Beruwala Attack: CBK To Take Legal Action Against IGP

The former President Chandrika Kumaratunga has written to the Inspector General of Police urging him to take action against the perpetrators of the Beruwala attack.

Sending a letter to the IGP N.K. Illangakoon through her lawyers, she said that if the IGP fails to take action forthwith she will be compelled to take legal action against the IGP and his subordinates for failure to perform your duties according to law.

According to Centre for Monitoring Election Violence (CMEV), this latest attack in Beruwala occurred last Friday around 10.00 pm when former President Kumaratunga and Hirunika Premachandra visited Western Provincial Councillor Mohamed Jemine Marikkar Mohamed’s house for dinner after a public rally in Beruwala. CMEV also reported, the police and the STF on duty had run for cover when the goons started attacking. Damage due to goon attacks includes property and former President Kumaratunga’s vehicle. Opposition Urban Council member Mohamed Mansoor Dalhan who was reportedly injured in the attack and taken to Beruwala base hospital had been refused admission by hospital authorities says the CMEV report. The OPD medical doctor is quoted in the report as saying the police had instructed her not to admit any casualties to the hospital.

Dear Mr. Illangakoon,

ATTACK ON FORMER PRESIDENT CHANDRIKA BANDARANAIKE KUMARATUNGE AT BERUWALA ON THE 26TH OF DECEMEMBER 2014 BY A MOB LED BY THE CHAIRMAN OF THE BERUWALA URBAN COUNCIL

I write on the instructions of my client Mrs. Chandrika Bandaranaike Kumaratunge, the former President of Sri Lanka.

As you are aware my client is one of the key figures in the campaign of the Common Opposition Candidate Hon. Maithripala Sirisena MP, contesting against the incumbent President His Excellency Mahinda Rajapaksa.

On the night of the 26th of December 2014, my client attended a public meeting at Beruwala and following her address stopped at the residence of Mr. Ifthikar Jameel of Kankanamgoda Road, China Fort, Beruwala. While my client and those accompanying her were in the said house, an unruly mob of about 75 persons had gathered at the opposite house belonging to Marjan Faleel Hadjiar, the former organiser of Beruwala for the United People’s Freedom Alliance. Both Mr. Marjan and his son-in-law Milfer Caffoor, the Chairman of the Beruwala Urban Council had been present and had given leadership to the unruly mob.

I am instructed that the said Milfer Caffoor has inexplicably been given a security detail of six officers of the Special Task Force, who were also present at the scene, displaying their weapons several hours before the arrival of my client and her party at the scene of the crime. The mob hooted and shouted threats and abuse at my client for over half an hour from the house of Mr. Marjan. The STF detail stood outside Marjan’s gate with their weapons, giving protection to the mob.

At this point the OIC of my client’s Security division – C.I. Jagath Chandrakumara, requested the ASP, Beruwala Division for a riot squad, which was sent immediately. They stood around the road and did nothing to control the mob. The mod shouted abuse and threats at my client and at the occupants of the house of Mr. Jameel, obviously with the intention of intimidating them.

When my client and the convoy accompanying her were leaving after dinner, the mob which was inside the residence of Mr. Marjan Faleel Hadjiar hurled bricks and rocks at the vehicle of my client from over the wall. Two vehicles KW-0461 and KV-6807 were damaged from the attack. The said vehicles are those allocated by the State to my client.

It is evident that my client’s vehicle was specifically targeted by the attackers, as several vehicles in which others were travelling were in front and behind her vehicle were not attacked.

It is clear that the rocks were hurled at my client’s car with the deliberate intent of harming her.

Early next morning my client’s security detail has made a complaint to the Cinnamon Gardens Police under reference number CIB II 95/161.

It is regrettable that despite the presence of the ASP of the Division and the OIC of the Police Station no action was taken by the Police either to apprehend the perpetrators or to prevent them from committing acts of violence.

As head of the Police Department you and your officers are under a legal duty to prevent acts of violence and to take action against the perpetrators according to law.

My client notes that it is regrettable that the Police have shown a remarkable lack of independence and impartiality and a lack of will to tackle acts of violence- especially those perpetrated by supporters of President Rajapaksa against the Opposition.

My client apprehends that the failure to take action against her attackers is wilful and is a part of a larger conspiracy to cause her grievous physical harm. This is apparent from the threatening statements made by certain politicians including Cabinet Ministers against my client amounting to physical harm.

You will note that the offences committed by the mob at Beruwala include being members of an unlawful assembly, attempted grievous hurt, criminal assault and criminal intimidation all of which are punishable under the Penal Code. They have also committed mischief on Public Property which is punishable under the Offences against Public Property Act .

Nevertheless she demands that immediate action be taken by you and your subordinates to bring the perpetrators to book. Both Mr. Faleel Hadjiar and Mr. Caffoor were members of an unlawful assembly and cannot escape criminal liability, having acted with the common object of intimidating my client.

