Bar Condemns Jaffna Court Attack

The Bar Association of Sri Lanka has today called upon the Attorney General and the other law enforcement authorities to bring the perpetrators who attacked the Jaffna Court premises to justice.

We publish below the statement in full;

The Bar Association of Sri Lanka (BASL) expresses its strong condemnation and abhorrence of the incident which took place in Jaffna where the Court premises came under attack. The Bar Association of Sri Lanka is of the view that this conduct amounts, to a serious and unwarranted interference with the administration of justice and the judicial process.

The Bar Association of Sri Lanka calls upon the Honourable Attorney General and the other law enforcement authorities, including the Inspector General of Police, to bring the perpetrators to justice.

Furthermore, the Bar Association of Sri Lanka calls on the authorities to provide the’ – necessary security to Court premises to protect the honour, dignity and the respect of the holders of judicial office and of the judicial system.

The Bar Association of Sri Lanka affirms that the honour, dignity and security of the Court and Court premises are critical for ensuring the proper functioning of a democracy and the upholding of the Rule of Law.

      I am of opinion that Bar Association of Sri Lanka, is a bunch of DOUBLE STANDARDS people who are fleecing the populace, and produce very little justice for the people.They are all after their self-interest. Shame on you, people.

      A school girl was raped by several men, Tamil men, and AFTER the body was found of the missing girl, people became agitated , and wanted the culprits apprehended and punished. People thought this was going to be another Kangaroo court with Kangaroo Lawyers, defending the accused, and setting the rapist free, as usual.

      You were concerned about bricks being thrown into a concrete building building the Jaffna Courthouse, and it was injustice.130 Tamils were arrested in this incident and jailed. The police did their duty.

      Now During Aluthgama Riots, 1,000 police were there assisting the rioters. Several innocent People were killed and property damaged, 13 were arrested and released. The DMO lied.lied. NobodY has been arrested so far. DOUBLE STANDARDS?

      Now Tell us, what did the so-called Bar Association of Sri Lanka, do.

      Do you think people do not have common sense?

    I thought BASL boss was Upul Jayasuriya, who openly encouraged attacks on the Judiciary itself when Mohan was the CJ after the previous CJ bought a Condo on mates rates.

    Previous Yahapalanaya under this same mob bar our Bodhi Sira, couldn’t stop one of our Super Judges getting knocked over by a Drug dealer.

    Can we expect the same mob. I mean CBK & Ranil in particular to go hard on their own mates this time, simply because few TNA supporters threw granite pieces and concrete rubble at the High Court and send four Sinhala Cops to Jaffna Teaching Hospital.

    Is this new BASL boss new to a Yahapalanaya too?..

    Why did they attack the Jaffna Court Premises?

    Looks like, there is a credibility issue with the Law and Order and the Courts.

    So, you need to address this credibility issue. If the credibility is an issue, why have Kangaroo courts?

    It is somewhat too late to condemn the violence in Jaffna. Years ago Jaffna civil citizens would never dream of such violence. But since the army occupation started there was systematic steps taken to degrade the Jaffna society. Drugs,prostitution and pornographgy were introduced by the army to distract the youth. In addition, covert support was given by the government to the thuggery and lawlessness promoted by Douglas Devananda. It was his encouragement that allowed thugs to rule the villages such as deft/Pungudutheevu where the recent rape case took place.
    I wish groups like Bar associations interfered with the corruption and vice that were introduced by design under the previous regime.

    Dear Geoffrey,

    It is you all the BASL has shown to the public in using the people’s enraged power even to introduce reforms within the judiciary. It is bad to damage court ahouses and the other public property. But the root cause is sowing the seeds of discontent within the population of the Northern Province that they do not have the opportunity to do things wheras enough of power is devolved on them to do so many things.

    Geoffrey, Why dont you take the lead to educate Wiggie & Co to use what they have to the maximum for the benefit of the Northerners and having shown so then cry for more.

    I am quite confident that if the remotest possibility of such an uprising took place when LTTE was controliing those places then all of them would have been summarily dealt with and there would be no questions asked in Geneva.

