US Is Concerned By Actions Taken To Impeach Chief Justice

“The United States is concerned by actions taken to impeach Sri Lankan Chief Justice Shirani Bandaranayake. We also note with concern recent threats to Sri Lankan judicial officials, including the assault last month on a judge who had publicly criticized government pressure on members of the judiciary. We urge the Government of Sri Lanka to avoid any action that would impede the efficacy and independence of Sri Lanka’s judiciary.” says US Department. 

Issuing a statement US Department Spokesperson Victoria Nuland says “the United States, along with our partners in the international community, continues to urge Sri Lanka to address outstanding issues of the rule of law, democratic governance, accountability and reconciliation.”

    I cannot recall the then US ambassador saying; “the US is concerned by actions taken to impeach Sri Lankan Chief Justice” when the UNP moved to impeach ex-CJs Nevil Samarakoon and Sarath Silva in parliament.

    I am highlighting it here because; the US is displaying full of hypocrisy and double standards: ‘The rule of law, democratic governance, accountability and reconciliation’ is not a theme that the US presses for its puppet regimes like Bahrain, Saudi and etc. They press such values only against those small countries that do not do things as they say and not bite bullets that its economic hit men ram.

    Unfortunately commentator WOGs here do not get it for they think they have become one of them when swotted up their language and a bit of idiomatic.

      Nothing exists as whole and parts in their natural context, pipsqueak.
      Saudi, Bahrain etc. don’t beg they are part of the de facto currency energisers.
      If you dream that China is adopting you while your largest export market is US and then India have a closer look at “Sudan now” where is the Oil and where is China? Before China had almost 90% of all Sudans contracts in exchange for arms and infrastructure.
      Where is the harbour? But in the Maldives “not dotta” where crime is negligible, 1 million middle class tourists and no drugs.
      Beggars cannot choose but comply to reason.

        I don’t see where Leela has confessed to dreaming that China is adopting her, which would, of course, be a rather unusual thing to dream (except, maybe, for a Chinese). And when you say “your largest export market is US and then India” are you addressing Leela in particular, or all Sri Lankans? What nationality do YOU claim?

        And what is the point you are trying to make about the geography of Sudan and China? Harbour? What harbour? What ARE you on about, Wu-Liang Guo?

      Leela, let’s pretend you are right and that the US (good for aid though eh?) is bad, you still have not addressed the real issue. There is no point attacking those who criticize, stop trying to hijack the debate making it all about the nations/international bodies who criticize. Right now we should ALL be more concerned about what is going on in OUR country, and the abuse of power. This ruse that many Rajapaksa supporters use here, of attacking the messenger, is not productive to the justice the Sri Lankan people need here, urgently.
      We are being systematically stripped off our rights, media is silence, and democracy is lost. Stop pointing fingers at the US.

        I have written my opinion on this matter clearly in another thread the same blog.

        No, I do not attack the messenger; I only point out the so-called messengers’ double standards and hypocrisy if any. There are so many here to criticize Rajapakses and his government, but not many to defend them. Not that there are many shortcomings, but I am in agreement with many things Rajapakses do in general. On the other hand, I think UNP under RanilW would bring about religious and class division to this country as was between 2001-3.

        Sure, we should be concerned about what’s going on in our country. But in so far as I can see, the Government is not preventing the opposition to have their rallies or press briefings or anything they may use to spread their themes and messages. See even FUTA had their strike for 45 days. Of cause government scuttled it. Then which government and where would they extol benefits of strikes.

        If only you watch ‘Swrnavahini’, ‘Hiru’ or ‘Sirasa’ you will see that MR and the government is under attack 360 degrees every day. RanilW or one of his buddies does it with RanilW’s class and style. Anura Kumara whacks it with his put on furious face. TNA is quietly doing their best to fix war crime charges at international arena. And NGOs and likes of you write scathing attacks through various articles and comments in numerous blogs.

        It’s amazing that MR survives such combined onslaught.

          Leela, I am sure the Rajapaksa’s are touched they have a loyal supporters who sees fit to protect them, but I am sure they are fully capable of taking care of those who criticize them, and from what we have seen of the media and activists who have stood up to them, the Rajapaksa’s have mastered the art of making them disappear, or they find themselves having to fight trumped up accusations.
          So your effort at being guard dog, is actually lost here. Remember in this so called democracy we have over 200 members of one family running this roost, and they have shown this country how brilliant they are in protecting themselves.

        Brian, absolutely. The means justify the end. Unfortunately the World Body is adopting such measures on countries for all the wrong reasons, to protect the interests of the mighty. It should be the other way about, where the World Players should in one voice impose sanctions and remove Leaders for violating and denying freedom for it’s subjects without playing politics. The present system of scratching each others backs for mutual survival has to stop.

      At times the US gets their puddings mixed up. They forget that Sri Lanka is only following examples of the US, the epitome of democracy.

      The Constitution of the United States grants the Congress the power to impeach “the President, the Vice President, and all civil Officers of the United States.” And Article III says that judges may remain in office “during good behaviour”. And Article One gives the Congress the sole power of impeachment and the Senate the sole power to try impeachments of badly behaved judges.

      That means the Congress and Senate may remove a judge for bad behaviour via impeachment and conviction for “treason, bribery, or other high crimes and misdemeanours.” Perhaps, I must mention here that according to Cambridge dictionary misdemeanour means action which is slightly bad or breaks a rule but not a crime.

      Anyway the Congress has impeached 14 federal judges and the Senate has convicted six of them to date. Who say what is good for the goose is not good for gander. The government is only following the procedure for impeachment of Judges as laid down in Sri Lanka Constitution.

        Leelananda first get out of the female garb Leela and be a man for once, in facing reality. Yes the act of Impeachment is there in the Constitution. To be used, to remove one from high office for Corruption or lack of behaviour and not for Political reasons. This is what matters now. Is the attempt to remove the CJ for the reasons mentioned?

    This is similar to other instances where MR brothers using their strong arm method to get rid of opponents to take the country on a dictatorial path. This impeachment is not against the CJ but against all the freedom, justice and democracy loving Sri Lankans. MR wants to make the country another IDI AMIN like dictatorship. MARAS has started to plunder the country’s wealth giving it to their goons and supporters to keep the dynasty intact.Also their sound mind is questionable. Therefore everybody including Asian Human Rights commission, The International Jurists and especially the British, European, Canadian and Australian Jurists should come to help CJ in this case. Since MR dictatorial regime will lead to another bloodbath in Sri Lanka and force people similar to 1983 to flee Sri Lanka and seek asylum in those countries making a burden to their economy. Therefore please act soon.
