“As Long As I Am The President, No International Participation In Judicial Process” Sirisena Declares

In what could be a visible setback to the country’s reconciliation process, President Maithripala Sirisena has declared that until he is the President of Sri Lanka, no foreign judges or courts will be part of any judicial process.

MaithriSirisena who has been adamant against any international participation in an accountability probe on war crimes allegedly carried out by both the military and the LTTE during the last stages of the war which reportedly killed some 40,000 civilians during 2009, reiterated his stand at an event held in Panadura on Friday.

“As long as I am the President of this country, I will not allow for any international courts, international judges and international organisations to interfere with the internal affairs of Sri Lanka and the judiciary,” he said.

Sirisena also added that he will not allow any national or international activity to take place which will prove to be a danger to the country’s integrity and independence.

Incidentally, Sirisena’s declaration comes just days after United Nations High Commissioner for Human Rights, Zeid Ra’ad Al Hussein underscored the importance of bringing in international judges, prosecutors, investigators and lawyers into the judicial mechanism to probe war crimes.

“The High Commissioner remains convinced that international participation in the accountability mechanisms would be a necessary guarantee for the independence and impartiality of the process in the eyes of victims, as Sri Lanka’s judicial institutions currently lack the credibility needed to gain their trust,” Zeid said in a report presented at the 32nd session of the Human Rights Council held on June 28.

Mid this week, addressing a press conference Foreign Minister Mangala Samaraweera termed Sirisena’s resolute against allowing international participation as a ‘personal opinion.’ ( By Munza Mushtaq © Colombo Telegraph )

      The UN High Commissioner for Human Rights Zeid Al Raad Al Hussein and his office remains convinced that international participation in the accountability mechanisms would be a necessary guarantee for the independence and impartiality of the process in the eyes of victims, as Sri Lanka`s judicial institutions currently lack the credibility needed to gain their trust. The High Commissioner`s report also stressed the crucial importance of the close engagement by the Council in underpinning this process and giving assurance and confidence to all stakeholders, particularly the victim community.

      We Tamils commend the High Commissioner and appreciate the commitment shown by him and his office and the member countries of the Council in taking tangible steps to establish independent and credible justice, accountability and reconciliation mechanisms, with meaningful international participation.

    This is a mistake. At least allow foreign judges to give technical advise and be observers. Then demand for an enquiry about UK And USA and their war crimes too. It will be a good thing. It is foolish for My3 to do this because RW and Mangy will now make sure USA threatens and puts pressure on My3 either via blackmail or by creating “spontaneous” violence as they did in Ukraine.

    I say allow them as observers and get technical advise including on how to record evidence in camera and get lie detector machines etc.

      Srilankens animated by Buruwanse et al are normally the most intelligent folks – so why do we need to even think of foreign judges or any foreign assistantce. Some sinhala speaking Japanese once said, sinhalese are the folks -with unbelievable MANAYA – SUPERIORITY COMPLEX – that they feel as the greater mistake. Best example to me these days is that GMOA secretary or one lanken MBBS holder behaves in terms of their making decisions hurting poor masses.

    There are different centres of power now. 3 to be precise.

      Mangy is far more intelligent than Sirisena I’m matters of foreign policy. His diplomacy saved Sri Lanka from isolation and ruin after the dreaded Rajapaksas were thrown out.

      Sirisena going back on promises to the UNHRC will be a disaster for Sri Lanka. As for Mangy’s qualifications he is a graduate of the famous and reputed Central St Martin’s school od Design and Art.

    I think this is a good development. Comm Zeid would have been aware of the attempts by the President to whitewash and he has now reiterated that foreign intervention will be necessary. The more the president goes along this slippery path, the more it will be convincing that SL has a lot to hide.

    The bitter power struggle will continue and SL will continue on the ruinous path. Sometimes it is good to see the country destroying itself. It has no moral to exist. No democratically elected govt has fared disastrously as SL. Racial strife, religious strife, lawlessness, corruption all had sunk the country. The country has gone to the dogs.

    Yesterday my comments have been removed by Colombo Gazette, it didn’t happen to me under MR government. The good governance leaders have very short memories, they have forgotten what India and the West had done for decades. This country will be screwed far worse than ever before. My3 says no foreign judges, but Mangala says that is my3’s own opinion. I can see what is coming, surely this fools deserve it. This fools won’t make this country as Singapore. If they do, it will be an insult for knowledge and hard work.

