Gang Rape Of 16 Year-Old In Wanni: Police Investigations Commence

The National Child Protection Authority (NCPA) has commenced investigations into the gang rape of a 16-year old girl – who subsequently fell ill and died- in Wanni, following media reports and an online petition that was initiated due to the inaction of the law enforcement authorities over the incident.

Children’s Affairs State Minister Rosy Senanayake releasing an update on her official Facebook page over the incident said the NCPA Chairman has notified her that a Police Officer form the NCPA has already visited the Mankulam area and is currently monitoring and helping the Police investigation.

The Karadanayagakulam Police, which holds jurisdiction over the investigation, has taken steps to record a statement from the grandmother and it has been revealed that the doctor who performed the autopsy has concluded there were physical signs of rape.

According to Minister Senanayake, the Police are yet to receive the Coroner’s full postmortem report. However, in what has been submitted to the Police, the cause of death has been stated as a ‘natural death’ further noting that ‘cause of death cannot be given – further investigation necessary, samples were taken.’

Meanwhile, the motion submitted by the Karadanayagakulam Police to the Magistrate’s Court yesterday afternoon to exhume the body to be sent to the Colombo JMO for the autopsy, was refused and the Police was instead instructed to submit the full postmortem report on the next Court date which falls on March 30.

Minister Senanayake further states that the NCPA OIC too is due to visit the Manklulam area to ensure necessary steps are implemented to carry out the investigation and added depending on the report, the NCPA will be taken steps to write to the DIG – Crimes on Monday to request him to directly monitor the investigation and to request the Attorney general to assist and advice in the investigation.

The 16-year old victim is an orphan and had been living with her grandmother and her siblings in Mannakkulam – a village located between Mankulam and Karadanayagakulam. She had suddenly fallen ill and hospitalized, and according to media reports it was then the grandmother had been informed by the doctor that she has been brutally gang-raped by not less than three men’. While in hospital, the victim had abruptly died and media reports also claimed when the incident was reported in media, the grandmother was threatened by the Police to state she died due to a mental illness.

    The police have threatened the grandmother to say the child died of natural causes and the same police are investigating the crime?

    Isn’t that a bizarre situation. As many other such cases the military or police men are the culprits and that’s why the case was being pushed under the carpet. I thought tamils will get justice under Sirisena!

      This kind of Bizzare situation were common under the regime of Mahinda Rajapakshe. So this is the reason why the majority feel not the least towards right path of an investigative process today ? People are far from understanding that such processes could take longer. They had been made used to condition that the way authoritiies reacted under the lead of MR was the right way to go forward…. entire society is mroe or less twisted by those mechanisms. People were used to see high criminals being not caught by the legal system believed to be active under the guidance of Mahadenamutta Mahinda Rajapakshe. He did not articulate enough at the time UNP fact finding missions risked their lives in Hambantota at that time. The harm made to those oppponents are not forgotten by people if people are believed to be normal. I really dont know why the people are that biased when it is focused towards the justice in this country. The crime commited by Rajapaskhe mechanisms were brutal ones of all times in this country. I still remember the days we faced it student unrest in late 80ties. But there, we all promised not to allow any other premadasa to rise up, but very same rural folks were twised by all blatant lies, by Rajapakshe brothers. Today after 60 days with MY3 RULE – Basil has not yet issued any single statements against all the allegations made against him. Why ?

    It seems the as per the minister, Magistrate is the suspect. Doctors are coverings it up. It seems police is having a hard time to get the culprit out. The minister is determined to bring in and have it confirmed (the puppets if she orders then those puppets have to go there anyway) IGP, Chief Justice … anybody.

    If god grace is there, there are others, the grand mothers may not see the natural cause during the investigation.

    Rosy talk of the Sinhala Intellectuals! We saw what happened in Krishanti’s case investigation drama. When Rajapakse was investigated the Chemani pit came out. Then they bulldozed everything. Do the NPC needs legal power under 13A? No No Not at all!

    What I say may look bizarre but there are reports to the effect that in these areas in question, girls to be married the next day must be “consumed” by a high public official for them to be fit for marriage. The practices are very funny and primitive and that explains why the crime is being attempted to be swept under the carpet and this has nothing to do with the ethnicity of the people in question. It is nothing but male chauvinism to the extreme.

    Hon. Rosy is given no easy task. She needs to be well equipped in knowledge and skills do deal with sordid action against women and children of these areas.

      It is not the story which you discovered bizarre, you yourself seems to posses a bizarre character, you must have accepted such a ‘consumed’ one for your life as future partner which appears to have the cause of letting your frustration getting the better out of you or you could be one of those who have been conducting such rites to orphan girls in the previous nights before their marriage. To imagine the way you did and to fabricate such utter lies, you must need some helps, go see a male doctor.

      Ridiculing a dead lacks common decency and ridiculing a brutally murdered orphan girl, wonder how do you face your mother and your sisters at their face. I don’t believe it is an attempt defending your forces, but it is more than that.

