Stop The Impeachment Motion Against The CJ: An Online Petition Launched

A group called ‘Coalition for judicial Independence’ launched an online petition against the Impeachment motion.

We below publish the full text of the petition;

We request the Sri Lankan president and government to withdraw the false Impeachment motion against the Chief Justice.

Chief Justice

A notice of an impeachment resolution signed by approximately 117 Hon members of parliament has been handed over to Hon the speakers, against the Hon Chief Justice of Sri Lanka.

Prior to this, there were a number of orders that had been delivered by the Supreme Court Presided by Hon the Chief Justice which may not have been to the liking of the Executive and/or the ruling party, culminating in the handing over of such resolution.

The Sovereignty of the people under the constitution of the democratic socialist republic of Sri Lanka in exercised and enjoyed, inter alia by;

a) Parliament consisting of elected representative of the people exercising legislative power,

b) His Excellency the president of the republic elected by the people exercising executive power, and

c) Court tribunals and institutions created and established or recognized by the constitution or judicial power of the people.

Thus you would see that there is, inter alia, separation of power between the executive legislature and the Judiciary, in order to ensure good governance.

We would also wish to place on reword that the standing orders (No 78A) which was brought into operation in the year 1984 does not seen to ensure a fair trial/ inquiry according to the accepted principles relating to four trial/inquiry to a person thought before a selected committee and it required a drastic amendment to the said provisions, if it is to ensure such a four trial/inquiry.

Further, an impeachment of Hon the Chief Justice at this stage, in the aforesaid backgrounds may have a negative effect on the independence of the Judiciary. This would well have a serious effect on the right of the citizens of this country.

In the aforesaid circumstances, we call upon you to sign with this e- petition to persuading the impeachment concerned to refrain from pursuing the impeachment motion.

    (1)She was appointed under controversial circumstances.
    (2) Her husband was appointed as NSB chair after his well documented failures at Sri Lanka Insurance Corporation. He was engaged in fraud at the NSB. Of course she knew what was going on
    (3) She ruled favourably on the Underutilized Assets Bill.
    (4)She was partial as chief justice until she decided wasn’t going to be partial.
    (5) Procedural shortcoming aside, the constitution provides for a method for impeachment.
    (6) The current process is consistent with that method.

    There is no doubt that the UPFA, headed by MR, is the most corrupt and self serving administration, seen on the Island and needs to be shown the door. These are political parties where politicians engage in the age old art of power mongering. Regardless of theory politicians worldwide look after their interests first.

    When educated chief justices start indulging in politics and their judgments reflects this, it can’t be blamed on politicians. Ashoka Sarath and now Shirani have all indulged in pleasing the countries politicians. The image of the court itself has suffered badly

    Ranil is right, the fact that this impeachment is political action does not detract from the fact that this particular Chief Justice is suspect to say the least.

    Let it serve as lesson to all chief justices in future. Keep your dignity and do your job. Don’t engage in shenanigans and then cry wolf
    when thinks go wrong for you.

      Agree that the present CJ is not an angel. However, we must protest the bigger evil at this moment.

      True, she is not an angel. But if you think this will teach the judiciary to uphold their dignity, you are highly mistaken. Look around, see the bigger picture ! The only lesson this process will teach the Chief Justice and all other Judges is that they are safe so long as they are with the regime. The moment they assert their idependence and dignity, the attack will start. Their task would no longer be to uphold the rule of law but to safeguard the Government.

      Yes.CJ may have given some verdicts due to MR’s pressure and only those working under him will tell what type of threats and pressure he put to his subordinates. Just see the sudden terminations, transfers, scolding, warnings, threats and punishments others get. Just ask GLP.
      No where in the history of the world what MARA did to Sri Lanka’s parliement..ie. bribing and buying over 100 opposition MP’s to cross over to fulfill his dream of becomming another dictator.
      What MR is doing to judiciary is to jump the last hurdle to endorse to be the next KING…COCONUT ..in Sri Lanka as his astrologers have told him.
      The disappearance of swards, rings,battons, coins etc, from museum, cutting valuable sandlewood trees and making chairs, tables and beds for MR are few of them. There can be so many other underhand stuff that we readers don’t here may be going under the nose of media and public.
      The citizens, religious dieties, judiciary,trade unions,opposition parties, diaspora and the International community will decide his astrological predictions whether MR ENDS UP IN THE KINGS THRONE….OR IN VELIKADA PRISON.