    If the Sri lankan justice system is not trust worthy, first the present chief justice should be asked to leave the position.

                    I have read Dharmapala to a certain degree. Why you guys put him down has a simple reason. His effort to arouse Sinhalese, specially Buddhists against English imperialists. And thats the very same reason for Suddas to treat Gandhi and Mandela, lately in a bit of softer way and harsh on Dharmapala. And his way of addressing people also was not in line with “sudda’s bogus disciplinary way” but in a very colloquial way that the common man could easily understand.

                    You have to be honest with you, if you really want to understand what s/b is. It is because s/b culture (not what practices mostly nowadays) even NATIVE VEDDAS still exists keeping their traditions enact. (N/As’ too have changed now but that is not due to s/b culture but western culture – judaic christian culture to be more precise – which is the dominant culture worldwide. It is because s/b culture, other beliefs too can exist in SL with harmony. But is it possible in other cultures? Dont tell me now, “in the west you have ample freedom bla bla”.

                    When I say, s/b culture, I do not mean it as the BEST culture in the world. Its another culture that had been the bed for our knowledge, our thinking, our patterns et el based on Buddhist principals. In other words, simplicity centric or impermanent nature based way of life which has been ruined by now due to various things. Its a complete opposite to ‘God-centric’ or One God based kowledge.

                    Native, do not even think for a moment, that I am in the belief of an unmix, lonely culture. Or I am not a campaigner for such thing. S/B culture is very much an open culture and it has a wide parameters to absorb anything from outside or within.

      I hope all the doctors too go to Maha Sangha to ask advise how to treat the patient and also Engineers go to them to ask advise how to make a construction, and same with the judiciary down to the bath room cooley. We will have a better and healthy Sri Lanka.

      Why not make the Maha Sangha the Parliament of the Sri Lanka and we could save lots of tax payers money! As I told if a doctor has to go to them to ask about what treatment then might as well make the priests as doctors instead for the ‘doctor’ being simply a middle man.

    Obviously the naked world Tamil diaspora of north and east Tamils can’t move a donkey.
    The troika is very strong with Obama Hussain. The Americans don’t like high profile investigations and even Chilcot said he did not believe Blair was criminally negligent.
    The cardinal too has objected to foreign judges or investigations citing there will be trouble.

    Then you shall be removed Mr. My3! You are not suitable to be President. You did not ‘earn’ your position by your own steam but it was on Mahinda Rajapakse’s efforts, rather his negative and anti Rajapakse votes you were simply pushed to victory!

    You do not have a charisma which am sure Mahinda had but sadly he abused it and that was his undoing. Now it is very clear you never really had any intention to bring justice to the people who suffered unimaginable hardships under Rajapkse but simply wanted to grab the opportunity of his unpopularity. You are a real typical corrupt and visionless politician and your name adds to the list of leaders who ruined Sri Lanka.

    You should first think and then act. If you did not want foreign judges then why did you accept it before and signed a cosponsored resolution with the UN? Was it a another trick to buy time and cheat the World to get concessions until you ultimately get caught!

    Ok My3, nothing lost, UN will have an inquiry and a hearing with totally foreign judges outside Sri Lanka and deliver justice to those who victims of war crimes and punish found guilty. But kindly remember you have only powers to stop foreign judges coming to Sri Lanka but cannot do anything what they do outside Sri Lanka. When a harsh verdict unfavourable to Sri Lanka is delivered which certainly that is sure and you know that as that is the truth, then it is too late to soften anything. Then do not cry and plead with them to come to Sri Lanka and hear jointly along with their judges and local judges who are of course handpicked to softened the severity of the verdict.

    All in all I think the victims of war must be thankful for your statement refusing any foreign participation so now the victims can have totally 100% unadulterated justice, inquired totally by foreign legal officers. We thank you for your foolishness!

    Being a wise leader, President Sirisena does not want to put mother Sri Lanka at the mercy of crooked judges appointed by these imperialists and commit hara kiri. After all the so called international community have no money, reputation or power.

    So no international judges, period.

    It is significant that the President whose primary duty is to protect Buddhism, announced this in the presence of the Maha Sanga. May the triple gem protect him from people like you.

