A Swift First Step: AG Appeals SC Decision Over Turned

The Attorney General today appealed to the Supreme Court to appoint a five judge bench to reconsider the ruling given by a three judge bench last month to allow lead to proceed in a case where three petitioners had asked that Parliamentary standing order 78A- under which Chief Justice Shirani Bandaranayake was tried and impeached – be declared null and void, the Sunday Times reports.

The newspaper said; “Senior Lawyer MA Sumanthiran who appeared for the petitioners in the earliar Supremem Court case said the new Chief Justice Mohan Peiries had not been legitimately appointed and was a usurper. Heobjected to the Attorney General’s application for a hearing  by a divisional bench which would be appointed by the new Chief Justice. The bench which heard the case today refered the issue to the new Chief Justice.”

According to the Sunday Times, legal analysts said today’s move appeared to be a swift first step by the government to legalise what the Supreme Court declared to be illegal and unconstitutional, when it last month heard the petition challenging the impeachment process and the parliamentary select committee trial against Ms Bandaranayake.

    It would be naive not to expect this, and this regime is in a hurry. It will also get the C of A writ referred to SC and obtain a favourable ruling.

    What’s the point of taking all the trouble to plant right people in AG’s Dept and as CJ now and in the coming months to the forthcoming vacancies due to retirements in benches in SC, if the regime leaves these decisions untouched, after all.

    Whatever they do here in the courts, it will rot even more as the judges and AG themselves will be dying a thousand deaths under the jack boot of the ruling clan however honorable they may look in their robes and wigs and expose their and the regime’s real characters. Yet, even the most pliant judiciary and the malleable parliament including its opposition can’t varnish over the PSC report that stinks to high heavens, never.

    And that will come to haunt this regime including its key perpetrators and apologists, and that’s the only consolation we have now and we build on this to seek justice for ourselves and for all those who suffered untold misery under these successive regimes, who fooled us no end, as we don’t believe in no special saviors and messiahs, but ourselves.

    When we, the ordinary people lead let so called leaders, if there are any left, follow.

    Govt moves to legalise perversion of the constitution. A rather transparent move to legalise the illegal by manipulating the judiciary. Lets hope the judiciary has the moral strength to withstand this move and uphold the constitution.

    Why is it that these judges and lawyers, especially those who work for the state, wearing these ridiculous looking wigs and black cloths. These 17th century clothing worn by Britishers in their native environments have no bearing, relevancy or place in the hot and sweaty tropics of Sri Lanka. They also still display some kind of acquired pomposity and we are better than others message to the general public. If this government, and its braying donkeys like modwansa and mervyn the vermyn, who make a hue and cry about nationalism and ethnic attire, then it is time that lawyers including the silly AG and Cheap Justice and all are told to get back to work on decent comfortable clothes. A white cuit with open neck collar, may be attache with a white dog collar, if they want, would be much better. Wearing wigs in the 21st century in Sri Lanka is the most ridiculous phenomenon. Our people are greta for aping others without any meaning; and these bumpkins are called lawyers and intelligent. No, none of them are.

    What rubbish thought some of you appear to have. Now the entire Supreme Court Judges except one or two have declared their solidarity to illegitimate CJ and would deliver all what ‘Executive Judiciary’ wants. Peoples’ trust placed in the Judiciary has gone to dogs. No sorry I should not insult dogs, peoples’ trust gone down the drain.
