Nagananda’s FR Petition On Current Crisis: Whose Cat’s Paw Is He?

The rise of Nagananda Kodituwakku to the national forefront has been rapid. With his rhetoric to rid society of corruption, the general public have naturally turned to him as a true knight in shining armour.

It is in this hope that the people of this country eagerly followed what was said and done by Mr. Kodituwakku. To many he came across a man of principle and vision to end corruption.

However, some had doubts as to what his true motive was and who his true puppeteer was. Actions speak louder than words, and sometimes words and actions both give out the true nature of the man.

The constitutional crisis created by President Sirisena by unconstitutionally dismissing Prime Minister Wicrkamesinghe and appointing Mr. Rajapaksa as the new Prime Minister appears to be the catalyst that truly exposed who Mr. Kodituwakku actually is.

Mr. Kodituwakku in a huff and a puff filed a haphazardly drafted Petition to the Supreme Court stating that his Fundamental Rights under Article 12(1) have been violated by the Prorogation of Parliament and seeks an Order from Court to annul the Order of the President proroguing Parliament. However, Mr. Kodituwakku takes the view that the removal of Prime Minister Wickramesinghe is constitutional and legal. This could be due to one of three reasons. First could be that Mr. Kodituwakku genuinely believes that the Constitution allows for it. The second is, his despise of Prime Minister Wickramesinghe compels him to justify the dismissal. Third is that he is being motivated by an invisible hand to do so. If it is the first, it’s simply his ignorance of the law. If tis the second, he is an opportunist and nothing more. However, if it is the third, it is most alarming.

The writer is of the view that it is the third for several reasons. Mr. Kodituwakku’s pleadings in the Fundamental Rights case clearly demonstrate that it has been designed to fail, thereby derailing any genuine effort to challenge the unconstitutional acts and bolster President Sirisena’s stance that the prorogation of parliament was correct and endorsed by the Supreme Court.

The first mistake Mr. Kodituwakku has made in the draft is that he has decided not to name Mahinda Rajapaksa MP as Respondent. Though he states that Mr. Rajapakshe has been appointed as the Prime Minister, Mr. Kodituwakku very conveniently omits the name of the present (right or wrong of the appointment aside) Prime Minister. This would probably give a ground to claim that the Petition is defective and that necessary parties are not before Court.

The second mistake is that Mr. Kodituwakku names Ranil Wickramesinghe as the Prime Minister in the caption and then in the body of the Petition states that Mr. Wickramesinghe has been removed from office lawfully.

The question that begs to be asked is, why would you not name the man whom you claim is now holding the office of Prime Minister, and only name the man whom you say has been lawfully disposed of the office of Prime Minister, unless your sole objective was to have a doomed start to a case of this magnitude and importance.

It appears that by design or otherwise, Kodituwakku has played into the hands of President Sirisena, who was left high and dry with his ill-advised (or possibly with no advise) move to oust the Prime Minister in blatant disregard to the Constitution. By this move, Kodituwakku comes out a winner – he was the only one who went to Court, but he also gets the opportunity of blaming the Supreme Court that its “judicial corruption” (a famous catch phrase used by him) which resulted with the dismissal of the case.

This entire exercise results with the general public being left high and dry. By filing a doomed case, Naganada is inviting the Supreme Court to dismiss a case, thereby allowing the MR & MS fraction to bolster a false narrative that even the Supreme Court has held the decision to dismiss the Prime Minister as being correct. It also prevents any genuine effort by any concerned citizen coming before the Supreme Court with a properly designed case seeking to correct this blatant wrong. So in that sense, Naganada’s ill timed, badly executed move has only strengthened the very forces he proclaims to bring down, making people wonder “whose cat’s paw is Naganada?” surely this is not the work of a loose cannon!

      I have seen Rajapakse Apologist Malinda Seneviratne (Who once saw “nothing wrong in an “adoring public elevating MR to a Maha Rajah” :-) ) now extolling the virtues of Nagananda Kodituwakku. I then realised it would be very useful for Rajapakse if Anti Rajapakse voters were split between Nagananda and the eventual presidential candidate of the anti Rajapakses.

    The unfortunate truth is that about 70 percent of the practicing lawyers in this country either cannot or will not draft a plaint or petition correctly and properly the first time. If they were surgeons they would botch up the first operation and then perform another operation on the patient to correct the shoddy work. Next to politicians, the biggest rogues are lawyers.

    Can you say Nagananda was a corrupt customs official. if you Google, you will read lot of material about how he was dismissed from customs for his honesty and he along with his family had to seek refuge in UK. He accuses JRJ, Ranil and Chandrika backing big vehicle and commodity importers to evade the law.

