No To New Gazette: Letter To The Election Commission

Subject: Gazetting a Date for Polls

Two days ago, the Chairman telephoned me to confirm my attendance at the Commission meeting on 20.04.2020, and proposed that we gazette polls for 28.05.2020, suggesting that if the COVID Pandemic is not over we could postpone again. I disagreed. I am writing this note to the Commission to argue that we must not set a date until we are sure that we will not be jeopardizing the population’s health by doing so. Here are my seven reasons:

1. Credibility and Infeasibility: 

Setting a new date would make us worse off than now. Once candidates commence campaigning in earnest, we would lose all credibility if we changed dates again. Close to 28.05.2020, we would have no feasible time to avert a constitutional crisis as the 02.06.2020 deadline for the new parliament to convene nears.

We must note that Dr. P.B. Jayasundara has already written in his letter to us, dated 06.04.2020, that after we announced the poll date, several independent candidates and several recognized Political Parties have accepted and acted in accordance with that announcement.

If we publish 28.05.2020 or thereabouts as the new date of election, Dr. Jayasundara will make the same argument that “several independent candidates and several recognized Political Parties have accepted and acted in accordance with” the new date. That is a strong reason why we must not get into the same predicament again. The first thing is to have a clear idea on where we stand.

Moreover, in these cash-short times, the new argument will be made that after the government spends  the billions of rupees by the new date of the election, the country would not be able to afford to spend it again after postponing once again. The candidates too will make the argument that they have already spent any war-chest they had.

Once we announce a new date without being sure we can carry it through, it will be too late to go back. Dr. PB Jayasundara has argued that we must set a new date. But section 23(3) does not set a deadline nor does it disallow the required announcements in stages. It also uses the word may, giving us some flexibility. (Note: The PM has made the same argument without addressing what I wrote a week ago in Colombo Telegraph).

Senior Indian journalist P.K. Balachandran wrote on 13.04.2020 with the long headline 

“President Gotabaya Rajapaksa is Reportedly Keen to Hold Parliamentary Elections on May 28; Elections Commissioner Mahinda Deshapriya Expected to Make Important Announcement on April 20: Curfews Likely to be Lifted Completely by April 30 to Enable Election Campaigning.” 

I learn from news media, rather than from the Commission.

3. Public Health: 

At this point, there are serious questions as to the public’s exposure to the virus if polls are conducted. Jaffna Teaching Hospital Director Dr. T. Sathiyamoorthy is emphatic in his public statement (16.04.2020) that in today’s situation, no one can forecast when things will improve or worsen. 

Others say they were unable to get true experts into the President’s Taskforce on COVID. Many express disappointment with the politicization of the epidemic but are fearful of being quoted. It is a new phenomenon. A positive feature is the Alliance of Independent Professionals (AIP), an organization that the Chairman’s brother Sunanda Deshapriya is a leader of. It says many professionals in charge of fighting the pandemic are political stooges. I recognize many of questionable reputation on the COVID National Action Committee, including one involved in spinning fake news and others who faced criminal charges. AIP has detailed in its report of 13.04.2020 the alarming deficiencies and untruths in the government’s narrative “to obfuscate the spread of COVID-19“ (through limiting testing and rushed cremations without post-mortems) and to tarnish the reputation of Muslims.

4. Human Rights Violation: 

The franchise to vote is a fundamental right. It will be violated if we hold elections when it exposes voters to life-threatening risk making many abstain. Importantly, the right to life is also a fundamental right. 

The Commission forcing our poll-workers and voters to risk their lives is a violation of their right to life, voters’ right to franchise, and the dissenting EC Members’ right to conscience in forcing the public to risk health. Surely this is not something we want.

5. South Korea 

When The Island (15.04.2020), “asked whether the SLPP was trying to justify parliamentary elections amidst crisis caused by the highly contagious virus, Prof. G.L. Peiris said that he merely pointed out that a nationwide poll was conducted in a country.” He, it seems obvious to many, is arguing for elections like in South Korea, despite the pandemic. Be that s it may, can we, a much poorer country, emulate South Korea in this? No!

