LfD Urges Rejection Of Report Of 7 Members Of PSC On Impeachment

“In the circumstances, we urge that no further proceedings or steps be taken on this  report, which is the report of the Government MPs of the PSC.  LfD and all its affiliates unreservedly reject this report as being bias, made contrary to Rules of Natural Justice, basic principles of Rule of Law.” says Lawyers for Democracy.

We publish below the full text of the statement;

After carefully monitoring how the impeachment proceedings were conducted and studying the developments based on confirmed media reports, LfD is of the view that the Report of the 7 Member of Parliament (representing only the Government) is totally unacceptable in any standards. We have learnt how the Chief Justice was humiliated by two MPs in the Committee and how the CJ was compelled to withdraw from the Proceedings before the Committee. Thereafter the 4 Opposition MPs also withdrew due to lack of procedure and unfair treatment meted out to the Chief Justice. The Opposition pointed out that the procedure adopted is contrary to the basic practices and courtesies that should be extended to the highest judicial officer of the country.

LfD is shocked to hear that the Government MPs of the PSC had called witnesses, contrary to their own ruling that the witnesses were not to be called. Basic rules of natural justice and Rule of Law requires that a e defendant be given sufficient time to prepare for the trial, which right was not given to the Chief Justice.

    Should the possibility of the President trying to do this, through a independent committee, be also considered. He may be trying to find a face saving way to get out of the quagmire. This may also put to rest once and for all the accusations against the CJ, provided the committee is truly independent, has the expertise and is above board. The CJ can continue to be effective and command even greater public respect if she is proven innocent of all the charges against her. If not, she will lose her moral authority and be subject to much sniping.

    We salute the brave lawyers and concerned citizens for taking up the important issue with a view to protect the Rule of Law that is diminishing day by day and as a result the President has now publicly accepted the illlegitimety of the PSC report………..LfD may file a case against the NDB/ Banks for revealing bank details of CJ to 117 MPs without a court ruling. If banks reveal A/C details to 3rd parties, in the future, the thugs will have a better time. I also recommend our readership to read Mr. Lal Wijenayakes’ book entitled ” Independence of the Judicery since independence’to understand the gravity of the problem.

    President is again trying a fast one. He has no authority to appoint a rview commission. President cannot make his own laws and procedures. Everything has to be done strictly according to the constitution and laws of the country.

      Quite true Safa, he is looking for an escape route. He never expected the CJ to be so brave and thought she would resign. Why should she resign if she hasn’t done anything illegal. The general public as really fed up with this dictator and the people have found a brave, honest, clever and a highly educated person to lead the country and save us from the present rogues. The support that she has got is unbelievable and if she comes forward, the Rajapakses will be isolated.
