Will Parliament Endorse The People’s Call For Rajapaksa Resignations?

There are three Ps in Sri Lanka’s political firmament: the People, Parliament and the President. But they are not peas in a pod. There is a massive disconnect between the political protests of the people and the survival games that pro-government MPs, the Prime Minister and the President are playing. The President is playing hide and seek from the people and getting his handful of Ministers to say that their boss is ‘not going to budge.’ The Prime Minister, the family’s only communicator comes on television and cuts a sorry figure as a long-gone has-been. The PM says he is ready to meet with the young protesters, but the young protesters are saying there is nothing to meet about and the only thing the PM can do is go into sunset with the President.

The 11-party dissident alliance in the government is going dizzy as it tries every trick in the book to stay politically relevant and insure their seats in parliament. Its 41 or 42 MPs are shuffling for a parking spot in parliament, but they have no connection whatsoever to ongoing politics outside parliament. The shameless Maithripala Sirisena even tried a fast one to become interim PM elbowing out MR. The bulk of the SLPP MPs are rudderless without Basil who is powerless to do anything. The entire government formation, so to speak, has been thoroughly debilitated by the protests. But the government has been able to hold on to its SLPP MPs to maintain a bare minimum but precarious simple majority.

The opposition formation is not very much different, except that it is not as decadent as the government. Ranil Wickremesinghe, the lonely UNP leader still pretending to be on his high horse, has been opining that “what Sri Lanka needs today is not a change of government but a change of systems including vast economic reforms to avoid a revolution.” To that end, he is proposing “new legislation for Parliament to take over the finances,” and he is “preparing a set of reforms for this purpose.” Mr. Wickremesinghe went further: “One should understand the situation which prevails today. People who have been led by the youth want a new beginning and a complete change of the systems. Parliament at the moment is focusing on a change of government. Peaceful protests that are going on at the moment will turn into a revolution if we ignore people’s demands.”

Parliament and the People

Mr. Wickremesinghe’s statement is obviously more sophisticated than anything that Rajapaksas can put together. But he slips into sophistry when he says that “focusing on a change of government” is somehow tantamount to turning “a deaf ear to people’s demands.” How so, when the sole demand of the people is for the resignation of the President and the Prime Minister? Mr. Wickremesinghe is not only mute on the matter of resignations, but he is also not explaining how he will legislate “for parliament to take over the finances” while the government and the President who destroyed the financial system continue in office.

At least objectively, the former PM’s scheme would serve the same purpose as the 11-party alliance’s proposal to establish a ‘National Executive Council’ under the incumbent President, or the crazy constitutional amendment bill drafted by Lawyers Romesh de Silva and Manohara de Silva to allow cabinet ministers to be drawn from outside parliament. And that purpose is to find a way to keep the Rajapaksa presidency going while appearing to address the concerns raised by the protesting public. These are political survival games played by or on behalf of politicians whom the people want thrown out lock, stock and barrel.

The JVP is honest about calling for the resignation of the President and refusing to be involved in any interim arrangement that will include the incumbent. However, the JVP has not been able to connect itself, let alone give leadership, to public protests that are now getting into the third week after their start on March 31 in Mirihana. The JVP started by being cautious about the initiators of the protesters and their lack of ‘accountability.’ Later it warmed itself to the protests but has not been able to establish any linkages with them. For a Party and its leader, Anura Kumara Dissanayake, who last year declared that they were ready to give leadership to the country, they have been nowhere near-ready to respond to the most spontaneous and sustained public protest that unfolded over the last fortnight.

The JVP and its leader have been totally ineffective about doing anything to align the business of parliament with the protests outside. This is quite a setback after AKD’s stellar performance in parliament exposing the innards of the controversial LNG deal with New Fortress Energy (NFE). While individual performances are great for image, you cannot achieve anything substantial in parliament unless you are able to work with others. Especially for a party of three, like the JVP. And the JVP has been woefully wanting in striking cross-party alliances in parliament when the people are crossing boundaries to unite in protest against the government. Unless the JVP changes its approach it will lose its political relevance despite its self-assured readiness for political leadership.

