Plan B For Northern PC Polls

Colombo Telegraph understands that the Mahinda Rajapaksa Government is discussing an alternate plan in the event that it is unable to pass the amendment to the 13th Amendment it is contemplating. This is due to reports it has received that the Sri Lanka Muslim Congress and the left parties would not support the amendment.

According to our sources, the SLMC’s delegates’ conference had decided last year that the party should not support and negative changes to the 13th Amendment. “We are bound by the decision of the delegates’ conference” an SLMC official told Colombo Telegraph on the condition of anonymity.

On Saturday, the Central Committee of the Communist Party decided not to support the amendment and on Sunday, the Central Committee of the Lanka Sama Samaja Party also decided similarly.

Our sources stated that although the Government rushed the Registration of Electors (Special Provisions) Bill through the Supreme Court and the Bill was to be tabled as an urgent Bill last week, it was instead referred to a standing committee. If the Government is unable to obtain a two-thirds majority, three voters of the Northern Province (a Tamil, a Sinhalese and a Muslim) are expected to challenge the holding of elections to the Northern Provincial Council. The Government is confident that the Supreme Court would issue a stay order preventing the holding of an election. The election would then be postponed until the CHOGM Conference is over.

            It appears this regime has gone beyond the pale. They have to go. I cannot think of a way in which they can be forced to go. We may have to wait for the next presidential elections to do the trick, provided that bigger tricks are not deployed to subvert an overwhelming vote. The bigger question is who will replace this bunch? I do not see anything even marginally better on the horizon. We may end up choosing a bigger devil. This has been the general downward trend in our political history. A very sad situation. However, unforeseen changes do take place, when the time is ripe. This is a lesson history teaches me. That time appears to be approaching fast.

              There is fairy deep and widespread resentment among the ordinary folk about the cost of living, the profligacy of the ruling cum political elite, corruption and the high handed and unethical manner in which the government is countering democratic dissent. The CJ Shirani Bandaranayake issue and the recent steep hike in power tariffs have added fuel to fire. The CJ issue and the manner in which she was dealt has touched a deep chord in the ordinary folk

              On the Tamil side, the debate swirling around the 13th amendment is not a major concern of the ordinary folk, as were the issues in the 1970s. The post-war circumstances yet dictate the primacy of survival and recovery issues. However, it is a issue that at this point in time-four years after the war- is of (& should be of) concern to the Tamil political leadership and intellectuals. Devolution of power to the periphery and power-sharing at the center with the periphery, are necessary developments in the context of the whole island. The ever increasing thirst for unbridled power by the center and its misuse, make the devolution cum power-sharing democratic development a vital necessity.

              MR who promised a 13th amendment plus with many innovations, is trying to now do away with the toothless 13th amendment itself, without presenting alternatives. What makes the whole exercise nauseating is that he has lied to all and sundry and is now orchestrating the whole thrust. he is patently trying to manufacture a non-existent Sihhala-Buddhist public opinion, even at the risk of rendering asunder the growing post-war relationship between the Sinhala and Tamil communities at various levels. This is anti-national brinkmanship of the worst kind, so soon after three decades of devastation precipitated by similar vileness in the post-independence decades.

              You say”you do not see anything even marginally better on the horizon” Is’nt that the same as ‘we have the best available’for the moment?and the possibility of ending up with a worst devil than the known one, why force the issue by pushing to change when there is no alternative?
              The TNA by making unrealistic demands with the LTTE diaspora is further tieing MR’s hands. What everyone who demands this or that does not seem to realise is,his own political survival. It is as same as Eelam stupidity to expect him to give Eelam in another name under 13A.
              Yes,he made promises. politicians make promises,and some they never intend to keep.Rajive Gandhi promised to disarm all rebels when the 13A was introduced after signing the Indo-SL accord in 87 but he failed to keep up to his promise. He tried but failed.
              Today,the problem is for some priorities have mixed up. Today the priority is to uplift the living standard of the people of north.That is the priority of the people and not the TNA.
              The TNA’s priority is to get as much power as possible before poeple get anything,because, they know they may not get even elected to power if the poeple get what they need.So,as the LTTE held these people as a human shield,the TNA is holding them to ransom for them to get to power.
              I think the provincial councils in this country died a natural death once the Eelamists tried to get their Eealm through 13A.

              The comments on articles in the Internet, do not reflect public opinion , although on occasions they are pointers to the direction winds are blowing. There is a lot of grumbling in the country. There is ‘ silent’ revolution brewing, how this will manifest is yet hard to discern, given that there is no individual or party around which it can crystallise. MR and his fortunes are definitely on the decline. He has lost the plot and his marbles.

If this was done after several hundreds of Hindu devotees commenced their padayatra from Jaffna and Kilinochchi this will be ugly. Poor form, dear boy. Is the mono theocratic State already here?

    There is no need for court challenges as a Plan B.

    President is giving the Left Over Lefties (to borrow from that learned Professor) and the minority part leaders a free hand to vote on whether to give LTTE proxy Sambandan the Police and Powers and the titles to Govt land or not.

    If they do agree for Sambandan’s demands and vote with the UNP there wouldn’t be any problem before the CHOGM meet.

    It is after the CHOGM that the shit will hit the fan, when CM Premachandran put his put down and start building his Eelaam.

    Then the President can go to the inhabitants and hold a referandum to ask whether they want the PCs or not.

    Surely the Diaspora IC can’t find any fault with that, could they?.

      Indeed the President is well known for his democractic principles and definately not corruption, nepotism and grandiosity.       Are you mad about this LTTE proxy because he is not boot-licking your war criminal President like the former LTTE proxies KP, Col Karuna and Daya Master? As Mahinda cannot win the northern election fairly despite the complete military annihilation of the LTTE and massive security presence, he therefore is showing his democractic ways by attempting to either postpone the election or make the northern province meaningless. I fully support this decision by the President because the 13th amendment is India’s obsession therefore anything that can cause an even bigger rift between Mahinda and Mohanmohan should be welcomed.

