, I am not aware of him and I presume he was serving during the days the judiciary was independent and only answerable to their professional bodies.

        So it collapses the entire system of the Judiciary. The Judiciary should have had the strength to fight this out as it involves justice to the people. It is a serious matter. So you agree there are many judges who did not have backbone and they delivered the wrong verdict just to satisfy the whims of their political masters and should have got a good lump sum ‘santhosam’. So these judges just multiplied the victims. Very scary and am not sure how many are unfairly locked up in jail while these judges enjoy their santhosams and bribes! Very worrying indeed. Thank you for agreeing, and as I told we do not speak about individuals we speak about the system whether it has a inbuilt mechanism to overcome outside and political influence and answer is a definite NO. So we have a Kangaroo court in disguise. That is all to it. None of the judges ever raised their voices and actually should have resigned en masse when pressure was applied to a judge to give wrong verdict. So I stand by what I said! I think with many readers for the Colombo Telegraph and surely a member of the Judicial professional body would have read my comment and should reply the readers and the public. What I wrote is really damaging, I have a right to do so and the fault is not mined but totally theirs.

        Further in another comment below, I as an outsider questioned the conduct of the Judicial Council or whatever the controlling bodies for the legal professionals. You can read my views.

        The controlling professional body never questioned Sarath Silva’s public acknowledgement and apology on his wrong and biased judgment in the case against the former President Mahinda Rajapakse. He went public and certainly that damages the confidence people have of the judiciary in Sri Lanka. Further it caused many ripples internationally too. Mind you he was chief justice, not a simple judge. To add insult to injury this fellow shamelessly joins Rajapakse in the same election platform to support his election campaign. What sort of self-respect does this fellow have? Such a conduct of a chief justice, unbelievable! Why was the judicial council silent? They should have inquired and reprimanded him. To the best of my knowledge nothing of that sort happened. The Judicial Council should have got his name erased from the Register. So what confidence can we have of the judiciary?

        Damn shame the Sri Lankan judiciary irreparable damage is done their credibility is lost and they are now on the street like a fish monger. I hope at least after reading my comment they wake up and attempt at least some damage control. Denial is not the answer because it is now public knowledge so first judicial professional bodies should accept and apologize and thereafter ensure strict code of professional conduct to avoid such political influence creeping into their judgment. They should inform the public of their remedial actions. We public should know otherwise it is unfair for all those who are languishing in jail for nothing. All prisoners have a right to feel victimized even though it may not be so.

        As far as the case against Sri Lanka accused of gross human rights violations, an accused (Sri Lankan side) cannot be also a judge for the case against him! That is against all norms of justice. Just because you are a qualified judge, that does make you eligible to hear case against you. Nobody will believe your verdict, you make on your behalf either way! Especially after proven loss of credibility when judges were successfully influenced by political pressure.

    Wimal is correct. His action will go to prove via the Parliament what the legal
    system is lacking, the missing sections to fall in line with Commonwealth requiements,
    and International standards etc. The need for SL to sign the Rome Statute in keeping
    with good governance, the fulfilling of new RTI Bill, Witness protection bill,
    deleting PTA etc.before even the commencement of a Hybrid Court. He did not protest
    when 3 Foreigners were incorporated to Paranagama Commission, even as advisers nor
    the ex-Indian Chief Justice leading a Commission.

    Wake up the Supreme Court and judicial council who control the conduct of the legal officers. You cannot hide a whole pumpkin in a few grains of rice. Serious damage has been done to your institution by the very officers you control. Do not blame me for dragging you to the streets and it is you who dragged your reputation to the streets.

    We the public feel the best of the judges get selected and become chief justice. We have witnessed what standards of personal conduct the chief justices Sarath Nanda Silva and Mohan Pieris maintained during their tenure holding such office, and were deplorable. We have read press reports related his private and personal character of Sarath Silva and are nauseating.

