Sri Lanka Is Descending Towards A Lawless State – GTF

Global Tamil Forum (GTF) strongly deplores the attack, by members of the Sri Lankan security forces on Jaffna University students staging a peaceful protest, on Wednesday November 28th and calls for the immediate release of four Tamil students subsequently arrested by the Terrorism Investigative Division (TID) on trumped-up charges and remain in custody.

The peaceful protest was staged after Sri Lankan military and police raided the campus and intimidated students who were commemorating Tamil Remembrance Day, the previous day. Security forces attacked the demonstrators which reportedly left many students injured with some hospitalised. The actions of the State security forces highlights the continuing oppression occurring under the militarisation of the region and reaffirms that Sri Lanka is fast descending to the civil unrest that previously triggered armed conflict on the island.

GTF supports the mass protests denouncing the security forces, which was staged in Jaffna by the key Tamil parties, supported by like-minded democratic political forces in the South, trade unions and many civil society organisations. In addition, the solidarity shown by student unions in Eastern University, Ruhuna, Peradeniya Universities in Southern Sri Lanka and Youth organisations overseas, with the plight of those at Jaffna University, underlines the desire to end the State’s repression of the Tamil people in the area.

The Government’s response has been to increase heavily armed military personnel around the Jaffna University, spurring arbitrary security checks and raising fear that there could be more arrests of University students on false charges under the sweeping powers granted to military under Terrorism laws. State authorities and security personnel have used these laws to criminalise dissent, supress politicians, human rights activists, journalists, trade unionists, restrict freedom of expression and commit human rights abuses with impunity.

This general breakdown of rule of law has been further degraded by the Government’s impeachment proceedings against Chief Justice Shirani Bandaranayake have raised concern from the United Nations, United States and the Commonwealth. Sri Lanka’s parliament speaker, who is President Rajapaksa’s elder brother, rejected a Supreme Court summons to a parliamentary panel looking into the impeachment. The inherent political interference with the judiciary erodes the basic fabric of democracy.

GTF is encouraged by the US Embassy’s continuous monitoring of the prevailing situation and urge the US and other international governments to continue monitoring the situation to ensure the safe release of those Jaffna University students who were arrested.

GTF welcomes the renewed pledge from Canadian Prime Minister Stephen Harper that unless there is significant progress on political reconciliation, accountability and respect for human rights, he will not attend the CHOGM hosted by Sri Lanka in 2013. GTF believes other leaders of Commonwealth countries too should stand in solidarity with the Canadian Prime Minister in calling for significant progress on political reconciliation, accountability and respect for human rights, if the trend continues leaders must boycott CHOGM to uphold the Commonwealth charter and its values.

As the world commemorates Human Rights Day, GTF also calls upon the United Nations and the international community to remain seized of the situation in Sri Lanka; to condemn the Sri Lanka authorities’ failure to promote and protect human rights, equality and fundamental rights to freedom of expression for all its citizens; and requests that they restore judicial independence as a means to re-establish democratic governance and rule of law in the country

    Isolated concerns and monitoring by some countries alone would not bear any results or cause the Rajapaksha government to comply with due processes and rule of law. Enough is enough now. Majority of Sri Lankans are helpless and their true voices and concerns are not brought into the surface or expression because the MR junta has suppressed everything and everybody in the country. It is time that IC and international bodies do something concrete to liquidate this government so that the general public is given a chance to form a government of their choice which will adhere to democratic process. Trade embargos, international war crime inquiries etc. alone are the measures that would speak in a language Rajapakshas would understand.

      Very pertinent issue. The biggest Question is why the War Lords of the World, are not taking action on their stoog? The slip is showing very badly. The reason is Obvious. Only Peer group Pressure will bring some result.

      I only hope you are not serious!. What matters is what the people of the country needs and this Government has to come to power many times thro a huge majority. So isn’t this ‘ the general public’s popular choice’ who should govern the Country?.
      It does not matter what GTF’s view is whether SL is a lawless country or not?. If only SL becomes a country ruled by their kith and kin ( and that includes late Mr Prabhakaran)will they say otherwise.It is like asking the thief’s mother who the theif is.How can one forget the atrocities LTTE commited and the agony ALL Sri Lankans went through until just a few years ago. Do we fear to step out to the city anymore?. How can we forget that cruel past?.GTF are only shedding crocodie tears still trying to recover from the shock,loss and embarrasment of having supported LTTE and lost the war in an unexpected and humiliating manner.

    I agree with Teshan, the time has come for some concrete action by the International Community. Mere words will not do. The country is sliding towards a military dictatorship. Parliment and now the Judiciary may become mere tools of legitimacy in the hands of the Executive. Other sectors are mostly under his control.

    Is this the same GTF, from the UK, which issued a sort of a fatwa threatening the Sriankan Prez not to step on their Turf, when Mr Rajapaksa was invited to talk to the Oxford students on reconciliation?.

    This threat was so serious that the London Bobbies warned the Prez to stay away for the police can’t guarantee his safety.

    Now this spokesperson rom the GFT is cheesed off about the Lankan Govt for not allowing the Jaffna undergrads to celebrate the B’day of Mr Prabakaran.

    He even extends his thanks to the Undergrads in the South and the West for their support and solidarity.

    Can it be that the GTF has changed their manifesto?

    Could it be possible that they now withdraw thier previous threats and asked the Oxford to reissue that invitation?.

    This is a nice,polite press release. Are we sure that this is what the Tamil community in Sri Lanka needs?
    The Tamil diaspora must come to terms to the real situation. Tamils in Sri Lanka suffer and need solutions now. I’m sure that in Canada, US, UK and Australia you can live for further 50 years dreaming of an independent Eelam. But you should care more about your brethren on the island. They are tired, hungry, unemployed, evicted. Surely we need to discuss and debate. But unless you bring solutions, all these words are polite, nice and nothing more.

