PM Ranil Insults CJ With “That Man Dep,” Compromises Stature Of Judiciary

Prime Minister Ranil Wickremesinghe in a statement with serious implications for the independence, integrity and stature of the judiciary has spoken dismissively and derisively of Chief Justice Priyasath Dep.

Addressing Parliament in the aftermath of Ravi Karunanayake’s resignation, the Prime Minister describing an injustice done to the Chief Justice while he was in the Attorney General’s Department, referred to him as ‘e miniha’ (or ‘ඒ මිනිහ – that man’): ‘because “that man” had criticized the then government when he was Additional Solicitor General, he was not appointed as the Attorney General but was “put” to the Supreme Court (shreshtaadhikaranayata damma – ශ්‍රේෂ්ඨාධිකරණ​යට දැම්ම​ ).”

Thereafter Wickremesinghe flippantly attributed the elevation of Justice Dep to the position of Chief Justice to fortuitous configuration of astral entities: ‘grahaya honda nisa miniha aga vinishchakaaraya una’ (ග්‍රහය හොඳ නිසා මිනිහ අගවිනිශ්චයකාරය උනා – ‘because the planetary positions were in his favor the man became Chief Justice’).

The casual and dismissive manner of this reference clearly demeans the Chief Justice, the Supreme Court and indeed the entire judicial system, according to close observers of parliamentary debates, established procedures and what could constitute contempt of court.

Wickremesinghe’s allusion clearly implies that the appointment to the Supreme Court had little to do with competence and that even the appointment as Chief Justice was more astrological than anything else.

Colombo Telegraph notes also that if this flippancy on the part of Wickremesinghe is ignored by the court then it paves the way for anyone to be as dismissive and derisive of the Chief Justice and since he is at the pinnacle of the judicial system any other judge.

      “Stop manipulating and intimidating the Judiciary!” This was Yahapalanaya’s number one slogan.

      A few days ago, the Prime Minister said that even the Attorney General was now in a position to question Minsters. He has no right to be surprised. On the other hand, who gave them the backbone? Surely not the Prime Minister.

      Attorney General should file a case against Perpetual Treasuries. Then the Prime Minister will be questioned in the open Courts.

      The Supreme Court is the only place where general public have some faith.

      The President never interfered in the Presidential Commission of Inquiry, that is the reason they were succeeded in bringing in the top people who were involved in the Bond heist, directly or indirectly, to the limelight.

      The Commission should have the backbone to summon the Prime Minister and question him about appointing a non-Sri Lankan to the post of Governor/Central Bank which is a serious breach of the Constitution. Actually, they should have first questioned the Prime Minister.

      Perpetual Treasuries were given undue personal favourism by the Prime Minister. He personally intervened to obtain Rs. 66 billion from the Bank of Ceylon for them to invest in Central Bank Bonds.
      How about local entrepreneurs? Many local industries collapsed due to government’s stupid economic policies. A local farmer or a small scale village businessman is unable to obtain even a small bank loan without collateral.

      All the “Phantom Capitalists” who have political patronage should be exposed. I bet the Prime Minister is one of them.

      Mr. Prime Minister, it should have been you who should have resigned first as the mastermind of the CB Bond heist which was the prime reason for the economic collapse in the country. At least you can then avoid a jail term, like Ravi K. Think about it.

        The most important matter is recovering the loss made to the government. Will the AG and the Judiciary have the backbone to do that?

        The general public (no faith in debilitated JO who didn’t have the backbone to file a No Confidence Motion against the PM and the government) should have the courage to insist the Prime Minister to resign.

        There is no use of any single Minister’s resignation as long as the Prime Minister retains his position. He will protect all the rogues and the money looted from the government. What is the point? The country will remain as it is and the people will suffer as usual and the local industries will bleed further. Nothing will change.

          What loss? At 12% p.a, the bonds were 3% over the going rate. So the “loss” per year is about Rs. 300 million. The bonds will only mature in THIRTY years. Peanuts!
          I am not ruling out collusion between Aloysius and Ravi.

            Simple. Here, you can do the math by yourself because I could not find a formula.

            1. Find the interest paid to Treasury Bonds in 2015, 2016, and 2017 and the unprecedented amount of profit made by Perpetual Treasuries.

