Stop Death Penalty: LAWASIA Tells Sri Lanka And Philippines

LAWASIA notes with deep concern a recent increase in the use of the death penalty for drug related offences, within the Asia Pacific region, which it considers to be a violation of international human rights law and standards.

LAWASIA takes notice of the Government of Sri Lanka’s recent selection of four persons, who were convicted of drug-related crimes, for imminent execution, and recent reports of the President of the Republic of the Philippines indicating, in his annual State of the Nation address, that he would take steps to re-instate the death penalty for drug-related offences.

LAWASIA find these developments deeply concerning. Both Sri Lanka, which has been abolitionist in practice for 43 years, and the Philippines, which has been abolitionist for 13 years, are obligated under human rights law not to reinstate the death penalty. Such actions would also run counter to the global trend whereby an increasing number of countries are abolishing the death penalty.

LAWASIA’s objectives include the promotion of “the administration of justice, the protection of human rights and the maintenance of the rule of law within the [Asia and the Pacific] Region”. In pursuit of the objectives, in 2018, the LAWASIA Council resolved to “call on governments in the ESCAP region which currently retain the death penalty to review their respective policies on capital punishment.”

LAWASIA notes that Sri Lanka has been a signatory to the International Covenant on Civil and Political Rights, 1966 (ICCPR) since 1980, and the Philippines since 1986, and draws attention to Article 6, Article 7 and Article 26 of the ICCPR; as well as the rights guaranteed by Article 3, Article 5, and Article 9 of the Universal Declaration of Human Rights, 1948 (UDHR).

LAWASIA notes that the Philippines ratified the Second Optional Protocol to the ICCPR in 2007, under which it is obligated to abolish the death penalty. Under international human rights law, a State that has ratified or acceded to the Second Optional Protocol to the ICCPR, is not permitted to withdraw from it.

LAWASIA also notes that Sri Lanka became a signatory to the Convention against Torture and Other Cruel Inhuman or Degrading Treatment or Punishment, 1984 (CAT) in 1992, and has been abolitionist in practice since 1976. The Philippines ratified the CAT in 1986.

LAWASIA believes that imposing the death penalty for drug related crimes would violate both countries’ obligations under Article 6(2) of the ICCPR, which holds that the death penalty may only be imposed for the ‘most serious crimes’.

In this regard, LAWASIA supports and adopts the interpretation of human rights law by the UN, as seen in U.N. General Comment No. 36, which states that drug offences can never serve as the basis for the imposition of the death penalty, as also the statement of the UN Office on Drugs and Crime, which attests to the unsuitability of imposing the death penalty for drug related crimes.

LAWASIA also draws attention to the lack of transparency in the method by which the four Sri Lankan individuals were selected, amidst hundreds who have been convicted for capital offences, 48 of whom have been convicted on drug related charges. This lack of transparency raises concerns of arbitrariness in the imposition of this sentence, and runs counter to Sri Lanka’s obligations to ensure the right to equality before the law, enshrined in Article 14 of the ICCPR, and to only apply the death penalty in a non-arbitrary manner, under Article 6 of the ICCPR.

LAWASIA urges the government of Sri Lanka to rescind the recent death penalty orders, and to refrain from taking any further steps to reinstitute the death penalty.

LAWASIA also urges the government of the Philippines to desist from taking steps to reinstate the death penalty, whether for drug offences or any other crimes.

LAWASIA calls on the governments of Sri Lanka and the Philippines to ensure that any action taken by the authorities concerned is in due compliance of the country’s legal obligations under international human rights laws and principles.

    Buddhists know very well about the non-violence and value the life. Sri lankan people has even forgiven the terrorists who killed whole villages. Just the way, they were behind LTTE and LTTE rump, even this DRUG Cartels and Wahhabis, I suppose, something that can not be stopped.     Drug dealing is the result of a cause. There are better ways to stop the causes from creating ill effects. There is no better way to teach the causes than revealing the authentic Buddha’s words that has emerged.