    Impeachment motion was initiated by ruling party MPs as a retaliatory action against Supreme Court ruling that approval to Divinuguma Draft Bill must be given not by the governor of Northern Provincial Council who is an appointee of president but by the elected council members. The president and his blindly loyal MPs cannot tolerate dissent of any kind.

    The heavy deployment of mono-ethnic military in the areas of predominantly Tamil speaking population even after more than three and a half ial years of the end of the war is to keep them under iron grip and fear psychosis. The military interferes in every aspect civilian life and spy on any social gatherings, festivals, school meetings and sports meet.

    The people in the north cannot even mourn or commemorate the loss of their loved ones. The assault on the students and their arrests show that the army and police do not tolerate the human rights of ethnic minorities in Sri Lanka.

    For better or for worse this is an internal issue for Sri Lanka and only for Sri Lankans to solve. Any foreign meddling will only unite us to fight the common enemy as was seen when SL armed forces took on the LTTE terror head on (which you and your mates financed).

    There is no argument there was opportunism, back-biting, favouritsm and all those negative features of the human condition in the Tamil militancy too. But it cannot be denied the central focus was to resist a numerically much larger and superiorly equipped modern tri-armed forces that outnumbered them 40:1. An ambitious uniformed man, now in disgrace and friendless, asked in 2007 for an army of 400,000 – which he said to have confided to his chauvinistic comrades – “to finish the Tamil race for all time from our sacred Buddhist Sinhala land” But, it cannot be denied even by the worst quizling, those who fell defended the Tamil Nation. Fascism and the lowest instincts of tribalism crept in with the passage of years in the resistance movement and consumed the intransigent leadership. The Tamil Nation was thrown into the streets; the lives of millions of them destroyed; half a million sought safety abroad and the entire race subject to the most inhuman condition in the recent history of this passive, law-abiding, religious race. Some diaspora outfits may have been taken over by suspected ambitious “businessmen” but the struggle for the ordinary Tamil not to yield to the State-inspired thievery of his land and the gradual liquidation of the Tamil race will continue – until justice is regained in its fullest sense.

    The power-centric and venal Royal Family will not give in although they know today their very supporters in the Sinhala electorate are against them. They are being gradually abandoned. If a General Election is to be held today under free conditions Ranil and the UNP will get a 5/6th victory need not be emphasised. It is not because the Sinhala South loves Ranil – but like in 1977 – they are hungry for a change.

    A hungry, thoroughly dissatisfied Sinhala people, ruined by a near-bankrupt economy; an uncaring regime unable to provide the promised employment to the unemployed, salary increases and the failure to honour an assured satisfactory PQL under the hoax called Mahinda Chinthana are becoming restless day by day. The extravagant life-style of the rulers; their regular and super-expensive “holidays” abroad in the guise of official work taking friends and the near and dear; the over indulgence of the brattish sons and daughters of the ruling clique are being watched by a helpless citizenry in the manner the French watched Marie Antoinette before the Guillotine made its way into history.

    The bulk of the ordinary soldier – torn outside his family and the safety of home – serving in the hostile NEP has already begun complaining of the quality of the food he is served. The lower ranks are beginning to openly complain. The meagre salary he gets and his condition compared to the risk he takes in keeping those in Colombo living in joyful comfort is now a matter of discussion among these soldiers – coming from rural families fed on a large dosage of the original JVP doctrine against inequalities in society. Sarath Fonseka talks of the soldiers “who gave their lives and limbs to destroy the LTTE are still in camps cleaning latrines, selling vegetables like vendors and repairing roads while their leaders are living it up in 5-star hotels in Colombo or travelling 1st class to Western Capitals”
    The explosion is inevitable. When it does come, the ruling clique will not hesitate, in its legendary calculated stupidity, ask the army to take on the people who will flow into the streets out of sheer desperation. The army will split into two factions – and once again the country will go through another massive blood-bath.
    This is not wishful thinking. This is the path in which that despotic President Ben Ali – while he and his family emptied the country for 3 decades -took Tunisia to economic ruin, turmoil and bloodshed ending in his flight.

    I think this guy must be desperate for some publicity. How can an any LTTE guy say “Sri Lanka is decending towards lawlessness???” According to this man when children were used as human bombs there was law? Thin of every train,every bus, bank, school they exploded every human life these guys blasted into pieces… Every tamil child soldier who is now back in school (thanks to their president who is from SINHALA community) will know better than you guys what is it like to be in a “lawful” place naturally by your LTTE standards.

    Kirilli and Raj – In my many visits to Britain and North America I made it a point to attend meetings of the diaspora. I notice these are lead by non-descripts of questionable intellect. Probaly close relatives of former militants – yet another unwelcome form of nepotism.
    In Toronto, a medical man and some of his colleagues in the front-table could hardly express themselves intelligently in the national language of Canada. After some questions from me they gave me the impression I was some sort of a Sinhala plant. I told them what I thought of them in due tones. Another man who comes on TV – and an open LTTE asset-holder – who is recognised as “leading” Tamils in Canada made basic mistakes in contemporary Tamil history. Even well-informed men like R. Cheran were jeered for advocating moderation. Those like N. Satyendra, Nirmala Rajasingham, Ahilan K are kept in the background. In France the leaders are ex-gunmen shooting and killing each other. I have a more accomodative opinion of Fr Emmanuel, who, I think, despite his involuntary closeness to the LTTE can bring the Tamil Nation peace and a future.

    That is the sad story of the leadership of the Tamil diaspora
