National Executive Council has made a unanimous decision to arrest former Defence Secretary Gotabaya Rajapaksa in order to initiate the probe into the Avant Garde floating armoury.

The decision has been made last evening when the Executive Council convened and it has been pointed out that he needs to be arrested in order to probe the floating armoury that was raided at the Galle Habour. A decision is to be made once President Sirisena who is currently in UK returns to Sri Lanka.
However, the National Freedom Front Spokesman Mohammed Muzammil holding a press conference this morning objected to the decision made by the Council to arrest Gotabaya, claiming that they have no authority to make such a decision. He said that whether or not Gotabhaya should be arrested lies with the law enforcement authorities and added that it is the result of a foreign conspiracy.
It has been a few days since former Pivithuru Hela Urumaya Leader, Udaya Gammanpila spoke of a ‘conspiracy’ to arrest Gotabhaya and former President Mahinda Rajapaksa.
Meanwhile the Executive Council had also discussed the investigations intoinformation provided by Wele Suda and it had been decided that all those who maintained links with him should be arrested and the probes should be expedited.

Well, as far as I am concerned one is innocent until proven guilty. We should not subscribe to the norm of the previous regime that one is guilty until proven innocent by a jury appointed by the regime or punished by extra judicial means. Gota should be given a chance to prove his innocence. Our main purpose is to restore the credibility and public fear of the justice system.
I think the government has thought about the repercussions of arresting Gota. Arrest might ignite protest by those who think he was the sole savior of the country therefore he should be absolved. At the same time not arresting if permitted by the law creates even more problems. First, it will give him and his supporters enough flexibility to create obstacles for an impartial inquiry. Second, it also sends the message to the pubic of impartiality of the justice system that is lenient to some. Third, the public elected the new government so that it would bring those convicted of corruption to justice.
What is important at the moment is for the government to show courage to uphold the law regardless of political consequences of doing so.
The President should not allow politicians to interfere with the legal process and protect the legal authorities from influence and intimidation. There should be a public awareness campaign as to educate the public regarding the reasons to make an arrest, in order to preempt the propaganda campaign by the NEF and others to mislead the public about the arrest.

An individual’s arrest is not fixing matter of that. Anybody can blame Tamils. Bandaranake’s death still remains unexplained. It is not a one man death. It brought its birth child JVP. Then the JVP’s birth remain unexplained. It brought the 1971 constitution, which was created to rule without “Rule of Law”. That made the Tamils to for Vaukkodai Convention. All things lead to 1978 Constitution. That brought Indian Army into the land. The matters went out of hand. Now Tamils are not going to be satisfied with the arrest of Brother Prince. They may not be satisfied, for making Tamils country-less, even if somebody turn back the clock and arrest DS , the originator of the Brother prince’s arrest.
If Lanka wants become back as Lanka that was dominant and flourishing like in time of the whites rules, if not be invaded by India or even if its not be stolen by China, it has to get rid of Mahanama’s evil betrayal. Regarding the Indian constitution, Judge P Satahasivam said “There are checks and balances and broad separation of powers under the Constitution. Each organ of the State, i.e. the legislature, the executive and the judiciary, must have respect for the others and not encroach into each other’s domain.”
When Jayalalita was arrested, I do not think the Indian judiciary asked for the opinion of the politicians or political councils. Though there was a lot of popular opposition against it, the people finally accepted it.
Since Sri Lankans boast that they are more advanced and literate than Indians they will accept it if the action is legal and sufficient grounds exist for the arrest.
Gota can be warded in Lanka Hospitals and as the previous owner he can get special teatment. I think that is what will happen.
