Fonseka To Take Legal Action Against AG For Blocking Gota Arrest

Democratic Party (DP) leader and former Army Commander Field Marshal Sarath Fonseka today said that he would take legal action against the Attorney General for blocking the arrest of Former Defense Secretary Gotabaya Rajapaksa.

sarath-fonseka- colombo telgraphFonseka said that the Attorney General had obtained an injunction order preventing the arrest of former defense secretary and an official of Rakna Lanka Pvt Ltd. despite their involvement in massive frauds.

 He charged that the AG was acting in an arbitrary manner preventing the arrest of several high profile politicians and officials of the former regime who are accused of wrong doings.

Fonseka told the media that the AG was responsible for delaying investigations and placing obstacles to deter others. 

He said that the credibility of the Attorney General’s department has been undermined due to the actions of the current AG.

Fonseka also lashed out at the government for failing to take action against the former Defence Secretary on charges levelled against him related to Rakna Lanka, Lanka Hospitals, Avant Garde and the MIG deal incidents.

He said that despite promises the present government has so far failed to prosecute politicians and public officers who are accused of fraud and corruption during the tenure of the former regime.

The former secretary of defense is under investigation by the FCID over his alleged involvement in several high-profiled financial transactions including the Mihin Lanka, Avante Garde and MIG aircraft transactions.

    Dear field marshal please remember that AG-DEPARTMENT was earlier under your former best friend MAHINDA so AG may take some more time to break away from his old habit.most people believe that problem between you and MAHINDA brothers is about TONS OF GOLD recovered from LTTE from mullivaikal when you were away in CHINA.it is better and not too late for you to MAKE A DEAL WITH MAHINDA BROTHERS and leave them alone and you and your family can live with all good things in life.

      This piece from ‘Paragon’ is such a disgustingly pathetic piece of writing, he needs to be told of it, which is why I have bothered to reply.

      Sarath Fonseka went to jail because he was principled and unbending; not because he did anything worth being jailed for. Many carrots were thrown in his way by the then ‘governors’ but he refused to eat them. He went to jail instead. Everyone saw the disgustingly callous way in which the man was dragged, thrown into a car and taken to prison. Everyone saw how he bravely spoke out, each time he was brought to courts, against the then regime. He was, and is, a real hero, the likes of which we may never see again.

      If it is humour you have attempted Paragon, let me tell you its been in very poor taste.

      They say that Robers when they commit a robbery stand united but when they sit down to share the spoils obtained that they start fighting. This is true in the case of Mahinda / Gota / Sarath Fonseka trio. See how these three are at each others throat now, seeking revenge.

      After the war was over, all three of them were friends and celebrated the victory. But Sarath Fonseka made a foolish move of visiting USA. There he was cornered by US agents who got the truth out of his mouth and only after that he was allowed by them to return to Srilanka.

      The content of the statement given by Sarath Fonseka to US agents about the unlawful conduct of the war especially white flag incident implicating Gota and Mahinda was let out to them. This started the animosity which led to arrest and harsh treatment of Sarath Fonseka.

      If Sarath Fonseka is honest he must come out with the truth about war crimes committed during his tenure in the army. UN has ample evidence of all the atrocities and has reported that it is beyond doubt. Will Sarath Fonseka do that or only try to victimise Rajapakse brothers.

    Any AG can take action only on the investigations carried out by the Police and their report on same.Sarath Fonseka is an Army man .Perhaps,he is unaware of how Legal Institutions operate.
    This does not mean that I am holding a brief for GoTA the serial killer!

      Unfortunately we are talking about Sri Lankan Courts! How can you find a clean judge untainted by Rajapakasha hands? If there are clean ones, they would be unlikely to be nominated to hear this case.

        people are intelligent enough to study the verdict of the judges because the verdict is not just yes or no,but has to be accompanied by legal justification.If they come out with a sham verdict then the corrupt judges will be exposed and a public backlash will take place.

    Seems to have a lot of defenders here to protect GR, no doubt in his payroll. The real fighter for Sinhala cause was dragged along to his prison by his heels over a petty allegation whereas masters of corruption have defenders even at AG Level. Fancy an AG preventing the arrest of a suspect!

