Mangala “Samayang” Samaraweera Strikes Again!

In his speech to the high level segment of the UNHRC session in Geneva, yesterday, Minister of External Affairs Mangala Samaraweera pledged a Third Republican Constitution by our 70th Independence Day (next Feb 4th), declared that “a Referendum is imperative”, opined that 69 years since Independence were “a failed experiment” and concluded pompously that we have to “put an end to that era”.

None of what he said seemed to have had the approval of the Cabinet or reflect the views of the elected executive president. This evening (March 1) appearing on T news, the Deputy Speaker of Parliament and SLFP MP Chandima Weerakkody reiterated while reading out the relevant portion from President Sirisena’s Jan 2015 manifesto, that the winning candidate had pledged to enact such Constitutional reforms as did not require a referendum. Thus Mangala Samaraweera’s latest Geneva speech was an exercise if not in unilateralism, at the least in a tendentious and contentious interpretation.

His speech, with its clear implication that Sri Lanka was a failed state and his conscious attempt to commit the country to the Referendum Trap of secessionist or proto-secessionist Tamil nationalism, left one wondering whether he was the Foreign Minister of Sri Lanka or of the Tamil Diaspora, especially the Global Tamil Forum/British Tamil Forum.

What exactly is the “Referendum Trap”? Last week, on the evening of February 21st at a public seminar of “The Constitution, Reconciliation and You”, organized by Sri Lanka Inc., the real strategy and battle-plan of Tamil nationalism was revealed or uncovered.

In my speech on that occasion I had made the point that Sri Lanka needed constitutional change but not a change of Constitution. I drew the distinction between ‘structure’ and ‘system’, making the case for structural reform but standing firmly against the replacement of the state system, the state form as enshrined in the Constitution. Arguing against me and much more importantly against the perspective of the SLFP and the JO as stated in Parliament and outside, Mr. Sumanthiran, TNA MP challengingly queried as to why we were opposed to a referendum at which the Sinhala majority had the opportunity to shoot down the new Constitution, and why we were for a mere reform which could be enacted by a two thirds majority in parliament.

Addressing Parliament on Feb 22nd in a 90 minute long speech (a written text) Mr. Sampanthan pushed the case for a new Constitution and a referendum. He was assisted by UNP Minister Mangala Samaraweera who made a 30 minute speech (also from a written text).

The real question was not why the SLFP and JO were against a new Constitution but why the TNA preferred a risky referendum at a time in which incumbent administrations were losing referenda to nationalist-populist protest votes throughout the world. Why did the TNA not prefer the far safer and surer option of one or more amendments that could be enacted by a two thirds majority in parliament?

At the seminar on Feb 21st, I ventured an answer to the riddle—and neither Mr. Sumanthiran nor Dr. Wigneswaran rebutted me. I expressed the view that what was more important for Tamil nationalism was not winning or losing at a referendum but the very holding of the referendum! For the Tamil nationalist project what matters more than a new Constitution is the referendum itself!

At a referendum the Tamils can be counted on to vote en bloc for a non-unitary model and call it a plebiscite which rejects living in a unitary state. It could be billed as an assertion of Tamil sovereignty and self-determination as a nation, and a huge endorsement obtained in the North and parts of the East.

The Tamil nationalists pulled the same number at the general election of 1977 at which they called for a vote on the single slogan of a ‘an independent, sovereign, secular, socialist state of Tamil Eelam’ and swept the board in the North as well as part of the East. It is that electoral result that was hawked throughout world as a mandate for Tamil Eelam.

Theirs is an exit strategy from Sri Lanka—let’s call it ‘TEXIT’ (for ‘Tamil Exit’). Either (A) the new constitution is passed at a referendum, in which case they will have the benefit of a weak, non-unitary, de facto federal state in which the majority will fragment along provincial lines under Chief Ministerial warlords while the Tamil-speaking North and East will be magnetically drawn by the demographics and geography of neighboring Tamil Nadu into a separate existence, or (B) the Constitution will be shot down by the Sinhala majority but the massive ‘yes’ vote in the North and East (Trincomalee district) will be the stepping stone for a Kashmir-style permanent civic uprising and a call for external intervention.

Given that Tamil Nadu is to Sri Lanka what Florida is to Cuba, with its attendant electoral dynamics, a Bangladesh/Kosovo outcome down the road is almost inevitable. The referendum is the first step in the process.