            2. What is the loss caused to EPF/ETF by the government by favouring Perpetual Treasuries? I mean, if it was not they and if it was EPF/ETF who were allowed to purchase Bonds in the primary market, how much profit could EPF/ETF have made if the Bonds were sold directly to them at the rate increased arbitrarily? (Hey, Old Codger, I don’t know how to write thirty billion in digits.)

            3. Apply the above to other State Institutions which invested in Bonds at the secondary level. How much money did they lose due to PM’s/Mahendran’s discrimination of state institutions?

            4. Who increased the rate which would otherwise have been on or around 9.5%, to 12.5% and what made the Central Bank to accept 10 billion instead of 1 billion in 2015? And what made them to issue bonds for 30-year period right away at the increased rate? Why didn’t CB issue this for 2 years? Calculate the loss.

            And most importantly how could only one primary dealer received this favouritism and that primary dealer happened to be the son-in-law of the former Governor? Isn’t this inside trading in Rajaratnam style?

            5. What made Perpetual Treasuries to use a router account initially? Why did the Bank of Ceylon not invested in CB Bonds by themselves, instead of Perpetual Treasuries? How much could they (BOC) have made? Why did they allow a private company to made this profit using government money? I wonder whether Mahendran/Aloysius have Central Bank (Forex) routing numbers? (I am joking).

            That is only the direct loss. Actually the indirect loss to the country/industries/each citizen is much more than the direct loss. You might pass out at the sight of the number. So I will spare you.

            According to your calculation the loss is “only” Rs. 300 million X 30-years = 9 billion ”peanuts”. How could Perpetual Treasuries make 180 billion based on your formula? Forget about how much they made so far. What was their initial profit in 2015? They made 5billion in March 2015 right away and by the end of the year 6.6 billion-peanuts from government institutions itself (as revealed at the PCoI).

            Let’s say if they were allowed to engage in this business for 30 years, they can make 180 billion at the end of 30 years!!! How about us? The country is already in 76 billion in debt. If we go on like this, (I mean the rotation of SLFP/UNP governments) there is no way we could pay this off in 30 years. By the time, the debt will be doubled, i.e. it will be around 160 billion.

            Perpetual Treasuries = 180 billion profit in 30 years

            Government = 160 billion in debt in 30 years

            Is this fair?

            I wish we have gone back to old style “Treasury Bills” which are issued normally for six-months/less than one year, instead of “Treasury Bonds” where you can go up to 50 years even and people who are good in insider trading can take the advantage.

            I am interested in recovering the money. Perpetual Treasuries has no right whatsoever to make this profit. Insider Trading is a serious crime. Therefore, whatever the profit Perpetual Treasuries makes is illegal. The government should take action to recover this money through a court procedure.

              Obviously you are not old enough to know that in 30 years, 160 billion will be peanuts. Probably a loaf of bread will cost about Rs.10,000. (It cost 25 cts 30 years ago) . Quite likely a labourer’s daily wage will be about Rs.30,000.

            I miss this part of your comment – Maturity!

            What is the meaning of the maturity of a bond? That is the date of which the principal amount is due. So in 30 years we have to repay the full amount to Perpetual Treasuries and in the meantime the interest should be paid (in every 6 months?), if wise, plus a portion of the principal to make the amount due zero or at least to make it small at the time of the maturity.

            I wish to know whether these Bonds sold to Perpetual Treasuries are Callable?

            That means will any government be able to “redeem its bonds” from the Perpetual Treasuries by paying the principle value at any time, if this government doesn’t have the backbone to recover the illegal money? Or do we have to wait for 30 years which is a crime beyond expression. What is the par value of these bonds?

              I know this is a complicated subject. I have invested in securities myself.
              1. FACT: The govt. has to pay interest at 12.5 % every year
              2. FACT : It has to do this for 30 years.
              3. FACT: Any loss to the govt is from the 3% difference
              4. FACT: Interest rates go up and down , from about 6% in the 50’s , 25% in the 70’s / 90’s to 8% a couple of years ago.

              6. FACT: Notwithstanding whatever profits PTL makes, the fact remains that the loss to the public is still 300 million p.a.

