Shirani B Won’t Go Before Bribery Commission Again

Chief Justice Shirani Bandaranayake will not appear before the Bribery Commission again, her lawyers said because she no longer had faith in the process.

Bandaranayake appeared before the Commission yesterday for an hour, where she is being grilled on charges of non-declaration of assets and other issues stemming from her impeachment.

She told the Commission that it had not yet responded to her submission some time ago that some members of the commission were prejudiced and could not sit on the case.

Instead of making a ruling on those submissions, the Bribery Commission had started proceedings at Magistrate’s Court against her lawyers for the impeached CJ said.

Bandaranayake charged that the proceedings at Bribery Commission were politically motivated in order to harass her.

    The Rajapakses, who had no compunction to send Sarath Fonseka to jail,
    will not bat an eyelid to impose the same fate on Dr. Shirani Bandaranayake once CHOGM is over in November. The Brothers have sufficient evidence to nail the former CJ on bribery-corruption and
    accumulation of wealth in excess of her known sources of income based on contraductions in her earlier declarations to Income Tax authorities.

    Whilst I agree that what Mrs. Bandaranayake is facing is political victimisation, I state very clearly that politicisation of the Judiciary was enabled by Sarath Silva and Shirani Bandaranayake. Although now the latter is trying to win the sympathy of the people and draw international attention to her case, every Sri Lankan remembers the role she played under MR’s direction on the Sarath Fonseka case.She gave legitimacy and legal right to the ‘kangaroo’ court-martial that took place. YOU REAP WHAT YOU SOW!

      I agree with James Ingham. The former CJ connived with many of the serious attacks on the judiciary by the Rajapakses while she was
      comfortable in her high position and her husband was making big money engaged in various rackets using the wife as a cover. A deterent example should be made out of her so that other SJs and CJs think twice before aligning with ambitious persons in the executive in breaking the law is not only illegal but also unethical and immoral. All of us will feel bad if one of our CJs goes to prison but the lady, unfortunately, asked for it.

    I feel sooty about this poor Lady. Her sorry state today is of her own making. Wittingly or unwittingly she played into the hands do MR, a numbe one Machiavelian whose plans for dictatorship was well hatched. . First he offered this poor lady’s husband a key post in the public sector, chairman NSB, which the CJ should never have allowed her husband to accept. This blunder made the CJ effectively under obligation to MR.

    Then came 18th amendment giving the Executive President sweeping power over other organs of the govt. And when it was challenged before the SC, the then CJ, Ashoka de Silva made her to determine it. This Lady simply betrayed the People’s judicial power and allowed it uncontested and without refering it for a referandum.

    Now it is too late to repent for the monumental blunder committed by the Lady CJ. Her error in judgment not only brought her down, but it effectively change the course of the nation from bad to worst.

    Two side of this article.Ok , Under the any regime of Sri Lanka ,Bribery commission seems to be a hell hole of bribery. Commissioners are all political appointees.Why not Even former CJ’s also politically appointed
    that position by the former President Chandrika.Former Justice Balapatbandi and Shirani’B ,and her husband , all are in the same boat.Do you think this is independent at any stage.No.No.No.(Meka Koholla babage Kathava vage Ekak.)Even Shirani is not act 100% independent during her judiciary appointment.But Some or other changed her track later and given judgements cannot implement to any government country like Sri Lanka.EX:-Extra 5000 A-level students admit to the Universities,Get the mandate from all the all the Provincial councils.This is impossible tasks to do.Therefore it is obvious she cannot exist as CJ in this country.
