Mohan Pieris’ Misconduct Case: ‘Deshapremi’ Threats Against Challenging The Single Judge Ruling

“I strongly suspect that those who do wish to suppress the serious misconduct charges levelled against Mohan Peiris, are behind the threat posed to my life. Therefore, I once again request the police to investigate into this matter without delay and notify me with the outcome.” says Nagananda Kodituwakku, the lawyer who challenged Mohan Pieris’s dishonesty and misconduct, concerning the defrauding of 619 million rupees of Public Funds.

Counsel Nagananda Kodituwakku has made the second complaint to the police regarding the threats he received.

On February 1, 2013 Justice Sathya Hettige refused to grant leave to proceed in a Fundamental Rights application challenging the misconduct of Mohan Pieris during his tenure as Attorney General.

“Action is being taken to file papers challenging the single judge ruling in (SCFR/536/2010) refusing leave to proceed, which is obviously flawed since that ruling clearly violated the Section 126 (2) of the Constitution, which specify that presence of two judges is required to consider a FR application for leave to proceed.  I believe that may be the reason for further threats.” Nagananda Kodituwakku told the Colombo Telegraph.

We published below the complaint in full;

I, Nagananda Kodituwakku, 58 years of age, a British Citizen, Sinhalese, Buddhist, Attorney-at-Law and Solicitor (England & Wales) by profession, domiciled in England and currently in Sri Lanka, at 99, Subadrarama Road Nugegoda, do hereby state as follows.

I make this statement further to the statements already made to the police on 23rd January 2013 and 31st January 2013 about the threats posed to my life, apparently for representing the Petitioner in the Fundamental Rights Case SCFR/536/2010, that challenged the alleged dishonestly and gross misconduct of Mohan Peiris, the then Attorney General.

I have already reported to the Police about threat to my life posed by electronic mail by somebody identified themselves ‘deshapremi’ and provided the details of their email address, requesting to initiate inquiries into the matter. And today I received another email from the same group, threatening me to abandon the case altogether (a copy of the email received today enclosed herewith).

On 01st February 2013, The Court declined to grant leave to proceed for the case referred to above, and as per the instructions of the Petitioner in the case, a revision application would be presented to the Court in few days, seeking reversal of the order made by the Court, for the obvious reasons set out in the application.

    Best take all neccesary precautions to protect oneself. You cant rely on the police in sri lanka who are hand in glove with the politicians. These deshapremi groups are the armed wing of the regime. Keep your actual location a secret etc.

    Though we cannot expect justice in today’s Sri Lanka, we have to keep fighting for justice as it will once again prove that there is no rule of law here.The mighty violate the constitution of the country without giving a second thought to it mainly because there is no strong movement against the regime.As the the UNP has abandoned its responsibility, the intellectuals of the country have to come forward and form a mass movement.

    This is going to be a great concern of the UNSCR meeting to be held Geneva in March. Entire story of the new appointments and why the head of state apointed a candidate with an abusive record following his uninanimous impeachment process that was illegally held not respecting international norms should be explained in the session in an comprehesible langauge to the UNO summit. I really dont think that MR and the supporters can make the majority folks in the country fool, but always not the International communities. Just to let the ALLARMING ISSUE GO disappeared in the carpet, as had been many other investigations of high concerns are becoming common to current srilanka.

    Country´s president seemS to have no sense to feel all these as no previous presidents had been in the past. Nor issues he any statements about the issue. Excuses are based on the mamuth tasks on LLRC impelementations, but Rajiva of REGIME reiterated that the move with implementations are painfully slow. And Canadian ministers have criticised this loudly and would raise the issue agian and again in the summit. Right at the moment, I personally did not get any article detailing what president would say about all the current problems – instead his big mouth allows him to make rhetoric that could harm the ethnic minorities meeting with their wound points. Also he seem to be enjoying his tours latest to the India then next to other locations of his choice – not even uttering a word of the need. Common man is reported to be suffering not being able to surive the life with sky high prices of the food items. Vegetable prices have gone up to unbearable levels while people incomes have not been changed.

    In the present climate of increasing authoritarianism by the Rajapaksas Sri Lanka needs people like Kodituwakku, Weliamuna, Saravanamuttu and others to take a stand against injustice, impunity and corruption.

    It is a very sad state of affairs that Mr Kodituwakku had to ask twice for police protection to defend freedom to challenge injustice. The sooner this regime is toppled the better it would be for the country and its people. These challenges show how hard Rajapaksa has been rattled and now having to seek divine intervention to keep himself in power.

      Interestingly, the regime is seeking devine intervention whilst playing pea and thimble games with the gods. One of the Maha Nayake’s was sent to Australia with a mini entourage to pray for the President from overseas whilst the President toured India with 70 memeber entourage to pray from there. The gods must be in a spin to see where the prayers are coming from.

    While appreciating and honoring all your brave efforts, it is expected that you would take good personal care.

    I also wish that you would build up important alliances, professionally, so that, every step that will be taken by the judiciary in denying minimum accepted levels in the Supreme Court will be recorded. It is useful to note, in a similar case against Mohan Peieris, by CPA et al; the journal entries by this respondent will count as a huge victory, as it stands out – not just empty accusations – the below accepted level of functioning by the judiciary, now.

    I very much doubt this case will be given a fair hearing, as it has such incriminating, soild evidence, backed up by official documents by DG customs etc;.

    So having a careful legal strategy that backs up the courage will make the regime more and more exposed, along with its acolytes in the SC.

    Hat off to great son of Lanka!You, Mr. Kodituwakku, being a British citizen, I think ` the Deshapremi gang led by `you-know-who’ might think twice before causing you any harm. However, why don’t you keep your government informed officially about the risk you are exposed to!

    Mr Kodituwakku is a close fried of mine. Foreign and Commonwealth Office in the UK is fully aware of Mr Kodituwakku’s every move in this case and also about the threats to his life by emails. In fact, I am aware that the Police have been provided with the IP address of the so-called ‘Deshapremi’ to locate exact address of those who are behind all this threats.

      Even if the IP address of ‘Desapremi’ was provided, the police would still come upon a blank wall if the threatening messages originated from one of the numerous inter net cafes which are spread around the country as they are not required by law to obtain any form of identity from those who patronise them.
      The fact that he is a British domicile may be a safeguard for Mr.Kodituwaku but in the end British too have to rely of the SLG and it’s corrupt police.
      In such circumstances it is he who has to take utmost precautions to ensure his safety.

    The gang is so dizzy with power, they have lost their sense of discretion. In fact, they have lost even the sense of what is right and wrong in the absence of the thing called conscience!

    What is this british citizen doing in Sri Lanka……..
    If SL or deshapremi want to harm NK they would not care two hoots and certainly do it whether he is a British citizen or otherwise.

    If NK feels that he has genuine threats, he need to return to the UK. Why must GOSL protect a UK citizen in Sri Lanka?
