Secretary General of the UNP Mr. Tissa Attanayake was quoted in media on a statement made by him this Saturday (05 January) to the effect, the UNP members who represented the select committee refrained from appearing in the Appeal Court as the impeachment motion was a matter that had to be dealt with in Parliament (emphasis added)

He had then said, they urge the government to introduce laws in line with the Commonwealth ‘Latimer House Principles’ on the removal of judges before going ahead with the impeachment motion, as it is the best option for the government, in the wake of the Supreme Court determination which declared that Parliament Standing Orders were not laws. (emphasis added)

Who ever who drafted this statement for Tissa Attanayake, needs to at least have some sense of ‘logic’ in arguing a case. Why go with the SC determination to have “Latimer House Principles” adopted for the conduct of judges, IF you don’t accept the judiciary has a right to interpret what is legal and what is not, about the impeachment ? IF you don’t even want to appear before the judiciary, saying the parliament is ‘supreme’ ?

Why the UNP has to go along with that stupidly confused argument is because, every one in the UNP is gagged and warned not to speak on the impeachment by their almighty leader Ranil Wickramasinghe, while the party was told to follow his disastrous leadership. Wickramasinghe does not talk politics of this impeachment. He avoids questioning why this Rajapaksa regime wants to impeach CJ Bandaranayake, who was a very loyal judge and a CJ to the regime, till Secretary JSC was asked to issue a statement that marked the conflict in public.

But, can Wickramasinghe deny the fact, this fight is only between the President and his regime and the Apex of the Judiciary, the Supreme and the Appeal Courts and has nothing to do with the parliament, except for the fact that it is being used by the Presidency to have a pre decided ruling of their own, against Chief Justice Bandaranayake?

Can Wickramasinghe disagree with the conclusion, this whole tragic episode of the impeachment against CJ Bandaranayake, WILL end after the two day parliamentary debate on the PSC Report takes a vote and the President would be advised on a majority vote to remove Dr. Shirani Bandaranayake from her post as CJ, exactly as he has directed his mouthpieces to do ?

The decision to have the post of Chief Justice vacant, was for sure made even before the 117 MPs were called upon to sign the impeachment motion. How it could be achieved was the only question that begged an answer. From the goon attack on the JSC Secretary Thilakaratne to the handing over of the impeachment motion to the Speaker and even after, the Rajapaksa regime would have been more than happy and comfortable too, if they were able to secure the resignation of Bandaranayake from the CJ’s post, than having to “remove” her from the post. They went into a dilemma when she did not resign from the post with a stout backing from the legal fraternity, though probed by many proxies of the regime and pressured to accede to the regime’s wishes. That was what compelled the Rajapaksa regime to keep pushing the impeachment process to its final conclusion for a vote in parliament and that is why there is now no turning back for both sides. For the regime, they can not waste time either, with “anti impeachment” protests gaining ground as “anti Rajapaksa” protests. They surely must be feeling their own Sinhala, urban middle class base turning angry against them.

This aggravating tug of war for each others stand point, was taken up by those lawyers who fought to save the CJ, more as a battle on a legal platform. That was what brought this debate about what and how the co-existence between the judiciary and the parliament should be. Ranil Wickramasinghe was in no mind to get into this debate as a democratic political leader. He is NOT prepared to accept a parliament that would have to accept judicial independence in par with the legislature. It was therefore his very abstract a-political interpretation of a “Supreme” parliament, the Rajapaksa regime is firmly fixed to.

His claim for parliamentary supremacy over the judiciary, is not valid and pretty much dangerous for a society that is fighting hard to live democratically, coming from a leader who would not allow any collective decision making within his own party. Ranil Wickramasinghe has proved he is NOT a leader who would allow democracy even within his own party, feeling secure now after he screwed the party to elect him leader for 06 years. There was no report of the UNP parliamentary group deliberating on what their position should be on the impeachment and whether the UNP should participate in the PSC. Therefore, Lakshman Kiriella MP and one of the two MPs who sat in the PSC from the Opposition, took it as his right to say he would abide by the notice of the Appeal Court and said so publicly. But Kiriella could not do what he thought and said was the right thing to do, because Wickramasinghe said “NO” and not the party. There was NO discussion within the UNP on that.