    The real question was not why the SLFP and JO were against a new Constitution

    Jackal Opposition aka JO which is UNP – thieves jumped to the Mahida Rajapske govt for escaping prosecution, thieves that were in the SLFP and CIA agents of all the leftist parties. There is a RAT in the SLFP- side by the name “CBK”. CBK wanted destroy Sinhala dominence in Sri lanka. So, the Jackal opposition is careful not to offend CBK because they loose nomination papers.

    Maithripala sirisena is voted by the people though it is CBK, Ranil and Mangala who presents all the politicy directives even though they don’t have any mandates. Even with Mahinda Rajapakse govt the major problem was Politicians using the system to steal and Mahinda Hekped those and enjoyed. People got elected Maitheipala to stop that. Instead, Maitheipala sirisena has a become a preacher and he says, how the corruptions occur in the govt but he does not stop. those things.

    So, the constitution is those three peoples’ policy for Sri lanka.

    With respect to the majority ethnic group needs, Sri lanka gone to dogs.

    Doktor(Dostara) Ahangama Silvalage Mario Dayan Jayatillke Silva is clearly dreaming about being Foreign Minister when he not even a ghost of a chance.He was a disaster in Geneva and in fact laid the foundation for dragging the country through the mud until Rajapaksa himself brought the man back.

    Poor DeeJay is no match for the high performing Samaraweera who in one marathon spell of 2 years brought SL back to international acceptance and respectability.Samaraweera has that natural suave ability and practical intelligence in him besides having a pleasing personality which DeeJay unfortunately has not been endowed by nature.( just have a look at the morose look in the photo above and judge for yourself.Even Sanja will concede this point!)

TNA, UNP, Maithree SLFP, SLMC, Champika’s party and few others are all supporting a new constitution the only group that is opposing is Mahinda’s SLFP members who have stolen money and JO who have no voter base and all are racists. Unlike your lies to United Nations, the present Foreign Minister is speaking the truth at the United Nations. So at least be honest in your writing.

    There is no doubt that Srilanka is a failed state and the current constitition is fundamentally unsuitable in terms of structure and system. The current constitution failed to proect its citizens to provide basic rights, completely wiped out the rule of law and justice system. This is a state though it is very small with highly educated population had massive mass scale massacre of civilians where the state constitution couldn’t do anything to stop or prevent these massacres. The law and order and justice system completely failed and it was much worse than the nations where dictatorship was brutal. This constitution could not stop Buddhist Sinhala Fundamentalism took control of law and order, justice system, military infrasrture and Sinhala Nationalism superseeded the Constitution.
    Dr. Dayan talks about Tamil Nationalism but he hide the fact that Buddhist Sinhala Fundamentalism and Sinhala Nationalism was the real cause of Tamil Nationalism and the cause of failure of Constitution. Today, it is the Sinhala Buddhist Fundamentalism lead by Mahinda Rajapakse with the ill advise of the cunning Dayan Jeyatlake and his other crooks took the country to face war crimes and human rights violations and genocide of Tamils in the international level. How on a world, a diplomat like Dayan gave advise to murder all surrendered LTTE members and its families after winning the war? It was done purposely by those crooks to create a bad image of the State because he was taken away from power.

      Any number of constitutions or referenda will not change the miserable fate of Tamils living in their own land under subjugation by the military, which has forcibly stolen their homes, lands, livelihoods, and human rights, and caused them to live as second class citizens.

      This so-called new constitution is only to strengthen the existing military regime and confer enhanced benefits to all politicians.

      Dayan J is a man who, while in UNHRC even suggested a referendum on the British Monarchy – and was laughed off the Council by all.

    Petroleum Resources Development Minister Chandima Weerakkody yesterday said the government would not introduce a new Constitution. Instead, the existing Constitution would be amended, he said.

    Addressing a press conference at the Ceylon Petroleum Corporation in Dematagoda, the minister said that the current Constitution would be amended in keeping with the mandate President Maithripala Sirisena received at the last presidential election.

    Whatever the UNP might say, the government would not replace the present Constitution with a new one, Weerakkody said.

