Regressive Groups Continue To Throw Hurdles At MMDA Reforms

Archaic minded groups continued to be an obstacle by throwing hurdles at the Muslim Marriage and Divorce Act (MMDA) reforms, with the Colombo District Masjid Federation (CDMF) carrying out a signature campaign in an effort to hamper the reform process.

Muslims Sri Lanka Colombo TelegraphLast Friday, the CDMF launched a campaign to collect signatures from Muslim men against the reforms process. A letter in Tamil along with a form to list the signatories were circulated across several mosques in Colombo requesting Muslim men who attended Friday Jumma prayers to place their signature in the document which said ‘Please no changes to the Muslim Marriage and Divorce Act.’

The latest move however comes while a committee tasked with reforming the Act is in the process of finalizing the report which will be submitted to Parliament. “We are still working on it, but we will finalize it soon and the report will be handed over to Parliament,” a member of the committee who spoke on the condition of anonymity told the Colombo Telegraph.

The latest impediment led by CDMF has come under heavy criticism, including from Ameer Faaiz, Director – International Affairs of the Sri Lanka Muslim Congress (SLMC). “This campaign by this group is a very regressive step. We must acknowledge that MMDA needs to be reformed, if it is to stay on,” he said.

Faaiz told the Colombo Telegraph if such anti-reform attitudes continue, the same people who are against the reforms now will have to face a situation where the entire Act might be at risk of being abolished, if the Act is not allowed to be reformed in a timely manner.

“The State must take ownership, and ensure this law is on par with other laws. There must be equality and it is the responsibility of the State to ensure that equality among all will be enforced,” he said.

Faaiz also highlighted that while there were some theologians who opposed the reforms, there were also quite a number of theologians who had voiced their support to the reforms. He recalled how one theologian had emphasized that age is not only about being physically matured, but one needs to attain a level of understanding where a contract can be understood by someone who is signing it. “Even Muslim countries have progressed and have enforced a minimum age of marriage for females,” he pointed out.

Meanwhile, Amjad Saleem, who functions as an independent consultant noted that the MMDA was not cast in stone and therefore deserve discussion and reflection. “I think there should be space for improving or making things better given the new context. If there are reforms to be done, then we should embrace it,” he added.

Due to the MMDA of 1951, Muslim women in Sri Lanka are openly discriminated and suffer from laws that deny them equality. The MMDA also offers no constitutional guarantee to safeguards the fundamental rights of equality and non-discrimination of Muslim women.

Late last year, the Sri Lanka Thawheed Jama’ath (SLTJ) led a demonstration in Colombo against the MMDA reforms, demanding that child marriages be allowed. Many studies have also highlighted the ugly sides of the Act including where girls as young as 14 were forced in marriage. The report titled ‘Unequal Citizens: Muslim Women’s Struggle for Justice and Equality in Sri Lanka’ released last year also sheds light to the harrowing experiences Muslim women undergo in the hands of the Quazi court system.

Women who have also been working in the MMDA reform process has been subject to various forms of harassments, while some activists were even threatened for their reform work. (By Munza Mushtaq)

        The Sri Lanka Thawheed Jama’ath (SLTJ) is really the Sri Lanka Wahhabi -Salafi-Thawheed-ISIS, Takiban-Boko-Haram Jama’ath with the Iblis, Satab, Shaitan following Wahhanis-Salafis behind it.

        They do not belong in Lanka, the Democratic Socialist Republic of Sri Lanka.

I think many Muslim women are doing well in life. I was in the negombo area a few weeks back, and the person who was manning a boutique who also happened to be its owner was a Muslim lady and her two children! So I don’t think Muslim women are as oppressed as you put it.

        Equal rights for woman and man is a misnomer. If it is true, man and woman should be put together in all games including cricket and foot ball. Can a man get pregnant and bear children? A man can walk on the road with a pair of shorts only. Can a woman do this? Islam recognizes these physiological differences in each gender and attaches the rights and duties accordingly but not equally.