In contrast to the JVP and its leader, Sajith Premadasa and the SJB have tried to take to parliament the momentum from outside. Like the JVP, the SJB has also refused to be involved in any interim arrangement unless the President resigns beforehand. But unlike the JVP, Mr. Premadasa has taken symbolic and practical steps such as a No Confidence Motion against the government and the abolition of the Executive Presidency. He has already signed the petition for a No Confidence Motion and the resolution for Impeachment. A bill for ‘abolishing’ the Executive Presidency is apparently in progress. Whether they will succeed or not will depend on how Mr. Premadasa is able to articulate parliament and the people and how he would be able to create voting alliances in parliament.

Parliament’s Task

At the same time, the onus of making parliament responsive to the people should not be on a single individual leader. It should be up to every MP to clearly show where she or he stands. Besides the SJB leader and MPs, Gajendrakumar Ponnambalam and his Tamil Congress MPs are also reported to have signed on to the two resolutions. This should double the onus on other Tamil and Muslim MPs. Especially the TNA and especially after its ill-timed meeting with the President after being stood up by him for over two years. Remarkably, while almost all Upcountry Tamil MPs have left the governing SLPP alliance, more than a handful of Northern and Eastern Tamil and Muslim MPs are still reluctant to break ranks with the government.

One would think the three JVP MPs will not shy away from supporting the SJB initiatives in parliament. The same goes for Ranil Wickremesinghe despite his rarefied musings about implementing financial reforms through parliament under the current government and its President. The key to any shifting of MPs and their numbers will be the 41 or 42 MPs of the 11-party alliance. They have indicated their non-agreement with the No Confidence Motion approach, but they cannot indefinitely remain non-aligned between the Rajapaksa regime and the Premadasa opposition. If the 41 MPs decide to vote against the government and if all Tamil and Muslim MPs count themselves against the government, then there will be a loosening up of the core SLPP contingent, assuming that there is something core about it.

All of this might enable passing a No Confidence Motion against the government, but launching impeachment proceedings against the President will still be a long shot. On the other hand, a more specific No Confidence Motion could be moved against the President. I alluded to this earlier as a potential parliamentary initiative. Since then, Dr. Nihal Jayawickrama has pointed out that parliament can, and in the current situation must, pass a No Confidence Motion against Gotabaya Rajapaksa under Article 42 of the Constitution which holds the President “responsible to Parliament for the due exercise, performance and discharge of his powers, duties and functions under the Constitution and any written law including the law for the time being relating to public security”

More than the government, it is the President who deserves a No Confidence Motion against him on account of his abject failure in the management of the economy through ill-chosen Secretaries and Governors, despite all the powers that he granted himself through the 20th Amendment. Even so, a No Confidence Motion can seemingly serve only a symbolic purpose as it cannot compel President Rajapaksa to resign from office. But actions in parliament can and do serve a substantive purpose, that of articulating protest politics with constitutional politics. Together they can bring pressure on the two remaining Rajapaksas to exit gracefully within an agreed upon time period.

The task before parliament when it reconvenes on April 19 cannot be clearer. It must rise to the occasion, stand in solidarity with the protesting people, and pass No Confidence Motions against the President and what is left of his government. If it fails, parliament itself, not just SLPP MPs, will become irrelevant.

    As I have always made it clear, I firmly and consistently support the NPP. I don’t take it on myself to suggest what their policies should be. Their leadership may make mistakes, but I think that they know the over-all situation in greater detail than I do.

    These guys won representation in Parliament as the NPP. In any case, although AKD and Vijitha Herath are indeed members of the JVP, Harini Amarasuriya isn’t.

