Bribery Commission Started An Inquiry Into CJ’s Assets, But Declined To Name The Complainant

“The Commission to Investigate Bribery or Corruption has started an inquiry into the assets acquired by Chief Justice Shirani Bandaranayake whilst a foreign travel ban has been imposed at its request on her husband Pradeepa Kariyawasam, who was the former Chairman of the National Savings Bank (NSB).” The Sunday Times reports.

 

“We have received a complaint against the Chief Justice about accumulation of assets. We are investigating the complaint. It has been sent under a name and therefore like any other complaint we receive we are investigating the allegations,” Commission Chairman Jagath Balapatabendi told the Sunday Times. He declined to name the complainant or elaborate.

According to the newspaper, a Commission official said she would be issued a “show cause notice” and further inquiries would proceed only thereafter. One of the charges is “not declaring in the annual declaration of assets and liabilities that should be submitted by a judicial officer the details of more than twenty bank accounts maintained in various banks including nine accounts” in the National Development Bank (NDB), The Sunday Times said.

    That’s pretty efficient of the Commission, given the speed of their reaction to the “complaint”. Wonder how they would respond to other “complaints” about the undeclared assets of Ministers and others of the GOSL?

    Oh Danny Boy – While we agree with you, simultaneously if the Inland Revenue Dept does its job without fear or favour most of these rogues – men and women – will be caught. At personal level I know this Declaration of Assets for MPs, ministers, MPCs is a sham. Initially, it will be those with less clout with the crooked in the ruling clique who will fall. But gradually more will come into the net. I am told of someone in a family who hardly pays Income Tax but yet made a bid to a Ceylinco property at Rs.900 million??? What medieval levels the country has been brought down to by these crooks.

    Curious. Isn’t this Jagath Balapatabendi’s son married to the former CJ Asoka Silvas daughter? Even more curious, isn’t CJ Asoka Silva a “presidential advisor” and known to have an animosity against the the current CJ Dr. Bandaranayake? Puzzling how no one seems to question this Balapatabendi’s integrity or motives… Hmm.

      Asoka de Silva’s daughter is undergoing a Msc or a PhD in the university of Netherlands and guess what her husband (Balapatabadi’s Son was employed as the deputy consul at the Sri Lankan embassy) this is just a political appointments done from nowhere to get them on the line of the Regime as done with CJs husband with NSB.

      Also the Bribery commissiner is retired IGP- Jayantha Wickremaratne and whoose wife is Anoma Gunatileka the woman who shouted like from Marakade aginst yesterday and was the secretary of BASL and who was thretening to resign.

      Im i am not mistaken the current AG – Palith Fernando is a brother in law Asoka de Silva and this is the Octopus that is working around the CJ and a clear prostitution.

      Quite true and as citizens of Sri Lanka, constitutionally we are above all and we should check whether this Balapattabendige has undeclared assets before he checks others. If I live in Sri Lanka, I would have complained personally to the Bribery Commission to check Wimal Weerasansa’s, Dilan Perera’s, Yapa’s, Rajitha’s Susil’s and all those signed blindly the Impeachment document and also all the Rajapakses to be checked whether they have any undeclared assets and bank accounts. Can someone in Sri Lanka do this please on behalf of the peace-loving Sri Lankans.

    Interestingly, the Chairman of the Bribery Commission is former Supreme Court judge Jagath Balapatabendi who is closely related to Asoka De Silva. Asoka De Silva’s daughter Kanishka is married to Jagath Balapatabendi’s son, Isuru. President Rajapakse did a big favour to De Silva and Balapatabendi by appointing Isuru as second secretary of the Sri Lankan embassy in the Netherlands. This was at a time when Kanishka was studying for her LL.M. degree in international law at Leiden University in The Hague. Asoka De Silva was also a judge of the International Tribunal for Rwanda at that time and was given permission by President Rajapakse to continue in that position even after he was appointed Chief Justice. The Rwanda Tribunal held its sittings at The Hague and it was so convenient to the families for which they are no doubt ever grateful to President Rajapakse.

    Another interesting family connection is that Attorney General Palitha Fernando is married to Asoka De Silva’s sister. It is said that it was Asoka De Silva who engineered the appointment of former Attorney General Eva Wanasundara to the Supreme Court (which was seen in legal circles as a ‘kick upstairs’) and the replacement by Palitha Fernando. If Kariyawasam is indicted the Attorney General’s Department will prosecute him. Palitha Fernando is viewed in legal circles as an honest officer but whether he will be able to withstand Presidential and family pressure is to be seen.