    Nagananda is a big gimmick. He probably, as somebody has said already, an embryo level or more mature level Old King. Some real or honest people are ending up supporting him because apparently No other Option left. Even in 2015, all other options were exhausted and they went to unknown devil. So, no talk of options this time. But good thing about Nagananda is, unlike New King, he will expose himself & make sure people don’t like him.
    He was suing the SC when a Tamil was the CJ. He withdrew the case as soon a Sinhalese was appointed as CJ.
    We opposed Old Kind dismissing Shiranee B and appointing Mokan Peiris. Same way, we objected when Ranil fired Mokan Peiris, SB and brought Puppet Sropowan without following the constitutional procedures. Nagananda too opposed Ranil, not Old King because, the end result of Ranil’s dismissing were a Tamil CJ.

    Nagananda is not even an MP. Court will ask a reason for why he is in that. He will have to establish that his fundamental right is being violated by president proroguing the parliament with the vested authority in him. (Remember, if that logic holds, there are 22 million are in similar situation and deserve a class action.) I would think that is going to be mountainous step to overcome. There is no doubt that he is doing this for popularity. But unless he has 18B in his foreign bank account, the path he is following to seek popularity is expensive.

    First Nagananda did not say anything, only listening. This argument went on for a long time & Nagananda had to sleep after a rough Friday.
    Next morning, I pushed Nagananda once again so hard, that he must go to courts against this UNCONSTITUTIONAL ACT OF SIRISENA on my argument, representing me as my COUNSEL.
    The VFW here is what U don’t know & will never know !!

    Now that so-called cat’s paw has spoken and is going to take legal action against this “Very Funny Woman”, there nothing much to add to this. Except, we would stand up for Mr. Nagananda as he has taken the right action as always to protect the nation from this evil clan. Our question is that why the editors of this page allow this type of shameless baseless accusations be published on this page like this? On what grounds the author has made these allegations? These statements disgusts us exhibits the level of greed of biased journalists who would even sell their soul for instant benefits. Poor country!

    It is well known that the numerous persons have expressed and offered diametrically opposed interpretations on the legality/constitutionality of the many matters related to this episode. These come from persons of eminence, legal eagles as well as many wearing coloured glasses.The Supreme Court is the only body that can give a binding , final interpretation. Yet, no one apart from Nagananda has taken the step to seek its opinion or a ruling.
    Instead of casting aspersions and making unfounded allegations on Nagananda and his motive, shouldn’t he be commended for being the only person with the courage to intervene on a matter of “this magnitude and importance”, that affects the entire nation , yet shunned and avoided by all including the most effected parties?

    This particular issue is a difficult problem. Nagananda asked only to cancel the gazette notification. Constitution says president can prologue the parliament. Nagananda is claiming that is violating his fundamental rights. Then the question is, is that president violated his fundamental or constitution violated. The answer to that question may leave whom Nagananda can sue. If it is constitution, then JR is dead. 19A opened up president’s some action to be sued. Under normal circumstances one cannot bring legal action against sitting President for his action during discharging his duty. Nagananda cannot name president in the law suit. He possibly could have named the Government Printer for releasing that gazette. Whether to convene parliament on 7th is going to be gazette tomorrow. If that happens, then even if Nagananda wins, there will be no effect. Only time and money lost for nothing. Nagananda may end up withdrawing his case if judgment delayed and parliament starts in the meanwhile.
    Nagananda allure him in troubles. No one can help him. Last time when he sued judges, I understand that court warned of his ridicules actions and wasting court’s time. He was told to withdraw that case and he did. If they decide this case also as one of Nagananda’s unwanted law suit, they may mete out some punishment and sterner warning.
    For his election purpose, Nagananda and Susandhika put out a video blaming lot of law professionals. That is going to be hanging over for some time. Some effected parties going research on Nagananda’s history and hit him back. Others may look for opportunity for other actions.

      Nagananda has the courage, many of us lack to go to Supreme Court(referee) to seek justice.
      There are three kinds of people in this world:

      This observation is timely on a day replete with high drama over a corruption involving an alleged criminal conspiracy to bribe MP’s to keep the power. Only one man fights and at least we should appreciate his courage.

        Are you saying the thief you saw on the road was the only one showed interest in protesting agaiant police brutality? You don’t believe that thief is not trying to take forward his personal interest?
        A common man, usually attends to his own business, out of a witnessed incident’s influence, acted to promote public interest, is a hero. There is an obligation on the part of viewer to evaluate the claim of honesty of his/her action from self-promotion hidden in any action done by a person who has pledged to contest him/her for EP post. If your writing has passed that test, the person you like is hero.

