MMDA Reforms: Committee In Shock As “Closed Door” Meeting Opened To All

The members of the Committee appointed in 2009 to propose reforms to Muslim Matrimonial Law and the upgrading of the Quazi Courts, who were invited by the Minister of Justice and Prison Reform Thalatha Atukorale, to a discussion last afternoon with the Muslim Members of Parliament of their Report handed over to the Minister more than a year ago on 22nd January 2018, were in for a shock. The meeting, which was expected to be a “closed door” discussion, was attended by several others as observers, most prominent among them being the member of the Constitutional Council Javid Yusuf, who was neither a member of the 2009 Committee nor a member of Parliament. 

As disclosed widely in social media, Javid Yusuf was one of those who went with a delegation of the Young Men’s Muslim Association (YMMA) to hand over a so called “consensus report” prepared by the YMMA to the Chairman of the 2009 Committee Justice Saleem Marsoof, PC and later to ACJU President Rizwe Mufti and Faisz Mustapha, PC last week. The YMMA report is said to be the product of the deliberations commenced by them at a Conference organized by the YMMA at Hotel Mandarina in September 2018, which endorsed the views of Rizwe Muthi and few others who signed with him and were opposing the progressive reforms proposed by the 2009 Committee. The YMMA had written to the Minister of Justice on 5th February suggesting that the Minister should request Justice Saleem Marsoof PC and Faisz Mustapha PC to study the YMMA recommendations and submit a revised report acceptable to the majority of the 2009 Committee members.

At the very commencement of the meeting, Justice Saleem Marsoof PC who was the Chairman of the 2009 Committee, was asked by the Minister to open the discussion, which he did, highlighting the fact that there was a great deal of consensus in regard to the matters considered in the Report of the 2009 Committee submitted to the Minister of Justice Thalatha Atukorale on 22nd January 2018. He also outlined the areas of contention which were mainly the question of the current disqualification of women to hold office as Quazis, issues relating to the applicability of the law according to their “sect to which the parties belong”, the qualifications necessary to be appointed as a Quazis, and the right of any person litigating in a Quazi Court to be represented by an Attorney at law of his or her choice which is now barred by section 74 of the Muslim Marriage and Divorce Act (MMDA) of 1951. He also said that in regard to age of marriage, polygamy and mata’a for divorced women, there was agreement in principle though there were some differences in regard to the details which need to be ironed out. 

The very first matter taken up for discussion was whether the word “male” should be deleted from sections 12 and 14 of MMDA, which had the effect of preventing Muslim women of suitable attainments being appointed as Quazis when there is no similar bar to them being appointed as Magistrates or to any other Judicial office, and was therefore discriminatory. ACJU President M.I.M Rizwe Mufti strongly objected to the proposal to remove the bar to women being appointed Quazis on the basis that this is contrary to the shariah. Justice Marsoof disagreed, and pointed out that the Hanafi opinion was that women may be appointed to officiate as Quazis, and stressed that sections 12 and 14 of MMDA violated the equality provision enshrined in Art 12 of the Constitution. This was brushed aside by Justice A.W.A Salam, who pointed out that the MMDA was “existing law” and remained valid. He then went on to make some adverse comments regarding the funding of a book written by Justice Marsoof in 2001 entitled “The Quazi Court System in Sri Lanka and its Impact on Muslim Women,” but was prevented by the Chair from continuing since this meeting was summoned not to discuss this book but the Report prepared by the 2009 Committee. 

Justice Marsoof stated that he and some progressive members of the 2009 Committee were targeted by certain ulema who at Jumma sermons expressed the view that some of the reforms proposed by them based on the opinions of the Hanfi school of thought were contrary to the shariah. He said that the great imams of Islam, Imams Abu Haniffa, Shaffei, Malik and Hambal, who founded the four major Sunni mazhabs, and their adherents respected each other’s opinion and were very flexible in their approach to developing the fiqh, and that he was very pained by these Jumma sermons. He said that while it is necessary to consider the opinion of the Muslim community in bringing about reform, which the 2009 Committee had done in earnest, it was necessary to make the Tamil version of the Report available to the Muslim public and give them time to study the contents of the report before consulting them in regard to the proposed reforms, since they have been misled by these jumma sermons.

