Six Countries Submit Resolution On Sri Lanka To UNHRC – Full Text

The full text of resolution submitted to the UNHRC on Sri Lanka on Monday by Canada, Germany, Montenegro, North Macedonia, the United Kingdom and Northern Ireland:

Promoting reconciliation, accountability and human rights in Sri Lanka  

The Human Rights Council,  

Reaffirming the purposes and principles of the Charter of the United Nations,

Guided by the Universal Declaration of Human Rights, the International Covenants on Human Rights and other relevant instruments,

Reaffirming Human Rights Council resolutions 30/1 of 1 October 2015 and 34/1 of 23 March 2017 on promoting reconciliation, accountability and human rights in Sri Lanka,

Recalling Human Rights Council resolutions 19/2 of 22 March 2012, 22/1 of 21 March 2013 and 25/1 of 27 March 2014,

Reaffirming that it is the responsibility of each State to ensure the full enjoyment of all human rights and fundamental freedoms of its entire population,

Reaffirming also its commitment to the sovereignty, independence, unity and territorial integrity of Sri Lanka,

Recognising the strong role played by Sri Lanka’s democratic institutions in the peaceful resolution of the political situation that arose in Sri Lanka from October to December 2018,

Welcoming the establishment of the Office on Missing Persons in September 2017 and the appointment of its Commissioners in February 2018 and the assumption of its work to fully implement its mandate,

Welcoming also the visits made by the Special Rapporteur on human rights and counter terrorism from 10 to 14 July 2017, the Special Rapporteur on the promotion of truth, justice, reparation and guarantees of non-recurrence from 10 to 23 October 2017, the Working Group on Arbitrary Detention from 4 to 15 December 2017 and the Independent Expert on the effects of foreign debt on the full enjoyment of human rights from 3 to 11 September 2018,

Noting with appreciation the return of some private land previously occupied by the military to civilian ownership while recalling repeated public commitments by the Government of Sri Lanka  to release all private land occupied by the military, to enable local populations to resume livelihoods,

Noting other steps taken by the Government of Sri Lanka to implement Human Rights Council resolution 30/1, including progress towards establishing an Office on Reparations and the submission to cabinet of a concept paper on a Bill to establish a Truth and Reconciliation Commission, the proposed repeal of the Prevention of Terrorism Act 1978 and the preparation of a draft Counter Terrorism Act,  while reiterating in this context the need for further significant progress and encouraging in this regard the adoption of a time-bound implementation strategy,

1. Takes note with appreciation of the comprehensive report presented by the United Nations High Commissioner for Human Rights to the Human Rights Council at its fortieth session, as requested by the Council in its resolution 34/1, and requests the Government of Sri Lanka to implement fully the measures identified by the Council in its resolution 30/1 that are outstanding;

2. Welcomes the positive engagement of the Government of Sri Lanka with the High Commissioner and the Office of the High Commissioner since October 2015, and with relevant special procedure mandate holders, and encourages the continuation of that engagement in the promotion and protection of human rights and truth, justice, reconciliation and accountability in Sri Lanka;

3. Requests the Office of the High Commissioner and relevant special procedure mandate holders, in consultation with and with the concurrence of the Government of Sri Lanka, to continue to strengthen their advice and technical assistance on the promotion and protection of human rights and truth, justice, reconciliation and accountability in Sri Lanka;

4. Requests the Office of the High Commissioner to continue to assess progress on the implementation of its recommendations and other relevant processes related to reconciliation, accountability and human rights in Sri Lanka, and to present a written update to the Human Rights Council at its forty-third session, and a comprehensive report, followed by a discussion on the implementation of Council resolution 30/1, at its forty-sixth session.

    The slimy Sri Lanka government will make every possible effort to wriggle out of its commitments as usual, by thinking up all kinds of excuses. It will be more of the same and this government will leave office without fulfilling any of its undertakings. Then the next government will do a repeat performance and the cycle will go on until all the victims and their surviving relatives are dead and gone. Most of the suspects will also be dead by then.

      India, Sri Lanka Bangladesh and Indian Ocean rim countries should submit a resolution at UNHRC against UK and US to enable return of the displaced people of Chagos Islands who were evicted from this British Indian Ocean territory so that US could build the massive and human rights violating Diego garcia military base in the Indian ocean not far from Lanka.

        UNHRC is a massive and expensive waste of time and a distraction from the lack of Economic Rights and Justice and the corruption racket by politicians that is at the root of conflict in Sri Lanka.

        Civil society is also wasting time on this UNHRC ritual rather than working against corruption and land grabbing and ocean resources grabbing by global and local networks of corruption.

          At one point, whole UN was struggling because USA was not providing money.. UNHCR is political organization. Srilanka can not quit, I suppose, they became beggars for everything. Besides signed agreements even with the DEVIl.