    “Fonseka to take Legal Action against AG for Blocking Gatta Arrest”. No. he doesn’t say that. What he says is, there must be some system to take action and even arrest AG if he is not acting according to legal provisions. He made that observation in reference to the court direction that GR obtained restraining him being arrested in relation to Rakna Lanka and Avant Gard investigations. That court case was filed on citing HR violations and requesting to prevent arrest. The decisions was only a temporary one to be argued on a future date. It was no doubt, every one expected AG to submit objections; but whatever the way the decision came in favor of GR. As FM Sarath Fonseka stated, the general public has become very weary of the investigations that are going on in a “snail speed” and nothing has come about the much “SPOKEN” and “PUBLISHED” allegations of “Mega” corruptions committed by the previous regime. A case in point was the Rs 600 million “Sil Redi” case in which the previous Secretary to the President is one of the accused. We are made aware that this was a blatant violation and mismanagement of Public Funds and Property that warrants “ARREST and “DETAINED until further action is pursued. It was some other court where the case originally came about and a “Travel Restriction” was obtained. But the main case has been filed in another court, through which the accused obtained bail. Even there the AG did not OBJECT to giving bail to the accused at least citing the provisions of the relative law of “Mismanagement and Misuse” of Public Funds and Property. It is so with Rakna Lanka and Avant Gard case, where even the President had to intervene and direct action even though the AG withdrew the case in Galle courts. Although, under Parliamentary privilege, Mr. Anura Kumara Dissanayake revealed alarming facts on this case and directly blamed the AG and his Department for “Negligence” and almost hinted that such action was “predetermined”.

    All these events and the way of handling “URGENT PUBLIC INTERESTED” matters do not demonstrate the “EFFICIENCY” of the authorities; but leave room to point fingers and accuse them of being BIASED and UNTRUSTWORTHY. In this regard it would be very interesting to read the 41 pages judgement of the Additional Magistrate in the case of these “Authorities” requesting the lifting of travel restriction on one of the accused in that Rs. 600 million “Sil Redi” case. This is how our WAY OF HANDLING Governmental affairs and the Legal Processes have been subjected to “RIDICULE” and “SUSPICION”. We have to get out of this STIGMA, as otherwise, the more difficult days are ahead for us. That is what FM Sarath Fonseka is trying to say. Please note, I am not a promoter of FM.

    Field Marshall Fonny now wants to prosecute the Prosecutor.. How cool.

    Fonny must have a decent cash flow to hire the Legal Eagles , Unless the BASL has offered to do it Pro Bono..

    This is not a job for the “pedestrians” who parade in front of our soon to be ” Hybrid courts” , touting for Business from the poor Dalits who have the misfortune to front up. to these vestiges from Batalanda Ranil’s mates…

    It was only five years ago that Fonny acted as the front man for Batalanda Ranil and scored nearly 5 Million votes and a lot more in cash.

    But couldn’t get a Gig this time , when some shady characters even, who who were written off by the voters now have got big Ministry jobs.

    No wonder the frustration , angst and the anger of being unable to take revenge.

    It was only a couple of days ago that Fonny was haranguing his ex mate Batalanada Ranil and Bodhi Sira for not prosecuting his ex Commander in Chief.

    This is what Fonny said.

    Can’t remember whether he mentioned the ex First Ladie’s poodles.

    “Now I ( Fonny ) have to go back to the Dalits and tell them what we said at the Election are are all bull..And they haven’t done anything wrong”..

    If Fonny was serious , our Dalits may even like him . this time…

            Hahaha Sumanasekeram, you are indeed one [Edited out]. Yes I am from the Vellalah caste and so is Prof. Hoole, who happens to hail from Nallur, an ancient Tamil kingdom. His dad was Rev. Hoole of St. James church Nallur. We all worked gas station, security and factory jobs. There is nothing wrong in any of these jobs. Then we all moved on to more career based jobs such as Scotia Bank and other banks, which I am part of. For a change you said one thing which came very close to what I do. Congrats!!!!

            But going from a gas station attendant to a mass murdering thug and Defence secretary kills me. So you have a problem with that?

    What we fail to understand is why the Govt of Maithri/ Ranil do not terminate or sack the AG and the Sri Lankan representative in Geneva. Both individuals are presumed to work against the present Govt and are colluding with the Rajapakses. Is there something the current Govt is hiding from the people of Sri Lanka?.