    So we have the Asoka Silva Family ganging up against the CJ.

    The President added: “I am telling you all this in strict confidence. Please don’t write anything about this revelation. After all, we have to protect the Opposition Leader. I also request you to back him whenever and wherever possible.”

        Commissioners of the Bribery Commission are disgruntled with the arbitrary acts of the Commission’s Chairman, former Supreme Court Justice Jagath Balapatabendi, sources from the Commission said.

        Sources said the commissioners who had investigated into the complaint against the Chief Justice’s husband, former National Savings Bank (NSB) Chairman, Pradeep Kariyawasam’s had informed the Commissioner’s Chairman that there was no evidence to file a bribery case against Kariyawasam. However, sources said there were doubts over why the Chairman continues to maintain the file as an open investigation when the investigators have “specifically stated” that there was no evidence to follow the investigation. The employees at the Commission are now wondering if the Chairman was being manipulated by an unseen hand to act in this manner.

        Balapatabendi and former Chief Jsutcie Ashoka de Silva are related. Balapatabendi’s son is married to de Silva’s daughter. The President had appointed Balapatabendi’s son as the first secretary to the Sri Lankan embassy in the Netherlands while de Silva’s daughter is engaged in higher education in the same country.

        Therefore, there’s considerable doubt whether the Bribery Commission Chairman is acting in this manner as mark of gratitude for the favor granted.

        The Bribery Commission is to file charges against Chief Justice Dr. Shirani Bandaranayake’s husband, Pradeep Kariyawasam today (25), reliable sources said.

        A senior government minister said that although the commissioners of the Bribery Commission are divided over the move to file charges against Kariyawasam, a very senior official in the government is pushing for the case to be filed without any delay. The minister said it is believed that the case against the Chief Justice’s husband would have an impact on the verdict to be delivered on the cases filed against the controversial Divi Neguma Bill.

        The Bribery Commission is to file charges over the incident related to the purchasing of shares at The Finance Company by the National Savings Bank (NSB). Former Court of Appeal Judge, L.K. Wimalachandra during the investigation into the transaction had determined that one person could not be held responsible for the transaction since the share purchase had been carried out with the consent of the NSB Board of Directors. The investigation noted that Kariyawasam could not be held solely responsible for the transaction merely because he was the NSB Chairman.

        However, a charge sheet is to now be filed against Kariyawasam by an unseen force at a time when Chairman of the Commission to Investigate Allegations of Bribery and Corruption, Justice Jagath Balapatabendi is overseas. Our sources said that it was a clear indication that certain elements were trying to put pressure on the Chief Justice to prevent her from carrying out her duties and to create an impact through it on Supreme Court decisions.

      Former Chief Justice Asoka de Silva who is now advising the President to impeach present Chief justice and former supreme court judge Jagath Balapatabendi are close relatives.

      Asoka de Silva’s daughter is married to the son of Jagath Balapatabendi. Jagath Balapatabendi is the present chairman of bribery and corruption commission of Sri Lanka. Balapatabendi’s son , Isuru Balapatabendi is a State counsel working at the Attorney General’s department. He has married Asoka de Silva’s daughter.

      During the wedding reception. Mahinda Rajapakse offered a gift of a diplomatic posting to the young couple. So Isuru Balapatabendi was posted to Sri Lanka Embassy in the Netherlands as First Secretary for 03 years. This appointment was approved by the Cabinet which is just a rubber stamp of Mahinda Rajapakse. The young couple moved to Netherlands in 2008. In Netherlands Asoka de Silva’s daughter studied for a LLM degree and the husband spent time at the Sri Lanka embassy doing nothing but receiving salaries at tax payers expense. Due to these obligations Asoka de Silva and Jagath Balapatabendi are indebted to Mahinda Rajapakse. Therefore, they will do anything assign by MR.

      The case of recently appointed Appeal Court Judge Jayatilake is also interesting. He is a close relative of Lalith Weeratunga. Jayatilake’s son Deeptha Jayathilake was also appointed as a Clerical Officer in the Sri Lanka Embassy in Sweden. According to patriotic Sri Lankans living in Sweden Deeptha Jayathilake has worked in the Embassy for 03 years until 2012. Deeptha Jayathilake was also appointed by the rubber stamp Cabinet. So, the country cannot expect any justice from the newly appointed Appeal Court Judge Jayathilake.