    There was no attack on the Court in the real sense; more importantly the demonstrators had no intention to insult, humiliate or cause harm to judicial officers, including judges. Their grievance was caused by the malice evident in the Police handling of the Rape incident that was perpetrated where the young girl died. This included the freeing of the main accused Mahalingam Sivakumar. The photos showed people on the roof of a building near the courts. No judge was attacked personally; no judge died, not even hospitalized.

    The Rajapaksa Gang want to show the Sinhala Buddhist electorate in the South, that Yahapalanaya is losing control in the North, that it is a matter of time before the Northerners break away and form their own Government. That was the purpose of the false flag operation orchestrated by the Rajapaksa proxies, particularly Senior DIG Lalith Jayasinghe as the following will show.

    Sivakumar, a drug dealer of the area, is a bosom pal of Tamilraman, an aspirant to contest the Pongudutheevu electorate, a lawyer, and a Dean of one of the Faculties of the Colombo University. Tamilraman is a bosom pal and benefactor of Senior DIG Lalith Jayasinghe of the North. Jayasinghe was asked by Tamilraman to release Sivakumar, and he was thus released.

    Jayasinghe is a known asswipe and lackey of the Rajapakses. Having released Sivakumar, the main rape suspect, he knew from reports that resentment was brewing, which he stoked as much as possible, and did not take any action to assuage the feelings of the people. What they received from Jayasinghe was the middle finger, purposely done to cause havoc. When the demonstrations were taking place he promptly conveys chapter and verse to Mahinda Rajapakse.

    The clueless black coats of the Bar Association now want the “Honourable Attorney General and the other law enforcement authorities” to lynch the protesters against favouritism and total disregard of the law by Senior DIG Lalith Jayasinghe.

    The above should make it obvious that these clueless black coats are indeed imbeciles. If these jokers have any sense they should check carefully the facts and demand from the Government strong action to dicipline the police officers involved and dismiss from Service Lalith Jayasinghe.

      Are you ready to come forward on the witness stand in a court of law and say all what you have said in writing?
      For a start if you had not so far made a statement to the police then why not do so now?

      It is not too late.

      If you do not trust the police then there is tthe Jafnna Magistrate before whom you can appear and make your statement to substantiate all your allegations.
      That will facilitate proceedings and the real culprits can be charged.
      Will you do it?

    The attack on courts,and the rape and murder of a child by cruel monsters should be condemned by all peace loving people. However, it is necessary that the rape and murder of the poor child should be investigated and truth has to be found and justice has to be done. We have to acknowledge that people have lost their trust on the law and order and justice system. It is not only in the North but it is the fact in the whole island. Politics of this island since independence become a nasty level where now crimes and criminals are above the law and institutions are corrupted, biased and racial. Justice has become a commodity and those who have power can buy it easily.

    The reason for transfering top Police Officers on the spot by the IGP
    as they were partly involved in the incident taking a wrong turn. The Chief Officer is
    also known to be a MR “plant” and the timing was to coincide with 18th May anniversary,
    as reported in a web-news elsewhere.

    This scoop is reported elsewhere, and CT keeps editing it out of comments, as it is
    its perorogative !!!

    The attempt to release the main rape suspect has been the motivation for the protests.
    The fault was with the judiciary and police.
    The Bar Association should explain how a rape suspect could be released.

    None seems to know the reason why the incident did happen, how it happened and why it happened. Yet a 18 year old school girl was ruthlessly raped and murdered by nine Tamil men from the same area. Who are these men? Is it planned rape and murder? Why the Police did not act fast enough? why the culprits were arrested and released after someone’s interference and influence. Who are these persons who influenced the police to release the arrested men. Ex-minister Douglas Devananda can answer these questions sincerely if he is a sincere person. The Islands in the North were under the control of Douglas Devananda and his men during the previous regime and even now. Several armed gangs work for him. The police and the armed services were in support of Douglas Devananda and his actions in the North are condoned.
    So why blame the people who were angry about the incident. Blame Douglas Devananda, the Police and the army.

