Illegal Surveillance On CBK: Full Text Of The Letter Sent By Chandrika Kumaratunga To President Rajapaksa

The former President Chandrika Kumaratunga has written to the President Mahinda Rajapaksa urging to stop all illegal surveillance on her. The letter was sent on March 05, , 2014 and acknowledged by President’s Secretary Lalith Weeratunge.

Harassment of Former President Chandrika Bandaranaike Kumaratunga Through Illegal Surveillence

I write to inform you of certain activities undertaken by your Government that have violated my privacy, caused much harassment to me and concern with regard to my personal safety.

This situation also violates my Fundamental Rights, impinging on my freedom of movement and freedom of association.

Since I retired from the Presidency in 2005 and you assumed the office of President, the secret services of the Government, which are directly under the authority of yourself and your brother Gotabhaya Rajapakse, Secretary to your Ministry of Defence, have relentlessly pursued the following actions :

  • Constant surveillance of all my telephone and email communications
  • Constant surveillance of my residences in Colombo and at Horagolla
  • “Visits” paid to several friends, consequent to their visiting my home, by officers introducing themselves as from the NIB.  They have been interrogated, in an intimidating manner, about what they did at my home, who else was present and what was discussed.

I complained in writing about this to the former Inspector General of Police Mr. Jayantha Wickremeratne by my letter dated 19th October, 2009 and also talked to him on the phone.  I did not have the courtesy of even an acknowledgement, similarly to several letters written to you, your Secretary Lalith Weeratunga as well as Secretary, Ministry of Defence Gotabhaya Rajapakse on other matters.

  • NIB officers visiting and interrogating the management of hotels, after I have happened to visit these hotels for entirely personal reasons.  They have been questioned as to why I went to the hotel, what I discussed, who I meet there, etc. They also place officers at the hotel, to watch and report on who attends my events.  The staff at these hotels has been so intimidated and frightened by these actions, that I now find it difficult to arrange even personal events at hotels.
  • Recently I went to the Kurunegala District, for a personal visit.  A few long-time friends learnt of my visit and invited me to their homes – one for tea and the other for dinner.  The local NIB officer subjected my hosts to constant harassment for several days before and after my visit, inquiring about the reasons for my visit, whom I met, etc.  In the context of a culture of white vans, these friends are terrified to associate with me anymore.
  • I also went recently to Anuradhapura with foreign friends.  The hotel I stayed in was under a 24 hour surveillance by NIB officers, who were recognized and spoken to by my security detail.  The net result would be that the said hotel management will be hesitant to accommodate me in the future.
  • It is noteworthy that my security officers have recognized some of the NIB personnel engaging in various acts of surveillance

I am deeply concerned about the above for the reasons given below :

  1. This is a serious violation of my Fundamental Rights to movement and association.
  2. This amounts to a calculated strategy of your Government to harass me and cause severe mental and emotional stress to me, while intimidating my friends and associates.  This situation is compounded by the knowledge that you have informed a large number of senior members of our Party and our Government to desist from talking and associating with me, during the past 8 years of your Presidency.
  3. Taking into consideration the prevailing practice of destroying anyone who is considered a threat to the higher authorities of your Government, by means of murder, “disappearances”, physical attacks, I have serious reasons to be concerned about my safety.  The practice of constant surveillance is an effective means of obtaining information about my whereabouts, in order to facilitate planned action against my person.

I say that the surveillance that has been mounted on me, the Former President of Sri Lanka, is illegal for the following reasons :

  • The only legal provision relating to this issue is Section 56 of the Police Ordinance.  This Section casts a duty on a Police Officer to use his best endeavours to prevent all crimes, offences and public nuisances, to preserve the peace, to apprehend disorderly and suspicious characters and to collect and communicate intelligence affecting the public peace, etc.
  • This Section evidently comes into operation when the relevant Police authority has reasonable grounds to suspect that the person they need to mount surveillance on is engaged in the above stated activities. I would be pleased if you could inform me what crimes and offences I have committed, in which way I have been a public nuisance or affected public peace, or behaved in a disorderly or suspicious manner.
  • In the absence of the above unlawful activities, I clearly wish to inform you that the surveillance mounted on me by your Government is illegal and unconstitutional and in violation of my Fundamental Rights.

I wish to earnestly request Your Excellency to take immediate action to instruct all relevant authorities to stop all illegal surveillance done with regards to myself.

