Writ Filed Requesting Pieris’s Passport To Be Impounded

A writ application was filed by Senior Lawyer N Kodituwakku requesting the Court of Appeal to impound the passport of former Chief Justice Mohan Peiris.

The writ had been filed in reference to a complaint made by Kodituwakku to the Bribery and Corruption Commission against Peiris on January 18, for causing a loss of Rs. 619 million to the government due to the course of action taken by him during his tenure as the Attorney General and Chief Justice, with regard to a fraud committed by the Colombo Dockyard Ltd. in 2000.

Pointing out that action has not yet been taken with regard to the complaint made in the Bribery commission, the complainant requested the Court to impound Peiris’s passport so that he would not be able to travel overseas until the investigations into the complaint conclude.

    Quite right for asking passport to be impounded provided this action is justified by the appropriate courts irrespective of the position held by this individual, the law must apply equally for all.

      If there be a prima facie case to impound the passport,the Senior Lawyer supported by others should take the charge to its logical conclusion in courts.

      Let the world say that the cleansing of the judiciary in SL has started with the CJ himself!

    Our Department suffered heavily and the loss of revenue to the government because of this man’s unbecoming conduct is some billions.

    We believe this man should surely punished for the frauds he was directly involved, setting an standard to other judges in the Superior Courts.

    Wish you success in nailing this man who denigrated the office of “chief justice” for two years.
    This case will be a landmark in the annals of corrupt judges who met justice in their own careers.
    I hope that our justice system as of now will carry this case to a conclusion.

    Mohan Peiris is like the man who coveted a silk Sarong and in the end lost even his Amude!

    Some judgements made by this man against the Customs opened floodgates for the fraudsters. Hope at least now the Judiciary open its eyes and restore Rule of Law.

    There was very serious charge of misconduct and dishonesty made against this man by then Director General Mr WDL Perera to the then CJ on 16th February 2001.

    The total failure in the Justice System in the country is such that the DGC not even received an acknowledgement notice from the Supreme Court.

    It is very unfortunate that people of this country have been denied a vibrant and honesty judiciary.

    This man would left the profession together with Upul Jayasurity had there been a Rule of Law in the Justice System in the first place.

    Visit the following cite for two affidavits delivered the CJ De Silva and Shirani Bandranayake (one against Mohan Peiris and the other against Upul Jayasuriya for disciplinary action for abuse of office of the Attorney at Law for improper purposes.

    No action whatsoever taken by the respective CJs on these allegations supported by the affidavits, not even an inquiry was initiated by them. This is the kind of Judiciary the people of this country blessed with that completely betrayed the Trust and Confidence placed in it by the People.

    Some say that judges in the superior courts are well looked after by the counsels. People allege that all expensive foreign law books required by the judges are given to them free of charge by the lawyers and therefore they cannot take any disciplinary action against such lawyers.

    This is very serious situation and I agree with comment made by another reader that the new regime should address this issue with installing separate body by law to regulate the profession and to protecting innocent litigants from lawyers corrupt to the core like Mohan Peiris.

    Revelation of the characters of Mohan Peiris and Upul Jayasuriya backed up by evidence is unbelievable.

    Now we can see why Upul J did his best to do justice to Shirani B. Hr must to much more her, If not for her probably by now Upul J would have been serving a suspension from the law practice.

    Hey, I know of Judges who take bribes and who pass judgment on whom they favor, and not purely based on any statutory law. I mean big bucks running into hundreds of thousands, not petty cash. Some also do it for sexual favors, (more common amongst lawyers handling divorce cases, when in consultation in isolation they ask the woman candidate a perfectly legitimate question to prove a point, such as ‘when did you last have sex with him’, and then thereafter it takes a course of its own beyond anyones control) after all they are both human and fallible. I have worked with lawyers and been in the trade and know what it is like inside out. It is quite shocking and a crying shame to hear of such things if for the first time, but these are truly happening although no one dares speak let alone question the misuse of powers. The reason is those Judges are considered supreme and above the Law, and like politicians are considered untouchable as long as it comes under their jurisdiction. Under such circumstances, I know only too well that no one is perfect and without sin, and we can never expect any form of true and perfect justice, except the justice that is served by God Almighty. To me, most everything else is ‘show business’.

    I invite your attention to the following go guess the great man who beautifully played a dual role as the Chief Justice

    • He is a great preacher of morality but practice completely the opposite

    • Lord Buddha preached about the character of VASALAYA and this man’s character perfectly fits there.

    • He abused his office to have sex with his friend’s wife.

    • All attempts made by his friend to stop this man interfering with family life was failed and finally when the friend, an engineer in profession, finally filed action to divorce from his wife, with this man name as co-respondent, this man abused his office to have the said case dismissed to stop his ‘good name’ being exposed in the public domain.

    • This man still claims to be a great man with good character, moral integrity and excellence and continue to practice completely the opposite.

    I leave it to you to guess the name of this man

    I guess that it is our great Chief Justice, Sarath N Silva, who alleged that removal of Mohan Peiris from the office of the CJ unlawful.

    Is everyone forgetting that Colombo Dockyard ltd that committed the Rs 619 million fraud should be brought to the Dock as well?
    What motivated the CJ (then AG) and another high GOSL official to move everything to sweep the fraud committed under the carpet ?.
    If dollars have changed hands or banks those who committed the crime can not get out free.

    If more men like Lawyer Nagananda Kodituwakku articulate, responsibly and fearlessly, as he does in trying to bring to book serious crimes committed by the cronies of the Rajapakse regime, there can be a drastic reduction in pre-meditated major economic crimes against this poor country and all of its people. Mohan Peiris is one of the first against whom charges have been preferred. There is much suspicion against Cabral, Jayasundera, Gamini Senarath, ex-IGP Balasuriya, Sajin Vas et al. If public life in this country is to be cleansed guilty men
    and women who sold the family silver must not only be sent to prison but all their crooked acquisitions should be confiscated – under the glare of publicity. Deterrent action is necessary to prevent future crooks in public service from repeating the history of the past decade.

    Another good example of Mr. Nagananda Kodituwakku’s articulation, responsibility and fearlessness in bringing serious crimes to book is his court of appeal writ application CA 152/2012 Naganada vs Neville Goonewardene and others. Anyone can easily find this on the internet in a google search. Dare all commentators here to read that writ as well and then comment.
