No Visas To UN Investigators, Missing Persons Commission Expands Furthermore

Continuing to expand the mandate of the Commission on Missing Persons, President Rajapaksa has appointed two more international experts to the advisory panel to the Commission to which includes Indian Human Rights Activist Professor Avdhash Kaushal and Pakistan legal expert Ahmer B. Soofi.

Mahinda-GotabhayaPresident Rajapaksa announced through his official Twitter account this afternoon of the two latest appointments.

Soofi is former caretaker federal law minister in Pakistan while Prof. Kaushal is the Chairperson of Dehradun-based non-governmental organization (NGO), Rural Litigation and Entitlement Kendra.

Prof. Kaushal confirmed his appointment to the advisory panel on the Missing Persons Commission last week, stating that he received a call from President Rajapaksa inviting him to be part of the panel. According to him, President Rajapaksa had visited his NGO in Dehradun on his invitation where over 20 Sri Lankans had pursued a course in Human Rights offered by the NGO.

It was in July that the President expanded the mandate of the Missing Persons Commission after which he initially appointed three members to the advisory panel including British lawyers Desmond de Silva and Geoffrey Nice and U.S. law professor David Crane. The panel headed by de Silva is mandated to advise the Commission upon request and might include other experts appointed by the President as and when necessary.

The expansion has been viewed by many as a measure taken in order to undermine the investigation on war crimes in Sri Lanka carried out by the Office of the High Commissioner for Human Rights that is presently underway.

Meanwhile, AFP today reported President Rajapaksa as stating that visas will not be granted to the UN investigators probing into the war crimes allegations against Sri Lanka despite mounting international pressure for the investigators to be granted access into the country.

    What are these two men going to advise on, in addition to Silva? Perhaps how to cover up with international connivance?

    They say one cannot influence an English Judge but you can find one who obliges you.

      If the Sinhalese dominated government cannot trust the UN appointed commission of inquiry, how can Tamils trust the investigation by the accused party?

      Furthermore how can the members paid (handsomely I suppose) by the accused regime be unbiased?

      The head of the overseas advisory team, a Sinhalese, is already on public record as saying that the LTTE is the guilty party.

      Isn’t this commission a mockery of justice, just as justice today is in Sri Lanka?

      Do Mahinda and his hired commissioners think the world is full of fools?

      How are they different from the UK Conservative MPs defending Sri Lanka in parliament after taking bribes from the regime?

      We have heard this before. At the right moment, Rajapakses’ arms will be twisted and they will simply buckle down – like in the case of Mrs. Pillay’s visit. This story of “Visas will not be given” is to satisfy those cantankerous regime hounds – Weerawansa, Champika R, Udaya G, Kudu Mervin – to keep them barking too early.

      Rajapakses know their fate is sealed if they refuse these Visas to UN senior officials from carrying out their legitimate functions. At any rate, UN is not going to relax her inquiry on S/Lanka under the Rajapakses post-May 2009 allegation of HR and War Crimes.

      Totally agreed. Pakistan is already a failed State while India is unable to restrict the rape incidents. Why should MR go after Federal States when he is unable accept Federalism? Are these two experts receiving a fat pay?

      The United Nations has insisted its investigation into alleged war crimes in Sri Lanka will go ahead despite being told it will be denied visas.
      Earlier, President Mahinda Rajapaksa said the UN team would be refused entry because only Sri Lankan authorities could investigate the allegations.

    UNCHR can conduct these investigations without coming to Sri Lanka. When UN-SG appointed the Darushman Commission within his powers as the Secretary General GOSL refused to grant Visas for the members and prevented them coming to SL. But when things got into a very serious level GLPERIS AND OTHERS met the Commsiion Members in Washinton.

    The argument about the UNCHR Commission is to say that SG-UN has no powers to appoint such body or the UNHuman Rights Commissioner has no mandate to appoint such team. In Sri Lanka the Parliament is supreme and President should get the approval from the Parliament to appoint Commissions after Cabinet of Ministers approve the Proposal. If Mahinda Rajapaksa can appoint a commission or members to such commission without the Cabinet or the Parlimentary approval, how can this man says that UN-SG has no pores when he was appointed by the General Membership and according to the UN Charter he is empowered to do so.

    Mahinda Rajapaksa very clearly knows that he brother Gotabaya with few Army Officers now serving as Ambassodors were responsible for the War Crimes. To save Gotabaya Mahinda is doing everything possible to stop this investigation. But he has for got ton that the Senior Military Officers sacked by Gotabaya as GSF lackeys has already given very valuable information to the UN as Gota treated them very badly after spending their life in eradicating the LTTE.

    By tring to save Gota who killed JVP guys in 1988/1989 period and the Tamils who wanted to surrender during the last week of the final battle, he himself will get entrap and may go to Jail in. A country whe re none can see him.

      May I remind you that it was not Darushman Commission as you think it is.

      The Report was known as

      Report of the Secretary General’s Panel of Experts on Accountability in Sri Lanka.

      Therefore it was Seretary General’s panel and not Darushman Commission. Nowhere in the report you will find the panel was named after Darusman.

      It was addressed as Panel of Experts or just panel.

    Vimal Weeravansa(a minister)is on public record as inciting the air force to bomb whole villages to get rid of LTTE: When the whole of Sri Lanka knows this how can you attribute the genocide of Tamils to Gota and a few military people?

    Do you think day after day for several weeks if not months jets taking off from bases and dropped bombs on no fire zones and elsewhere happened without Mahinda’ knowledge?

    Did the pilots not know what they were doing?