        Going on the offensive against countries that are genuinely concerned about abuse of power will be counter productive. The facts are all in the public domain supported by photographic evidence that have been confirmed to be genuine
        Accept the facts and take the responsibilities for the actions of the state against its’ own people .Give assurances that such abuse of power will not occur in Sri Lanka in the future .
        Let UNHCR take action against all other non state organisations that were involved in the conflict

    The human rights endgame in Sri Lanka is setting up a US military base. That is why US citizen Gotabaya Rajapaksa who had command responsibility for crimes is free as a bird!
    Sri lanka should take the UK to the UNHRC for human rights violation in the Chagos Islands whose people were displaced to build a US military base. Last month the UN’s highest court, the International court of justice ruled that UK must return the Chagos Islands to Mauritius “branding its occupation of the Indian Ocean archipelago illegal. UK and US gased the dogs on the island and deported the Chagossians.
    The islands, which are home to US military base Diego Garcia, were separated from the former British territory of Mauritius during decolonization in 1968. The international Court of Justice (ICJ) has ruled that act was illegal under international law.
    For years, the US base has been vital to the military, serving as a landing spot for bombers that fly missions across Asia, including over the South China Sea. The UN ruling raises questions about its future.

NPC, CPA, ICES, Madam Nimalka Fernando and Colombo NGOs should organize protests outside UK and US embassies in Colombo and take up the Rights of displaced and poverty stricken Chagos Islanders and Indian Ocean communities to their lands and ocean resources that are now used and over fished by EU colonial powers.

      Civil society in Lanka should stop turning a blind eye to our neighbours, Chagos Island people’s struggles and broaden Human Rights work and look beyond the shores of Sri Lanka to neigbbouring counties , particularly and the rights of Indian Ocean Communities

        The US has more than 80 military bases all over the world, and is the biggest exporter of weapons in the world – selling 57% of arms, which is more than the rest of all the other arms exporting States in the world.

        US is a danger to the. rest of the world and is militarizing the Indian Ocean in order to grab its resources too with the CITES Conference or Washington Convention on Trade in Endangered Species which is really to promote private property rights in the global commons to promote US corporate Land, ocean and mineral resrouces grabbing.

    It’s hilarious, how the rupee is at an all time low, the shares are at a 5 year low, and this is the 3rd UN resolution on Sri Lanka, and the Sri Lankan govt (both factions – Sirisena / Rajapakses and Wickremesinghe) thinks it is beating the International Community and Tamils.

    Talk about frogs in a well. In a democracy, people truly deserve their leaders.

    Tamils are a victim here but Tamil cause is to exploit Srilankan natural resources. The answer is DEFEAT the politicians and political parties that Support these overtures. I don’t like the UNP national govt as well as most in the SLPP.. Just Srilankan Speaker tried to become the President, in Venezuela also the Speaker was appointed the president.

    Mangala Samaraweera unilaterally decided to co-sponsor the October 2015 resolution without getting the approval from the Cabinet and President. This is a violation of the Constitution. No other country in this world that has self-respect would have done such a stupid thing.

    Remember Northern Ireland Parliament MP, Ian Paisley Jr. He let it be known that he had the ears of the then British PM, David Cameron. The then GoSL invited Ian Jr. & family on all expense paid holidays, one was in March 2013 and another in July 2013. Ian did not declare the trips to the Northern Ireland Parliament. The willy Ian escaped impeachment by the skin of his teeth.
    Remember at the November 2013CHOGM, David Cameron did what he did.

    Another signatory to the resolution on reconciliation etc. is UK. A big noise in British Government is Liam Fox, an EU-skeptic, some say to satisfy his thirst for publicity. He is said to be in the inner-circle of the British PM, Theresa May.
    Liam, at times with THAT Adam Werritty, has enjoyed holidaying in SL. Two were all expenses paid by the then GoSL and three paid by Sri Lankan Development Fund. Liam was late or did not declare these to the Members Register. Liam was censured.
    Liam maintained that his visits were to promote reconciliation. My my foot!

    There is no point accusing other nations of doing worse or the same. We have to hold those responsible accountable, and bring justice to the hundreds of families, who still want closure. Why are we protecting those who were guilty of these terrible crimes? If we want to be accepted as a democracy, and keep benefitting from international aid, we have to act like a nation that does the right thing by it’s citizens, and act like a grown up, or we will continue to be looked upon like a rogue nation.

    Accountability. Reconciliation, Transparency are frequent terms used by UN . Sri Lanka has its own delaying Tactics. It has more internal political problems. UN was deceived by that strategy. UN should force Sri lanka to accept international inquiry to investigate HR violations. What action is being taken to return all the lands to the owners ?

    Aiyo… another useless resolution. How many more resolutions are you going to make? Please give some strict warnings to have investigations and bring charges in our courts within a given deadline. Failing that the international community must step in. If this chain of making useless resolutions continues, even the great grand children of the victims will be dead and gone, and everybody will just forget about getting justice to the victims. We need some proper action NOW. Land issue will be automatically be solved when the army has no excuse to stay in the area. Already 10 years have passed. That’s half a generation.

    Tamils must drop your hateful wish to get the Sinhalese stamped as genociders, and concentrate on getting justice for individual victims. Drop the war crime and genocide thing and go for murder and other usual categories of crimes. Because of the Tamils’ wishes to get a genocide conviction, the real victims are overlooked. The dead and their loved ones are tried to be used in a way to make a bigger case than it is, in the Tamils’ quest to get even with the Sinhalese. Take case by case and see what comes up. Maybe later on you can try for a genocide conviction. When everything is mixed up and muddled with everybody having their own private grudges and agendas, with corrupt politicians, military, NGOs and international geo-politics and what not, and into all that muddle, the Tamil national question is also tried squeezed in, the victims will never get justice. The killers and abusers will be the winners of all this.