    Did Sarath Silva obtain the judicial council’s permission before he went public to admit his wrong and biased judgment against the former President Mahinda Rajapakse? Later to join him in the same election platform to support his election campaign is really disgusting. It is a very serious matter as a member of the public as we too can become victims of the same judiciary. I feel Sarath Silva’s professional conduct was very deplorable and the judicial council should have taken it up for inquiry and struck his name off the register, and apologized to the public for his conduct in the name of a chief justice.

    We the lay public have the right to feel he was selected as a chief justice as he was best among the whole lot and it is just natural to conclude the rest of the judges and judiciary are far lesser capable than Sarath Silva (& Mohan Pieris) and so a rotten lot. Sarath Silva is a representative sample of the entire judiciary. I have nothing to doubt that because again the judicial council never woke up from their sleep to restore the damage he had done along with Mohan Pieris. When Sarath Silva went public on his biased judgment and apologized, the judicial council or whatever controlling body should have also gone public to restore public confidence but to my knowledge never did so but was in deep slumber!

    With such a judicial council it is only unfair to hear any cases of the public who has lost your confidence and it is correct for the prisoners who are languishing in jail to feel they are victims of a biased and incapable judiciary. Now it is your turn JC!

    MP Wimal Weerawansa: You speak of: “number of serious accusations against the country’s security forces..” That is the only reason given by you for opposing this so called “Hybrid Inquiry”. In the report there are also very serious accusations against the LTTE. What and how do you propose to investigate those accusations? Your opposition to that “Hybrid Inquiry” must surely be applied to the accusations against LTTE too, as otherwise, it is not fair and equitable to let off one party and apply stringent rules on the other. You mentioning the case of ONLY county’s Security Forces, INDIRECTLY SUPPORT the LTTE too. Who knows, you can be bought over now that you are out of so many perks and huge income. In power, that man “KP” also had your blessings and his wealth is still hidden. Hope some MP will not discuss these matters in that debate you have asked for. If that happens, we call that scenario (in village terms) “ILLANG PARIPPU KANAWA”.

    Next question to you: What is your opinion on this report? Do you agree or not? If agreed, then how do you want that inquiry be done? If not, then what do you propose this Government to do? In this debate you have asked please remember to address these questions too. So without going on your usual “gilmart” please do not put up a a tent in front of the UN office in Colombo and go on “Fast unto Death”. If you do that this time, I do not think the President or Prime Minister will call on you and offer “orange juice” to revive; but it is certain you will “PERISH” in that tent. Weerawansa, Gandhasaara, Gammanpillay, Dayan Jayatilleke, Vasudeva Nanayakkara and Wigneswaran are all playing the role of buffoons these days providing an endless source of amusement to people who can think. As such they are fulfilling a vital social function. They never fail to crack me up amidst all the gloom and doom of politics.

    This despicable scoundrel is the worst thing to happen to our political culture in recent decades. How a semi-educated, racial rabble rouser – until only a mere newspaper reporter – reached the heights of our political landscape is in itself an indictment of the deformed state of our societal health.
    That those with toxic tongues can gain ministerial power only because they can excite and move thousands of dregs from political platforms speaks poorly of our governance system. That he came penniless to politics and now remains a billionaire having accumulated wealth in land, buildings, vehicles and cash within about 10 years speaks ill of our income tax, law and order and safeguard systems. That his equally ambitious wife is also a millionairess mysteriously during the same time leaves many a question unanswered. She may not be guilty only of impersonation, forgery and passport frauds – but much more. It has certainly helped many to have been part of Ali Babas many thieves. Tragically for the country now a days, utterly corrupt political husband-wife combos are a dime a dozen. This certainly sends the wrong message to coming generations who might grow up in the belief crime pays.

    Having been relegated from any position of importance, he is at his old tricks again.

    Weerawansa knows that at this rate he is going to fade out of politics very soon and like a drowning man tries to cling on to a straw, Weerewansa is resorting to desperate tactics to survive.

    I don’t blame him, for he is not an educated man (2/2=0), Sri Lankan politics is the only trade he has all the necessary skills to excel in.

