Serious Doubts On The Inquiries Into The Mass Graves At Matale: Gota The Suspected Perpetrator

“Serious doubts have emerged regarding the future investigations into the mass grave at Matale where the remains of 156 persons have been found. In today’s press it was reported that the Judicial Medical Officer in charge of the investigation has been transferred (JMO in charge of Matale mass grave also to be transferred — Sri Lanka Mirror, May 20, 2013). Furthermore, it is also reported that the magistrate conducting the inquiries is also to be transferred,” says the Asian Human Rights Commission.

“There is a widespread fear that the government may sabotage the inquiry, particularly as some of the names of suspected perpetrators include some powerful politicians. Among them the most important is the recurrence of the name of Gotabaya Rajapaksa, the President’s brother who is now the Secretary of the Ministry of Defence and who has been mentioned as the Commanding Officer of the regiment that was based in this area at the relevant time. The relevant time, according to the findings of the experts is between 1986 and 1991.” the AHRC further says.

These transfers are happening at the same moment when a greater momentum of interest is being expressed regarding the mass grave. A number of persons from the families of missing persons have come forward to the court claiming that the remains may include those of their family members. The newspapers have reported that 13 separate families have already listed their names in the court and according to the JVP, who believes that these remains are of their former associates, there are more persons who have met with their lawyers with a view to presenting their claims to the court.

The key issue in the investigations now is to have the remains tested by DNA experts and thereafter to compare the samples from the remains with the DNA samples of the family members who have come forward. The identification of the persons whose remains lie in this grave is the first step to be taken if this inquiry is going to lead to any judicial process.

The identification of the actual persons who were killed is important not only for judicial inquiries but also from the point of view of the families who have been searching for their missing loved ones for almost two decades now. Besides there is also the social responsibility to bring this matter to a final conclusion through a just and fair inquiry.

However, there is a widespread fear that the government may sabotage the inquiry, particularly as some of the names of suspected perpetrators include some powerful politicians. Among them the most important is the recurrence of the name of Gotabaya Rajapaksa, the President’s brother who is now the Secretary of the Ministry of Defence and who has been mentioned as the Commanding Officer of the regiment that was based in this area at the relevant time. The relevant time, according to the findings of the experts is between 1986 and 1991. The university experts who conducted their inquiries to ascertain the possible time period to which the remains belong came to their conclusion on the basis of their observations and tests and ascertained the time as between 1986 to 1991. The period coincides with one of the most brutal conflicts between the Sri Lankan forces and militants led by the JVP which caused the enforced disappearances of around 30,000 persons.

While the JVP claim that the remains may belong to their former supporters extensive evidence led before the commissions which inquired into the enforced disappearances also brought forth evidence of many SLFP supporters and very many innocent persons being among those who became victims of enforced disappearances during this time.

The government and particularly President Mahinda Rajapaksa in the past has been a prominent campaigner against enforced disappearances and he even went before the then Human Rights Commission of the United Nations to complain about the matter. Therefore under normal circumstances the government would have seen some political advantage in dealing with these enforced disappearances as the responsibility for such is attributed to the United National Party which was in power during that time.

However, at present there are other considerations that seem to affect the government’s approach to this matter. The government is heavily committed to hushing up all the allegations of human rights abuses attributed to the military and the police. The political system that has emerged in recent times has shifted away significantly from democracy and now relies heavily on the military. As a result any serious inquiry into enforced disappearances may be seen as opening a Pandora’s Box. Further to the covering up of military and police abuses another factor that seems to affect the government’s approach is the increasing allegations that Gotabaya Rajapaksa may have been seriously involved in the enforced disappearances of the time.

The government recently spoke of the appointment of a commission to inquire into all issues relating to the mass grave. However, this has come under serious criticism as commissions are largely seen in Sri Lanka as means of covering up crimes. There is hardly any credibility attached to the work of commissions. Besides in this instance the matters that are to be dealt with cannot be done by a commission. Establishing the identity of the persons whose remains have been found is primarily a task for forensic scientists whose work would be supervised only by a judicial officer. This inquiry which is one of the most complicated of any criminal inquiry requires the work of skilled and competent criminal investigators and the credible working of judicial officers.