        You need to understand the three mutually separate elements- incidents in the coup.
        1). Old King is appointed as PM- a criminal action violating Constitution.
        2). Ranil is removed from PM position – a criminal action violating Constitution.
        They both can be sued at court.

        3). Parliament prorogued under the vested authority in EP. Not any criminal action- Not under any fascist action. But proroguing parliament for illegal end or trying to achieve a legal end by illegal techniques, even if proroguing is allowed in the constitution, that specific proroguing is illegal. Donkey Trading taken place has to be established in the court for seeks any remedy from court for using proroguing to illegal purpose. Nagananda is not following that path. Proroguing parliament, whether for legal or illegal can be sited as undemocratic if it was attempted to prevent Peoples’ reps using their voting rights. As others are for internal court matters and until there is verdict no further action on that is possible, this undemocratic political action in an opening for IC to put forward its saying. That is the reason all Foreign Government and UN are concentrating on this political topic instead of court cases. The best bet for Nagananda is, instead of taking a lonely desert route, he could have supported Ranjan, Hirunika, Ajith Perera, other UNPyers……. and IC who all are trying to achieve outside court what Nagananda is trying in vain at court.

    This is very correct and is the perception of the majority who have followed him. The numbers will increase rapidly as he gets more publicity , that the so called independent media is not ready to give.

    I think there is corruption in all Govt. depts. but, particularly, the SL Customs comes to mind as the most corrupt. However, I am sure there are some people with integrity in all these institutions. Many are honest by nature but have to go with the flow for survival & turn a blind eye as their hands are tied. In these circumstances, it takes immense courage to oppose the status quo. Until there are specific allegations against NK, I am prepared to give him the benefit of the doubt & accept that everyone is innocent unless proven guilty. Of course, those who are competent crooks will not leave evidence to implicate them, as the case with most of our current politicians but I would expect some specific allegations & an opportunity for NK to defend himself before I make up my mind.

    Until such time, I will support NK in his political bid, if he so wishes, as I am not prepared to go with the known devils anymore. Hopefully NK will be a breath of fresh air in stinking Diyawannwa. It’s time to drain the swamp.

Why doesnt the writer has the guts to name UNPers who are willing to shed blood now to uphold democracy when they have track record of burning sinhalese youth on tyres not many moons ago, has failed to file fundamental rights petition against this so called undemocratic unconstitutional act under UNP’s own bahubooth constitution & 19A hatched by any Sri Lanka mafia aided by $$$ sucker in Kolombian jungle ?

    I am one who has reposed faith in Naganada. There was an article by Grusha Andrews that sought to pour scorn on Nagananda, but I wasn’t greatly impressed by it.
    .
    Grusha’s main complaint was that Nagananda’s English wasn’t “elegsnt”. True, but given the present state of affairs does that matter at all?
    .
    The present article faults the filing of this most recent Supreme Court case on three counts; I well understand the complaints made.
    .
    What about this article itself? Has it not been written by a Ms Dilrukshi Kirindigoda who cannot spell her own name? Why is it that her photograph, like that of Grusha Andrews hasn’t been displayed?
    .
    A few more observations will follow, but let me submit this first. I’ve been reduced to browsing the web with a phone, and have got stymied a few times already.

Those who want to know the reason for initiating this case must watch the video published yesterday by Nagananda (link provided below). Nagananda talks only truth and those unworthy want to tarnish his character publish only untruth. But people are intelligent enough to judge the difference between them.

    Any right thinking,sincere and an honest person who has understood and digested what Nagananda has conveyed to his listeners cannot disagree with him. The root cause of all our country’s ills from top to toe is due to the total failure or absence of our country’s justice system, politicians have virtually taken over the functions of the judiciary. This was quite conspicuous during the last two decades where judgements were dictated over the phone by the political masters. Almost all Govt. MPP and their cohorts enjoyed these and other unlawful privileges. As a result the politicians din’t care two hoots for the law and they were a law unto themselves. In this back drop and in the absence any other citizen or political party Nagananda came forward to explain and educate the people with the limited publicity resources he could lay his hands on and people began to appreciate his genuine commitment to the good of the society. I am of opinion that all who have the interests of our country at heart must join hands with him to usher in a future that will ensure a just and a civilised society with justice to all citizens of our country. None of the political parties so far has dared to challenged him. it is understandable, but I guess some of their agents are making aspersions about his motives and credentials vis- a -vis his sudden entry into SL politics. I for one, like many others totally agree with his views and analysis of the bigger picture of SL
    political landscape. If there are any genuine and honest politicians whose hands are clean they should support Nagananda at least for his clear vision of the problems, absence of which has been the bane of SL.