        Islam prescribes a complete way of life. It is in most of the cases obligatory on every Muslim to follow this way.
        The way of life followed by Muslims do not cause any harm to non Muslims. It is not the business of non Muslims to meddle with the internal affairs of the Muslims.No body attacks Christianity, Buddhism or any other religion in the same way as Islam.In a way such attacks contribute for the growth of Islam. Islam is on a solid foundation.

There are eminent scientists believing in the Bible but they constantly admit, they do not believe in it literally, E.g. Universe was formed in 6 days etc. But you cannot do this in Islamic Quran. You either believe in it literally wholesale or become an apostate, the penalty for which is death. This was accepted in medieval times, but these days people have access to superior education, world opinions and religions, it is an impossible task.

        Because the Earth is huge and its curvature cannot be seen from a short distance, it appears to be spread out and one cannot see anything that would make one fear living on it, but this does not contradict the fact that it is round, because it is very big. However they say that it is not evenly round; rather it is indented or pushed in at the north and south poles. Hence they say that it is egg-shaped.

        Thus it is known that the Earth is round, and that is not contradicted by the fact that it is like an egg. Rather the false view is that which claims that it is flat, as the Church used to believe and for that reason used to curse and burn those scientists who said that it was round.

        Just go to the sea and observe, ships disappearing in the horizon ! Why it is because of the curvature of the earth. Any kid knows this.

        Today scientist have come to accept the scientific facts mentioned in the Quran. A few years ago the Nobel
        Prize was awarded for the one who found out about the expanding universe. This has been mentioned in

          Facts, data, and observations are hard for those believers who are brainwashed and immersed in the myths, lack reason and critical thinking skills, and believe in the literal interpretation of the scriptures. This is general, and Muslims are not an exception, but prominent, courtesy of Wahhabism. Just read up on Copernicus, Galileo, Kepler, Newton and Foucault. Still 25% of american, 354% of the Europeans and perhaps more than 50% of the others still believe that the Sun goes around the Earth, as claimed by the scriptures.

      Ask the question, why are they destitute?

      Is it because they are suppressed more than their fellow citizen women of other communities, on a relative basis.

      When they are divorced, they are more destitute than their fellow citizens.

      They are restricted in the work and the professions they can practice.

      Repealing MMDA will help reducing the destitute-ness of the the Sri Lankan Muslim women.

      Now Muslim women in the island do not dress in this Tamil Muslim style. Wearing the saree and just covering the head. This sort of dress, that was very common around 25 years ago, belongs to a by gone era or still worm by some elderly Muslim women, who still stick to their Tamil Muslim tradition. Now instead of progressing they have become regressive and cover their entire body and hair and most of the face in the Arab Muslim style, and try to look like some pathetic carbon clones of the gulf Arabs. The regressive extremists elements have indeed taken over not only creating chaos within their community but even to the rest.

    The fact that a Committee of Muslim Professionals and Theologians appointed by the then GOSL to examine and recommend amendments to the MMDA of 1951 will be celebrating it’s 8th Anniversary sometime in 2017 without being able to submit even a Draft Report of it’s recommendations, reflects poorly not on it’s constituent members, but rather on the Muslim Community in general and on the religion of Islam in particular.

    It throws sharply into focus the ambiguity, lack of clarity and direction in many aspects of Islamic law and it’s sources of inspiration and interpretations. So much so that to the amusement of it’s non-Muslim compatriots the local Muslim community is beginning to look like a headless chicken trying to find it’s way out of a hole.

    I would request my Muslim brothers and sisters to dwell on the words of Galileo Galilei “I do not feel obliged to believe that the same God who has endowed us with sense, reason, and intellect has intended us to forgo their use.”

    Why do we need to have a separate act or law in the first place?

    Despite whatever race or belief structure practiced by yourself, we are, at the end of it all Sri Lankan.

    We should follow one law where marriage and divorce is concerned with the fundamental rights of either party enshrined at the heart of it.

    If you dont like it, maybe you need to find a different country to live in…

Meanwhile, in lands from Persia to Spain, Islamic culture, science, philosophy, reason and inquiry was thriving, dazzling those Europeans fortunate enough to catch even a glimpse of the scientific advances coming from Baghdad, Antioch, or Toledo. There, philosophers, mathematicians, scientists, and astronomers were steadily advancing the frontiers of knowledge, as well as revitalizing the works of Plato and Aristotle that had been lost or forgotten.