According to Foreign Policy, over a quarter of eligible voters – 26.7 percent – used early voting there. This significantly reduced queues. But we cannot do this. The law requires postal ballot applications to be made from the seventh to fourteenth day from the proclamation of elections which was on 2.3.2020. It is too late now. 

Moreover, when the Commission asked government for doctors to be given the postal ballot because hospitals had no doctors when they went to vote, we were ignored. Do we have South Koreans’ will and public mindedness to do what they did? Here is what happened there:

“In order to cast their ballots, voters had to clean their hands with sanitiser, wear face masks and plastic gloves, stand at least one metre apart, and have their temperatures taken. Those with a temperature above 37.5 oC had to cast their vote in separate booths that were then disinfected after each use.  People who had tested positive for coronavirus were under strict instructions to only vote around 6 pm as polls closed and at specially designated polling stations. They were also forbidden from using public transport and were only allowed to walk or take their own car”.

Culture also is relevant in applying their methods here. In the US, Youngmi Kim of Edinburgh University says, voters will not wear masks. Will our voters, who stood crushing each other at supermarkets when they opened for the first time after curfew, maintain the 1m distancing?  Will they spend on hand-sanitizers and masks? Will poll-workers come to work? Will our government spend so much? Does it even have the money?

6. Wisconsin

Prof. Peiris also quotes Wisconsin courts forcing the election on 7.4.2020 without postponement. In that instance, President Trump’s Republican Party had moved courts to prevent delaying polling to a safer date. 

What Prof. Peiris failed to say is that, as reported in Time, many polling stations closed anyway after poll-workers dropped out citing health fears. Just five of 180 polling stations opened in Milwaukee – Wisconsin’s largest city.. Will our poll-workers have better attendance?

7. Respect for Commission

When the South Korean Election Commission asked the public to participate in elections during the pandemic, the public responded with an increased turn out than before. They trusted their Commission. South Korea’s NEC is constitutionally equal in status with their National Assembly, their executive branch, their Supreme Court, and their Constitutional Court. 

However, will our EC command the respect for people to follow our leadership? We cannot even reject the explicitly prohibited nomination papers of an unqualified candidates like at Maharagama’s Local Government Elections and must await court action by a spirited citizen. It took two years to throw out dual citizen Geetha Kumarasinghe from parliament. We are unable to remove a mistakenly elected councillor at Wennappuwa. A local government dual citizen case to which we all know the answer is still going on as the judges ponder the obvious.

There is little respect for the Commission. Parliament has ignored many of our urgent revisions like revising the impracticable quorum for commission meetings. Many accuse us of bias with a view to our reappointment in November. A video from “President’s Counsel” Ali Sabry threatening Muslims who did not vote for his boss passed by the Commission with impunity. Our senior staff are unhappy. 

Unlawful backdated political appointments are being made in this election-period but the Commission is unable to act. Today 16.4.2020 according to news reports I judge reliable, lorry-loads of goods for the needy from private donors came to the Jaffna Kachcheri and were parcelled and taken on the GA’s instructions by the Disaster Management head (going alone without Kachcheri workers) to MP Angajan Ramanathan, while Ramanthan  made a speech on his Facebook listing previous government distributions as if by him. Now we know why all Northern GAs were transferred ahead of the elections. 

Who will take our exhortations seriously? I fear none.

Conclusion

G.L. Peiris (The Island, 2.3.2020) has spoken of a Saboteur at the Election Commission. He expressed 

“serious concern over the likelihood of the electoral process being sabotaged by a member of the Election Commission (EC). […] He warned of a deliberate attempt to cripple the electoral process.  […] The SLPP Chairman pointed out that in terms of the 19th Amendment to the Constitution, the EC couldn’t meet without the presence of all three members. He said that nowhere in the world were all members of a particular body required to be present for a meeting to be quorate.”

