WikiLeaks: It’s Not Genocide, Army Could Have Won The Battle With Higher Civilian And Less Army Casualties – ICRC To US Mission To UN

Jacques de Maio, ICRC’s Head of Operations for South Asia, began by stating that, because of ICRC’s strict confidentiality rules, he would be unable to share any specific information regarding allegations of crimes by either side, nor would he be able to direct Williamson to sources. That said, de Maio engaged in a lengthy discussion of the conflict and offered a nuanced view of the complex situation on the ground. For example, he said that the Sri Lankan military was somewhat responsive to accusations of violations of International Humanitarian Law (IHL) and was open to adapting its actions to reduce casualties, but only to the extent that this would not undermine its overriding military objective – to destroy the LTTE.” the US Mission to UN informed Washington.

The Colombo Telegraph found the related leaked cable from the WikiLeaks database. The “Confidential” cable discuses what had happened on the ground during and since the conflict. The cable was signed by the US Ambassador to Geneva Clint Williamson on July 15, 2009.

After a meeting with Jacque de Maio, ICRC Head of Operations for South Asia on July 9, 2009, just two months after the war, the ambassador wrote; “The army was determined not to let the LTTE escape from its shrinking territory, even though this meant the civilians being kept hostage by the LTTE were at increasing risk. So, de Maio said, while one could safely say that there were ‘serious, widespread violations of IHL,’ by the Sri Lankan forces, it did not amount to genocide. He could site examples of where the army had stopped shelling when ICRC informed them it was killing civilians. In fact, the army actually could have won the military battle faster with higher civilian casualties, yet chosen a slower approach which led to a greater number of Sri Lankan military deaths. He concluded however, by asserting that the GSL failed to recognize its obligation to protect civilians despite the approach leading to higher military casualties. From his standpoint, a soldier at war should be more likely to die than a civilian.”

    The ICRC’s views as expressed in the abovementioned article allow a rational and meaningful discourse to develop. The ICRC is probably the most experienced organization in the realm of operating in battlefields.

    One hopes that the vituperative contributions will be strictly edited out by the moderators.

    The reason Callum Macrae is having a free run with his “NoFireZone” gutter production is becuase Sri Lanka havent even bothered to respond to these wild allegations. There must be a tonne of material than can be produced at any investigation really. For eample, the artillery fire locating radar batteries would have logs detecting LTTE fire coming from within the NFZ. In most instances there were no retaliatory fire.

    LTTE must be the only cannibalistic “freedom figheters” that the world has ever seen. Who else would kill their own women children to protect their own skin?

      Macrae’s bias is undeniable. The regurgitated tosh of the old was ONLY interrupted by ONE sentence when Tamil terrorists were mentioned as having shot at the people who wanted to move to safety. Widely available video clips were ignored. No mention was made of arms, motars being kept within and in close proximity to hospitals. Wikileaks has done a great job exposing the truth about the Tamil terrorists.

    I am happy to see that ICRC has reported the correct situation during the last stages of the war. The Army chose a slower approach which led to a greater number of Sri Lankan military deaths.

    As reported by Wilkileaks, the LTTE chose to store weapons in hospitals and near them. Efforts to destroy heavy weapons stored near hospitals appears to have resulted in damage to some hospitals, which is normal and does not amount to a war crime.

      How could India help, when they were the architects of this conflict by creating and training Tamil terrorist groups including the LTTE. If there is an investigation, then it should cover the entire period of the conflict, rather than what has been promoted by USA and India to restrict it to the last few weeks, thereby letting India off the hook for creating terrorists and the subsequent IPKF crimes in Sri Lanka.     My take and that of many is( and was) that the Sri Lankan army could not defeat the LTTE for 30 years due to the risk of causing casualties of civilians, and soldiers. There was severe pressure exerted from HR bodies as well as countries such as India, US, UK and also the UN. LTTE always used civilians for cover. We all knew it for decades. In 2009, the army commander Sarath Fonseka along with Gotabhaya insisted that the war has to be finished even with heavy casualties of civilians and soldiers. At long last the influential countries gave the nod to go ahead but within a timeline. That is how the war ended. A large number of innocent people died along with huge casualties amongst LTTE and army. Was it genocide? I doubt it. Were surrendees killed? Yes, for there is stark evidence.Should those responsible be punished? Yes. Is the government in a pickle? Yes. Was it worth it? No. A single life lost is not worth the satisfaction gained.