    The above statement (very similar to Wimal and Mervin) should go very well within the country among the Sinhala Buddhists who loves to hear these statements but however, for the International community it is undiplomatic and brutal. He may have to eat his own words or lose the credibility that he has gained.

    On the other hand, Maithripala Sirisena and the Sinhala government is Proving that they can’t & won’t prosecute Sinhala war criminals thereby allowing the impunity against SL Tamils to continue without any checks or balances..!

    The more they deny about ‘War Crimes’, the easier it becomes for SL Tamils to obtain JUSTICE from International fora..!

Isnt “leelawathi’ sounds very much ‘gode’ and more like a bayya? Unlike “Mahinda”, “Ranil” sounds very modern and he anyway is THE model politician of yours. As a blind, stupid follower of him, a name change would be a positive thing for you. Here’s my suggestion: “Laila”. A better alternative for the age old name “Leelawathie”. So Laila, think of that.     We Buddhists accept you and all other ethnic and religious groups as brothers.You have total freedom today in Sri Lanka to live your life according to your culture and religion when the blacks in the US are getting killed by their police for no reason.

    But we cannot accept the international judges or experts interfering in our affairs. Their intentions are malafide. See what they did to Iraq, Libya, Syria and the like.

    Sri Lanka is a Buddhist country just as the UK, US, Australia are Christian countries. Saudi Arabia and Iran are Muslim countries.

    So the Maha Sanga, as the custodians of the Buddhist faith should guide the rulers. The President has done brilliantly well by listening to them.

    A section of the Tamil Diaspora always claimed that there is no difference between Mahinda Rajapaksa and Maithripala Sirisena. The difference is only in name but both are Sinhala – Buddhist supremacists! So President Sirisena’s declaration that “As Long As I Am the President, No International Participation In Judicial Process” will amount to self-fulfilling prophecy! This will sound music to their ears!
    President Sirisena should not treat UNHRC’s resolution 30/1 as a piece of paper of no consequence. His stand may derail the process of reconciliation and accountability between the Sinhalese and Tamils. Aand if President Sirisena persists in his folly, he will be wantonly dissipating the political capital he has built among not only the Tamil people, but the western governments as well.

    The war crimes inquiry is not only against the armed forces, but also against the LTTE, that is against those who are alive now. The inclusion of foreign judges gives credibility to the judicial process as the Sri Lankan judiciary remains tainted in the eyes of the international community.

    The argument that members of the armed forces are lily white and they should not be punished even if they are found guilty of war crimes is misplaced. War is fine, but it should be conducted according to rules of war called humanitarian law.

    The days when governments committed horrendous crimes against its own citizens and escaped scrutiny and punishment are gone for good. Human Rights in the conduct of government affairs are now in front and centre. Proliferation of treaties, conventions, and protocols over the past fifty years has significantly advanced human rights norms. President Sirisena may indulge in rhetoric, but he cannot defy universal institutions like the UNHRC. He should remember that two-third of Sri Lankan exports goes to the Western countries and economic sanctions even on a token basis will send Sri Lankan economy into a tail spin.
    If President Sirisena is opposed to the appointment of foreign judges then why did the government agreed to co-sponsor the US resolution? Why he waited all these months?

      War was conducted according to so called rules, actually SL lost more soldiers because they wanted to minimize civilian casualty. SL’s war is exemplary when considering the wars waged by west.

      This war crime investigation should be rejected by SLns on several reasons.

      1. The method this investigation was brought is totally wrong. Office of high commissioner of UNHRC cannot decide on an international war crime investigation.Never in the history has such an investigation or a judiciary process taken place. Either it was through ICC ( which is impossible as SL is not a signatory) or via UNSC which is also blocked due to china’s veto power. Actually US and UN was cornered without being able to bringing a proper international investigation.

      The stupid RW government fell for the trap and helped the be-leagued UN.

      2. There are NO proper evidences to initiate an international war crime investigation. SL is noway similar to the charges in Serbia or in Ruwanda. There was NO incident of mass human massacre and only some video tapes of LTTE cadres. These are no substantial evidence to initiate one.

      3. LTTE’s crimes are whitewashed or underestimated in the report and the Mangala said NO word regarding it. UN has not mentioned LTTE human shields despite many evidence by NGOs but a mere mention of an LTTE buffer.