        Central to this effort was the royal library in Baghdad, known as the House of Wisdom, where an army of scholars worked at the behest of the Abbasid caliphs.

        Thre were brilliant Muslim thinkers, such as al-Khwarizmi, pioneer of algebra; Avicenna, the physician and philosopher, Gaber, who made great advances in chemistry; and Ibn Rashd, Averroes,one of the greatest Islamic Scholars and Philosophers, a polymath, renowned simply as ” The Commentator” for his writings that expounded and extended Aristotle’s great works of logic.

It has been stated that early Muslims, based on the Quranic verses, “And say: My Lord increase me in knowledge.”(Qur’an, Ta-Ha 20:114), interpreted the acquisition of knowledge mandatory for Muslims, to explore what God, Allah, has created.

        This is because knowledge is the basis of all good; it generates actions that are based on the commandments of Allah and the instructions of the Prophet . Hence, every Muslim must instil in his mind a desire to seek knowledge. Allah (Most Exalted is He) instructed His Prophet — and thus all Muslims — to ask Allah to increase him in knowledge. He said:
        “And say: My Lord increase me in knowledge.” (Qur’an, Ta-Ha 20:114)

        The first speculative theologians in Islam are called Mu’tazilites ( from about 723 CE). A later generation of theologians, the Ash’arites, named after Al Ash’ari, born, 773 CE, are forced by weight of evidence to admit a certain irrationality in theological concepts.

        The Ash’arites,hold the middle way, between the traditionalists ( who literally interpret the Quran) saying Revelation is above reason and Observations, and the others,Mu’tazilites, who affirm that reason unaided by revelation is capable of religious truths.

        Unfortunately, by 1,200 CE, due to the theology of Hamid Al-Ghazali, the HEGEMONY OF ULAMA AND MULLAH, the so-called Islamic Scholars and Theologians, prevailed POLITICALLY.

        Revelation was elevated above Reason and Observations. The traditionalist Theologians were happy, and they were able to maintain their hegemony. Reason and Free inquiry declined.

        The Islamic Science and philosophy has not recovered since the 12th century. With the advent of the Devil, Satan, Iblis following Wahhabites (Wahhabies, Salafies, Tawheedis, ISIS, ISIL, Taliban, Deobandi, Boko-Haram and other clones), the task of recovery has become much harder.

        Meanwhile the rest of the non-Muslim world of making great progress in Science, Development and in other spheres.

        Have the Muslims identified the problem, yet?

        By the mid-eleventh century, the Muslims were hard at work on three great cultural projects, pursued respectively by scholar-theologians, philosopher-scientists, and Sufi mystics. At this juncture, one of the intellectual giants pf world history was born of Persian-speaking parents in the province of Khorasan.His name was Abu Hamid Muhammad al-Ghazali.

        In his day, some Ulama had elaborated a theology to compete with that of the Mu’tzalites. The Asharite school, as it was called, insisted that faith could never be based on Reason, only on Revelation. Reason’s function was only to support revelation.

        Asharite Theologians were constantly squaring off against prominent Mu’tzalites in public debates, but the Mu’tzalites knew fancy Greek tricks, for winning arguments, such as logic and rhetoric, so they were constantly making Asharites look confused.

        Ghazali came to their rescue. Then he wrote a book on Greek philosophy called The Aims of the Philosophers. Then he wrote the Incoherence of the Philosophers.He attacked the cause-and-effect relationships among material phenomena.

        Gahazali allowed that mathematics, logic, and even natural sciences could lead to true conclusions, but wherever they conflicted, with the Revelations, they were wrong. But if science is right only when it reaches the same conclusions as revelation, we don’t need science. All the truth we need we can get from the revelations. This is the position of the theologians, and those who literally interpreted the revelations.

        Some of the philosophers struck back. Ibn Rushd, Averroes, wrote a reposte to Ghazali called, The Incoherence of the Incoherence, but it did little good, even though Ghazali was shown to be error 17 times,and when the smoke cleared, Ghazali had win the day.