They benefitted from insider trading because their close relationaship with the former Governor which is a criminal offence. They use this money to invest in the stock market and purchase various assets. This is not healthy for the country.

                  Whatever profits made by dealers do NOT change the fact that govt. (or the public) pays 12% every year for 30 years.
                  At the end of 30 years, 10 billion will be worth only about 1 billion in today’s money, or less.
                  There is no law against making profits. The govt. borrowed money at interest (bonds). What PTL does with the bonds is their business.
                  If there was corruption in the placement, THAT is the crime.
                  As i said before, it is the govt. that scammed PTL, not the other way around.
                  If you can, prove that the yearly “loss” is not 300 million.
                  Indirect losses are not relevant. PTL’s profits cannot be said to be govt. losses. By your logic, SriLankan airlines losses are govt’s profits then!

                    It would have been their business if they come through proper channels. That is the issue you cannot grasp as you have no idea what happened since 2015.

                    Perpetual Treasuries robbed the opportunity of other primary dealers and state institutions to make profits by investing in bonds. They are making this colossal profit depriving state institutions because Mahendran was the Governor and Ranil was the PM and they involved in insider trading which is a criminal offence.

                    As for your Rs. 66 billion BOC loan and Rs. 10 billion joke, as far as I could remember, Perpetual Treasuries bought 6 sets of them in February 2015 and that is how they made Rs. 5 billion profit in one month in March 2015.

                    My apologies if the words “router accounts” and “collateral” are big words for you as I always use simplest of words when I comment. If I write an article, it won’t be the same. “Routing accounts” were first introduced to the world in 1900s and “collateral” means the security that you provide when applying for a loan which could be forfeited by the bank in case you defaulted the loan.

                      This is exactly what I am saying. The crime is insider trading, NOT making profits. In any case, how can they make 50% profit in one month (as you claim) when the bonds have been traded at a mark- up of 1%? READ the Commission reports!
                      Here is an excerpt:

                      Perpetual Treasuries Ltd. Continued as a primary dealer at the Central Bank even when Ajith Nivard Cabraal was CB Governor and during this period (2014) it received a profit of 400% said Chief Executive Officer of Perpetual Treasuries Ltd. Kasun Palisena.
                      He also revealed Mr Cabraal’s sister Shiromi Wickremasinghe was a director of Perpetual Treasuries Ltd. at the time.”
                      So what’s new, Champa???

                      Well, your memory is wrong. There was only 10 billion issued.
                      The reason that people deal in Treasury bonds is that they can make any profit and not pay tax, like share trading. Quite legal, for your info.

Now, the Penthouse Ravi has been favoured by the AG and not arrested and not kept in the jail. Even the yahapalana politicians say they did some thing good. They don’t say that I know nothing Ravi had to quit because one of his so many thefts were revealed by he himself. there are so manh other thives in both sides of the yahapalana govt.     Let’s be honest , some of the appointments to the judiciary made by the yahapalanaya govt as well as the MARA govt are highly questionable.

    Look at the last few years appointments as PCs. Some of them even don’t have a decent practice.

    Whole bloody thing is politicized.!!

    There are tens of thousands of lawyers but need a few Nagananda Kodituwakku to do the clean up.

    I’ve finally heard that part of Ranil W.’s speech, at the third or fourth attempt, many hours apart. I don’t think that it’s worth talking about – his so-called slighting of the Chief Justice.

    Ranil’s Sinhala is clumsy, but he was not speaking insultingly. His English is only slightly better, actually! I myself am, in many senses, a villager; I often interact on equal terms with those who speak no English. It is amusing to hear such people imagining that Ranil speaks excellent English on two baseis: 1. that his Sinhala is poor, and 2, that he started as an advocate (in the days before all became Attorneys-at-Law.

      Also, he was speaking in Parliament, where he has every right to say anything about anybody outside the House.

      Very good point Sinhala Man, regarding Ranil’s proficiency in English and Sinhala both.

      The problem is, he thinks he is an entertainer, and tends to be flippant to raise a laugh from those around him. He lowers his own stature immeasurably, but doesn’t know it.

      The well of the parliament is not a canteen or a tuck shop. Besides, Ranil is our Prime Minister. If he needs to be shown respect, he needs to earn it.