At this stage Safana Gul Begum, Attorney at law spoke about the need to upgrade the status of Quazis and the Quazi Courts and to redress the abuses taking place in these courts. She emphasized the need to make it compulsory to register all marriages since the absence of registration caused difficulties to women claiming maintenance and children applying for schools. She said that since the reforms deal with marriage and divorce, which involve both males and females, there was an acute need to consult the opinion of affected women in regard to the untold suffering they are made to undergo in the Quazi Courts. Attorney Nadvi Bahaudeen, who has held office in the past as the Chairman of the Board of Quazis, outlined the practical difficulties faced by Quazis and made some useful suggestions on how they may be removed through administrative measures. 

Hon Mujibur Rrahman then proposed that since there is no time to consider all matters in detail, a committee be appointed consisting of Justice Saleem Marsoof PC, Faisz Mutapha PC, Sheikh Rizwe Mufti and Constitutional Council member Jawid Yusuf to attempt to reconcile differences of opinion in a manner acceptable to all members of the 2009 Committee. Attorney Razmara Abdeen stated that the 2009 Committee has completed its task and handed over its Report, and the ball is now in the court of the government to implement the Report. 

The Minister of Justice agreed and said that administrative measures will be taken to redress some of the grievances of the Quazis and litigants. The Minister of Justice also said that there was wide consensus that the Muslim Marriage and Divorce Act requires urgent amendment, and that it was also necessary to take immediate steps to publish the Report of the 2009 Committee in Tamil and go ahead with the proposed reforms in consultation with the Muslim members of Parliament. The meeting was attended by Minister of Justice Thalatha Atukorale, Ministers Rauf Hakeem, Rishard Bathiudeen, Abdul Haleem, A.H. M. Fowzie, State Ministers Ali Zahir Moulana and S.M.M Harees along with other Muslim Members of Parliament.

                All what you are say are not part of Islam, these mythical stuff and superstitions intruded among few Muslims in some countries due to regional and cultural influence of mostly Hinduism like how some Muslims in SL followed Tamil rituals unknowingly up until recent times. For example, when we observed the recent solar eclipse, many people including Sinhalese and Muslims in SL, believed that cooking food was bad during the moment. But not many knew that it was a Hindu myth and scientifically not true.

Why do you fight when these Kovils that don’t belong to your original identity are destroyed by Sinhalese or Muslims in SL? Are you lacking any reformists?

            Do you know in the US, in 17 States there is NO minimum age for marriage? And in 13 States, the minimum age varies between 14 and 18?

            The only Muslim country with No Minimum age is Yemen, while, in case of girls, Iran comes next with 9 and Saudi and Sudan 10. Other Muslim countries range between 13 (Brunei) and 20 (Libya)

            So, you have to start your campaign for fixing the minimum age for marriage for girls in the US. So STOP babbling here and displaying your woefully pathetic ignorance.

    The Quran can be interpreted in many ways, and we do not have to follow the interpretation by Saudi Arabia, that is primitive, and even abusive to women. These Mufti’s seem to want to follow that route, and discriminate our Muslim women here in
    Sri Lanka. Women in Sri Lanka should all have the same rights, and that includes the legal age to marry. That will prevent the rape of young children, and when it comes to divorce, Muslim women should have the rights to child support, at the very least.

      Interpretation of the Quran different from the Wahhabi-Salafi and Orthodox versions, i.e. reformed versions , would lead to loss of hegemony for the Ulama, and not acceptable.
      See Quran 3:7. According to Ibn Rushd, the Ulama are Not the people of knowledge, but the philosophers, who have wisdom.

      So, the Ulama got the ruler to persecute Ibn Rushd, aka Averroes, exiled him, and got the philosophy books burned.

    Its shame to say that this Rizvi Mufthi and other Mufthees in Sri Lanka, most probably do not have even GCE Ordinary level certification.

