Speaker, SLFP/UPFA Should Take Action against Two PSC Members!

When I wrote my last piece on the impeachment debacle, “Parliamentary Select Committee Exposed,” I was extremely concerned and shocked about the fact that the Chief Justice was insulted and humiliated by two members of the Parliamentary Select Committee. These happened reportedly irrespective of protests by the CJ, the legal team and the opposition members, and unfortunately complete disregard or tacit approval of the Chairman of the PSC, Anura Priyadarshana Yapa, whom I so far considered a decent gentleman or politician.

The walk out of the Chief Justice was in protest against this outrageous situation and there were unfortunately some who even considered the walkout itself as impeachable completely approving the humiliation that she had to undergo before these two male hecklers.

It came to my attention how much pain or anguish that public humiliation could inflict on a person, a woman or a man and in both of these cases women, when I came to know about the suicide of a female nurse in London who was humiliated unintentionally though because of a ‘royal prank’ call during the same week from Sydney, Australia.

It is not my intention to say that both cases are same except the fact of humiliation. When Kate Middleton, Dutches of Cambridge, was in a private hospital in London for reportedly morning sickness, there was a call from two young broadcasters from 2Day FM, Sydney, pretending to be the Queen and Prince of Wales asking about Kate’s health early in the morning. A nurse of an Indian origin who was at the telephone exchange at that time allowed the call and information. She was apparently gullible under the circumstances. The radio in Sydney without much consideration for the implications, broadcasted the prank in effect humiliating the nurse. The nurse, a mother of two young children committed suicide on Friday apparently because of the humiliation.

The humiliation inflicted in the case of the nurse was not intentional. Last night I saw the two broadcasters who gave the call apologising and virtually crying. But the humiliation inflicted on the Chief Justice was not unintentional. Otherwise an apology should have been in order by now. I am sure that some even would unashamedly justify the humiliation and some have already done so by trivializing the words used.

One is a nurse and the other is a Chief Justice and a recognized legal academic. There is of course a vast difference in education and background and hence stamina for endurance. The Chief Justice probably would like to forget about the insults given her stature, determination and courage. As the Buddha said, if you don’t take insults, the insulters have to take them back. But humiliation is humiliation whether it is a nurse or a Chief Justice. In the case of Sri Lanka this is a public interest issue given the deteriorating ethics and culture of particularly the politicians. Some have become nose biters and ear eaters!

The reported utterances of the two members of the PSC are completely unacceptable by all standards, national and international. Therefore, disciplinary action should be taken against these two members. By whom might be a million dollar question? The following are some options.

  • There is no much point in asking the present President personally to take action against these two Ministers. Asking any justice from him would prove futile given his jubilant attitude against the rivals or enemies and also jovial defence of people like (Dr) Mervyn Silva. He does not seem to be serious about justice.
  • Asking the Speaker to take disciplinary action against these two members of the Parliamentary Select Committee however is in order as they were appointed to the PSC by him in his official capacity. At least in that way the Speaker might be able to preserve the reputation of the Parliament from public contempt. Otherwise talking about ‘supremacy’ of parliament is useless.
  • Asking the Secretaries of the SLFP and the UPFA is also in order because one Minister is a member of the SLFP and the other one does come under hopefully the discipline of the UPFA as his party is a constituent member.
  • Whether the above efforts would prove futile or not, another option left for the legal fraternity, the civil society and the opposition political parties is to boycott the two ministers from all public events at least for an earmarked period in protest.

We all have seen the photograph published in The Island newspaper yesterday (10 December 2012) captioned “Divided in fighting, united in feasting.” No one would ask opposition parliamentarians or anybody else to be impolite or disrespectful to anybody in the government even those who were involved in insulting the Chief Justice. There are circumstances that we have to be civil and social to all human beings. But politics simply would become a joke if the opposition politicians are not serious about what they preach or claim to fight for. The following is the photo.

    Your concern is correct and understandable but you are writing to different kettle of fish. In Sri Lanka insults, humiliation racial abuses are day to day affairs. I was a Sri Lanka Telecom employee for more than 20 years and once even selected by the institution as best. For an inquiry from a senior officer about an injustice I was insulted like this” අඩෝ ගැරී තම්බියා , උඹව උස්සලා පොළොවේ ගහනවා”. I resigned and came home on that same day. There are good people but we are living among others too.

      Similarly,while defending a colleague of mine in a domestic inquiry the complainant Chief, the case for the defence was was the Chief Officer’s usual arrogant behaviour in the office was the main reason for the accused employed refuse to carry out an order given to him. When another subordinate officer was giving evidence to support this defence the Chief Officer became intolerant and insulted the witness. This was recorded by the Inquiring Officer. Finally the accused employee was acquitted and the Chief Officer was warned not to repeat his arrogant behaviour and was transferred out. This was in the 1970s when at least some sort or justice was prevalent in the country. Now it is all going to……

      This could well be, but they should be able to behave well at least those places like – UTHTHAREETHARA SABAWA -supreme place above any other bodies in the country- the parliament.

      I find this article is very good one help many opening their eyes that the president as Dr. Fernando describes it —

        I have lost my leaast respect that I had towards this -pork greedy John Amarathunga who is seen as the joker sitting next to MR on the picture. His behaviours of this kind harm the respect of good ones in the opposition.

        I have no idea why he was appointed as the head of oppotion members in PSC. Is he at all capable of representing opposition in such a grave /serious issue such as the impeachment process of current CJ ?

