A Minister and a member of the notorious Parliamentary Select Committee which investigated Chief Justice Shirani Bandaranayake was also among the Golden key depositors the Colombo Telegraph can reveal today.

The name sited as Dr N.H.R.H. Senaratne, NIC number 501501760 V, who deposited RS 7,500,000 is none other than Dentist and MP Rajitha Senaratne. This information has been extracted from Watawala report.
By being a Golden Key Depsitor, Dr. Senaratne demonstrates a significant personal interest in an important part of the subject matter under inquiry. What makes matters worse, is the fact that he has not at any stage disclosed this conflict of interest to the CJ or her legal team – and CJ would have been well within her rights to object to him being a member if this was done. If the PSC purports to exercise ‘judicial power’, such undisclosed (and apparently hidden) personal interest arguably constitutes denial of the requirements of natural justice. It could also be argued to amount to corruption, in as much as the PSC would effectively be seeking to consider the propriety of the CJ’s conduct in relation to the Golden Key case, which can only be done by persons who (unlike Rajitha Senaratne) have NO personal financial interest in the matter. Another serious and ugly concern arises – whether those who secured Dr. Senaratne’s appointment to the PSC were (a) aware of this conflict of interest and were furthering such corruption and/or sought to use such conflict of interest to somehow procure purported ‘findings’ to the detriment of the CJ, and more seriously to the detriment of the Rule of Law and due judicial process and judicial independence.

If Dr.Rajitha Senaratne’s matter is investigated properly, number of unknown answers will be exposed. Was it a sabotage to charge Lalith Kotalawela and company with the view to grab those monies and mislead the public. What happened to the monies that were deposited in the Golden Key. How many of them have plundered these monies in the Golden Key and invested in share markets. Why can’t the Tax Department find out the persons having great number of shares in flouring establishments like Appollo Hospitals, some 5 star hotels, Super Markets, etc. Some of the monies would have been converted in foreign exchanges too. Will not be better if every persons (especially the Parliamentarians)account goes through the bank and scrutinized by the Income Tax Department. Now it is the turn of the Supreme Court to order the Income Tax Department to expose the declaration of assets made by the parliamentarians. It won’t be a surprise if the PSC government members will now insist on the principles of Natural Justice when it comes to their hearing in relation to their accumulation of their wealth. however, these idiots may get some tuition from M.Karunanithy (whose family plundered the national wealth) of Tamil Nadu.

The PSC has declared the CJ is guilty of the charges without an accepted mechanism. In Malaysia, the charges against the chief justice are probed by three chief justices of Commonwealth countries. There is also proper system adopted in India. Clearly, the UNP or SLFP does not want to improve the system when they are in power. Have they done anything to solve the ethnic minority’s problem since 1948. Have they achieved anything significantly since they got independence?
We do not have smart leaders, that is why we have been fighting since 1948. If we had smart leaders, we could have used the young people who have been killed being part of the Tamil armed groups, JVP and defence forces, in order to expand the IT sector and the manufacturing sector. Do you people have any idea how much we have lost due to lack of decent leadrship? This why we need Lankan think tank for the Sri Lankan intellectuals to get involved all around the world, to come up with stable domestic and foreign policies, economic reforms, educational reforms, strengthening the judiciary system etc. Trusting the political leaders is foolishness.