    I blame the public who fall for this sort of cheap, lying, cheating, conniving, thieving, back stabbing, low life, tricksters/con artists.

    I used to dismiss this guy as just a loud mouth but after I read his predictions especially about MR regime in early 2014, I started to pay more attention to his words. I don’t remember what he said but in 2012 he said something that came to reality after couple of years. He predicted MR’s demise in early 2014 unless MR takes up reforms. He said MR cannot run for another election on war victory.

    I would not totally dismiss his claims. This is just me.

    Mr.Weerawansha has got a point here. The Hybrid Court is against the country’s constitution. These are all pre-plans, planned before the general election and the presidential election. Mangala and Ranil knew what was going to be in the UNHRC report before the elections. If the voters knew there was going to be a unconstitutional-hybrid-court then the UNP lot wouldn’t be voted.

    Take the war criminal Adele Ann Wilby (Adele Balasingham) and the ex-LTTE leaders to this Nonsense-Hybrid-Court FIRST!!!!

    WW has a honorary Phd in Law. After all, we all saw this shining example of a legal genius as part of the PC set-up to investigate Shiranee, the then CJ. Word got out that his incisive questioning and input baffled even seasoned lawyers in the committee. He should be considered as the next CJ. Only worry people will have is whether he will start dusting the streets in his mock fast in a big way. Well done Wimal.

It is your macho posturing that nearly made this a pariah nation, and left all the accusations of War Crimes,fabricated or not, in the hands of foreigners with corroborations from the overseas diaspora. You should be grateful, we now have the right to appoint the judges ourselves and co-operate to accept or refute the findings. How long do you think we could have gone on refusing to co-operate? This is what happens when we elect godayas to parliament, they do not have a clue how the world operates beyond our shores.

    By any chance the world wouldn’t let Sri Lanka off the hooks. Also we don’t have the means and capability do it and fight it out and win it.

    People of Russia and Iran with huge petrol and gas wealth are under going immense and untold sufferings due the economic embargo for not toeing the line of the world.

    It was reported hundreds of thousands of children and elderlys were malnourished and died in Iran due to want of milk and medicines. These essential items are permitted and not in the embargo regime but finance and banking are in it. It’s because these they are finding it hard to pay for it. They are allowed to sell some oil to buy food and other essentials goods as oil for food program, but this money was hardly sufficient to buy food for 70 million people, not alone other essential goods like medicines.

    Next factor is with whom you are confronting? The prime and main sponsor of this resolution, the USA and their allies. Whether we like it or not we should know a bit about them. In here, we shouldn’t say you did this and that in Iraq and Afghanistan etc, and it wouldn’t work and bring in terrible consequences.

    USA is the only supreme super in the world,and it has unmatched capabilities in every sphere of the world. Technology no one could match it, it’s the technology power house, you name it any thing IT,industries, power, agriculture etc they are on top. Now, it is the biggest producer of oil and gas in the world, the petrol prices came down, because they have stopped import of foreign oil any more. In fact the USA congress is debating to lift the ban of export of USA oil.

    Militarily non in the world has their capabilities. They have eleven nuclear carrier based battle groups each with a nuclear powered aircraft carrier which could go round the world without refueling for two years, with several hundred highly advanced lethal fighter planes with stealth and all weather capabilities. Each group has 6,000 highly trained men.It is they who flew over Pakistan in the dead of the night, all they from the Arabian sea to Bin Ladin’s house and placked him back to their vessel, he house almost inside military base.

    They have military bases all over the world, in Japan, Korea, Philippines, Australia, Diego Garcia, Qatar, Bahrain, Abu Dhabi, Saudi Arabia, Iraq, Afghanistan, Central Asia, Georgia, Turkey, Greece, Italy, Germany, UK, Spain, Portugal, Hawaii etc.