If you fail to take action forthwith my client will be compelled to take legal action against you and your subordinates for failure to perform your duties according to law.

My client also wishes to point out that the state of lawlessness is evident when she a former President of Sri Lanka is being subject to such intimidation and physical attacks, which were perpetrated while the police looked on.

My client wishes to stress that she will not be deterred by acts of violence and thuggery and that she has in the past and will in the future, continue to resist state sponsored thuggery.

    One thing is assured, the ONE ABOVE has already sealed MARA’s FATE and on Jan 9th, he will be a goner, until then he can do all what he can, but will never succeed, that’s confirmed beyond any doubt. Just Keep going until then and the masses are behind you.

          The IGP cannot and will not go to each an every place of violence. He IS responsible for violence happening under his watch just like how MR is responsible for all atrocities committed against PEOPLE irrespective of Caste, Creed or Religion. IGP is NOT above the law either, he CAN be held responsible for NOT taking action through his subordinates. IT IS HIS DUTY and why he is PAID by the PUBLIC funds NOT MR’s loot.

      I am suprised that you are now acting like a rebron woman to call shots in this country. I am no supporter of MaRA or My3 as both of them were working together in last 10 odd years. What suprised me, is that it took 10 odd years for this Wanni Ganmaya to understand how bad MaRA was. But I respect only MaRa (and others work with him at that time) for a one noble action – what he has done to terminate the brutal LTTE terrorists fron this land.

      Since you are asking the justice from SL police for waht happpned to you in Beruwala, I thought I should remind you few things. Do you have any answers to the following questions:

      – why were vocalists Rookantha Gooonatilake and Chandralaka Perera eatern almost to death and shaven their heads during your period of presidnecy of this country? Was it properly being investigated or lead to investigate? What was the outcome? What happened to the attackers?

      – Have you been accussed of sending garlands to the ruthless terrorist leader Valu Preba’s daughter in her birthday? Did you pay the price of loosing one of your eyes as a a return? What a shame!!!!!!!!!!

      – Can you please point out any constructive actions that you took to lift the game in SL during your decade administration? Perhaps sending thounds of SL’s brave defence force people to the mouths of blood sucking terra leader’s monkey army?

      I can go on with my list if you want or you may read Victor Ivans book on you to get a pretty good idea.

She’s made of sterner timber, for sure. But then, when she was in the saddle she didn’t fail to err either, eh! But then, that is all part of depraved Sri Lankan politics of recent years. Can Cardinal Malcolm Ranjith, who reportedly arranged the visit of His Holiness the Pope to tilt the scales in favour of his friends – the Rajapakse family, guarantee the safety of the Pope anymore?     Madam,

    It is not surprise that IGP did not take any action against the criminals. He cannot take action because he has to follow his masters orders. The orders comes from Top to Bottom. I don’t think this is only happening now. It is the fate since independence or even before. Time to Time this is the case. Of course this time it is exceeded the limits. I don’t think you will get any response from IGP. However, I would advise you and Maithiri that people want a real change in politics and give a warning now to all civil servants, particularly those who are in top positions responsible for maintaining law and order cannot escape from justice irrespective of any race, relegion or any political party whether it is from ruling party or opposition party. It should become as a practice, not as a political game. Can you do it?

    BRAVO !!! Madam… You’ve taken the right decision to instruct the IGP to perform his duty via an official letter.. IF he doesn’t take measures..please file a case so that you can proceed with it after the loss of the current regime.. THESE BLIND AND DUMB police officials NEED to be taken to task for failure of duty.. THEY are paid to feed themselves and their families by the CITIZENRY of SL NOT funds from the MARA clan.

    This Marjan is NO hajiar, he is a thug of the area who thinks he is next to God… The dawn of 9th January would make people of the area to dismantle his house brick by brick.. trust me that is the word doing its round in the area… His son in law was NOT known until 3 weeks ago… when GOATa visited their house for a meeting where he had instructed the provincial councilor to be the area organizer. He was promised with a security detail and a fleet of vehicles for propaganda work to be done in support of MR.. GOATa had stated that he would not bat an eye when the need of more resources are needed but provide ASAP….

    Where was this Marjan when the Aluthgama and Beruwala violence against the Muslims was taking place? he had claimed to have called Basil seeking assistance to which he had said.. quote ” It is wrong of the Muslims to have assaulted a MONK..” unquote and dashed the phone stating there was not much he(Basil) could do. Marjan does not have any support from the Muslims in the area, he may be the son of an old SLFP stalwart late Faleel Hajiar BUT Ifthikar Jameel and Imtiaz Bakeer Markar are made of class and command the respect of people of the area and woo the votes easily…

    One of Marjans siblings were involved in making Passports without documentation for a fee to help people abuse the Immigration departments protocol via his “catches” which enabled certain elements to flee the country… such is the caliber of the siblings who think they are ruling the area… He was netted by the TID but president had to intervene to get him released. LMAO…