      According to legal experts it is highly unethical for serving judges or officials in the judiciary to accept bribes like above as these judges and officials are expected to be neutral and serve justice to everybody equally. But MR and family has been able to give them incentives like diplomatic postings – to their sons and daughters and change discharge of justice.

      The present Chief Justice will be framed both by Asoka de Silva, now presidential advisor and by Jagath Balapatabendi who is Chairman of Bribery Commission. Not only that her husband will also face a tough time due to Bala’s high post at the bribery commission.

      Further, the wife of Public Trustee Senevirathne – who is regarded by all right minded people as a serious crook – Indira Senevirathne was recently appointed to a diplomatic post in the Sri Lanka High commission in Delhi by the Rajapaksa regime. It is also understood that moves are underway to appoint sons and daughters of district judges and magistrates to all diplomatic missions around the world.

      Sadly it is only in Sri Lanka judges accept bribes for their kith and kin. So, god (if there is any) bless Sri Lanka!

    When was this complaint lodged? What is the hurry in taking up this inquiry when there are so many other complaints which were lodged before this complaint and not taken up for inquiry yet.

    I think the members of the legal profession should start lodging bribery complaints against each of the 116 signatories, the speaker and the ruling family including the brothers, relatives, and their children.

    Declararion of Assets and the 20 Bank accounts were part of the PSC CJ impeackment. So why again by Commission of B & C.

    This is another MARA’s cheap mud slinging tactic on CJ and her family.

    It’s time that Supreme Court start investigating on all Govt. Parliament members, their extended families and friends…..assets, employment and businesses details as I herd most of them are unqualified to hold their positions and were recruited with political influence. A travel ban on them until the investigations are over, will save a lot of foreign exchange to country.

    Also a must on Kelaniya Senior and Junior Mervin along with witnesses.

    What else we could do other than laugh at the President’s behaviour, who’s job is to serve people and not himself. Here we work and he play all the time.

    It’s shame Mr. President….Get back to work and solve people’s real problems.

    As any one can request the statement of assets declared by the ruling politicians since it is considered a public document.Civic minded people should ask for copies of declaration of assets by Moda wansa,Rajitha,dilan,Mervin and the rest including the deceleration of assets by the Raja parapura.Then only we can see wanders taken place of in our country thus showing the true colors of the so-called saviors of this country.

    How about the Hambantota Harbour, Mattala Airport, Norochcholai power plant…..all are heading for Millions of US Dollars losses and to resume re-payment of loans are getting closer.

    CJ investigation is peanuts compared to these mega Billion Dollar losses….It’s time somebody start investigating on these and punish the culprits.

    It’s time to seperate donkeys, monkeys, foxes and ants….and start work on common cause to uplift the country.

    We are all privy to facts clearly laid out by CJ in her response to the allegations. This is just a circus to trump up an audience. If justice will prevail, CJ will come out of this stronger, else, it will time for citizens to get out onto the streets in support of justice and fairplay. We all know what happened to all the gold jewellery looted and robbed by LTTE, from ordinary citizens both of Tamil and Muslim origin who lived in ‘their’ territory. It all ended up in government hands in 8 safes, when caretaker KP handed in the keys, on guarantee of protection. This immense ill-gotten wealth was invested in the stock exchange in a hap hazard manner and even achieved the status of ‘best performing in the world’ when everything else in the country was in the doldrums. How can any country prosper with this kind of ‘blood’ money in circulation within its economy, let aside money earned on interest. Naturally, we citizens will have to bear the burden of what the government and its cronies did to its citizens, and may never be witness to a truly golden era in any near future.

    I can’t understand why Police allow the Bribery Commission to steal a march over them. Can’t they arrest or file case against the CJ on the strength of a complaint by a non-existent person? After all, if the dead people can vote at elections, why can’t the dead make complaints to Police? By the way Police can get that “Kudda” who was arrested in connection with the Museum burglary to say that he carried out the job on instructions given by the CJ? There is nothing to worry about proper procedures or recording evidence. Because there are Kekille kings from that august assembly holding courts!

