President Gotabaya Rajapaksa’s Viyathmaga member and the Governor of the Western Province Seetha Arambepola is in stark violation of the constitution of Sri Lanka and continues profiting in her professional capacity, Colombo Telegraph can reveal today.
Seetha Arambepola is an ENT surgeon by profession and was appointed as the Governor of the Western Province of Sri Lanka from December 2019.
However Governor Arambepola despite functioning as the Western Province Governor can still be consulted as an ENT surgeon every day at the Golden Key Hospital Ltd and Hemas Hospital – Thalawathugoda and Wattala.
According to the 154B (7) of the Constitution, the Governor shall not hold any other office or place of profit. It says: “Upon such assumption of office a Governor shall cease to hold any other office created or recognized by the Constitution, and if he is a Member of Parliament, shall vacate his seat in Parliament. The Governor shall not hold any other office or place of profit.”

Well, Western province politicians need a governor who can treat them for not hearing the criticisms from the people. .Prof HL Peris can find a loophole in the constitution to overcome this issue. In Sri Lankan judiciary there is always a way out as in case of Gotas National ID and citizenship case The President is supreme over Judiciary by overruling those who were convicted for death. Sri Lankan Constitution is very weak and only on paper in WPB. Now they are trying to get two-third majority yo ake the president more supreme. then the Judiciary. These with come to light in March at the UN HR meeting in Geneve. That is why Got is meeting Russia, China

CT you are absolutely correct about Art 154B(7)
A governor (i) cannot hold any office created or recognised by the Constitution. In addition, she (ii) cannot hold any other office or place of profit. These are two clauses in 154B(7). The words ‘of profit’ clearly envisages an office other than ‘an office created or recognised by the Constitution’. I cannot think of an office created or recognised by the Constitution which is one ‘of profit’.
The phrase ‘of profit’ may be read as controlling (i) either or (ii) both ‘office or place’ The better view is that it should control only ‘place’ which would then have the effect of preventing her from holding any office, whether for or not for profit.
The prohibition is drawn very wide and rightly so.
The rationale for the prohibition is to ensure (i) that the governor does not have more than one master to serve, (ii) that she engages her undivided attention to her office as governor, and (iii) that she is not placed in a position where her personal interests could come into conflict with the interests of the state and the region of which she is the governor. She should be available at all times to meet the demands of her office, and not those of her other office or place

A state governor moonlighting in any profession, even after hours, is unconstitutional & unethical as there is bound to be a conflict of interest. Governing a state is a full time job & if there is even a hint of any politician in a democratic country having an interest in any private business while in office would be grounds for immediate dismissal. It is not only state officials but even mercantile employees are subject to that policy.
Maybe this doctor does private practice as a hobby or prevent her surgical skills going rusty in case she decides to go back to her old job in the future. Though she maybe not accepting the perks that goes with being the governor, the fact that she is charging her patients for her ENT consultancy, she is certainly not doing it with the goodness of her heart. Now that she has come forward to contribute her time & education to help the President to build the nation, I would respect her if she does her ENT consultancy voluntarily instead of charging fees from poor patients & that is if she can find the time because a full time job done diligently leaves little time for a second job, even part time..

She must be active in her profession to remain current in her profession. If not she becomes obsolete. As long as she does her job well, no one should complain. Why should anybody bother?

What surprises me is the comments and not the subject matter. Lankans always find ways to normalize issues which are not. What ever may be the intention of this good doctor, still there should not be any exceptions when it comes to Law or Constitution. Yes, she may be better person than most of our corrupt politicians but does it mean there can be exceptions. If she is practicing in private hospital then it is for profit. But even if she is doing so in Government Hospital, she is still earning a monthly salary and being a governor how will she meet the full requirement of her work hours and duty ????? If so , why should poor government employees get penalized, for working after hours to make extra money(teachers) , that too, to make ends meet.