Rather strange that his own party voted for the nineteenth amendment and that I was ignored when I, for the past 4 years, have been asking for the quorum to be made 2. The Commission also formally asked for an amendment that no right-thinking parliamentarian would vote against. But our MP’s and cabinet were too lazy to bother.

It is perhaps because of this ruling party concern that towards the end of my term that I have been given a Coordinator with a car in Jaffna, – for if I do not attend the meeting on 20 May, there can be no quorum to set the election date. 

Indeed, now to leave Jaffna with a curfew-pass, a doctor is required to certify that I have no symptoms of COVID-19. My position is that I will not go about my election duties without a doctor examining me and certifying that I have no COVID-19 symptoms. I am worried about going to the hospital to stand in line for a medical certificate to attend the Commission meeting. What then is the position of the wider public of voters? Surely, this needs time and a proper assessment by persons whose competence and commitment to the public cannot be questioned. 

Exit Strategy

We must choose simple solutions eschewing complex ones involving public health risk. The easiest way out has two steps. First, the President cancels the Gazette of 02.03.2020 and buys time at least till 02.09.2020 with parliament there to sort out the legal problems that arise including government funding. 

And second go by the advice of the College of Community Physicians issued yesterday: Exit strategy of COVID-19 epidemic in Sri Lanka. 

The report needs full reading but the experts emphasize 

1. Decisions on the lockdown need a multidisciplinary expert panel from across the nation without strict time-lines and through frequent revisions.

2. Decision-making must include accurate predictions of behaviours, and health system capacity for testing, treating, enforcement of restrictions, human behaviour, dynamics of economies, socio-economic consequences, etc

3. Economic resumption in Western Province (WP). No election will be possible until there is adequate return of normality in the Western Province. o election will be possible until there is adequate return of normality in the Western Province. 

Taking the foregoing into account, it is important that Epidemiologists, public health experts and virologists/microbiologists and experts from other areas (economics, transport sector, finance etc.) be included in the decision making process so as to balance the need for restarting following lockdown and in order to balance the needs. 

The EC cannot play at being all these experts at once.

You say it is not the president that is executive, It should be the EC and you have instructed EC how to conduct the election.       Thank you. Go for 02.09.2020 or later. Why should people risk their lives and health?People are not in a hurry to elect a new set of crooks and racists .         Independent commission in place is just 5 years old only- PRIOR TO that, RAJAPAKSHES were totalitarian by every means.

        A) What would be the case, if this commission was not the authority set up in today ‘s uncertain situtiona came into being through COVID 19 pandemic ?

        B) What would be the case, prior to the introduction of ELECTION commission ?
        .
        Do you agree, that Rajaakhes brothers and their henchmen would go and hold election already on the 25th April ?

      Mr Hoole: Why dose the useless opposition and minority parties fear elections so much?! UNP, TNA, JVP all do not want elections.
      They just want their parliamentary privileges and perks back?!!!

      Corona flu is less dangerous than the normal influenza which kills over 5.500 Sri Lankans every year.

    At least over 7 million of voters in this country would agree with your reasons.

    Not a man with a heart would agree to go to election, amidst the high risk for corona infection is growing.

    But there are also 5 mio or so that would change their own opinion going by the misleading propaganda of Mafia boss MaRa and his brother GoRa.
    But as far as my own opinion is concerned, whole lot of people would want to risk going to vote to those poll stations. Meaning the voter turnout would be 20% of lower – that is why Mafia Boss perhaps not his brother GOTA has been making every effort to fish on muddy waters, since their crediblity is diminishing so repidly these days, because very poor people have not gotten any kind of assistance even if the state repeatedly boast on that.

      Brilliant analysis and clear explanation why the elections must be postponed until at least the end of the year. The corrupt exposure of GLP as a scoundrel and sycophant cannot be disputed. Well said Dr Hoole and we the citizens of SL are so grateful for the honourable stand you have taken. We have always felt that Deshapriya is. Rajafuksha stooge.