      All these let spreach further so long top leadership would not react against Mervin type of behaviours openly. No sufficient displinary actions were taken against Mervin, Weerawanshe or that Kumara (transport minister) however they behaved in the parliament. So how can his sympathisers further respect this man MR is my quesiton. But as you say- that is used to people inthe country.

      I wish we could have an era that people in Germany are facing it today. If you call someone – to the abusive manner that you added it to your comment, he or she should pay 1000 Euros with an official explanation not to behave int hat way again. Our societies would not learn it from any others – politicians are capable of studying all these closely. Steps like calling Disiplinary actions should be obligatory in such occasions when being victimized by abusive people. General public will then learn to follow the politicians.

      Nowfer, I am sorry for the insults and humiliation you suffered. We are the only country in the world that is very comfortable with racism, relishing the opportunity to humiliate fellow human beings. Don’t we practice apartheid in segregated schools? When we are not ashamed to teach our children to hate, why would you expect them to be different when they grow up to believe it is acceptable to do so be it the CJ or someone else?

    Laksiri says he thought Anura Priyadarshana was a gentlman politician.There are various guises of politicians appearing innocent as babies when the occasion demands or appearing gentlmanly at the correct forum.But basically at the very core these men are ruffians hanging on to power and wealth from being in the Govt..Their behavior at the PSC is to please the demonic leader and get plum positions at the next cabinet reshuffle.Hence they do not care whether they do justice or injustice to the CJ.We admire the guts of the CJ who is facing humiliation at every turn by the State media, by every thug minister and by the socalled Head state.Parliamentarians in the opposition having a whale a time with the dictator while criticising him for being a dictator.Quovadis? University academics/ who could not be bought over, who could not be cowed down by threats please get your act together with the Judiciary, the lawyers ,the civil society and all the right thinking people to rid the country of this bunch of ruffians.

      This Anura Priya is said to be lawyer- if it is the case, he should not deny rather admit what his colleagues deliberately attacked the CJ in that session in all abusive manner. How dare he could reject it. That what caused me to feel what a man he should be. I though never thought that he was a gentleman by listening ot his kind of talks to the press several times, but I expected him to be fair against the victimized CJ in that session.

    It is time for every citizen who can stand for truth and justice to make an oath. That is to fight in whatever way possible to give CJ a fair trial. It may be tomorrow may be after many years. Yet we will have to have the tenacity to keep fighting and give fair trials also to the two white clothed disgraceful members on charges of sexual harasement, a fair trial to the chairman of the psc and the rest of the ruling members of the psc and the speaker who do not seem to have a voice but only mouths.
    If we do not do that we will have to face the trial one day for our cowardice.

    This picture tells the reality of Sri Lanka…be happy and enjoy at the expense of others. However, I wonder, can all of us do this? Remote villagers cannot..but I know for sure some/perhaps majority of politicians and learned professionals especially in the state sector do this.

This man is a disaster, if any change would not be case soon – OUR NATION WILL END UP WITH ISOLATIONs on the world.

      Lokka is attarayek -(above the law) – she would not even be easily burned down – no serious attitudes towards Justice of anyone, but big rherotics to manipulate the masses as has been sofar. How many more months the folks can be fooled in this way is the question, that always raise

He allows them to do what ever they wish and let them get involved in corruptions and pilfer public funds.whoever turn against him will be blackmailed and destroyed at the end.That is the way he rule the country with help of these uneducated rascals.

    After rejecting all their reasonable demands by the PSC and by the Speaker, and the PSC hurriedly summonning witnesses preventing cross-examination, I expected the opposition to boycott the Budget voting and boycott Speaker’s dinner. That would have been the correct thing to do. I am very disappointed.

    So, what next, for the Chief Justice of the Supreme Court of Sri Lanka? A new political party, perhaps? (party as in group of like-minded members, not party as in having a whale of a time)

    I remember a story I heard from a very close family in London who has met the current PM of Sri Lanka when he was visiting UK few years ago. PM has said at his residence that ‘we in the government and opposition speak angrily at the parliament but we are very good in our private matters. We ahve to show that we are critical at the debates but it is only for the public’. Today, we see this same among members of parliament both in the oppositon and government. No change. Disgusting behviour. John amarathunga was a member of the MPs and others the jumbo gropu who went with President few yearas ago to US.

    Lokka knows very well what has taken place and the culprit as a thotha baba is now preaching descipline and morlas to the Public .all types insults to the CJ is planned by him. Every Lawyer,Govt. Servant,be it a Parlimentarian having an iota of self respect do not devour shit,for sake of holding your positions, his shadow of revenge is right behind you. No compromise.The DJ a more versatile Law professor than ouw own ponna Prof.Peris their law counsel; should contemplate on all avalable avenues to SUE those two rowdy element, the dumb idiots who signd blindly the petition,the Head of he PSC for failure to descipline his 7 puppies and the ohers concerned.People will surely voluntarily contribute to the cost of litigation.

    I used to have some hope with the current administration, simply bacuase there was no other party that would not do worse. Since this incident, it has put me over the top. They can all go to hell, and I’ll take the consequences for our nation as it comes – good or bad.
    Unless politician learn to respect other human beings, they cannot expect the population to do so. We will always remain lawless.

    Mervin Silva would have been a better member or Chirman of select committee of Parliment to inquire into CJ Impeechment