    Political interference with the judiciary is becoming the norm the world over.
    In Lanka, JR J looked the other way when goons threw stones at the houses of certain judges. More recently the appointment and impeachment of Shirani Bandaranayake was blatant interference.

    Ranil implies that important appointments in SL are not merit based. This is our weakness and Ranil is expected to rectify this.
    But Ranil goes a step further and attributes appointments to astrological phenomena. This sort of superstition propels him to run to Indian Hindu temples seeking favors. A true Buddhist will not entertain such beliefs..

    Ranil throughout his political life is known to be a calm and collected person. With 40 years in active politics under his belt and not a single serious charge of corruption, abuse of power or unethical behavior making people nit-pick his words and grammar.
    These same people should listen to how the previous govt spoke of key public figures before making a fool of themselves.

    Having said that: if Ranil was to speak his mind I am sure he will have some choice words about the AG’s dept which was corrupted to the core during the last govt and its still doing the bidding of the previous govt.

    This is what a key figure of the last govt and current President has to say:
    “Responding to allegations made by a number of United National Party (UNP) Ministers over the lack of action taken in investigations into corruption cases connected to the previous Government compared to the speedy action meted by the Special Presidential Commission of Inquiry on the Bond Issue, Sirisena told Cabinet that law enforcement bodies tasked with investigating corruption allegations of the previous Government were not under his purview and were beyond his direct control.” LOL

      Oh yeah, the calm and collected Ranil took 40 years to put a sohpisticated masterminded plan in place to rob the Central Bank by way of a governor and his CEO son-in-law’s company using conflict of interest and insider trading. Sure, you need to be at least 40 years in politics to make up your mind to bleed the economy of your own country. Soros – No. 2. At least Soros didn’t rob the Reserve Bank of his own country.

      The wealthy is sucking the country dry. A radical change is imperative at the next election.

        Aloysius as a individual did not buy anything. The firm that employs him is one of the registered firms with the bank.

                  Thanks for your advice . In my view, I think all those whom you have named will respond much better if we expressed ourselves in a public forum without stooping to insult, levity and other derogatory references.

                  Life to me does not get better or more entertaining by insulting another through the written word in the public domain. This is a point missed by many, including our Prime Minister, which is how this discussion began.

          Of course, that is what is called conflict of interest.

          The Tender Board did not know who the bidders were. But the former Governor knew as one of the primary dealers were his sons-in-law. Therefore, there should be a valid reason for Perpetual Treasuries to offer 10 billion instead of 1 billion at the first place. And how did the Governor decide to sell bonds worth 10 billion and not 1 billion as envisaged if not to favour his son-in-law’s bid? And also to increase interest from 9.5% to 12.5% which matches with Perpetual Treasuries bid? Is this coincidence? This was well planned by the Prime Minister and the Governor got his protection. If the PM is not involved, no Governor was dared to do something like that which could otherwise have made him ended up serving a long term jail eventually.

          Actually there should be strict law in place to avoid conflict of interest in all government’s financial transactions.

            BS. If the above is true the tender board failed in its fiduciary duty.

            Wrong again. Son-in-law was not a primary dealer but the entity that he worked for as CEO. One person teams are unheard of in this type of a negotiation.

            CB recognized Perpetual Treasuries as a primary dealer in Oct of 2013 when MR was holding the portfolio as Finance Minister and Cabral as Governor.

            Oversubscribed is a common issue. Why Mahendran decided to sell I don’t know. May be to service the debt the Rajapaksa’s put this country into.

    We had a selective Justice system starting with CJ Sarath N Silva’s time. Then under MR the entire Judiciary was packed with stooges. If any in the Judiciary differed, the fate that befell Shirani Bandaranayake was sure to follow suit. What is so demeaning in Ranil pointing out facts? How subservient the Judiciary was, is an open secret. Can Ranil be blamed for not indicting MR and family with a Judiciary packed with yes Judges both men/women who are totally biased to MR?

    It was reported that President Sirisena had told Ranil to be careful in promoting Arjun Mahendran for an extension as the Governor of the Central Bank. I think the President genuinely believed that Ranil was a so called clean politician. I too had the same views on Ranil.
    But after the Bond scam and how Ranil behaved in defending Arjun Mahendran, it became obvious that Ranil is not a clean politician! His involvent in the Bond Scam should be probed into.