    In Sri Lanka and many developing countries police are corrupt and political influence and money buy (in)justice. In Sri Lanka for more than 9 years in the recent past there has been also a culture of immunity for rape, abductions, torture and extra judicial killings. Investigations of crimes have also been meddle with by political leaders. The victims were silenced in many cases as in this very horrible crime.

    The new government must make sure the law enforcement officers do their jobs impartially and no political influence to applied to pervert the course of justice.

    What is all this farce about a police investigation when they themselves are obstructing justice?

    The moment the allegation was made that the Police was suppressing the incident, the investigation should have been passed on to officers from a different station. If that is not done, a whole lot of lives of witnesses etc. are in danger, if not coerced and the outcome would not be worth anything.

    surely the girl would have died of infection following rape or due to bleeding. Most probably the doctors in the ward can confirm this.

    How safe are women and girls in these areas ?

    How can the government ensure safety of all citizens?

    Backward caste tribes in India and Sri lanka do not think rape is bad. First of all collect DNA evidence. Protect the chain of custody of physical evidence. People do not die of mental illness unless they commit suicide. The backward mentality of people in Sri Lanka and India are appalling. This sickens me. It is repugnant how incompetent people are. No wonder in India people take the law unto their own hands and lynch rapists. Cut off their testicles and whip them after tieing them up.

    Who raped the girl and why is the magistrate and police not enforcing
    the law. In Sri Lanka even state machinery can be bribed and they
    themselves adopt to very low strategy to sweep cases under the carpet.
    All theses guys have to be dealt with severely if not such incidents
    can be repeated day in and day out. Poor girl I feel sorry for her
    and the grandma who have gone through such torment.

    This is a country where a magistrate sent a poor remote girl to prison for writing something in Seegiriya ” kata path pawura” . It is a shame under the same government if the criminals who did this kind of crime can go scot free.Whoever did this should be brought in front of justice promptly. I cannot understand why our human rights champions, women’s organisations appear lethargic in a henieous crime like this. No one should be able to get away under the shades of political patronage , racial sentiments or ” ranawiruwa” decorations. We need law and order in its fullest swing under ” Yahapalanaya “. Dear Rosy, do the justice to the poor girl and her grieving grand mother. Whole world is following this dirty incident.

    The judicial medical officer or one acting for him must first ask the victim in cases like this, in private, about the event and record same in writing.
    But in sri lanka, the police insist on being present – to intimidate the victim and even the doctor.
    It appears that the police are trying to cover up the fact of rape.
    A pathological post-mortem is required for every such case of death in hospital.
    The post-mortem will reveal the time, manner and cause of death.
    These facts appear to be suppressed.

    The minister can obtain advice from the university forensic medicine department.
    Why doesn’t she ?

    So, those who committed this crime are thugs and alive. The poor orphaned girl, the victim, is dead. Will the powers that be do the right thing? Don’t hold your breath folks.

    On the other hand, a fresh posse of lawmen may find the culprit/s and during investigations the suspect/s may try to ‘escape’ and will be shot dead. Even in Maithriyaland, Justice could comes about in the strangest ways.

    The poor innocent has died and at least for her soul to rest in peace, the culprits must be arrested immediately as possible and punished. But, why didn’t the Police act fast in this case? Were they trying to cover up somebody? Therefore, Minister, Child Protection Authority, etc move for proper inquiry against the Police personnel of the relevant Police Station and suspend the guilty officers and punish them according to the law.

    If, by chance, the ministry does not persue this matter vigorously, the culprits would escape and the masses would lose the faith in this ministry.

    according to tamil newspapers this child lost the parents during war time and was living the grandma .she went to a known person’s home where her brother was living . then gone with some known persons from that home to thiketheeswaram for sivarathri and returned ill but got admited to hospital late only

      She is over 16 and as per SL law, can decide to be with whom ever she wants. that being said the PARENTS of the girl should be responsible. These BUSINESS minded parents do NOT have time for the kids. All that they are after is Money. The kid would have felt that she was losing LOVE at home and the parents were not giving her the love and attention that she is looking for. The parents may provide ALL luxuries BUT if love is lacking at home( especially at her age where guidance is VERY important), the kids will look for love elsewhere.

      Sadly the parents called a media conference at a LUXURY hotel and highlighted this incident, which MOST people wouldn’t have known. They just spat looking UP not knowing it would land on their faces.. STUPID decision by a Businessman… The parents should have pursued this with the Authorities and settled matters in a different way. Whether it be Rajitha’s son or any mothers son.. one do NOT have the right to KIDNAP people, if she was under 16 charge him with kidnap..He is NOT above the law…

    If you cant find the culprit – close down the police
    If you cant deliver justice close down the country. What a shame.
    Under Mahinda this was known as a humanitarian operations and the officers would have been rewarded.
    If somebody wanted a separate state now you know why.
