Chief Justice To File A Contempt Of Court Action

Chief Justice Shirani Bandaranayake is considering to take legal action over references to her husband in the impeachment.

Allegation 5 says; whereas, Mr. Pradeep Gamini Suraj Kariyawasam, the lawful husband of the said Hon. (Dr.) (Mrs.) Upatissa Atapattu Bandaranayake Wasala Mudiyanse Ralahamilage Shirani Anshumala Bandaranayake is a suspect in relation to legal action initiated at the Magistrate’s Court of Colombo in connection with the offences regarding acts of bribery and/or corruption under the Commission to Investigate into Allegations of Bribery or Corruption Act, No 19 of 1994; Whereas, the post of Chairperson of the Judicial Service Commission which is vested with powers to transfer, disciplinary control and removal of the Magistrate of the said court which is due to hear the aforesaid bribery or corruption case is held by the said Hon. (Dr.) (Mrs.) Upatissa Atapattu Bandaranayake Wasala Mudiyanse Ralahamilage Shirani Anshumala Bandaranayake as per Article 111D (2) of the Constitution;

Legal sources close to  Chief Justice Bandaranayake  told the Sunday Times that this charge should not have been listed on grounds that the matter was sub judice. This is on the same basis that the Speaker had disallowed the issue relating to Pradeep Kariyawasam being raised in Parliament by UNP MP Harsha de Silva on the same grounds. These sources said the legal action contemplated was on a leading figure in an apex bank as well as others for allegedly violating banking secrecy. They had reportedly secured bank account details for the resolution in violation of laws governing banking secrecy.

      Have you any proof that she asked BASL to help her?
      It is not only BASL but the entire citizens (who are honourabe)
      as well as many in the international community have taken up her case.
      You also ask “Why she visting Mahanayaka’s and asking to help her?”
      What is wrong in her visiting the Mahanayakes she being a devout Budhist?
      How many times the President did visit them and even the other religious leaders- many Hindu priests here as well as in India
      and even the Pope for blessings.
      Even with all their blessings he does belive in auspicious times and even the petition for impeachment was sub,itted at an auspicious time.

    The above comments show the unity of the public against the wrongful impeachment brought agaist the CJ.How dare the State media’s foul mouthed Hudson arrogantly abuses CJ knowing very well that the Supreme courts can take action against him for contempt of court.Though this has been the practise they hide behind the immunity of the Executive President.Since there is no vibrant Opposition party to take up issues it is vital for Professional organisations and Trade Unions to come to the fore not so much to protect the CJ but to protect the Judiciary from being prostitutised

    First and foremost the Constitution of the Country should be upheld. In the Constitution it is very clear that an MP elected from one Politicl party cannot cross over. Sarath N Silva violated this principle with his own interpretation. Therefore the present CJ should take steps to rectify the anamoly created as an URGENT measure. This will put everything in place as balance of power would be restored. This should be the main concern of all citizens to restore Democracy to this country once again.

    The issue before the country is crtical from the country’s point of view.We must keep personalities out and condemn the Executive for disgracing the judiciary and his attempt to demoralise the judiciary at all levels to fall in line with is government composed of a set of puppets whom he manipulates on a string.Sadly as was said else where the cabinet is a rubber stamp.All the puppets are well looked after world trips all at the the expense of the tax payer with a nelsonian eye to the corruption which has gone over the roof.
    No doubt he did a good job with the war but that does not mean that he must be allowed to destroy all instituitions particularly the judiciary the hallowed shrine which was desecrated by Sarath Silva.
    All right thinking people Unions OPA and retired judges should voice their views and stop this assault on the judiciary.Its the instituition that matters.Its great to note that the learned Chief Justice who has no political links standing up to tyranny and trying to clear her name.I guess her brother and sisters in the entire judiciary and the unofficial bar, except that disgraceful woman who got elevated recently to the Appeal Court will stand by her.

    CJ has a golden opportunity to send the culprits a lesson. CJ is charged for violating constitutionally mandatory procedure in Special Determination in Divinaguma Bill, therefore would have to and would be justified to reverse the Special Determination on the Expropriation Bill as constitutionally being a nullity, which would result in MR having to return the grabbed assets to the lawful owners.