    “Director of Carlton Sports Network (CSN), Rohan Welivita yesterday (10.08.2016) denied any knowledge of the Rs 157.5 million which allegedly belonged to his company.
    On a request made by the Financial Crimes Investigation Division, the Kaduwela Magistrate approved the transfer of the illegally procured Rs 157.5 million to the Central Bank.
    Speaking to Ceylon Today, Welivita, who was also the media secretary to former President Mahinda Rajapaksa, claimed that CSN was not informed of this transfer and that he was ignorant as to where this money, connected to CSN, came from.
    He added, “I have no idea what this is about. I am trying to find out what this money is and where it came from. I am discussing this with my lawyers. I didn’t know about this transfer, I found out via an SMS like all others.”
    On 25 August 2015 Welivita was questioned by the FCID, which the then Police media spokesperson ASP Ruwan Gunasekera stated was due to financial irregularities reported within the company. In the subsequent months, Welivita was questioned by the FCID several times and then was arrested, along with a few others, including former President Mahinda Rajapaksa’s second son, Yoshitha, in January this year, on charges of money laundering. They were released on bail in March.”

    What was the provocation for the PM to talk like that, especially in the floor of the house? Every one knows that MP’s speaking on the floor of the house can talk almost anything and everything and RW made full use of that except in making a clear charge against the CJ beacause then a substantive motion is required. So it was not a mere provocation but a calculated veiled reference of a threat. The obvious inference is that the CJ could not acede to one of those requests of the PM. Oho! in Queen’s Ceylon not a single politician dare would not make any requests even to a Magistrate leave alone either to the CJ or to any of the other judges. Of course the PM’s at that time were of a much higher standard than present fellows and would never refer to any one in the floor of the house as “ඒ් මිනිහ.” Such are the degradation of the entire population of Sri Lanka.

    There is absolutely nothing in his parliament talk that gives an impression that RW insulted the CJ. He related stories about how he ( before becoming CJ)was treated during the past regiment. Don’t see things through jaundiced eye. It was a jovial talk and he talked in a lighter vein.

    The only plus point for the jaunty Prime Minister of Sri Lanka
    is the gift of the gab.

    He does not think in normal terms. He thinks of a million jobs
    for his countrymen when he cannot find one hundred. He does
    not think of importing cars. He wants Volkswagen, the people’s
    car to be owned by every Sri Lankan. So he put up a factory which
    was just a garage and had no links with Volkswagen. He promised
    jeans to the farmer to replace their amude. He promised lap tops
    to the youth.

    He governs Sri Lanka with his gay friends, school and classmates.
    He speaks of grandiose schemes. His world revolves around a
    handful of his cronies.

    See how he tried to stall the no faith vote on Ravi Karunanayake. He
    was worried some references to him would come out. The JVP in
    fact said he should be probed.

    During the 40 years of politics, he has remained a complete FAKE.
    Has he not been over rated as a leader? His only strong point is to
    manipulate matters. Can anyone, except his bootlickers, point out
    any significant contribution he has made to the country. He loves
    travel, helicopter rides, pomp and pageantry like guard of honour
    etc.

    The whole country has now learnt that he is presiding over a
    highly corrupt empire and he is NO LONGER a Mr. Clean!!

    I wholeheartedly agree with Dimuthi Gunawardena though he has
    missed out on many aspects. What he has set out encapsulates the
    man who is UNP leader, Prime Minister, economist, strategist, planner
    and presumed visionary.

    Take a look at those he has chosen for his cabinet. Young men (with
    a few loving exceptions) are not encouraged to climb the ladder.One
    such case is enterprising Harsha de Silva. He spoke of the wrong doings
    in the bond issue was cut down to size.

    What the writer did not mention is how Ranil takes a vacation every
    two of three months from work. He goes to local resorts with good
    company. At least twice and year he goes on holiday overseas. Sometimes
    The local visits are timed with some official event so everything is at
    state expense. One such trip is now round the corner. That is for a house
    warming in Morawaka. Official engagements are being lined up.

    He has tailor made the UNP constitution. Like Kim Il Sung the dictator,
    he can remain leader until he dies. I do not wish that happen. The UNP
    will also die.