As the appointment of a fake commission would serve no useful purpose in itself, there is a considerable fear that the government may sabotage the inquiry altogether. The transfer of the JMO who did the initial inquiry and who has shown great commitment to his work may be the first step in that direction. The transfer of the magistrate would also cause serious delays. If a magistrate who can be politically manipulated is put in his place many maneuvers might be done to delay or otherwise damage the inquiry.

What is even more worrying is the security of the remains themselves. Earlier inquiries into the alleged mass graves at Chemmani left many unanswered questions about the possible tampering of evidence including the alleged removal of the remains from the site. Given the present utterly disorganised state of affairs in Sri Lanka it is not difficult to tamper with the identified remains at the Matale mass grave. Given also the increasingly degenerating situation of the administration of justice in the country such concerns about the remains found at Matale cannot be treated as an exaggeration.

The United Nations High Commissioner’s Office has an obligation to intervene in this inquiry and to ensure that a proper inquiry is conducted and the credibility of the judicial process is maintained.

Meanwhile research into the evidence given at the Commission for Involuntary Disappearances at Uwa Province has revealed more names and other details of persons who disappeared from villages closer to Matale during the relevant period.       PS: UNP and SLFP do not lack killers in their top ranks. In fact, they are nurtured and promoted. We live in a country governed by two very violent political parties.

    (TheIndependent )“The court has stated that the skeletal remains unearthed at the Matale mass grave belonged to the 1986-1990 period. Deputy Minister Nandimithra Ekanayake has said that Gotabhaya Rajapaksa had served as the district coordinating officer of the army in the Matale District during the period. C.A. Chandraprema’s book Gota’s War clearly states that Gotabhaya Rajapaksa was summoned to Matale in 1989 and appointed as the head of the district. It also states that army officers Shavendra Silva and Jagath Dias were also deployed in Matale during the period. These are people are alive and they have to be held repsonsoble,” JVP General Secretary Tilvin Silva said at a press briefing at the party headquarters in Pelawatte on the 1st.

    “Chandrika Bandaranaike giving leadership to this government in 1994 shed false tears over those murdered during the 1988-1989 period in order to win votes. They dug mass graves in Sooriyakanda. They formed the mothers’ front and organized protest marches. Then parliamentarian Mahinda Rajapaksa complained to the Human Rights Commission. All this was done to win power and all actions were taken against the UNP government.