His gagging every UNP Parliamentary Member and denying them from taking an independent position on an extremely important and serious national issue, belittles and contradicts his own position that the parliament is supreme. How can this parliament be supreme, IF the remaining UNP MPs from the 60 elected, can not decide collectively what their position should be in parliament on the impeachment ? IF they are arrogantly gagged and they can not democratically decide, it only means they are compelled to forfeit their right to represent their constituency. Therefore what Wickramasinghe wants as a “Supreme” parliament is one that would decide and act the way he wants. His perception of a supreme parliament is not a democratic House that represents the people, though elected by the people.

Therefore what difference if any is there in UPFA members of parliament voting for the impeachment as dictated by President Rajapaksa because his regime now wants a CJ of their choice and the UNP members of parliament being driven to debate the impeachment motion report and legitimise the action of the Rajapaksa regime, because the UNP leader wants a parliament of his choice to decide his way ?

People’s representation is deformed and warped in there, any way. Wickramasinghe should know best that the vote his party received at the 2010 parliamentary elections is not reflected in this parliament any more. He should also know, after the 1978 Constitution with a powerful Executive Presidency, the parliament is now subordinate to that power in every way. It is not a “supreme” parliament now and can not act supreme, independent of that executive power as a legislating body. This parliament is therefore totally alien to what this society wants and expects from an elected parliament.

In such political context, the UNP decision to allow this regime’s 2013 Budget to go through the House unconstitutionally and with their participation, was not a decision taken collectively by the UNP parliamentarians, but one where the UNP leadership compromised with the political necessity of the Rajapaksa regime. Therefore, having participated in the budget debate and voting against it, in making the unconstitutional Budget legitimate and constitutional, Members like Eran Wickramaratne grumbled in public that the Budget is “unconstitutional”.

Such is what Wickramasinghe is scheming and manipulating over the impeachment motion against the CJ. His decision therefore has to be publicly condemned by every citizen and politically challenged at every level of the party organisation, from local government bodies, through provincial councils to party MPs and electoral organisers. The big question for the UNP is, can they win back some democracy for them in the party, before talking of democracy for the people and society. Or else, any regime change would only mean, a change of faces but not politics of arrogant power.

    Under the clutches of Rajapakse no opposition party/leader can function effectively. If Ranil tries to be smart, Rajapakse will buy a few more UNP MPs to undermine the position of Ranil. We all know how Rajapakse destroyed the UNP.

    No opposition political leader can win any election against this tyrant; he will play all dirty games to win any election – he very well knows he will be in a huge trouble if he loses the next Presidential election.

    That’s why I have been saying we must bring CJSB as an independent candidate to defeat this tyrant. I think she has the charisma to wipe him out. Of course, all political parties must support her. Her objective should be specific: dissolving the parliament; conducting a fair parliamentary election and dismantling the executive presidency.

      Why worry about Latimer principles and procedures and ethics? If an elected government does not want a dodgy CJ it should be able to get rid of her after all she was appointed by the government in the first place. When she was appointed the opposition cried foul and now she has become a paragon of virtue to them.Look at all the anti government pundits and traitors trying to split hairs with the impeachment issue . Where were these pundits when the JVP and the Tigers were killing thousands of innocent people ? Where were these traitors when the previous government was prepared to hand one third of the country to the Tigers? Mahinda destroyed the terrorists and saved the country now all these pundits and traitors have got the freedom to undermine the government and try to defend a dodgy CJ. I ask the government to sack all these dodgy judges in the Supreme Court and Appeals Court and throw out the dodgy CJ and also kick the back side of the Black Coats as well.     Is it also possible that Ranil is laying a very devious and nasty trap for president Rajapakse? It seems the president has walked into it with his eyes wide open! Pay back time probably for the president for stealing Ranil’ s men in parliament. It is also seeking his revenge cunningly for his defeat in 2005 with the purchased support of the mercenary VP. It is battle of wits between two individuals, in which the interests of the country have no place! However, both have lost in the public eye.

    Yes, one of the biggest casualties of this impeachment is RW. As i saw in in several sinhala writings at lankanewsweb and by relatively upright people like Elmore P. whatever (false) claims he had as a “thought leader” to borrow a phrase from RW’s beloved conservative movement, his being stripped mercilesly together with any claims for same by acolytes such as the officials in his party.