        From this time forward, Greek-based Muslim Philosophy and science lost steam and Muslim interest in natural science foundered. It has not recovered since.

        A expected, Ghazali won tremendous accolades from the theologians for his work. The political leadership of the Caliphs went along.

    I don’t know what the MMDA comprises, but Muslims SHOULD fight against child marriages. As the Quran says that an individual can only marry under the following conditions:

    1. Reached of age where he/she can take over control of his/her properties and

    2. Has the maturity of mind to take the solemn covenant of marriage. This solemn covenant is the same type of covenant taken by the prophets before God and also by the Children of Israel. It is a weighty oath and it is doubtful a child can take it.

    Equal rights for woman and man is a misnomer. If it is true, man and woman sould be put together in all games including cricket and foot ball. Can a man get pregnant and bear children? A man can walk on the road with a pair of shorts only. Can a woman do this? Islam recognizes these physiological differences in each gender and attaches the rights and duties.

      There are lots of things that men cannot do , what women can do. Apart from it, earlier women were not allowed to study and now look at the AL results and the University Entrance results. They are doing far better than men. Women are living longer than men.
      Women are topping legal and medical professions.

        If physiology is to decide on the rights, disabled folks would have separate rights. When men and women become elderly, they are feeble therefore they should have less rights. All men are not equal. Physically and mentally they are different. Some men are superior to some men and some women. Some women are superior to some women and some men. In fact, they only ratification required was the 21 UN world conventions, which SL had always been a signatory. Some of which included labour regulations, manufactured products compete with other Int’l markets and human rights, which was in short supply under MR’s regime. Now that the country’s HR situation has vastly improved, the EU is reconsidering granting this preferential treatment afforded to only 13 other poor and least developed countries.

    The Quran on Men and Women:

    The Quran, in addressing the believers, often uses the expression, ‘believing men and women’ to emphasize the equality of men and women in regard to their respective duties, rights, virtues and merits. It says:

    “For Muslim men and women, for believing men and women, for devout men and women, for true men and women, for men and women who are patient and constant, for men and women who humble themselves, for men and women who give in charity, for men and women who fast, for men and women who guard their chastity, and for men and women who engage much in Allah’s praise, for them has Allah prepared forgiveness and great reward.” [Noble Quran 33:35]

    This clearly contradicts the assertion of the Christian Fathers that women do not possess souls and that they will exist as sexless beings in the next life. The Quran says that women have souls in exactly the same way as men and will enter Paradise if they do good:

    “Enter into Paradise, you and your wives, with delight.” [Noble Quran 43:70]

    “Who so does that which is right, and believes, whether male or female, him or her will We quicken to happy life.” [Noble Quran 16:97]
    The Prophet of Islam (peace and blessings be upon him) said, “Women are the twin halves of men.” The Quran emphasizes the essential unity of men and women in a most beautiful simile:

    “They (your wives) are your garment and you are a garment for them.” [Noble Quran 2:187]

    Just as a garment hides our nakedness, so do husband and wife, by entering into the relationship of marriage, secure each other’s chastity. The garment gives comfort to the body; so does the husband find comfort in his wife’s company and she in his. “The garment is the grace, the beauty, the embellishment of the body, so too are wives to their husbands as their husbands are to them.” Islam does not consider woman “an instrument of the Devil”, but rather the Quran calls her Muhsana – a fortress against Satan because a good woman, by marrying a man, helps him keep to the path of rectitude in his life. It is for this reason that marriage was considered by the Prophet Muhammad (peace and blessings be upon him) as a most virtuous act. He said: “When a man marries, he has completed one half of his religion.” He enjoined matrimony on Muslims by saying: “Marriage is part of my way and whoever keeps away from my way is not from me (i.e. is not my follower).” The Quran has given the raison d’�tre of marriage in the following words:

    “And among His signs is this, that He has created for you mates from among yourselves, that you may dwell in tranquility with them; and He has put love and mercy between you. Verily in that are signs for those who reflect.” [Noble Quran 30:21]
