Sirisena’s Blatant Attempts To Manipulate Judiciary: Delays Appointments Of Two New Judges Ahead Of Dissolution Case Hearing

President Maithripala Sirisena‘s brazen attempts to manipulate the Judiciary are underway with Sirisena delaying the appointments of two new Supreme Court judges whose names have been approved by the Constitutional Council.

Two new judges – namely S. Thurairaja and Gamini Amarasekera – are yet to take oaths as Supreme Court judges although two positions on the bench remain vacant. The two judges, promoted from the Court of Appeal, have unblemished track records and have not been accused of political bias thus far.

The Constitutional Council selected them from the four names presented to the council by the President. One other name that was recommended by the President was Deepali Wijesundera, the judge who convicted Former Army Commander Sarath Fonseka in a politically orchestrated trial under the Rajapaksa rule. The Constitutional Council declined to endorse her appointment.

Sirisena’s resistance to appointing the two new judges comes ahead of the hearing of a crucial case, in which the apex court will determine the legality of his move to dissolve Parliament prematurely and declare snap elections.

While Sirisena is deliberately delaying the appointments of two new judges, the Attorney General, on the instructions of President, has asked for a fuller bench to determine on the constitutionality of the dissolution of Parliament.

Suspicions have been raised in the legal circles if the Attorney General’s move is aimed at getting partisan and corrupt judges to hear a crucial case that will have a lasting impact on the country’s Parliamentary democracy.

One such judge is Eva Wanasundara whose questionable links with former President Mahinda Rajapaksa was exposed by Colombo Telegraph in a recent article.

Wanasundara, in an interview with ‘Deshaya newspaper’ in July 2014, publicly admitted that former President Mahinda Rajapaksa was one of her closest friends during the ‘Law College Days’.

In the same interview, Wanasundara said, “I was suddenly called up to Temple Trees by President Rajapaksa. He just asked me to drop by at Temple Trees on my way home after work. I was surprised at this gesture but went to meet the President nevertheless. Upon greeting me, the President said he was going to appoint me a Supreme Court judge and asked if I had any concerns. I was shocked by the sudden announcement. At the same time, I felt so happy as I always wanted to become a judge and suddenly, the person in front me was offering exactly what I wanted.”

Further explaining the level of her close friendship with Rajapaksa, Wanasundara said, “One day, one of my colleagues had shown a picture of me to another friend saying he had an affair with me. Mahinda, a close friend of mine then, had seen this incident. He promptly conveyed this to me as he was concerned that it could bring me a ‘bad name’”

There were allegations that Wanasundara soft-pedalled several cases involving the members of the former first family, especially former Secretary to the Ministry of Defence Gotabaya Rajapaksa, due to her alleged connection with the former President.

      Now with all the blocks being upcoming towards the island nation, there can also be FOOD and Medicine scarcity in the country. No banks would issue them loans as I got to know since the instablity governing in the country is treamouring into any govt and pvt institutions day by day.

      I am sad to see, what is going on in the country, EU and other countries are ready to support if they are ready to resolve the constitutional crisis, though it is seen as internal matter.
      The stubborn nature of DUO BALLIGE Putha cant bring us forward, but our image of the country as a small beautiful country in indian ocean, is long being tarnished.
      How woudl these two buggers ever iron out the destruction being made, is far from understanding.

        How could this be a contempt of court? CT has only voiced their concern. Besides, people have a right know as there was a move to seek a fuller bench which arose suspicion.
        It is everybody’s understanding that President’s move to dissolve the Parliament is unconstitutional. What is notable is, as expected, he didn’t get people’s support for the dissolution. Instead people were aghast at the move.
        However, we have faith in the Supreme Court. The interim order is proof that they are above political manipulation which is a good sign.

            Read again. CT didn’t say they have suspicions about the Judiciary. They say legal circles have raised suspicions on Attorney General’s move.
            You must remember that people have lost faith in the Judiciary for a long time. SC was the only place people had faith. Therefore, naturally people raise concerns when they see any move to manipulate the SC which includes countrywide mushroom protests demanding premature general elections. How come there was nothing of the sort before the interim order?

      It’s not going work, even if they include “Judge Gedara Yana Gaman” the same result come as final. If there is no material in the petitions SC wouldn’t have given stay order. Even without 2 Judges majority should be with the correct path. This so called “Legal Lunumiris” should be hanged by his own balls.

    The Attorney General,

    We assume that you have common sense and have been trained in law. Three of the judges have unanimously determined that the dissolution of the Parliament was unconstitutional. Even if the President fills the two vacancies with the most corrupt and dumbest, the verdict will still be 3-2. Of course, it won’t be unanimous.

    Attorney General, just move on with it. Sirisena, the Traitor, Se the Sevalaya’s days are numbered, and just do the RIGHT thing. The people expect that. See what the Police Commission did regarding the illegal transfer.