    Now they are in power. Mahinda Rajapaksa is the President. If they were humanitarians in 1994, now they have all the power to take action. They have the power of the executive, the government and the judiciary,” Silva added.
    Following are comments made by Silva at the press briefing:
    “After the Matale mass grave was first detected in November last year an investigation report was released on 17th March. The judiciary and medical reports revealed that the skeletal remains found in the grave belonged to 1986 – 89 period. Any doubt regarding the period the remains belonged to has been solved. The Magistrate’s Court has definitely stated the skeletal remains belonged to those who died during the 1986 – 89 period.
    We all know that there was a huge suppression during the 1988 – 89 period. What has been unearthed is the outcome of that suppression. The government is following a very silent policy regarding this. The government attempted to sweep the whole episode under the carpet. The unearthing of the mass grave was an accident. It came to light when the ground was being prepared to construct a building for Matale Hospital. The government attempted to stop excavation work and hush up the incident. However, excavations had to be continued due to a court order. We held a media conference and demanded that an investigation was necessary. Ministers and MPs of the government as well as the police spokesman attempted to show that skeletal remains were of people whose deaths had occurred long, long ago. The police spokesman said the remains were of those killed in an earth slip in 1940s. However, this attempt failed as a coin belonging to 1960s was found there. The government once attempted to say the remains were of those who died in a smallpox epidemic. The government attempted to somehow conceal facts. The Matale grave is the largest mass grave found in the country. Excavations unearthed 154 skeletons and 81 skulls. Investigations revealed that the owners of the remains had been subjected to cruel, inhuman torture. Pieces of wire, cables and plastics have been found from the grave. Investigations also revealed that skulls had been cut with tools such as saws, the heads had been severed from bodies and limbs had been broken. Despite finding 154 skeletons, only 81 skulls were found. This indicates that some were murdered by severing the head. We all know that human heads were on display on roads during this period.
    If all these 154 persons had been murdered, it is a very serious matter. However, the government has not taken any action regarding this. The government likes to bury the whole episode. The government is worried about finding the mass grave. This government under Chandrika Bandaranaike shed crocodile tears regarding those killed during 1988 – 89 period to get votes of their families. They excavated graves; formed mothers’ associations; went on demonstrations. Mahinda Rajapaksa, who was a Parliamentarian then complained to the Human Rights Commission. It was carried out against the UNP government to topple it and come to power.
    Now they are in power. Mahinda Rajapaksa is the President of the country. If what existed in 1994 was humanitarianism, the government has a good opportunity now to show its humanitarianism. They have the presidency, the government and the judiciary with them.
    Those who were murdered were patriots who loved this country. They fought against the Indian invasion. The government that shed crocodile tears to come to power is following a silent policy now. The perpetrators should be punished. The UNP was in power at that time. However, the politicians who were in charge of that area are in the present government now. This is why the government doesn’t want to carry out further investigations regarding the matter. For, the UNP too is supporting the government at present. As such, the government is being grateful to the UNP. Most of the members of the UNP during that period are in the government now.
    The District Coordinating officer in charge of the Army during this period was Gotabhaya Rajapaksa. This was said by the Deputy Minister of the government Nandimithra Ekanayake. Also, C.A. Chandraprema, who wrote Gota’s War’ had clearly stated that Gotabhaya Rajapaksa was called to Matale in 1989 and the Army there was placed under him. It also states special operations were carried out in the area and officers Shavendra Silva and Jagath Dias served in Matale during this period. They should be responsible regarding the incident.
    There should be a special investigation regarding these murders. We would pressurize the government in various ways until such investigation is carried out. On several occasions we demanded the government to reveal to the country the period the murders took place and how they were murdered. Now medical reports have reveled they belong to the 1986 – 89 period and they were tortured before they were murdered. As such, the government should commence a special judiciary process. The UNP leaders of that period, the district secretaries, Grama sevakas and other administrative officials that served the area, officers in charge of security and the people from Matale should be invited to give evidence and help in the investigation. We would continue to pressurize the government until this process is begun.
    We will also commence a special programme to collect details of those who disappeared during this period. We ask the people in Matale to give us all the details they know regarding this. During the past people like Dulles and Dilan spoke about those who disappeared and they shed tears. However, they have become completely silent now. They are like deaf, dumb and blind now. Those who sold the dead to come to power should have the courtesy to utter a word on behalf of them. I would like to make a special thanks to the mass media. The government could not sweep the matter under the carpet due to the vigilant of the media.”

      The very same killers from the military went on to commit mass murder of tamils in 2009. Gota was in command in Matale 20 years ago and he was dishing out orders to the military commanders 20 years later in 2009. The war criminals killed both Sinhalese and tamil people and should be considered the enemies of both and shot after a public trial.

        They did not have the facility to destroy the remains in 1989 , but the same people had the facilities gifted by China to eliminate all evidences of killing and now go on telling the world that their hands are clean and no civilians were killed.

        But the actual fact is that they have committed war crimes, by killing of their own fellow citizens and have committed a criminal offence of killing and the mass bury or burry the vicitimes to hide evidences.

        The whole world and also all Sri Lankans are now convinced that War Crimes have been Committed except a very few stooges of Gota and MR defend for hey want to be in power.

      The rot set in when the armed forces were given free hand to deal with JVP terrorism in 1971 by the then SLFP government under Sri Mao with the connivance of the left.

      The armed forces are part of permanent institutions of the state and its perpetual existence warrant deeper investigation.

      For example Janaka Perera was then a Lieutenant in the army and saw active service against the JVP. He was promoted to the rank of captain just after the violent suppression. He continues to serve until 2001.

      There had been a continuum of service from 1966 to 2001. In between he saw off JVP twice with immense loss of innocent lives and nearly 20 years fighting the LTTE. Like him many became powerful part of Military Establishment.

      When Chandrica’s three commissions investigated Human Right violations of limited period and found the perpetrators, the political military establishment refused to charge them. Remember her uncle General Ratwatte was running the show then. He did not want to upset the armed forces for they were fighting a just war for peace against the LTTE.

      My point here is the need to look at the structure of state and its components. Political and military expediency might serve to provide impunity those killers and war criminals but it always fail to serve the people or protect them from state atrocities.

      In the scheme of things Gota was only doing his job the way he understood.

      One has to look at the history of brutality by the police and armed forces and see how best to change it.

      Therefore the rulers need to appoint a independent war crime commission to look into all that had happened in the period from 5th April 1971 to date.