    They went to Pakistan and Taliban Styled closed madrasa they spent their time after spending kind of cage life in Sri Lankan Madrasa and he and other mufthees cannot understand the world realities.

    They have the problem of letting Justice Saleem Marsoof taking the chair as they think they deserve this chair more than Justice Saleem Marsoof.

    These Mufthees read some books in Sri Lanka and Pakistan Madrasa in Arabic and Urdu that are customary practices of some Arab villages almost centuries ago.

    They were dressing Pakistani style dress and even think that is the dress code of Islam.

    Other counsels who are around the Mufthee are having kind of personal account with Saleem Marsoof and they use this opportunity and let Rizvi Mufthee disrepute Saleem Marsoof.

    Also, there is no single article written by these mufthees with regard to MMDA and they presence in these kinds of the forum to tackle any social matter is nothing but utter shame just like Butcher is carrying out surgery are a hospital.

    This Mufthee cannot come with a document explaining the sources and fundamental principle behind their understanding that different from what Saleem Marsoof proposes.

    It seems the minister also wanted to have a big show out of this and she plays lots of unplanned games as they want to keep some topic to show to the public as they are working.

      There is no controls what so ever by these mufthees of ACJU on the Muslim community and they were not selected in any transparent form. It’s becomr a union of those who spent their time for some time in Madrasa that was formed to earn for to fill the stomach of those mufthees as they don’t have any competence to do any other job .

      Only thing they do is announcing Eid festivals holidays that also not inline with customary traditions of Muslim community as per moon sight but to satisfy textile businesses to make more sale by delaying the Eid festival beyond the exact day.

    Sometimes it remains a question whether prophet Mohamed was right in getting married to a girl child of age 6 and consummate at the age of 9. How can logical arguments prevail, even among muslims?

      A country’s law must be respected by any means. But in the case of MMDA, it is an accepted law in SL and Muslims follow it.

      For the sake of logical argument:
      When it is the nature that decides if a woman should be fertile, and make a little girl go through puberty, preparing beginning of adult sexual life, why should a country’s man-made law determine that? Again, this age factor is not universal. Different countries have different ages set to determine this.

      Prophet did not marry any female prior to attaining puberty, and at that time there was no Law that said a girl entitles for marriage at so and so age, even among the West.

      What are the reasons as per you that countries have the law to determine this? I doubt you know that.

      This was a 7th-century custom, and there is controversy about the age when the marriage was consummated; the current research suggests, at age 18.

      Sunni and Shia are not castes, that is a theological division based on opinion of each sect who should succeed the Prophet. There is nothing like ‘one is superior to the other’. There is no Shia-Sunni discrimination in Quran.

      Memon and Borah have nothing to do with sects in Islam or plays any major roles, they are just 2 (closed) communities with Indian origin. Memon who follow Sunni sect, originally from Sindh, India. Borah who follow Shia sect, originally from Gujarat, India. They arrived in SL for doing business.

      Wahabi or Wahhabism is a movement founded much later by a theologian, Abdal Wahhab just like RSS’ Baliram Hedgewar and Golwalkar or BBS’ Gnanasara with a view to strengthen the religion through extremism

    First step to reform…get rid of the Business man parading as a cleric, Rizwi Mufti.
    Then, investigate the Jamiathul Ulema.
    Then, most issues from Halal to Shariah interpretations will be gone. Note I say interpretations because that is what all these statements are. Muslims are supposed to apply these Quranic principles and Prophetic practices to their lives as deemed suitable. Some things are expressly banned and those are not up for interpretation.
    Islam is a very simple religion. It has NO clergy for this very reason. Characters like Rizwi are beneficiaries of people’s lack of proper knowledge. They will never give up the benefits they get, very easily.

    Sri Lankan Muslim community is exactly same as SriLankan Bhudhist community. The Buddhist monks in SriLanka are divided on their own and they are isolated from the mental and spiritual quest of the people and having power competition within and they too don’t have much time to understand real social issues and demand to establish national policies that ensure ethical standard of poverty free nation.