    Finally the plain truth is out. The SL Army could have ended the war at least three months earlier, if it was not concerned of civilian casualties. In fact, even the so called international community and INGOs/NGOs never bothered to even request, leave alone demand, the LTTE to stop the war. This is despite MR asking the LTTE to surrender several times so that war could be ended sooner and loss of lives reduced. But VP believed till the end that the international community and the INGOs/NGOs would somehow come to his/its rescue. It is recalled that the international community and the INGOs/NGOs never exerted any pressure on (leave alone demand) VP/LTTE to release the human/hostage shield he/it had setup for self preservation (damn the humans).

    If one may recall, the last ditched efforts of Miliband and Kouchner to save VP/LTTE was hilarious, as it was apparent that politics/tamil diaspora votes were at the heart of their efforts.

    The SL Army suffered the most by loss of life and limb on account of its policy to protect civilians.

    Contrast this with the massacres perpetrated by the invading British colonialist Army on citizens of Sri Lanka in the 1700s and 1800s and the continuing wars against the people of Iraq and Afghanistan, and you see the difference between the SL and British Armies.

    Yes, Sri Lankan government took maximum care to prevent civilian casualties. Its the LTTE that is responsible for civilian casualties for using them as a shield.

    By eliminating the LTTE, its mostly the Tamils living in the North and East that benefited. Not the Tamil diaspora, they are in fact is very angry about that because they can no longer play that card to get ‘economic refugee’ status in the West. Had the LTTE continued, the number of Tamils that would have been killed by the LTTE by now is much more than what may have killed in the final operation, that too the responsibility is with the LTTE.

    Tamils do not have a country, only a state called Tamil Nadu in India. So what can Sri Lanka do about that! Tamils are living as equal citizens in Sri Lanka. If the Diaspora wants a separate state, please do that in Tamil Nadu. Don’t mess with Sri Lanka. You are warned!! We can only help the Tamils in Sri Lanka to get back to Tamil Nadu, if they so wishes (and vote for Jayalalitha or Karunanadi asking for a separate state for Tamils in India)). Canada, be aware, it will be Toronto that the Tamil Diaspora will ask for a separate state…. before long…. (however much they be equal citizens, they are looking for a country for themselves…)

    Without facts the statement is one man’s opinion.

    How do you explain the enforced starvation, Mr Jacques de Maio?

    There were 456,000 men, women, children and babies lived there according to the then Government Agent – the register is in the possession of the government. But the government insisted only 70,000 and ICRC was not allowed to take food and medical supplies to those civilians including babies.

    310,000 came out of the narrow strip. So the government starved those people. Starvation results in deaths, too.

    THe government admitted 310,000 surrendered. The army divided husbands and wives and put them in separate camps preventing natural production for over one year. That, too, is genocide.

    In war civilian casualties do take place. What is important is whether a legally constituted force under an elected government acted responsibly. Rape and torture after surrendering is something that can be condoned. We are born naked and innocent not knowing if we are sinhalese Tamil or Muslim. When a child is being killed in cold blood for no fault of his or when a young girl is raped simply for being amongst the residents in an area controlled by a terrorist group then it becomes an issue. I am sure none of us irrespective of our racial ethnic or religious beliefs would even dream of such an atrocity befalling a member of our family. Let’s for a moment leave the war aside. After the war ended when Prageeth Ekniyagoda disappeared simply for being critical of the regime one expected stern action from a regime that preaches and show cases democracy. A few months ago a member of the ruling party had the audacity to sadistially state that Prageeth is living in France happily. This sent sadness and shock among the family and peace loving citizens. This grotesque act was neither condemned or rejected by the regime. In fact it was cheered on by the rulers. My school mate Romesh Abeywivkrema had to secretly leave the country when his wife and he were attacked for not complying with the instructions of the stooge who was funded by the regime to buy over the Sunday Leader whose founder a person i associated closely was brutally killed in broad day light. Forget the innocent civilians in the north if you were one who is inhuman and racial. Anyone who goes against the regime faces death or torture regardless of his or her ethnicity or race. In fact today the north is a tad safer as one has the consolation that it is run by an educated and rational minded person. Can majority sinhalese boast of true freedom in the south ? The blood shed by the innocent is alive and will sadly haunt this country for years to come unless justice prevails and wrongs are corrected.