    Nobody can escape responsibility for crimes against humanity including Mahinda the King.

    Unless of course you use the logic of the bhikku who told Duddagemunu that he only killed 2 Tamils in the war!

      NA name I used to nominate the Three man commission as Dharusman Report is because it is the name adopted by Sri Lankans to denote that UN-SG’ commision. I knew the correct name as I follow these well. There are two bodies inquiring into Human Rights violations in Sri Lanka. The one came first was the one nicknamed as Darushman Report, as Hon. Darushman was the Chairman of the group. Second one is the one appointed by Chief of the UNCHR with the approval of UN-SG which is now the main focus of the MARA regime.

      Are you suggesting that 29 years of atrocities by the LTTE was eliminated by the Force s with sticks? No they lost on the last count 6632 0officers and soldiers to save 300,000 Tamil civilians. When the LTTE used Every kind of fire power the only way Defence Forces control them was to used MIGS and KAFIRS with rapid firing guns. In a situation like that none can separate civilians from the Rag Army of the LTTE.

      The Tamil Daispora should thank for how the war ended, as the total loss of the Service personal was well over 40,000 for the 29 years of fighting and approximately 100,000 civilians, Sinhalese and Muslims including Tamils.

      What the UN is trying to establish is the atrocities during the last stage of the final war, and not how people got killed from Carpet bombing or other type of bombing. If you guys try to bring the entire 29 or 30 years into this equation, most Tamils now live in variou countries may get caught for aiding and supporting the LTTE to kill and maim innocent civilians along with the Forces.

    It is possible that Mahindas Consultative commission to work against the
    UNHCR Resolution was a creation of his “kitchen cabinet” and this did
    not require Official cabinet papers etc. The funds are there as MR is
    also Minister of Finance and the wealth made from “Development” projects
    useful now to save lives of Leaders/Patriots.

    It will not surprise the world that this appendage of a local commission may be increased to say 16 persons – with some from Russia and China – finally to come up with a “Majority” Report should the 1st three lean dangerously to Western standards!!

    The UN too is being taken to be made up of fools by the King and c^man of
    the CW !! Last ditch stand of mortals.

    The Indian chap, who ever heard of him- would be better off examining the killings of the Indian army in Kashmir. Rajapaksa is wasting state funds to exculpate himself from crimes for which he has to face trial either in SL or abroad. It is time that the country holds every leader who has killed and every soldier and policeman who has killed accountable under Sri Lankan law for their crimes. We simply have to bring about such a system for peace to prevail.

    Our Boss, Hon.President, Sri Rohana Mayaratna is absolutely correct. In my opinion he should have further expanded this Advisory panel by adding members from China, Russia, Vietnam, Iran, Swaziland, Uganda, Bolivia, Somalia, Libya and our Friendly Countries that has democracy like ours.

    He should remember when selecting a member from China it should be a Chair person of the Institute where Rohitha Rajapaksha got his certificate.

    I am also pretty sure that our Opposition also will agree with this as usual as they don’t want be deshadrohees by opposing Hon. mayaratna’s moves. Also they have no time to look in to this kind of minor matters as they face bigger problems than this. now their biggest problem is how to make Saith Premadasa satisfied and what kind of position suitable for him. If the UNP Leadership doesn’t have a backbone to kick this shit out how can they chase this big-shit Mayaratna out?

    Prof Avdhash Kaushal had awarded a Doctorate to President in recognition of his great humanitarian service in Sri Lanka…..
    Mr Ahmer B Soofi is a Legal expert….who has questioned the rights of US to intervene militarily in Pakistan and demand of an inquiry into the Osama Bin Laden’s presence in Pakistan…and that ” the primary purpose of the demand for an inquiry to be carried out on OBL’ s presence is politically motivated fixing responsibility on some particular state institutions ” …..

    Besides this is what he has said on Laws for Missing Persons….” Solutions for enactment to resolve the stigma of missing persons within the constitution are available. Government’s attention and some innovation can bring out these solutions.’…..this on Pakistan Military Action….

    There is no doubt that both these personnel have been bought as much as the other 3 …primarily to justify the Action taken by the Govt in quelling the Terrorism..and to clear the Command Structure of all allegations….

    Now the question is how can this local Inquiry be actually an Independent Domestic inquiry..when all the advisers or report writers are imported by the President to write a report that will save him from humiliation…? NOT THE COUNTRY…..the only world authority to inquire into matters of this nature is the UN….no one else….IF the UN accepts these then the UN should be dissolved without mocking..

    The advisory panel itself shows the seriousness of the depths the President is in….he has messed up the Country right royally…now he is history…

    Bonanza for Presidential commissions – as reported in Lanka Truth

    It is revealed that Rs. 272,693,591.76 has been spent for 17 commissions appointed by President Mahinda Rajapaksa for various incidents that occurred during 2005-2013, the 8 year period he has been in office. This is revealed when the Prime Minister responded to a question posed by Parliamentarian Anura Dissanayaka in Parliament.

    The commissions were appointed to inquire into anti-peoples incidents, frauds and corruption that occurred in state enterprises, incidents of human rights violations, frauds occurred when buying weapons for security sections, abductions, disappearances and murders.

    The commissions were appointed by the President to suppress the opposition that erupted in the country regarding aforesaid matters. The people have no confidence in the commissions appointed say political analysts adding that inquiries by the commissions did not bring any results.

    Is this Diaspora / West instigated Pillai Investigation going to probe who provided the co ordinates to the LTTE Political leader’s whereabouts?.