    R.100 million for Rajapaksa sons’ duty free racing cars

    It is reported that Carlton Motor Sports Club has imported 19 motor cars including Lamborghini, Italian luxury and super sports cars at a cost of nearly hundred million rupees (Rs.93,366,272). The luxury cars have been taken away from the port without paying any taxes.
    When importing goods Port and Airport Development Levy (PAL), Customs duty, VAT and Nations Building Tax (NBT) are levied. However, none of these taxes have been paid and the amount the country has lost is more than Rs. 202,231,439. Despite tax has been withdrawn for racing cars, the custom levy has to be paid. The President removed taxes for racing cars in his 2013 budget.
    Thirteen of the nineteen racing cars have been removed on 11th December paying Rs.2500 as service charges.
    Among the cars that have been imported are Porsche – 3900 CC from Japan, Aston Martin -3500 CC, Nissan Fairlady -3500 CC and Honda Civic – 3500CC from Malaysia, two Lamborghini Callardo – 4961 CC motor cars from Hong Kong and Macau. Thirteen cars have been imported from Toyota Kirloskar Motor Private Limited in India. Among the cars imported from India are brand new Etios Motor Racing Cars with 1496 cc capacity and 1197 cc capacity.
    The motor cars are imported by Gac Logistics ltd for Carlton Motor Sports Club on Carnet scheme which permits the temporary importation of private vehicles. Carlton ahs made use of this loophole to get down vehicles and custom officers say there is no guarantee that the cars would be taken back as required by the law. According to the regulation the vehicles have to be returned to the country of origin within five months. However, this period could be extended. Custom officers are randomly transferred on political needs so that the mass scale racket could be concealed say customs sources.

    1 Porsche – 3900 CC – Rs.6,120,100
    1 each Aston Martin -3500 CC,
    Nissan Fairlady -3500 CC
    and Honda Civic – 3500CC – Rs.25,782,550

      Those Racing cars came here to stay. Racing event was the bait for public to get down the cars …..duty free.

      These Racing cars are not Taxies…..They are highly sophisticated, very delicate, highly complex and ARE MADE TO WIN….WIN….WIN…

      Therefore after each race these cars go through a full overhaul….including dismentling the whole engine and replacing all the worn out parts….even thay are re-usable. They are including Pistons, piston rings, gear box, exhaust systems, wheels incluging the tires. A pair of Lamborgini tires could cost between US $ 2,500 to $10,000.

      The point I want to bring is….after the race…. to replace the parts and labor cost on these highly sophisticated racing cars are costing almost equal to BUYING ANOTHER CAR….They are built and race to win….and not for old crocks rally.

      Therefore I guarantee the company or the guys who leased these cars will charge almost the cost of buying one….for leasing these highly sophisticated racing cars….

      Do you know that Michale Jordan who is a Racing motor bike fan…has employed a hugh full time employes to upgrade his racing motor bikes (Michael Jorden Motor Sports -initiated 2004) Invested Billions of Dollars and yet to win a race.

      My Final conclusion is TO LEASE THESE MOTOR CARS THE LESSOR CHARGES ALMOST THE AMOUNT AS TO BUY A NEW CAR…..leave alone Comprehensive full insurance and liability coverage and cost of shipping back to Lessor.

      So these cars are here to stay…….duty free.

        As I have informed Safa the amount is very small Rs202, 231,439 is less than £1million and todays Euro is £69million for a £2 ticket min is £10 million twice a week. National at £1 is a min. of £2.2m and 4million.
        These are things that have been happening long before by big-time government contractors and sponsors of foreign aid projects eg 9 dump trucks and 1 Benz (escort car). There are 1000’s of vehicles over there as collector’s items. It seems the customs are more worried about their transfers :)

    Now is the corret time,to re-open the Hambantota Account case,where CJ Sarath N Silva,knowing that Mahinda Rajapakse was guilty of embezzlement of funds donated for the welfare of tsunami survivers,gave the wrong verdict purposefully – as he has admitted – for reasons unknown, and freed him.
    If the CJ is to be investigated for unaccountable wealth,MR too should be liable to answer how tsunami funds ended up in his bank account.

    It is beyond doubt that the Bribery Commission is politicized and DOES NOT use transparency in selecting allegations for investigation.

    So it picks and chooses and basically chooses all opponents of Govt. and leaves those allegations of Govt. people aside.

    Under this basis they have lost credibility in the eyes of the world and hence any allegation they decide to pursue lacks credibility.

    Effectively the Commission MUST be disbanded and a new one formed but by whom? as the President only appoints people who are partial biased and not independent.