    Rajapakhes have never been law bound. The reason why president of the ELECTION commission to become strange time to tome is because of Rajaakshes influence. This shows very well how srilanken public servants work – they have always much to boast about their carriers but mostly they dont work in compliance with the law. So how can we ever expect, this nation to rise up. It can take another few decades people to learn to be bound to law and order.

    There is a popular saying sinhala vernacular – dog s tail would not be straightened even if you would have put it in a bamboo sheath – like wise, may well be Rajapakshes talks the palatable to grab the votes, but their criminal nature would never be changed.

    We also remember that DIVINAEGUMA bill and how Mahinda Rajapkashes sacked then Chief Justice- Dr Shirani Bandaranayaka, within 24 hours. Unfortunatley, people in this country, masses would not care even if their lovely ones may have been raped and murdered down by Rajapakshes – people are made to be so indifferent. That is why how they repeatedly voted for any criminals regardless of the crime reocords of each.

    (not even 5500 tests are completed yet for a country of 22 millions)

    Health authorities confirm – lanken capacities are for 1200 tests /day

    Experts say, at least 3000 tests/day would be necessary to protect the nation from being infected by COVID

    Is that because they dont have enough FUNDs to go for it ? Or they prefer more to keep those funds for their election campaigns?

    China alone has provided them with PCR kits sufficient for 40 000 tests… why then they still stay havind not done even 10 thousand tests sofar ?

    WHO recommends any country to go for TEST, TEST, TEST.

    Why the govt of the day in SL – stay mum, but boasting about having achieved nothing…. why do they spread FAKE news about their self aggrandizement ?

    Chairman Mahinda Deshapriya(MD) should listen to Dr Hoole and do JUSTICE to the people of Sri Lanka and not to “RAJAPAKSAS” by not gazetting polls for 28.05.2020. There is no need to please Rajapaksas during this pandemic. If MD goes ahead to please Rajapaksas then natural justice will punish him without any doubt.

    Of course you are. However if the election would have given you a way to kick GR and MR out of power like back in 2015 you would have wasted no time donning some PPE gown, mask and gloves to get the medical certificate.

    This Commission of Election is not an Independent body. I am a voter in Sri Lanka and I have every right to say this. This Commission was appointed by the previous government and these Commissioners are biased towards the interests of the previous government.

    There is a news paper report on Island News paper today. This man has indicated that he is in Jaffna and he is not going to attend the meeting and because of that there is no quorum for the meeting . He can not declare that. All over the world, business and government organizations, they can can have on-line meetings. This simple pact, that they can not have an on-line meeting (as a Professor of Engineering), indicate that he is not serving the broad purpose of the society. This guy is working for the agendas of UNP, TNA, SLMC and Samgi Janabalawegaya.
    The government needs to take appropriate actions on these biased behavior.

    What Prof. Hoole says is completely correct but those who are intoxicated with power never listen to any professional or experts.

    Now fools can see the true colour of the leader.

    Hoole has to decide whether he want Democracy or Dictatorship. I heard that he complained to UK that Sri Lanka is gradually moving towards a Dictatorship. But when the President and PM want to hold the election, he says ‘NO ELECTION’.

    The President and PM should listen to the voice of majority in this country who do not want election and bring a set of don keys to Diyawannawa who could become a ‘Pain in the Neck’.

    The need of the day is health and wellbeing of the people of Sri Lanka and the world at large. Everything else is secondary, including the constitution and the political agendas of opportunists.
    All right-thinking medical professionals have warned not to conduct elections at this juncture. People are vehemently opposed to this as well. Only the politicians and their boot-licking stooges are canvassing for election at any cost. Even before this pandemic, this country was in a debt-trapped financial bankrupt state. For some reason, if this virus spread among the population in a large scale, that would be the last nail in the coffin of Sri Lanka. People should try their best to prevent the election been conducted.

