President Can Appoint An Acting Chief Justice, No One Can Challenge It – Advice From Sarath Silva

The President can appoint an acting Chief Justice says former Chief Justice Sarath N. Silva. Under the article 109 (1) the President has this option, therefore Chief Justice Shirani Bandaranayake should think  about it and take leave during the impeachment.

Silva made above remarks with Sinhala weekly Irida Divaina today.

Article 109. (1) says;  If the Chief Justice or the President of the Court of Appeal is temporarily unable to exercise, perform and discharge the powers, duties and functions of his office, by reason of illness, absence from Sri Lanka or any other cause, the President shall appoint another Judge of the Supreme Court, or of the Court of Appeal, as the case may be, to act in the office of Chief Justice, or President of the Court of Appeal, respectively, during such period.

No one can challenge the clause “any other cause” Silva says.

    This man is most corrupted CJ we ever had in the history. That is a known fact to the masses. And MR has records to have worked with all uneducated, criminals, drug dealer mentality bearers and similar charactors. Perhaps, bird of a feather flock together fits more here. However, neglecting all dignity and respect, also knowing that his sympathizers would not agree with his current behavoiours but to continue in this way can end up with a tragody- hopes the best for a regime change. There are plenty of all kind of corrupted personalities in lanken society, but president^s nature to have close contacts with them clearly shows his unique nature of bad governance – that a president or any politicians must not have.

    Since the incumbent CJ is able to exercise, perform and discharge the powers, duties and functions of her office, because she is not ill, she is in Sri Lanka and she has no other cause not to exercise, perform and dischrge her duties, the former CJ is wrong. I think he has given another rope or money must speaking or a species of the opposite sex must be near him!
    By the way when the impeachment was handed over to the Speaker against him when he was enjoying a Monica Lewinsky when “gedara yana gaman”, did the then President appoint an acting CJ or did he withdraw from his office, though he was at least mentally ill to qualify under the illness clause for misbehavior by the road side?
    Only advice that can be given to him is “Palayan yako pissu nokela!” (Get lost!)

        The present Judiciary should take immediate steps to rectify the wrongs committed by Sarath N Silva. The first shoud be to uphold the Constitution preventing MPs crossing over. This will lead to all those cross overs being unseated, that would result in a balance of power. Thereafter everythng else would fall into place. This is one legal step to put the country back on track.

    Now the issue is, there is nothing that impairs the present CJ from performing her duties as stated above. Therefore what makes it required the appointment of an Acting CJ or an Acting President of the Court of Appeal, if the Party is Fit, Able and Willing to?

    No sensible head of state should follow the route suggested by Sarath Silva. It would undermine the judiciary and seriously so.

    The Chief Justice is not “his Chief justice” for a president to summarily replace her any time she wants. If he were able to do so then all he has to do is to get some allegations going and use it as a pretext to stand down the Chief Justice with another.

    Sarath Silva is a good example of how quickly political allegiances change in Sri Lanka today. This also shows how unprincipled and opportunistic Sarath Silva is. He must have accepted thirty pieces of silver from Rajapaksa to turn his back on those in the opposition he supported. He caused so much damage to the judiciary when he was the CJ and will continue to cause damage to the country by colluding with Rajapaksa.

If the opposition has become ineffectual the sole responsibility rests on the stupid people of this country. They have been presented over and over again now about 29 times to cast their vote for the opposition and establish a government that would reflect their wishes and uphold democracy. But look what they have done! They have casted their vote for the thugs of the government and now they blame everything on Ranil and the UNP!       If by ineffectual opposition she means the UNP, then she is wrong. They despite the turncoats within it who should have been excised are doing a sterling job within the limited resources available to them.

      Remember the Sri Lankan people are to blame for the situation we find ourselves in, by being taken in by the lies of the Ruling Cabal.

      It is only with hindsight that we realize the foresight of the UNP leader Ranil. Can we now blame him for not being on the same stage with Sarath Silva and Sarath Fonseka? Now they are both in disgrace.

      Stupid people question why Ranil was not more forthright against the impeachment. Legally his hands were tied and people even in his own party did not realize it. If his party is to judge in the PSC on the proceedings, how can they express an opinion on the case? Judges are NOT supposed to express their opinions on a case before the case is even heard. So in LAW all the statements made by the Government MPs and members of the Govt. PSC are out of order.

      RW’s legal point is that whatever they come up with and vote in favor of impeachment, it will be thrown out in LAW as the Judges had prejudged the case and therefore must go to a mistrial.

      Who then is able to Judge? NO ONE. So in Law the CJ cannot be impeached by the Kangaroo Court. The dimwitted Rajapakses don’t understand that, or rather they don’t care, that is until they realize they are in contempt of court, and therefore have to be guilty!!

      All this in the end is a technical farce. We just have to take to the Streets to overthrow this illegal regime and in law or not in every country where it has happened, NO ONE has challenged the legal right of the people!! Now how about that? I am sure the CABAL are counting on a passive electorate. When you push us just that much more we crack and it is likely that we will reach that point fairly shortly when the excesses just get out of hand.

      1) When one notorious minister’s son says that his hobby is to collect TOYS and he has four of them with one of them costing 400 million rupees without taxes. He also says he goes to the most expensive night clubs 3-4 times a week. The mystery is HE DOESN’T WORK.
      2)A provincial council member says a candidate contesting spends minimum 50 million rupees. He wants to sell his duty free car permit to recover some expenses.
      3) The ever famous “Can’t remember” is in a FOREIGN HOSPITAL FOR MORE THAN A YEAR….where as I have to fore-go one month’s salary or have to pawn my wive’s jewelry to stay 3 DAYS IN A LOCAL PRIVATE HOSPITAL.