    You hit the nail on the head. This is why the Indian American is plotting in Sri Lanka for as well. So are the Indians in one way if they feel China is still too cosy with Ceylon. It is the americans who are plotting and also already making Satellite and other surveys of Trincomalee. Their joint exercises with the Ceylonese armed forces in Trinco were excuses to test their weaknesses and test the strength of US Marines and also to ensure landing. This is how the referendum will unravel. It is defeated but voted overwhelmingly by the Tamils.

    They take that as a Victory to the US and to EU. They declare recognition immediately when TNA and Wigi declare independence. By then Sri Lanka would not have Russian or Chinese support. Russia will go along with the Trump USA. So Marines will land and take over Trinco claiming it is to prevent genocide. They already have all the data about water levels, tides, depth space capacity of all the ports in Ceylon. Mark my word in 2018 Tamil Eelam will become reality. Your sinhala Kavun eaters will have to stuff bananas down your trousers. End is near. Ask the American ambassador and the Indian high commissioner. Eelam will happen in 2018 without a shot being fired. CBK and Mangala will be ecstatic. Final we Ceylon tamils can come home. No shots fired. Sinhala people will get their rears reamed.

    This article is a good indicator showing clearly the mentality of former Administrators of Sri Lanka towards Tamils. The author is clear that no solution should be made giving Tamils some autonomy for taking care of themselves. See hid thinking below:

He is not worried Sri Lanka needs to pull out of its precipices and level up to a world order for the future generations of his Countrymen. His only worry is Tamils are getting a deal from the new regime! He is further pulling back the Country from allowing the International community help the Country. For him those trying to do something beneficial for the Country are helping Tamils!. Is there anybody who can make him understand it is his thinking from the time of independence that brought Sri Lanka to its present state.       A referendum should be held among all Tamils (Tamil speaking people) in the island if they wish to establish a Tamil Homeland in the North/East. The rest of the country will be declared Sinhala Homeland, implication of which will be all Tamil speaking people living in the Sinhala Homeland will be required to physically relocate themselves into the Tamil Homeland .

        Wrong.

        Alternatively, the proposed constitution should be approved by a referendum (will of the people). The constitution should have the powers to grant the noisy minority Sinhala/Buddhist the right to build their own ghetto in the deep South, in an area not more than ten square miles, with a condition that all such registered noisy minority are to be made stateless and expelled to their promised land (the Ghetto).

        If you want you can merge your ghetto with China.

        What ever the referendum it should make it clear if Tamils can make a Tamil homeland, sinhala people should have theirr homeland and tamils and muslims should go to their homeland whether it is in Yapanaya or kathankudi.

    The promise of referendum on NE province merger in the 13th Amendment was not fulfilled.Reform SL into a more ethnic & religious tolerant country in North and south first. Constitutional change and referendum might be a risky job.

    The well articulation is not always a good analysis. Dayan’s articulation is like that. Dayan has been trying to manipulate his project by the name of defending Sinhala nationalism. In his view, Sampanthan and Sumanthiran are trying to get support for their Tamil nationalist project through referendum. In fact, it is Dayan’s delusion.
    In fact Sampanthan and Sumanthiran are not Tamil nationalists. Dayan also knows this well.
    Why Sampanthan has urging for a referendum? Answer is very simple. Samanthan has asking referendum for escaping from the political trap which is pushing him to leave from the engagement with the Ranil – Maithiri government. But Tamil will vote if there is a referendum. The referendum definitely didn’t consisted the federal demand and north – east merger. There is no barrier to get Sinhala votes on referendum if those two things are abundant in the constitution. This is the Sampanthan hidden plan.
    If Tamils vote for the so called new constitution then Sampanthan can just say that Tamil would give up the idea of federal demand and north – east merger those were the key demands of the TNA and TULF since 1972.
    Perhaps if the issue is resolved by 20th amendment, Samanthan cannot escape from the trap. That’s why Sampanthan harping on this matter. Actually, Sampanthan helped to Sinhala people not to Tamils.

    This is the main problem with this government and its leaders; even Ven. Prof. Bellanwila Wimalarathana Thero pointed this out again in a recent meeting. That’s why investors are scared to invest in Sri Lanka. Those who had invested take out their investment and go out of the country. Isn’t this anarchy? If not, what do you want to call it?

    This is despicable.
    A learned doctor resorting to underworld language to insult an elected MP of the people.
    I am no fan of Hon. Mangala but the person deserves to be treated with respect on print.
    Wonder if DJ would have dared to call one of the MP’s of the former regime with the name of a underworld character?