      4. No soverign country has ever conducted or allowed such a hybrid court in their country against their own army and in SL against an army that defeated 30 years of terrorism in the country fighting the most ruthless terrorist group.

      5. The backers of this investigation like US and UK are one of the biggest violators of humanitarian laws. US has killed hundreds of civilians every month by their drones but no action, obvious links with terrorist organisations like ISIS. Had backed Al qaeda and war crimes in Iraq, Cambodia, Vietnam, Laos, Japan and Germany and again UK in Germany, Kenya, Philipines, Ireland and Iraq. Should we allow these well known violators of HLs in war zone to question or even investigate our army which fought a legitimate war in a legitimate manner.

      6. the supporters of these actions, LTTE fund raisers who should be responsible for continuing misery and human suffering in SL by funding an LTTE for 30 years. Should we allow this government to do what LTTE sponsors want?

      7. And look at the UN? recently it was obvious UN is a corrupt institution which had received money from Saudi Arabia to give it chairmanship in Human rights commission. Should we allow such a corrupt institution to judge us? And UN officials in SL at times supported LTTE terrorism in SL soil.

That is what Tamils also say and Tamils and victims of the war wants the inquiry and hearing totally outside Sri Lanka and with totally foreign judges so there cannot be any conflict of interests because the same party being the accused also part taking in judgement. As you say here too no where in the world the accused side also sit in judgement.

        Tamils too say no hybrid courts or foreign judges to come to Sri Lanka and these judges, totally foreign should stay outside Sri Lanka and inquire and give their unbiased verdict. Because there is very serious allegations and video proofs of abuses by the Sri Lankan armed forces.

        So Tamils and Sinhalese are once together to say no foreign judges or hybrid courts and for the UN to have their inquiry and verdict totally outside Sri Lanka and deliver the punishment.

        As Sachoo said, and I too say Hitler’s war crimes were also heard with totally foreign judges outside Germany.
        So Sachoo Tamils are agreeing with you not to have any hearing in Sri Lanka.

        UN Please, we want victims who ever they are to be compensated well for the severe trauma they suffered. So please have a unbiased judgement and verdict without involving the involved parties to the crime also to sit in judgement and deny justice to the victims, so have only foreign judges and have the inquiry outside Sri Lanka without any hospitality from the criminal country as that too can influence and affect the verdict.

    I guess some Tamils and many in the International Community were hoping that Sri Lanka had turned the corner in January 2015 with respect to the continued brutalisation of Tamils with impunity, something which started in the 1950s (long before the LTTE came into existence). But just like all the bogus Commissions created to investigate anti-Tamil pogroms of the past that saw no justice being delivered for Tamils, it can be certain that the war crimes investigation promises will never deliver justice either. History shows, Tamils will NEVER EVER get justice in Sri Lanka. You do not have to be a political genius to figure that out.

      Exactly and I agree 100%! That is why Tamils really wanted a totally foreign inquiry and verdict out side Sri Lanka. But UN tried to accommodate Sri Lanka quite unlike it did to other countries to give a concession by allowing Sri Lankan judges also to sit in judgment even though Tamils felt it was unfair for the accused also to sit in judgement. So now thank you for saying no foreign judges we love it so UN can go totally foreign without local judges and certainly outside Sri Lanka and give an unbiased verdict and then do not complain. UN tried to give you a helping chance quite against the wishes of the victims. We love you!

    When Sri Lanka co-sponsored the UNHRC resolution was Mathripala sleeping? This is typical behaviour of Sinhala leaders – agree to something and then drop it. The history is strewn with such broken agreements leading to the non-resolution of the ethnic strife for the past 60 years.

    Sirisena is a copy of Sinhala racist leaders before him. Protecting war criminals gives a clear signal to the police and the military to continue their atrocities against the civilians. Sirisena has to realise that the Sri Lankan military and police have an appalling reputation when it comes to human rights abuses. The numerous YouTube videos of these inhuman rights abuses provide ample proof.

    He is taking a backward step as far as reconciliation is concerned. No wonder the Tamils who supported him overwhelmingly have become disillusioned. He and the present government can’t depend on their support in future elections.

    I donot know on what context you have released this statement. Are you trying to say that as long as you remain as the president of the country there is no justice for the victims of the war? It is now almost 18 months passed after you became President of the Country. During this period not a single victim of the war received justice from the courts of Srilanka. Are you ashamed of your justice system?