    The children of Sri Lanka are deprived the authentic home grown teaching of the Buddha. The corrupt Buddhist establishment including the heads of the 3 Nikaya’s are blocking the truth from being revealed. The head of state are also complicit in the conspiracy.

    The longer it’s hidden the more people are deprived a teaching that belongs to human kind. Let this be a warning to all. Unless the truth is revealed the country again risks entering.a dark age that will last a very long time.

      I do have close friends in the Phillipines and once check with them, I find its due to poverty and its hard to eradicate drugs without increasing the poor peoples living standards.

    Death penalty is a must in Sri Lanka, starting from many of the politicians who cheat the people of the country and who siphon the country’s wealth and who are involved in drugs trade , and people who commit heinous crimes. I doubt even the death penalty would change anything in Sri Lanka.

    Though I am totally AGAINST the death penalty, if it is going to be implemented, it should start from Diyawanna place. Majority of the 225 creatures inhabit that place, and their family members will be perfect candidates for the start. If real justice is going to serve, to take care of that flock, we might need at least a dozen hangmen and a dozen gallows working around the clock for many months. Where else one can find the worst thieves, Tsunami charity robbers, drug dealers, rapists and murderers? I don’t think we can find any better group suitable to start among the general public.

    Whatever the seriousness of Duterte of Philippines, I, as commented before, consider the Sri Lankan threats as a hoax. It is clear that neither the Ministry of Justice nor the Department of Prisons have ever received the Presidential warrants specifying the name of the condemned and the date & time of execution. But HE claims to have signed the warrants and HE too doesn’t reveal the details. Hence, one way is to conclude that one of the parties should be lying that is either the President or the Prisons Department. The other possibility is that both are not lying. The big man has indeed signed the warrants but the signed document has not yet been sent to the Department through the Ministry. Photocopies of it can be taken and secretly be shown to the condemned to drive a chill on them and thereby lure them into an under the table bargaining resulting in a deal. We indeed remember how presidential top brass were found counting notes by the bushel in hotel car parks. So another set of presidential operatives, according to this hypothesis, should have been active. The decision of the courts to stall this indeed stalled the another primitive wheeler dealer operation. I am inclined to believe the second possibility, judging from previous activities that has engulfed the country.

    Because there are 10 Tamils listed within the 20 convicts selected to hang, Tamils believe that this is another Yahapalanaya anti-Tamil activity, not about abolishing the drug menus.     So far Old King has not said either New King or Old Brother Prince as Slap Party or SLFP candidates. If Old Brother Prince is not selected in Slap Party, he cannot risk facing the American Court case empty handed. He has to stand as on his own (effectively as SLFP) opposing New King. Then if he wins, he is likely to get SLFP and EP. But very unlikely he gets to get Slap Party, if he didn’t stand on that. This victory is 100% dependent on who comes out of UNP. If Old Brother Prince stands in as common candidate of SLFP and UNP, the victory is probably confirmed, like last time. SLMC & ACMC’s support is guaranteed to him, in that case. So it is in Ranil hand. We can see if the Singapore hospital meeting can yield any fruit, in his matter. If Old King is not selecting New King as SLFP candidate, there would be a storm in their relationship. If Ranil or Old Brother Prince wins, the parliament election would be one year away, not in February. Ranil might need some more MPs and he would go for Donkey Trading in SLFP. New King would have only one month to manage his affairs to burn the docs and close the bunkers, filling earth. If he wants to fire all his traitors out of parliament, that will be rush at that time, for him. So he may start to work on this as soon as the candidates are selected, instead of waiting for the election result. (This tells the candidate selection would be done only on the last to file the application- JVP may select earlier than others). So we can expect that the boomerang multiply itself into many fireworks and flying back and forth, starting from September. Our prediction need not to have any excitements, as could be as the reality, because we assumed SLMC, ACMC and most part of the UNP and TNA would be inactive.