      The AG and the Geneva Rep do not work for this or that politician. They work for the people of Sri Lanka.
      The AG can ONLY act on robust evidence presentable in a court of law to achieve a conviction. The evidence gathering is NOT one of his functions, nor can he interfere in such collection of evidence.
      The Permanent Rep in Geneva has been doing a good job, till the FM pulled the rug from under him, by agreeing to co-sponsor an ill-thought out Resolution to placate his masters in the West.
      Neither can be blamed for doing their jobs, simply because it is inconvenient to others. Fonseka is merely displaying his inadequacies in the civilian world.

    Well, many of the corrupt fraudsters of the former regime are in the Yahapalanaya government, seven of them given Ministerial portfolios. What do you expect. Promises are promises FM Fonseka when it comes to politicians in Sri Lanka. You must not take promises made by any politician including My3 or Ranil as real promises.

    The AG should be investigated for his questionable decisions regarding the protection of individuals like Gota, Tiran, Weerawansa and others who should have been incarcerated ages ago.

    Why the Yahapalanaya administration is blind, deaf and dumb to the AG’s decisions is the major mystery!

    This semi-educated Paddy Field Marshall has put his foot in his mouth in several public utterances. He is a regular cause for laughs. The insinuation against the Attorney General is a calculated attack against the judicial system. Action must be taken against him.

    In rejecting him and his Party outright the Sinhala people have begun to accept the war victory was not the result of individual acts of MR,
    GR or Sarath Fonseka. The ordinary soldier brought the victory in a battle where nearly 300,000 men with fully-armed modern weapons downed a rag-tag band of about 15,000, mostly barefoot, Tamil youngsters. Over 100,000 Sinhala soldiers died in the conflict and are mostly unwept and unsung. Bodies of thousands of them were burnt in the front in the fear of bringing these to their villages – in the fear of actual figures becoming known to the public.

    The weak aiyo Sirisena granted it to prevent further nuisance from Fonseka. Sirisena cannot be expected to know that titles in the army are usually given according to battle strength. Ayub Khan, in neighbouring Pakistan, made himself a Field Marshall in the country’s large army – described as the 6th largest in the world. It has a strength of nearly 650,000 – excluding reservists.

    One wonders why Fonseka did not ask to be made Supreme Commander of
    Allied Forces? Sirisena would have even granted that while the world would have been in fits of laughter.

    What nonsense! Sarath Fonseka is a super hero and deserves to be made
    Field Marshall – like the other Field Marshall in Uganda, the late Idi Amin. The world turns to smiles and laughter at the very mention of Idi Amin. Fonny has taken us to that level – thanks to Gamarala Sirisena. Remember the day Fonny told the country he is now educated. He said he read one book while in jail. What an educated man!!!

    If by some chance Sarath Fonseka won that Presidential election in 2010 what would have been the fall-out?
    There is one scenario:None of the Rajapakses would have been amongst the living.
    There would have been no FCIDs,there would have have been no Gamini Marapones etc.Some would welcome it some would revolt.
    Perhaps SF would give me some books to read; I would choose the author P.G.Woodehouse!

      In the nature, mental makeup and IQ of the man SF would have hunted down the entire Medamulana Rajapakase House of born Rogues and predictably caused the death of some of them. The same way Lasantha, Raviraj and others came to their end. He would have also probably finished some of the other service chiefs with whom he had scores to settle. He would have also perhaps finished many Tamils for “asking this and that” in this, what he insisted was, exclusive Buddhist Sinhala land where Tamils had absolutely no place. He would have loved to declare war on Tamilnadu. This was the reason he suggested when MR/GR asked why he wanted SLA ranks increased to nearly 400,000. For sometime, there would have been some governance to the liking of the country to be followed by utter corruption. Sri Lanka would have becaome a Police State. Remember when he was in the good books of the Rajapakses he engaged in huge loading of invoices etc using his SiL, who went missing for years. This was in respect of purchases of bullets and grenades for the army. And that was before he had political power. He was found with a large amount of US$ and multi-millions of rupees in different bank vaults. How did he come by them on the relatively low salary of Army Commander?

      The story of Sri Lanka would have been like that of that once prosperous Zimbabwe. Feel grateful Sri Lanka wasfortunately spared SF rule as well was JVP rule under Wijeweera during 1988/89.

      PG Wodehouse – So you are a fan. I always wondered why PGW found a special place among the large English-speaking Indian population, where he was a big favourite – faithful valet Jeeves and all that.