    All in all, the JVP may be right to hold back in their extra-Parliamentary protests. I’m tired now, 5.38 am, and I must get some sleep. No other responses to your article visible yet. I’ll return with more later.

      …I think that they know the over-all situation….
      Or like opportunists, they never thought this protest will strengthen and even initially, said it will fail without a leader or accountability.
      Now today they are surreptitiously joining it, while SJB to their credit said they will always support it.

          SM, good news. Few comments in newspapers suggest JVP/NPP rally was a total success. One said he has never ever seen this many people in any political rally. (needs to be confirmed). I guess the police shooting would have added strength and speed to the rally.

        The fact is that Gota at least has abjectly surrendered. His Viyathmaga geniuses are all in the dumpster, from Cabral to Lakshman and PBJ. Even Basil kaakka is out. He has recruited a new set of economic advisors, including Coomaraswamy, Devarajan, Nandalal Weerasingha, Dushni Weerakoon and others, none tainted by association with the Viyathmaga jokers. He seems prepared to listen to their advice, so far.

    THIS IS DANGEROUS for BOTH sinhala and tamils because unlike the KID GOLVE treatment of them sinhala protestors by the barbaric sinhala government and barbaric sinhala armed forces (who even DELIBERATELY burnt down the Jaffna Library) when tamils get involved these barbarians wont have any compunction in killing the ceylon tamils (despite being rice feed that has been fertilised from the toilets of tamil nadu and gifted) and then saying the killed sinhalas were terrorists and collaborators of the ceylon tamils

        However, it would take a very long time to recommence, placing trust by the minorities on the Majority community and enable unity in thought and action, after 70+ years of divisive politics in SL!
        According to EE the blind Eye, it started with the ‘Batukotte’ resolution of TULF; Others differ, say it started with DSS anti-Indian Tamils in the plantations; another group plug-in to a much earlier era, even 1915 Sinhala – Muslim riots and another to earlier era to the perceived preferential treatment meted out to Tamils, which tempted to harbour animosity against the Tamils!!!
        Then we had a “latter day explanation”, to the birth, fostering and nurturing of the LTTE and active terrorism to the 1983 program of JRJ, in the new foisted kingdom of Sri Lanka!!!
        Whatever, the cause is irrelevant and immaterial now, save to say, that the effect and aftermath, we are living now are a result of all these by itself or in combination!
        Dare say, economy of country demolished to the extent, exposed and destroyed ‘roots’ of vibrant economy SL had, post 1978 liberalisation!!!

        What perplexed all of us patriotic Lankans is the aim, need and pursuit of the antagonistic attitude towards Muslims, who had lived for centuries in amity, from the time of ancient Sinhalese kingdoms, helping the security of our kings and rulers and importantly against the latter day terrorist – LTTE – in the 30 year war, ending in May 2009!!!

        Example the case of the Dr Shafi – Gynecologist of KNH – promoted subtly by some idiots including the ‘Z’ score and quota system educated doctors of SL and brought to a climax by the “ATHANA, METHANA, NATANA, HITHANA” Naluwa.
        To say the least it smacked to high heaven and reeked of Communalism! Alternates not entertained! OPEN AND SHUT CASE, IT IS.
        The guys are so inept, even they cannot lie with confidence and believable
        Buddhist priest went to the extent, trying to rouse support to the accusation, went on record that he has FIRSTHAND EVIDENCE, (Celibacy being the predominant objectives of Theravada Buddhism) that, Sinhala Buddhist women had been made ‘baron’ by this beleaguered medical professional, had performed under the pretext of a ‘C’-section operation!!