    For terrible criminals death penalty is acceptable. But the problem is the legal and judicial system in SL and how it is manipulated, and abused to meet personal needs. It is extremely difficult to trust our legal system, police investigations, political interference, etc. that terribly interfere with the judicial process. I know too well how people were forced to make false confessions for crimes that they have never done. Even Tamil relatives were forced to write letters to say their loved ones were terrorists to claim the dead bodies.The lawyers, judges, police officers and even the so-called experts who conduct the cases do not have enough knowledge or understanding or ability to learn and analyse before determining the outcome. Racial bias is another curse in our legal system. So it is extremely difficult to determine whether someone found guilty in our law courts are really guilty or not. Evidential materials are severely tampered at various levels. Documents favourable to defence are kept away from them by prosecution. For the poor there is no proper system to defend themselves. The so-called assigned counsels are of no use. So, even though serious criminals may be hanged yet we dont have a proper, fool proof, legal system to protect the innocent. Simple example is the Thajudeens case. What is happening. There are many views, many stories and many speculations. The killers are trying to look for scapegoats to place the blame, even doctors are accused of complicity while the killers are going about scot free.       All what you have said about the judicial and legal process in this island is absolutely true.
      For the poor especially if he/she is of minority Tamil ethnicity the chances of having a fair trial and obtaining justice is remote and hopeless.

    I am shocked at the attitude of my fellow Countryman,
    how be it ?
    when rumours are spread in connection towards anyone ( not just Muslims) even a politician with almost zero facts and myths the respond is always overwhelling as long as there is prejudise against that person or persons, However when the media exposes with proof of clear evidence about garbage ( containing dangerous & Extremely harmful substances that can destroy our enviorment and the humain remains left exposed to all weather which may even bring in plagues similar to ebola and others which those human remains may contain and could kill in millions , Yet I do not see heros among the medical profession , the judiciory or from the clergy who champion to save race, Religion and country condemning except for just one Buddhist Clergy and one Media.
    does it make sense to import garbage to recycle into a country which is not equiped to recycle its own waste?

But the UN or any human rights agency never said anything about that. The UN is a joke! The UN only goes after poor countries who don’t have a strong military. If a rich country with a strong military commits severe human rights abuses, the UN says nothing at all. The Yanks started unprovoked wars and occupations of Iraq and Afghanistan and the Yanks have been killing innocent civilians in those countries for nearly 20 years, but the UN is completely silent about it.

      and their system is so transparent its impossible to hang the innocent , today even the PM is behind bars in Malaysia.
      First His Excellency must prove he has the iron in him to at any cost change the constitution where the parliment becomes thee supreme and the people will have the power to hold anyone and everyone accountable , he needs to do this before any elections , he must use all his power to presure the entire cabinet to agree to do so and then he can bring in the death penalty,once we have a system that is 100% accountable and transparent and 100% peoples power

              ya mate , but such rigid force wont work in Sri Lanka , with all the short commings we Buddhist,Hindus, Chatholic,Muslim& others of Sri Lanka are very similar minded when it comes to freedom , yes freedom lovers and anyone trying to take that away could be very disastrous , Madam Sirima’s biggest failure and why JVP will never be a signifigant political force ever and soon as the educated and intelect class of younsters of all races become the deciding voters there will be lot of changes.
              If a person takes over with high hopes of instilling fear in people , it wont work , it might at the begining on minorities, but some how it will lead to the majority too.
              The only viable system for Sri Lanka with different cultures , religions and language will be a Swiss Canton type system , Switzerland has four official langauges , besides English as a working language esp in Geneva and also its the almost the size of Sri Lanka , but Sri Lanka is more blessed with Arable land than Switzerland though a champion in farming and agriculture it has more mountains than land & I just do not get it why we can not even have enough affordable rice and local veges & fruits , now that is how far our system is screwed .
              So fix the system right once and for all or in the near future there could be a serious rebellion , especially if a non democratic government is voted in.