      I can write many more but I don’t know where your nuts are when you read the newspapers. Moreover my mother never showed me a passport visa, or the parachute to show how I came to this world. I only can tell you is when I go to bathroom I leave my shit there, where as you leave them in this forum. Any way keep doing what you know best.

    Sarath Silva has said, “no one can challenge the clause ‘any other cause.” Yes, but on the condition if the CJ is “temporarily unable to exercise, perform and discharge the powers, duties and functions of his office.”

    “Any other cause” relates to something similar to “illness, absence from Sri Lanka.” Long term leave can be a cause.

    Is this the same Sarath N Silva, once upon a time a lawful CJ, who was then living unlawfully in “lawful adultery” with the lawful wife of another man, speaking on the lawful procedure of appointing acting CJs?. This man is the most disgraceful man ever to have sat on the bench of the CJ of this lovely country. He belongs to that breed of men, who are bred in the art of proving that “black” is “white” and “white” is “black” in order to gain political advantage. He being a “pot black” is now trying to compare a “white ceramic tea pot” to a “pot black” like himself.

    President can even appoint his OWN mother for this and other position when looking at the manner he has made appointees to the positions neglecting required qualifications but prioritizing his closness.

    Even late president of the lybia was not reacting to the manner that the lanken Incumbent president governs the country today. So, times ahead will be not nice for me – when reminding the fate of Gadapi – that was later end found on a drain.

    Gamini – One admires your consistent faith in Ranil. I agree he is streets ahead as an able/educated leader than most of the current dregs of sociey. He is of a total different calibre, coming from a generation of leaders of substantial wealth. The Island recently traced their ancestry to Parakrama Bahu, who by the way, was Tamil. That variety does not need to steal the meagre wealth of the public like the kleptomaniacs from the deep South who had stolen even the power structure. But he has to learn to be strong and fearless – unlike that trip from the airport when he had the clear and visible support of a million in the street – when some of his close advisers/Ministers told him to stand-up to the viles and trickery of the manly CBK when she unlawfully sacked 4 of his Ministers. He got cold feet and failed to stand against injustice – and let the entire nation down.

    I note you still trust he will come back to power. I agree many rich countries in the world will back him up to the hilt. Not for anything else but he has the brains, the men/women of ability behind him, who can lift this country to the heights JRJ did in 1977-1983. He will not go into cheap stealing from the till although some of his close friends who financially supported him till now will expect some form of quid pro quo. But this is not unusual so long as it is kept to acceptable limits. But the wimpish Ranil knows the Rajapakses will not give up without a fight – and that’s an area where the knicker-wearing left-handed batsman RW is congenitally weak. But, as they say, people certainly can change. I hope so in the case of Ranil – in the interest of 20 million.

      Senguttuvan, one naturally builds faith in a person from his conduct. I knew RW briefly when he entered the Faculty and I was doing my A/Ls. I was in the same circle of friends of RW. Stanley Obeysekara, Crystal Perera, Wijitha De Alwis, Jayantha Jebomoney and a few others. Once he became a Minister I found him not that friendly and I was not a person running behind any mother’s son. I was also very closely known to Gamini Dissanayake and family but I had my self esteem not to run behind any Politicians although I had very close relatives in both the UNP and the SLFP govts holding high Office. I always had my sympathy towards the UNP as they were the lessor evil of the two main political parties. There were more rogues in the other parties than the UNP. I was supportive of GD at that time, but after his demise I realised that RW is the most suited to take leadership of this country. I speak on his behalf not expecting anything but for my own good and the country’s emancipation. That is all. I feel confident he will take over this country to govern sooner than most expect.

    The phrase ‘any other cause’ does not mean any ‘reason’ that comes to the President’s mind. In lawyer’s speak any other cause must be ‘ejusdem generis’to the words that precede the phrase.

    The incumbent CJ is perfectly capable of discharging the duties of her office.

    Dear Gamini – You and I are in the same trajectory. Although I have my personal take on RW, as I said earlier, has no par today for the ideal leader to lead us out of the morass we are in. Every country whom we need to take us out – India, Japan, USA, EU, Australia – share this view. They trust him implicitly. I know many close friends of mine – who know Ranil well – concerned at his mercurial behaviour towards them. But that’s his nature. Malik and John A, two RW faithfuls, have to do much more to liberate him from this damaging weakness.

    I came to know Gamini somewhat just before his death. Excellent PR and fearless leader. Knows where he is going. He was courteous to me although he knew I came under Thonda’s (Snr) orbit.

    I watched former CJ’s interview at Derana’s 360 degrees. There were several deficiencies which he showed at the interview. He told the viewers that he had the practice of worshiping the Buddha twice in the morning before he took the bench. The implication was that he could not do wrong in his judgments because he was guided by the Buddha in his work. Then he said that in his confrontations with MR regarding the Hedging issue and fixing the retail prices of gases, he had to retreat because he could not bear the wrath of the President and the government. That is unbecoming of a man in whose hands people have placed the administration of justice. If he felt that that was the justice, whether he earned the wrath of MR or not, he has to deliver it to the people. At that level of positions specially created in the constitution, people have to take risks on behalf of the principles they uphold. Society does not respect cowards!