      We need to welcome the continuing stupidity of the Mahinda faithful in viewing the 13th amendment as leading a path towards separatism as opposed to viewing it as a model which fundamentally acknowledges the unitary nature of the Sri Lankan state (which is why the LTTE were determined to destroy it).

      Again the 13th Amendment is India’s baby and has a personal resonance for Sonia Gandhi due to the feeling that Rajiv died for its implementation. Therefore any attempt by Percy to destroy, weaken and undermine this Amendment should be used intelligently by the TNA to bolster their ties with India and the West in preparation for the next American resolution at the UNHRC which should hopefully have more teeth once the Indians get on side

    the CHOGM go through by India, and it will stand even under Plan B –
    proving that MR is abiding by SC Order! Everyone has been taken for
    a ride. Once CHOGM is concluded, there will be no NP Elections there-

    The 13th Amendment to the Constitution has given powers to the Provincial Councils exceeding the power granted to an Indian State by the Indian Constitution. An extract from analysis produced by a member of OPA is given below.

    COMPARISON OF POWERS VESTED UNDER 13A IN THE PROVINCES IN SRI LANKA WITH THOSE ENJOYED BY THE STATES OF INDIA

    1. In terms of Article 3 – the Parliament of India may
    (a) Form a new State by separation of territory from any State or by uniting two or more States or parts of States or by uniting any territory to a part of any State;
    (b) increase the area of any State;
    (c) diminish the area of any State;
    (d) alter the boundaries of any State;
    (e) alter the name of any State:
    This can be done with a simple majority of votes in the Parliament provided that the President seeks the views of the States on the proposal.

    In the case of Article 154(A) it is obligatory on Sri Lanka to establish a Provincial Council for every Province. The Parliament of Sri Lanka can join one or more Provinces but cannot resort to other options as provided for in the IC. For example boundaries of a Province cannot be altered even with the concurrence of the Provinces affected.
    It is obvious that this provision is merely to facilitate the joining of the Northern and Eastern Provinces and establish the Tamil Homeland

    2) Under Article 257 -, the executive power of the Union shall also extend to the giving of directions to a State as to the construction and maintenance of means of communication declared in the direction to be of national or military importance:

    There is no parallel provision in 13A.

    3) Under Article 312 -, Parliament may create all India services [(including an all-India judicial service)] common to the Union and the States.
    At present the All India Services are the Judicial Service, Indian Administrative Service, Indian Police Service and the Indian Forest Service.
    The officers of the All India Services are recruited and trained by the Union Government (“the Centre”).

    a) All India recruitment makes possible minimum and uniform standards of administration throughout the country. It enables the induction of the best available talent to these services.
    b) With personnel drawn form different States, each State cadre gets a leavening of senior officers from outside, whose vision and outlook transcend local horizons.
    c) Systemic deputation from the State to the Union broadens the vision of the officers so deputed and brings to the Union an experience of closeness to actual realities.

    There is no parallel provision in 13A.

    4). Article 44 – requires the (Indian) State to endeavor to secure for the citizens a uniform civil code throughout the territory of India.

    13A has no such requirement, the absence of which could lead to many legal tangles.

    5). Article 76 (3) – gives the Attorney General of India, the right of audience in the performance of his duties in all courts of India.
    13A has no such provision.

    6). Article 139 A – empowers the Supreme Court, in cases where questions of substantial and general importance are involved to withdraw cases pending before High Courts and dispose of the cases by itself.
    The Supreme Court may, transfer any case, appeal or other proceedings pending before any High Court to any other High Court.

    13A does not have any such provisions.

    7) Article 141 of the Indian Constitution stipulates that the law declared by the Supreme Court shall be binding on all courts within the territory of India.

    There is no parallel provision in 13A.

      ‘Truth’ as you are a supporter of the Rajapaksa faithful along with their associated acts like Duminda Silva and Col Karuna, expecting you to show great insight into complex constitutional matters is like expecting Gotabhaya not to go mental when asked difficult questions by critical journalists. Firstly, India has many states like Uttar Pradesh which are larger in terms of population than most countries therefore having the means to split them into smaller units for admin purposes is called logic. As Sri Lanka is much smaller both in terms of population and area, it is not surprising they agreed to keep the provincial lines fixed. Also this decision to create provincial councils was as a safeguard for Tamil-speaking people to have some measure (for the sake of peace) of regional self-rule away from sinhala nationalists in the centre and their obsession with mad monks, buddhism and sinhala only. This 13th amendment is quite explicit in ackowledging the unitary nature of SL state which is why the LTTE were prepared to destroy it and why the Indians were prepared to sacrifice their own soldiers to implement it. Therefore why the incredibly thick Rajapaksa supporters think its a back door to Ealam is beyond me but these are the same fools who think its a good idea to rely on the support of muslim nations at the UN whilst cheering on the bodu sena’s anti-halal campaign.

Remember this same ‘Truth’ thinks 13A is backdoor to Ealam so when one has entered into such a twisted mindset, attempting to speak sense and reason to them is obviously a massive waste of time. These people are hardcore sinhala nationalists who cannot comprehend the existence of minorities and their rights even after a horrific 30 civil war.         I have no reason to doubt the accuracy of this Analysis. Both Indian & Sri Lanka Constitutions are given in the web. Study them and write some sense, without talking nonsense through your Elam hat. I have nothing to do with the Rajapaksa family and recognize their strengths as well as their weaknesses.

    The truth of the matter is that the UN and the Commonwealth have both let down the Tamil people especially and all other people of Sri Lanka as well..