        Who should feel sorry for this corrupt Ex-President? Nobody.

        Her corrupt family run party, SLFP nominated and brought the current corrupt clan destroying Sri Lanka beyond recognition into power.

        Therefore this woman and SLFP are responsible for the unprecedented tragic, brutal form governance Sri Lanka is experiencing now.

        She also had 2 terms of all mighty Presidency of Sri Lanka to strengthen our institutions of government. She did none of that.

        Now whining about the dictator her party brought to power.

        Sri Lanka needs to kick all these people out of our politics. We need a clean start. These people are not required.

          CBK is not responsible for the present tragedy.She never liked Mahinda so she tried to prevent him coming to power.
          She presented a new constitution with more power the North and East and she tried to abolish executive presidency through it.It was the UNP and others including Vasudeva which sabotaged it.
          Her fault was she did not burrow money to build roads airports, ports etc.
          Everybody makes mistakes.She has not attained arahathhood.

            You are right saying that CBK did not agree with Mahinda even from the beginning on. But she has to respect views of others too. I wish that Kadirgamar could have been appointed as the PM by her, but that could have worked… amidst the resistence made by party senior. I now believe, if Mahinda was CBK´s position then, he would have elected any candidate he thought was right, but unanimously. His performance today is more like unanimous decisions, abusing executive powers. See alone the matter with Minsiter of Justice without ministerial powers. All the authorities have been taken over by MR… so Minister of Justice is seen as a puppet. People attack him for not doing the due, but President has made him powerless. Jvpers have proved how many depts have been taken over by president.. it is over 100… can you imagine ?             Recalling what Sengentu added to CT readership few weeks ago, the way how CBK`s son offered a wheelchaired lady his business class seat in a flight heading to london and the security levels that they then enjoyed were much less compared to today´s situation where president sons, wife and the entire family enjoy. Cosmetic queen is said to be the most wasteful woman that the country has ever produced sofar. And people in colombo areas are highly distubred by unbearable sound exposure deliberately caused by their night car race show. Nobody is going to criticise that..

      Well in 2000, you agreed to LTTE’s demand for an Interim Self Governing Authority [ISGA] and offered north and east to Prabakaran to rule for 10 years without elections, without opposition parties, without any military camps and without disarming the LTTE.           CBK is the worst president of Sri Lanka. Mad woman fought several wars and peace thavalams by awalams and numerous peace talks for 11 long years. But we neither had any peace nor win the war. It was under this woman Sri Lanka reached a negative growth. Stupid woman thought changing the timezone would promote growth.

          She spend billion rupees to build a presidential castle by Diyawanna oya (you can see hordes of piles even today at Palawatta end) thinking she would remain president for ever.

          She should not be harassed but be charged in a court of law for cheating and misappropriating public funds and property throughout her 11 year rule as described in Victor Ivon’s famous book ‘Bandit Queen’.

          But I commend CBK for one thing. That is; not letting your bugger gal-Ranil win that 2000 election and become the President. Had gal-Ranil won the Presidency that year by chance, Sri Lanka would have been two countries. If remained a ‘one country’ it would be like Syria now.

          In less than four years MR had eradicated the terrorists and promoted an absolute peace to the entire country. Today, unlike Arab spring countries, people of Sri Lanka enjoy democratic freedom. They can have protests and elect their own local, provincial as well as central government even before due dates. Inflation and unemployment is down and growth is over 7%, much higher than India. No wonder separatists are moaning. But MR is winning every election.

            So given that choice people would rather say yes to CBK
            and would make a coalition together with UNP.. that will then allow Ranil to do gentleman politics safeguarding the respect and dignity of the nation. Latter is what lacking at the moment.
            So, people will get this soon, today is better than tomorrow.
            Ones that respect dignity, respect, law and order will rally round to form a new coalition with UNP… Rev. Sobitha will help them abolishing the current excutive presidency. CBK will have no deisire to rule the country, so people will have to chose their future leader. That is it. Those who support CBK within UPFA will no doubt join them soon. These are the realities in this country soon.

      4. The Considerate Ethics of the Sinhala Buddhists and that of the Sri Lanka State created an environment for what they are doing to you and the lies they perpetuate.

But the man seem to be REACTING a dog that underwent SHOCK THERAPY, being that frghtened to express his critque against Brutal MR REGIME… directly the man MR why ?

