The Colombo High Court today permitted Yoshitha Rajapaksa to travel overseas for medical treatment, after he said that he had sustained a sports injury.

The Court, which had impounded Yoshitha’s passport had permitted him a period of one month to seek medical treatment for his injury and return back to the country. According to the application by Yoshitha’s lawyer, Yoshitha requires foot surgery and hence he has to travel overseas for the operation.
Although the Attorney General’s department had objected to Yoshitha’s request, High Court Judge A. A. Heiyanthuduwa had said that until proven guilty, Yoshitha was still considered innocent and therefore, he can go overseas for medical treatment.
Yoshitha, the second son of former President Mahinda Rajapaksa, is currently out on bail over money laundering charges.

Our own health minister went for treatment abroad & now a rich kid going abroad for treatment, presumably, for a relatively minor ‘sports’ injury (is it life threatening or serious enough to cause permanent damage?) The GMOA thinks SL doctors are the best, so how come the rich have no faith in them?
I believe there are some countries, particularly, in the Caribbean, who offer permanent residency with no questions asked & not bound by extradition laws for 6m US $. Maybe the Rajapakse clan are thinking of island paradises away from SL if things get hot.

Had it been an average joe , would the judge grant such permission to a prime murder suspect like Yoshitha ? Yoshitha’s defence lawyers can bring up numerous legal points , thereby, persuade the the judge to concede ! the point being , is there any guarantee that Yo would be returning home ? my guess is as good as yours , he will not be returning to SL to face the death penalty , he would utilise all his ill gotten wealth to seek a refugee claim some where in the the world. Did the joker judge even ask the most rudimentary question, “Have you consulted any doctor or surgeon in Sri Lanka before making the decision to go overseas”.
Did the joker judge ask if Yo’s medical records have already been seen by any overseas doctor.

At the very extreme, a specialist could be brought over without too much expense, similar to how Scotland Yard is hired for investigations. Why are they letting him go overseas? While I respect the judge’s comments about being innocent until proven guilty there is the issue of ‘flight risk’. That is to say, if an accused has the means to live abroad indefinitely then he should not be allowed to leave the jurisdiction.