    So, please don’t waste your efforts on exposing them.

    The issue that you brought up (asking the opposition to boycott the debate denying the veneer of parliamentary democracy) is not an issue any more either with the SC ruling made public on 3rd.

    If you are serious and has any inkling what this regime is upto ( as you should know as a helpless eyewitness to sivaram’s abduction) your energies and focus must be on much more sinister and dark deeds, as this RW is already in the history of dustbin.

    If you read the process correctly, this has gone beyond so called parliamentary and party politics, where ruling regime can virtually do anything to its opponents, political and ethnic.

    Now this is in the realm of the not upholding the constitution, including RW.

    So, I hope your will focus on these new challenges, instead of flogging dead horses.

And all my relatives and friends have so far been brainwashed with the true state of affairs of course never to trust RW he is one day IF ( not happening) elected to office of the executive will be worse than ,Rajapaksa. JRJ was much cleverer than Ranil but he was also very old. Look at the destruction he caused. This man is already older than JRJ physically and, he is diabetic , he is already worse than JRJ. He has , been extreamly vindictive in this CJ fiasco. He is laying no trap .he has put self before country.
      In the CJ fiasco it is about the office and not about Bandaranayake . But this man does not care. Never ever vote for this thick skinned ,shameless man ever again.     It is unfortunate to view that the democracy, in dependency and whole political and administrative structures are spoiled and deteriorated. There is a big responsibility and roll for new and old media to play. This is high time for all media and their actors to inform the people and mobilize them to achieve true democracy and power. Media and actors of them like Kusal should get together to restore Order, Equity and Freedom of the state. We are lucky to have people like Kusal performing well his role to make the people informed and mobilized. But..we need more and more Kusals!!

    I am not sure why the UNP exists as a political “Party”. It appears to act according to the whims and fancies of its leader, Wickremasinghe and as such for reasons known only to himself fails to provide any tangible opposition to the corrupt and anti-democratic actions of the Rajapaksa regime. Is it because Wickremasinghe feels that the UNP will never come back to power as long as he was leader and so is manipulating his position as the leader and enjoy all the perks that come with that position?

    He may also be colluding with the cunning Rajapaksa to exert his authority over his party MPs. It is a terrible shame that at a time of great need for the country under threat from the vile Rajapaksa brothers the opposition is totally standing idle and neglecting its duty as the elected opposition.

    few years ago i had lot of respect for RW but now its all gone with the wind , RW’s mentality is somewhat similar to MR , that he thinks every one is dumb & deaf , luckily only RW die hard supporters (absolutely dumb )are backing and standing by him for what ever reasons , as far I see these were/are the few colossal blunders committed by this contemporary Don Juvan.

    1) Sidelining and dumping general SF soon after his release from prison (similar to MR’s dumping after the war victory )
    2) Manipulating the whole process to elect himself for 6 long bloody years (similar to 18 th Amendment )
    3)sidelining all the descent(Sujeewa S, Buddika P, Thalatha A, Dayasiri,Rosi et al )
    4)collaborating with all the” eheiyyas ” (John A, Joseph M, Jayawicrama P , Karunasena K , Tissa A et al )
    5) Having under hand dealing with notorious brothers.
    6) Giving the full blessings for the squalid impeachment saga.

        This is a myth that continues to circulate among public for both MR and RW

        1) people who are dumb & deaf believe there is no other potential leader to replace MR among 21 million people.

        2) Equally bias & blind RW supporters continue to spread the same falsehood about RW , that no one is to replace RW , hence continue to put up with his autocratic/selfish /self centered dictatorship .

        i’m afraid i don’t see any truth in both assertions , as far as UNP concern the party needs real reforms not pseudo reforms , UNP needs to change it’s constitution favorable to it’s supporters and the country at large not the party leaders whims & fancies.
        to answer your question about replacement , at the moment karu Jayasooriya is a hopeful , i know he has committed so many blunders after blunders ( without any shame he pole vaulted along with 17 other MPs to strengthen MR’s hand , unsuccessfully tried to challenge RW). if one takes karu’s political career , there are not many corruptions , bulling , misappropriation of funds , abusing power associated with him , so far he has been a gentleman and proved that he is not after money or building a dynasty .