    Mind you how they did it in Iraq and Afghanistan, it’s good or bad, it’s a different issues but here we are trying to show with whom these foolish people are going to confront. The huge B52 bombers with their tons of lethal cargo flew their sorties from Diego Garcia and Germany with midair refueling by tanker aircraft, in this area these are the only two places from where they could operate, a round trip of 4000 miles for one bombing ride, and think of it, the mind spins.

    The above was mentioned to put some sense to all with whom we are going to confront, if at all any. Then about the capabilities of their allies? So, we are not a match at all to win this by confrontations.

    Hence, the best and next option for all to have win, win situation is through dialogue with lot of good will and good intentions for all, else it wouldn’t be the hybrid courts but the Hague, where the match is over, and Sri Lanka would be under the full and total mercies of the forefingers.

    It’s Wimal’s boss MR and cronies messed up the whole thing in the first place. Just after winning the war, they could approached in sensible ways to patched up every thing with the USA and the world instead of trying to cold shoulder them, always bad things happens in a war.

    The Sirisena and Ranil government is God sent for these foolish lot. By their good intentions and good governance they have won the USA and their allies into their fold, and they are letting Sri Lanka to have a domestic inquiry with the condition that it should have international involved. This not new, MR too brought in foreigners, paying huge sums to do these kinds of things, and didn’t get good results.

    If not for the Sirisena and Ranil government all these foolish lot would be ready to face the music in the Hague, might be, including Wimal in some form.

    It’s high time for them to catch Sirisena’s and Ranil’s hands, and sorted out this mess once and for all.

    Don’t ever think again playing China and Russia cards for they are both in utter mess and wouldn’t bring any good results. Russia is facing the good music with their Crimean adventure, now the question for Putin is survival, the Russians are thoroughly disgusted of him, the economic sanctions are hurting them very badly.

    China’s is slowing and in a mess. As it’s no more cheap, lot of companies are closing factories in China and moving – close to their main market the US – to the cheaper Mexico to take advantage of cheap energy, from the cheap US oil and gas, and NAFTA – North American Free Trade Agreement between Mexico, USA and Canada. So Chinese leaders hands too are full, workers loosing jobs, it this is create massive headache for them. Also trillions of dollars of their surpluses too invested in the US treasuries. Hence, Chinese look and think hard before doing any thing, if the US put the real screw on Sri Lanka. Their self interest is the first and topmost for them than others.

    Finally, we have to be very pragmatic and deal with this sensibly for a good out come for all, there are many examples and lessons we could learn from the world.

    In South Africa, minority apartheid white rulers did so much cruelties to the majority blacks, and in fact they kept Nelson Mandela in prison for nearly thirty years. When he was out of prison and the majority black rule was established, he embarrass the whites and made them as his partners in the government. At that time lot of white people moved to the West fearing the black rule but many of them are returning back to South Africa saying things are much better there than the West.

    At last, for the sake of generations to come lets get together solve this issue once and for all for the good all with out playing petty politics.

    Why does Colombo Telegraph give s disgusting fellow any space at all?

    Newspapers and news media must fashion the thinking of society in a good way. Particularly in a public that finds it hard to discern the right from wrong.

    Public representatives who are smeared with bad repute and under investigation should be given little or no space at all in terms of publicity. Remember, nearly 50% of our population is still “impressionable” as polls showed. News media has a duty to publish only those who deserve to be, and not fear mongers.

        Maalumiris your point is taken, and then again not taken fully, if you know what I mean; all very politely of course!

        The current ‘public’ are highly impressionable as was shown but some of the types they returned to parliament at the elections, resulting in Mr Mayadunne’s resignation.

        Although what you say is perfectly right, I’m afraid it applies only to a mature, intelligent public, and not one which is vying to be one of the most incredibly bad and dangerous societies in the world.

        I do believe the newspapers and websites have also a duty to perform, in fashioning the minds of others towards lofty thinking, denouncing the bad and the immoral, demanding justice and demanding that it be not only meted out but seen to be so done, and ensuring the likes of this Weerabangsha’s wife receives her just desserts.