    To prevent crime in the worn torn areas of North and East, government should put adequate controls in place to monitor any foreign visitors who are visiting this part of the Island. I suggest any foreign visitor who wishes to travel to this part of the Island to submit a criminal record check from their country of origin and have authorities verify the authenticity of the report before the traveler could embark on their journey. This is not to discriminate anyone but to add an extra step as a further precaution to prevent those who intend to have a free hand in their native land and to subjugate their local relatives as submissive and gall-able. We have to understand that many Sri Lankan origin expatriates who are returnees to this part of the island once left this country using illegal means and therefore, it makes much more sense to verify their track record in the country where they have been domiciled for all these years. Many who are uneducated but have earned foreign dollars visit these areas throwing their cash and in return, assuming their supremacy and high mindedness against their poor relatives. This could also destroy the true fabric of values in their society and tamil culture and thereby, importing foreign elements who have criminal intent. Also, promoting cultural programs to rehabilitate and educate the masses will also help in preventing or reducing these kinds of hideous criminal activities in their respective communities.

    Have you not heard of Colateral Damage. If you havent I suggest you ask Desmond who has advised GOSL that the killing of the 140,000 Tamils through Colateral Damage is justified.
    But you take exception to the fact the Eelam Tamils attacked the Court Premises ( causing colatrral damage ) to avenge the Rapits and Murderers who are aided and abetted by the authorities.

    My friends if this is not Jungle Justice can you tell me what is.

    Dear All,

    Does the Constitution mean that politicians and the mob should stay away from courts? I believe and hope it does. Any experts out there? Thank you.

    Below a quote from our Constitution from 1978:

    “Interference with judiciary an offence.

    116. (1) Every judge, presiding officer, public officer or other person entrusted by law with judicial powers or functions or with functions under this Chapter or with similar functions under any law enacted by Parliament shall exercise and perform such powers and functions without being subject to any direction or other interference proceeding from any other person except a superior court, tribunal, institution or other person entitled under law to direct or supervise such judge, presiding officer, public officer or such other person in the exercise or performance of such powers or functions.

    (2) Every person who, without legal authority, interferes or attempts to interfere with the exercise or performance of the judicial powers or functions of any judge, presiding officer, public officer or such other person as is referred to in paragraph (1) of this Article, shall be guilty of an offence punishable by the High Court on conviction after trial without a jury with imprisonment of either description for a term which may extend to a period of one year or with fine or with both such imprisonment and fine and may, in addition, be disqualified for a period not exceeding seven years from the date of such conviction from being an elector and from voting at a Referendum or at any election of the President of the Republic or at any election of a Member of Parliament or any local authority or from holding any public office and from being employed as a public officer.”

    Why no one is bringing out the fact that Tamil thugs of Army was sent in to mix with the geninune protestors to attack the court house. Unfortunately for the army, these thugs also got arrested and the motor bikes 60 of them left behind these thieves and criminals Aruna Group or whatever its name is who were nurtured by army shed light to the whole episode.
    But the army keen on arresting non violent protesting students while police unwittingly arrested the real criminals

    Bar association should be bold enough to highlight this.
    Everybody knows court attack was ploy by army to keep army in North. No wonder Machina was well aware of it and used in his propaganda.
    That is why Wiggie said we do not army bprotect us. He did not say we need to be protected from army. Democratic institutions like Courts need to be protected from army.

    How come it did not dawn on you to say a few words of sympathy in your
    statement to the grieved family, who lost their teenage daughter due to brutal raping and killing by a gang supported by a political party known for thuggery and intimidation and this brutal gang had the support of a lawyer who is [Edited out]

    Your above statement should have been issued by the CJ or the Justice
    minister and not by you as you are not the minister of public works. As a lawyer you defended the other lawyer who was responsible for getting the criminal released from the custody of Police and making this statement is a cover up to blame the public solely on the incident
    but facts are emerging that there was a hidden hand in instigating the public to react violently. The same thing happened in 1983.

    How come your association did not make a statement on the brutal rape
    and murder of this young girl and you should offer free legal services to this poor family as the gangsters have plenty of looted money in their hands to defend themselves.