          I really dont know why the people react as if they are powerless.

          Even if we are all aware of the fact that BRUTAL regime ´s performance has reached its all unbearable margins…. nodoubt more will vote MR guys into power…

          As one who has not lived inthe country for the last 3 decades I question myself not once several dozens of times, why over 93% literate nation react to the very manner as Paksitanis or Morroccans (whose literacy rates are lower to 50%) do.
          I guess our people are easy vulnerable targets for any kind of frauds. They just look the surface and get cheated easily.

          If senior profesionals like Srinath Perera and the like or some have come from longer stays in abroad (usa) may clean the nation is my great hope. We need more of the mentioned kind of candidates to gear up the nation. They will surely be exemplary to this nation making new better canddiates to face the future corruption less politics.

    What CBK complains of and suffers is inflicted on hundreds of others in society too. In the Tamil North it is worse and unspeakable.
    The similar sins, grossly illegal acts, were committed during CBKs regime. Some of which perhaps some under her directions, including the one in which armed gunslingers in her chosen favourite gang in the STF machine-gunned the Chinese-Restaurant of a former politico (now Ambassador) at Queen’s Road off R.A. de Mel Mwa in Cbo 3. Remember the same gang made a similar attack the house of the late Lasantha W. When out of powere she refused to go to visit her favourite “thug in uniform” in prison when he was taken into custody by the Rajapakses. She too is party to the state of a failed society that we have been forced to.

    I do not say she has no cause for complaint here. But she clearly sowed the wind and now suffers reaping the whirlwind. All these people are responsible for ruining a once peaceful, united and respected country.

      I bet Man-gala must be giving all hopes to CBK that she would be the common candidate at the coming up presidential election.

      But the JVP knows by experience that CBK’s promises and agreements to abolish the presidency are not worth the paper it is written. Besides, Gal Ranil wanted to contest the presidency this time around. SF thinks he won the last Presidential election and therefore he alone can beat MR todate. Sobitha is working hard to be the compromise candidate. I say, chance of any of them winning the Presidency against MR is no better than CM Wiggie winning it.

    This criminal family from deep south is not only suffering from inferiority complex but suffering from superiority complex as well. Individuals with a superiority complex often exhibit a sense of grandiosity.     If this is the case for a person like you, you can imagine the situation of others. The day you dissolved a democratically elected government with the advise of THEN JVP, thats the day you gave the green light to kill the democrasy thus paving way for a megalomaniac lunatic to succeed you.

In Nurenburge Trils declared the Nazi Gestopo as a criminal organization and comdemmed these activities as crimes against humanity.     If a former president of the country is fearful O&G the Rajapaksas imagine the plight of ordinary citizens. The great dictator is getting more paranoic as he collects more and more enemies. This shows he is weak and insecure with increasing criticism from within and from outside the country. His time in power is coming to an end and I hope it is as violent as the violence he perpetratedon his adversaries.

    Chandrika committed several critical errors during her rule. Appointing the current monster to head the SLFP was the worst of them. While the CJ appointment set the stage for her own premature demise. All of the bad choices were made in the belief that championing the underdog or the scum bucket will yield loyal and supplicant subjects. The lessons were never learnt but repeated on a much grander scale by the current monster. However, just dragging her misdeeds to sling mud at her as if somehow this would justify the current even worse situation is missing the point and done with malicious intent. That the head of state is allowed to carry out this vicious vendetta and I have no doubt that the allegations are all true knowing the nature of the man she accuses is disgusting. There is not much left of a proper functioning democracy.

    Look who’s is complaining – Chandrika Bandaranaike
    Kumaratunga, former President and Minister of
    Defence.

    The way she used the then National Intelligence Bureau
    (NIB) for matters which were far outside national
    security interests is highly deplorable. How many are
    aware she was poking her nose into the love affairs of
    many a minister, learning the personal lives of her
    political opponents and initiating illegal action against
    them.

    There is a serious flaw in her letter. She says NIB
    operatives were visiting the residences of her friends
    and hotels. If that is to be believed, she is a compulsive
    liar. The NIB ended with her reign. What is in place now
    is the State Intelligence Service.

    Whilst in no way condoning any illegal surveillance, if
    that is true, Chandrika is the last person who should cry.
    Volumes can be written about her misdeeds. If she challenges
    this letter, I will come out with a few matters that will
    shut her up for life.