    Kusal’s concerns and fears are clear in berating RW in his last line of his article. ‘Or else, any regime change would only mean, a change of faces but not politics of arrogant power’. May I remind Kusal that to cleanse the Mess and Corruption created by the Rajapaksas and his Cohorts, the future leadership of a regime change certainly needs the Powers to put this country back on it’s tracks and establish Law nad Order. This society can be assured that RW will not use the Powers vested for Political Nepotism as the Rajapaksas has done to promote family and friends. Neither will he try to save any from Corruption or wrong doings as done by MR. The Judiciary will have it’s Independence to perform on it’s own merit and so the Legislature. All Public Servants will have to take Responsibility and Perform without favours and fringe benifits. No one need any connections to know any in the system for what is rightfully due to the masses. This is the difference we will see with a Regime Change in this country, although some are sceptical at the moment fearing of losing their importance in the society as VIPs.

I wonder whether these assholes understand that the killing of Rajiv Gandhi was a direct result of JR’s IPKA initiative and thereafter the destruction of LTTE though reluctantly had to be tolerated by India due to Rajiv’s killing by the LTTE! If anybody takes the pain to read the last statement of Tissa Attanayake it will be clear that the stance of UNP from the beginning to the end is very correct, factual, practical, shrewd and internationally and strategically viable and correct. It was the UNP who surfaced and questioned the CJ’s husband’s deals with the regime, the regime was exposed and cornered and forced to take action against the CJ’s husband, regime already had a grudge against the CJ and they thought of getting the support of UNP to get rid of CJ, the statement of Ranil about the supremacy of parliament pumped adrenalin to the brainless meat-trunks of the regime, they conducted fast forward and overtime featured impeachment trial and there you are-sinking ever so deep into a quagmire of gradual suffocation and death! While you all fuckers were dragging by the leg of Ranil including those maggots within his own party such as Sajith et al this country is now in the verge of constitutional crisis involving breaching of the very constitution by the Executive and the Legislature signifying that the Executive and the Legislature render themselves unfit to hold their official positions and liable for being impeached for contempt of court and contravention of the constitution! This regime cannot only be liquidated by the timid moronic fuckers like those I referred here but there must be an international intervention.     The dilemma that is Ranil! He is faced with a huge conflict, owing to the exercise of insane judgments in the past by the Judiciary, (schizophrenically run) which has been the single biggest reason for the demise of the UNP, and the blame solely falling on Ranil W, and the clamoring opposition against the Government being directed at defending this self same judiciary.

    Ranil’s personal rationale of taking it out on legal eagles, and letting them stew in their own shit, is not sitting well with the populace, and his own MP’s. His assertion that Parliament is Supreme now sounds old fashioned, but if he DOES NOT stress that, the Sarath Silva judgment gets credibility.

    Unfortunately an illiterate populace, and even more illiterate media, who will never understand such basics, are bent on splitting hairs about RW’s stance, and blame him for giving the President a free ride in the impeachment process, and many even have the affront to accuse him of conniving with the President in the current impasse, which he finds amusing.

    It is a terrific story for a convoluted spy novel, but we are playing poker with the future of the Country at stake and only one individual understands what it should be for Sri Lanka to regain its rightful place at the top of the world.

    No guesses therefore that RW is scheming for Mahinda to eat his own shit, and he is dumbfounded that his own party is obstructing him in doing so.

    The game is very simple. Do not challenge the Supremacy of the People as represented by a theoretically democratically elected Parliament. The impeachment process will be handled in the way the Constitution permits, and will be passed by the Govt. with the majority and by Friday, the CJ would be fired. As per the current rules. Then all hell brakes loose!!!

    Hey Presto! Who will look a fool dictator and a moron? MR only. That done, and the Judiciary well and truly compromised, all prior judgments of the SC will be challenged. SC will rule against the Govt. and we will discover that the Parliament is incorrectly constituted. All cross-overs will lose their representations and the 18th Amendment declared illegal, and therefore the 17th will automatically be enforceable, with MR effectively being time barred from challenging RW at the next Presidential.