        Yes Tamils will join the protest, if their grievances are also included in the protest. Some well meaning Sinhalese wanted national anthem to be sung. Immediately a Buddhist comes to the tent and finds fault with them for doing so. His argument is that Indian national anthem is in only one language, ignorant of the fact that it is in Bengali, a minority language. There is also Hindi version, which is not sung in national events. Singapore national anthem is in Malay, despite Chinese making 75% of the population. In New Zealand, National anthem is sung in both English and Maori. Sinhala call for Tamils to join is hollow without addressing concerns of Tamils. There is going to be demonstration in London on May 1st, and they contacted me to join it. I told them, well and good. If you hold the placard “Gota get out of our country”, then I must have the right to hold the placard “Army get out of our homeland”. If you have the right to hold the placard “Bring back our missing money”, them I must have the right to hold the placard “Bring back our missing people”. That was the end of it, and I have not heard from them ever since.

          Knowing your ways, I am reluctant to get involved with an opinion of yours. But, I have a responsibility to get involved to clear Tamils of bad representation.
          A demand that Tamils would join hands only if our grievances are also included in the protest is tantamount to opportunism.

          The public is protesting against the administration. It is nothing proper that we support the protest in whatever way we could.

            Demanding ones right is not opportunism. If Sinhalese are oblivious to the grievances of problems faced by Tamils, and do not want them to be brought out, then matter ends there. I am in daily contact with Sinhala class mates and batch mates, I can assure you that participation will not bring any benefit to Tamils and non participation will not have any adverse effect. Listen to the young Indian Tamil couple who attended the protest : “Is this protest real ?, will this last ?, Will Srilanka people really stop seeing us as lower citizens ?. That will never happen, they will just vote another supremacist after Rajapakses are gone. But let us enjoy the feeling of equality for the moment at least”. You do not seem to have even this amount of insight of ordinary people, but like a big fellow start commenting on to mislead Tamils. Read the article in Sunday Times, where people of Northern province who had suffered similar situation for 25 years, have given forthright views about these protests.

      Please see page 4 (I may be wrong) of the Sunday times of yesterday, the article explains, why the north is not affected by this deprivation!!!
      No wonder, inspite of Hirunika’s valiant effort came to naught!!!

      Stage personalities like Rohana Weerasinghe Jackson Anthony Ravindra Randeniya Deepani Silva all joined the protest of “a bunch of Toiyas” !!
      Sanjeewani Weerasinghe top supporter who was appointed ITN Director now in LA, was booed there when she tried to join their protest.
      So how many “voters” without fuel gas electricity fertilizer milk powder, who cannot voice their anger in public, are still with Gota?

    Money brokering plays an importnat part. Basil is an expert on that brokering What is the haram un giving 2% from the ten $ xommision thye get in negotaiting laons. Thts is the Sri lankan political cuture . Singhala buddhis voted for them to swindle the coutry. They proved it.

    I don’t think Gota will resign. Even Mahinda will not resign. They may form a Cabinet without other Rajapaksas. There are some other factors that should be analyzed. I think China and India may like to have these Rajapaksas in power, because it is easier to dictate terms on these corrupt leaders who have no sense at all to arrest the inflation of Sri Lanka’s currency. It is very difficult to state that to what extent the economy of the country will be ruined by these Rajapaksas. At the same time, it cannot be ruled out that there is suspicion that the protest is a swift move by the CIA. It appears that Gota is seeking the assistance of Gnanakka, while Mahinda is relying on country’s two popular astrologers whether to remain power.

    The no confidence motion is very important to see who is supportting the government while being in the opposition.Sajit should first get all 54 SJB MP’s to sign it.I thnk that has been already done.Then he should get the only MP of the UNP ranil to sign it.Ranil could be a rajapakshe mole in the UNP.

    More than Gota, it’s Mahinda who should be sent home first. If not Mahinda will continue to pull the rug under Gota using his SLPP slaves. Kick Mahinda out first and a new PM will have more freedom to work with Gota. As long as we are a Presidency controlled government Gota will be strong, so its better to replace the PM and then use the pressure of the PM and his parliamentary members to manage Gota.

    Rajapahshas will never leave on their own. They are used to plunder the country so much for so long that leaving on their own is out of the question.