    Our Hon.C.J. is no Angel. She is a human being,like you and me.Everybody has his/her weaknesses.But comparatively she is a better C.J. She is less corruptive and less partial. One will never be able to find all good characters. When it comes to public interests her work record is far better than the previous ones. That is where we stand. I think she has not done anything graver to deserve this sort of punishment. Prior to this impeachment motion, there were no allegations, as far as we know, against her personal life or life as the country’s top Judge. Compared to the previous C.J. I honestly believe she is far better in giving judgements and in listening to public interests.

    No body should sing this petition, she open the door for corruption in the Supreme Court. this is a good lesson an a punishment for all the government department head’s not do corruption.

    IF THE C.J.IS BEING ACCUSED OF IMPROPRIETIES AND CORRUPTION,IT JUST DID NOT HAPPEN OVERNIGHT. IF WHAT SHE IS ACCUSED OF IS “FACT” AND NOT “FICTION”, THEN THE BLAME FOR APPOINTING HER SHOULD GO TO NONE BUT

      Leelo, MR is lucky that RW is there as the leader of the Opposition. If the UNP was under Sirisena Cooray type in control, today the CJ would have been bumped off and all the fingers will point towards MR and there would be hell to pay.

    Please don’t get scared to this MR village Pon-a Hu-tha or his pakk-li three wheel stunt bast–ds. His Mo–her is a wh–re. Bad Bl–od. He want to show his puspart in Colombo. Very soon he will be taken to Hague for war crimes. Until that time charge him for robbing Tsunami donations. There is ample evidence. He is the biggest Alib-ba in the country now. Also his 175 some junior pin padi alu gos-vas in the parliament.
    He is not worth even your sh-t.
    Please teach him the most unforgettable lesson in life. Send him round the mulberry bush and back to weeraketiya junk yard or vanatamulla goo bok–wa, before he get free load of parippu from sky.

    Gamini Ranawaka – To borrow an analogy from the late and celebrated FBI Director Edgar Hoover “there cannot be such a thing as a slightly crooked” Chief Justice in as much there cannot be a slightly pregnant woman. You are either one or the other. Instead of comparing her to that characterless Sarath Silva, you should be choosing comparisons from some of our revered former CJs – like Sri Skandarajah, HNG Fernando et al.

    One of the signs of active democratic society is to have an independent judiciary that has the ability to protect the interest of the justice for all. Judiciary should maintain an impartial and higher ethics and stay above the turmoil of srilankan politics that had invaded by nepotism, thuggery, favoritism, intimidation, corruption and political assassinations. It is evident that the democracy in srilanka once hailed as independent and impartial, now restricted to foster dictatorship. When all the institutions in this country succumbed to the influence and property of the ruling family and its associates, judiciary stood and commanded some independence to protect the eroding democracy. However, as the world witnesses, the vagabonds of the ruling family have been able to use the loopholes and its mighty bully pulpits to silence the last ray of hope of the people.

    If I read the thinking behind the feature comment in the Sunday Island today right, it is curtains for the CJ. It is no secret the newspaper’s main journalists are in cahoots with the regime. The Big Boss himself sang praises naming 3 of the journos. A senior Govt Minister, whose views are in the same trajectory as the Rajapakse family, is also an important component in the ownership of the newspaper.

    More than average knowledge of jurisprudence is not sufficient in today’s Sri Lanka where the office of CJ is also part of the Executive – hang what Montesque and Jennings had in mind.

    I don’t know actually th CJ is guilty or not.But the way the Govt is handling the matter with its so called PSC is is very indecent.They bit investing they are joking at her.Actually is the a provision in the constitution that the MPS have the right investigate a judge?