          Whenver you go out please respect 2m social distancing measurement and also wear a mouth-nose cover mask.. apart from that not to forget to use disinfectants when you return home. That is how we are used to in Germany for all these 3 months.

    Kothapaiya needs a Parliament. With an economic crisis coming, he has no money and no basis on which he can raise loans. That is the dilemma. He is banking on ethnic chauvinism and his “efficiency” in dealing with the coronavirus. The former may still exist but even the thrice blessed did get the virus. The efficiency argument is fallacious. It appears from an article in the Hindu that South Asia was not much affected probably due to warm weather, several bouts of diseases giving immunity, wide BCG vaccination and other factors. If any one pulled us through it is Dr Jasinghe and his crowd, the army of nurses and PHI inspectors who went around advising people. People trusted them and complied. So having an election may only reveal that the Kothapaiya and his cronies are putting their interests above the public interest. We have to wait and see. In the meantime, if anything happens to Hoole, we know who did it.

    This commission of Elections is well known for its apathy for elections. They will hang on to the flimsiest reason the can find for not holding elections.
    Prof. Hoole’s reasoning are all nothing but speculation and I ‘m sure he knows very well that there is no credibility left for the EC to lose any more.
    It is not difficult to understand the UNP,SJB,JVP,TNA and the other hangers on’s fear to face elections.
    But, the EC, even though it is well known, must not expose their partisan attitude towards them.
    The EC has got its work cut out and they have a constitutional obligation to hold the elections with in a time period set out by the constitution, failing which,to put in Trump’s words “will have to face the consequences”

    hoole,don’t try to stop the election.You will also be taken by the CID for terrorism.Just write to the parliament that to bring in an amendment to the constitution that in future if any elections are held at any level(central,provincial or Local govt) then if two thirds to turn up and vote is mandatory to validate a result.Otherwise the election has to be held again within 3 months.

    ps.make use of this opportunity of corona virus to make the people’s power stronger.

      This is misleading the readers – I dont think Prof. HOOLE has been trying to block the election. Instead, he makes it clear, need of the hour is to concentrate on the coming out of the COVID 19 pit we are all fallen in.
      And, his reasons are comphrensible to anyone with a little brain. He could add one sentence ” Election date setting can only be made after settling the ground situation regarding the safety of people, that have now been caught by COVID anxities”. Meaning to give some hope for holding it once the NATION would feel much better…
      It is likely to be able to go for it after August for example….
      depending on the situation – the EC authorites and their staff could get ready for it.
      But now to set a fixed date on is totally absurd actually.

        that is why he should ask for a mandatory two third turnout.If people fear the coronavirus they are not going to come out and vote.If they don’t fear the coronavirus they will come out and vote.Hoole instead of giving the impression of a soilsport can put the hot potato back into the politicians laps instead of keeping it on his lap,unless he likes all the publicity etc.

        Also it is two birds with one stone.In future the parties will have to put out good candidates and policies if they want a two third turnout.when the people see the same wine in a new bottle they will stay at home.A constitutional amendment making two thirds turnout for any future elections is a win for people.

    Your article is full of ‘NOs’ and you sound like a proven pessimist.
    In SL, the current motto is: ‘Nothing is impossible’ (Nohekkak Nometha’).
    You have submitted several points but I don’t see any force, validity, logicality and/or legality in many of them.
    For instance, I don’t know why the EC did not set a new date in its first communique when it postponed the first set date of election. You (along with your members of the EC) could have easily mentioned that you would postpone the election to May 25. Period. By the end of April, you evaluate the situation and confirm it. If Covid-19 is still a threat to hold the election you cancel the date and leave the decision to the President, constitutional experts and the Supreme Court!
    Had you done that we would be talking about something more important and timely at this moment.
    Many of us, Sri Lankans, know how to argue, but only a few of us know how to make critical decisions!