    Blatant disregards towards democratic principles and values by MR & his brothers and sons, his entire family was a blessing in disguise for this man, who was hiding somewhere inside coconuts grooves in Kurunegalla in the very night of 2015 president election fearing for his own life. Now he has been hellbent on destroying the values that he said he wanted to restore. The case of absolute power corrupted him absolutely. This guy even cannot comprehend how he was elevated to this spot, he forgot it was the UNP votes that propelled him to this chair. The moment he lend his support to MR gang, he has lost the confidence of people at large. The SLFP votes are won by MR, raising the question that what voter base supports the president. So in essence, the current PM doesn’t command a majority in the parliament, the current president doesn’t have a voter base, all in all, nothing seems real, all fake. What seems to be real though is Johnstone Fernando’s leadership, and the moron he who slapped the police officer while he was on-duty. Now, the gang asking for a full bench to make a ruling on president ill-informed decision to nominate MR for PM but less these two judges…….they obviously want a convoluted verdict which goes against the 19th amend. To read what is in 19th, you don’t need to be a judge, but an eighth grader. Too many selfish oldies have highjacked this county at the expenses of our next generation. Like in Arab countries, they deserves some severe public lashes on the streets so no one take this county for granted.

    Sirisena is trying to imitate Trump….manipulating the court systems, criticizing the Supreme court judges, silencing the media, making them the enemy, contradicting his own words, placing puppets in the Department of Justice, trying to sabotage any investigations, possible obstruction of justice, and an incompetent thug trying to make himself a dictator, gradually stripping laws, and the constitution. Always acting like he is above all laws and the constitution.

    Blaming everyone else, taking credit for other’s achievements, and not taking responsibility like a man, are other negative signs. “Strong men” are usually thugs and bullies, but actions show they are damn cowards, and cannot take criticism.
    They are also absolutely selfish. They put their interests before the nation, leaving it in a mess if necessary.

    By this Sirisena is sinking deeper into shit, if things go like this no way to redeem or salvage himself from these calamities. The spotless image he built up since he got elected has gone in the winds. At leat a moment, he should reflect, and see how the history would record him but all say he is the worst leader Sri Lanka ever produced.

    The verdict is (i.e. Dissolving the parliament is legal or illegal) irrelevant because most of the subsequent actions are dependent on Ranil’s whimsies. Ranil decided not to contest his dismissal. He has such a blatant disregard for upholding the country’s law. He was so arrogant to fight with the people to restore the democracy, their right. If people elected Ranil next time, in more serious incidents too, Ranil will collude with the conspirators, instead of he protect people’s rights. Ranil supported CJ Shiranee’s dismissal. He refused to vote against that. Then he fired two judges using more serve heavy handed actions. That time his claim was Parliament was superior to court.

    Now he pawned the Parliament to executive action. In Lankawe, when Parliament was dissolved illegally by president, it was the opposition party leader filed the case. Ranil did not file any cases to restore democracy so far. That is an interesting point to be noted in the World History. Under normal circumstances it would be the opposition part that would have welcomes the dismissal.

    So Ranil is keeping him free to going against the court by not getting involved in the Court law suit entanglement.

    There is a saying: In politics, there are no permanent friends or permanent enemies.
    In 2015, Maitreepala Sirisena was treated as the savior by some groups. The same lot condemn him as a traitor now. Who condemn him now? White Supremacists who like a puppet leader; Tamil Diaspora, INGOs in Sri Lanka, Local NGOs who thrive on $$$s from their pay masters in Western Countries, TNA, few Civil Society Organizations and U.N.P. One of the reasons is President Sirisena thwarted the plan to get the Federal Constitution passed.
    In 2015, about 5.8 million people hated Maitreepala Sirisena because he betrayed the Great Leader who eliminated Demala terrorism and brought peace to all the citizens; Sinhala, Demala, Muslim. Most of them are Sinhalayo. Now they are praising President Sirisena for saving the country from a ‘Thuppahiya’ who wants to introduce a Federal Constitution and sell national assets to foreigners.

    I will bet my last penny that MR will win any election.
    It’s only 10% of the population that could understand and see the true motives of the “so called” Sinhala liberators !! (MR camp)

      The lawyers, filed the case in SC, asked for injunction and it was granted. Outside it was considered as a victory, but inside of TTH it was considered defeat for Ranil.
      Everybody fighting for restoring Democracy, Ranil is on the stand of securing TTC for him and his partners

      He is trying to establish EP has has more authority than SC, so SC has to mind its business, but not meddle between him his EP when they have secret meetings.

    Okay first things first, the full bench or at least 5 or seven is needed in this kind of a landmark judgement, and there is precedence from the 2002 constitutional amendment attempt, the still born child who later was reincarnated as the 19th amendment.
    Secondly publicly accusing a sitting judge of SC of bias can have grave repercussions, beautiful Ranjan was sued for much less.

    If this true, this is yet another hindrance to the Sri Lankan’s democracy saga. I am at a loss to understand why the Sri Lankans are keeping quiet.