    TIME is of the essence, and TIMING is most critical. RW therefore does not want to raise any eyebrows, and let his detractors sling mud mercilessly decrying all his dictats as dictatorial. Trust me he is the only true democrat we have who wishes, to reintroduce democracy to the political fabric of Sri Lanka, no matter what allegations have been laid as to how he runs the party. Eventually when he is proved correct, the electorate first and then the Party will forgive him for being sly and not explaining his plan, lest the enemy will stifle him from achieving his goal.

    For the moment let us say, that the conflicting points coming out his spokesman like Tissa Attanayake saying, Parliament is Supreme therefore do not challenge it, and get fooled into going through with SC rulings just yet, and then later forcing Latimer House Principles to dictate how a properly constituted court should act and then accepting the ruling of the Supreme Court when properly constituted, is lost on some biased journalists.

    They should not question a system in Sri Lanka that is inherently flawed today, and try to find rationale in a statement made by Tissa Attanayake, but wait for reason to prevail, correct some of the flaws in the system, and then re affirm the true independence of the Legislature from the Judiciary and Executive, where Parliament reigns supreme as a true reflection of the will of the people, something which it is not today in practice, but in theory cannot be legally questioned.

    We will then get back to the simple principle as in all democracies that Parliament can make laws, and the Supreme Court merely interpret the laws, with BOTH bodies independent of the other and not tainted as it now is.

    Unfortunately until we have enough reasonable people to be able to explain simple concepts, we cannot show the general public what it is we wish to achieve. In truth, because they are unable to make that decision, that they elect representatives, and appoint judges through independent processes, both of which is currently non-existent. So give RW credit for attempting to bequeath a legacy of being a true liberal democrat in an increasingly mindless, violent, lawless state of ruffians, hooligans and murderers disguised as Chief Justices, President’s Counsel, Presidents, Ministers and Members of Parliament. He may be the only true patriot we have left, though I do not wish to use that term, as it now refers only to traitors in Sri Lanka.

    Not only by coming to power one can serve his country or
    democracy or punish tyranny.By not being an obstacle to a
    suitable candidate and stepping aside paving the way for
    someone else to carry the flag,one can achieve desired
    result on behalf of the fellow country men.People are in
    the dark about the next generation leadership from both
    Govt and opposition (mainly UNP)sides.Some are trying to

    Ever since we got Independence the Parliament was run by two major powers and they make sure no body else will interfere into their property…..either judiciary or SC or Appeal’s court.

    RW’s priority is not to seek justice for the people or CJ whom should be his first priority to serve people he represent………but to help MR to hold onto parliament powers for the long term financial, political and administrative benefits.

    I am still tryying to find what RW’s annual parliament pay……as Tiran Alles said on the other day in parliament debate that RW is getting Rs: 86 Million Per year. I still don’t know if this true or this amt.is for the whole UNP MP’s as salary……only if anybody could confirm.
    Maybe Mr.Kusal Perera could find out.

    I personally think that Parliament is run like a family business…..and the reason for UNP two PSC members not participating for the Appeal’s court hearing could be part of this deal.

    Ranil’s dream of becomming the next President is just a dream,…….. but with a hefty Rs:86 million as opposition Leader’s annual salary….one cannot say it’s a dream..

          Mr. Jayantha, I will need some time to give a complete reply to your long post. However after a glance I see you are not fully conversant with the facts, the line of thinking of Ranil and UNP as a political leader and a party. I am thousands fold confident you have never come across and spoken to someone knowledgeable in the party about these issues or made serious analysis of UNP politics. How and why do you hold these views? I think you are getting most of these things from the media in the country. I don’t think I ever require telling you there is no free media any more in this country from a long time-after Eknaligoda and Lasantha all these timid unprincipled traitors so called “journalists” are fornicating themselves. The collective consciousness of people have been totally conditioned and destroyed by the regime and no wonder you are writing these views believing they are genuine facts. My only request to is to speak to someone in the party who can explain these things to you, watch the television debates where top UNP party leaders feature, undertake more skeptical, penetrating and pragmatic research into the political realities in the country. By looking at the effort you have made in compiling your post I feel you deserve better than sometimes harshly treated by me since I cannot help write the way I write as your comments make me do that. When you say you do not belong to any party then why must you make all this efforts and then face brick bats? Criticizing just for the sake of criticizing will not result in anything other than just frustration and humiliation which I do not think any human subject himself to.