    US, UK & EU are well aware that there was no genocide by the Army and they accept that in any arms conflict no one can avoid civilian casualties except for minimising it, which our forces have done better than their forces. But the problem is that the Rajapaksa Government is not ready to bow down to commands of the West. The West therefore is using a bogus Human Rights issue with the help of AI, HRW & Tamil Diaspora to try and make a regime change, which they can manipulate.

    The West will anyway continue to bash Sri Lanka until such time Rajapakse steps down or sent to jail & hand the government over to a Puppet leader of their choice.

    First of all let us get this into perspective:

    1) US Ambassador to Geneva Clint Williamson hails from a country which invented the word ” Shock & Awesome” during the Iraq War. So us Tamils don’t have to take his word as Gospel.
    So his Judgement on what the Sinhala Army did in Sinhala Lanka has to be taken with a pinch of salt.
    2) He may be justified in saying what his Country did in Iraq & Afghanistan was to protect his country from Religious Fanatics after 9/11.
    3) But what we had in Sinhala Lanka was nothing compared to 9/11.We never waged a War outside of Sinhala Lanka and ours was confined within our Country of Birth which we have inhabited for Centuries. We were fighting for Freedom from Sinhalese Tyranny and for our survival. So if the Ambassador reads this he needs to redefine the Word GENOCIDE in Sinhala Lanka.
    4) By a Conservative estimate between 70,000- 120,000 civilians died which is unacceptable. But this number was in addition and a continuation of Sinhalese Brutality stretching back 64 years.

    It is obvious from the following that concerns regarding the Conduct of the War and the Type of Weaponry used by the Sri Lankan army were raised by the Director of Operations:

    At a press conference in Geneva on 21 April, the ICRC’s director of operations, Pierre Krähenbühl, described the situation in the north-east of Sri Lanka as “dramatic”. He explicitly warned that government forces and fighters of the Liberation Tigers of Tamil Eelam (LTTE) must take immediate action to prevent further mass casualties among civilians.

    As for government forces, ” they have a specific responsibility to ensure that the methods and means of warfare they employ make it possible to clearly distinguish at all times between civilians and civilian objects, on the one hand, and military objectives, on the other. ” Mr Krähenbühl added that he was particularly concerned about the impact on civilians of using weapons such as artillery.

    If the Ambassador reads this and as the Author of the above report I would like him to respond to the Following:

    (New York) – The Sri Lankan armed forces have repeatedly struck hospitals in the northern Vanni region in indiscriminate artillery and aerial attacks, Human Rights Watch said today. Commanders responsible for ordering or conducting such attacks may be prosecuted for war crimes.

    Patients, medical staff, aid workers, and other witnesses have provided Human Rights Watch with information about at least 30 attacks on permanent and makeshift hospitals in the combat area since December 2008. One of the deadliest took place on May 2, when artillery shells struck Mullaivaikal hospital in the government-declared “no-fire zone,” killing 68 persons and wounding 87.

    1) Do you justify the killing of up to 120,000 civilians by indiscriminate shelling including hospitals to entrench Sinhalese hegemony. If this is not Genocide what is Genocide.
    2) Is shelling Hospital Justified to defeat LTTE.
    3) What steps does your country intend to take to minimise the killing of Innocent Civilians during Drone attacks and is there another way other than Drone attacks.

    It took four years for channel 4 to come up with some evidence and ICRC also needed 4 years to come up with these evidence and statements. Why this timing?
    Who are these civilians? Are they Tamils or Sri Lankan citizens? If GSL thought they are Sri Lankan citizens, will they still continue with same type of operation? If they thought they are just Tamils and dropped the bombs then it was GENOCIDE.

    As for genocide it started long before 1983 in the form of government sponsored land grab, depriving education (so the cream of the crop will leave the country), disfranchising estate workers, government sponsored racial violence, and burning of the library. 2009 was only a finishing act.

    As I have said sometime back, the mistake made by Gota and the army chiefs was they did not have anticipated that LTTE will take people as hostages and hence did not have a 100% good contingency plan ready.Was it the first time in world history that people who claim they are fighting for a group of people taken same group of people as hostages? Normally in guerrilla war fair members of enemy were taken as hostages.Nobody can say genocide was committed. Army soldiers paid with their lives as well as causing some civilian deaths.
