Sujeewa Senasinghe Caught With Pants Down For Vehicle Permit Abuse: SC Refuses To Intervene

The Yahapalanaya Government which came to power pledging to rid abuse appears to be following in the footsteps of the former regime, with ministers in the current government being involved in various forms of misuse which has resulted in the country losing millions but the ministers earning in millions.

Deputy Minister of International Trade Sujeewa Senasinghe, who was a vociferous campaigner against the corruption of the Mahinda Rajapaksa led former regime has been accused of selling his duty free car permit.

On June 17, 2016, a Toyota Land Cruiser was imported by Senasinghe using his duty free car permit and was registered with the Commissioner of Motor Traffic on July 20, 2016 with the vehicle being transferred to the name of the vehicle permit buyer Ali Akbar Salehbhai on the same day.

This came to light when the Duty Free Vehicle Permit Abuse case was taken up at the Supreme Court recently. The case is filed by rights activist Nagananda Kodituwakku. According to Kodituwakku, the permits are sold at 25 million rupees or more in the open market by MPs, with buyers permitted to import any vehicle of their choice with no limitation of the engine capacity. Already over 34 units of Toyota Land Cruiser vehicles have been imported abusing these permits, with entire tax element exempted and only data entry fee of Rs 1750/- charged by Customs.

The case was taken up after Chief Justice K. Sripavan who took up the car permit abuse issue in late July, permitted Kodituwakku to make a written submission over the alleged car permit abuse by MPs.

When the case was taken up this month, Kodituwakku supported his argument with documentary evidence which showed how MPs were abusing the duty free vehicle permits. He requested the Supreme Court to provide a full bench hearing on the basis that it was a case of national importance.

After coming to power, the Maithripala Sirisena – Ranil Wickremesinghe led administration, having appraised the colossal losses sustained under the Mahinda Rajapaksa administration, in its first financial policy statement presented in the parliament on November 20, 2015 declared that government had incurred a heavy loss of over 40 billion rupees on tax free car permits, therefore the administration proposed to abolish all such permits altogether including the permits issued to MPs which was openly abused by them.

However, few months later, the same Finance Minister Ravi Karunanayake who presented the initial fiscal policy statement made a U turn and made an order (published in the Gazette (No 1965/2 of 02nd May 2016) under Sec 3C of Excise (Special Provisions) Act exempting levies on motor vehicles imported by MPs with CIF value up to US $ 62,500/. However, as required by the law to protect the government revenue, there was no condition whatsoever imposed against the abuse of such permits, allowing MPs to sell their permits in the open market.

The request for registration information of the vehicles already imported on these permits by the rights activist, presented to the Commissioner General of Motor Traffic, demonstrates that for each vehicle, the government had incurred a loss of over 33.5 million rupees and except one US made Hummer vehicle, all other 33 vehicles are Toyota Land Cruiser Diesel Jeeps, a very popular vehicle with a high demand in the high end domestic market.

The tax-free car permits have been issued to all MPs under Section 3C of Excise (Special Provisions) Law No 8 of 1994. This law empowers the Minister of Finance to exempt from charging of levies on any goods, having regard to the economic development of the country, with an Order in that regard published in the gazette, subject to such conditions as may be specified in that Order by the Minister.

The activist emphasized the importance of restoring the rule of law in the country where people have been ruthlessly betrayed by the MPs who had openly sold their tax-free permits for unjust enrichment and therefore action must be taken to deal with them appropriately.

The activist told the Court that the current regime promised people to abandon the Rajapaksa regime’s bad policies but instead they have surreptitiously abandoned their promises and now continue with the same policies causing colossal losses to the country’s revenue and tremendous hardship to the people.

Despite the evidence submitted by the rights activist, the Supreme Court declined to intervene against the tax-free permit abuse and grant leave to proceed to the activist’s right application on the basis that the permits have been issued with no condition specifically mentioning against selling such permits to 3rd parties.

    This decision or indecision by the Judicial system of Sri Lanka is blatant and smacks full of foul smelling collusion with the Yahapalanaya government. Independence of the judiciary is just a byword for collusion with countless corrupt practices.

      Th SC has reasoned a basis for making it’s decision on a loophole in the law which It could have by itself remedied by a process of interpretation if it was so minded especially when it comes to financial loss to the exchequer of he country.
      There is what is known as judge made rules.
      In this case the supine CJ had decided not rock the government boat by making a correct judgement in the best financial interest of the country at large because he believed he should please the government by not closing the loophole which permits the abuse of the tax free permit by MP’s and government servants. That is all.

      I tend to agree with you – the Rules do not prohibit the Sale. How can a
      Judge be guided otherwise? As Political leaders, they are aware of the expenditure incurred in the run-up to make good a Ministerial position. So ignoring the restrictions sought by this Activist despite the alarming misuse of same in the past and PRESENT does and should not bother the present leaders. The fact they made promises on platforms to win the citizenry is a matter of electionary tactics only.

    I was there in the Court house and I believe the submission made by the Counsel represented 20 million people of this country.

    In fact Judges commented him for courage to expose corruption and abuse of peoples sovereign rights in this manner by the other two organs.

    However, when the Judges were reluctant to intervene, quoting Lord Justice Denning, Activist Nagananda had courage to inform the Court that Judiciary cannot afford to be timorous souls and Judges cannot remain impotent, incapable and sterile in the face of injustice.

    This ruling probably with give more courage to dishonest rouge politicians to embezzle public funds at will.

The problem here is the entitlement mentality of these scoundrels once elected. Even if the president and PM want to get rid of the permits they are forced to go along or risk a rebellion. These fellows can be easily bribed and with Rajapkshe lapping at their heels they are compelled to carry one giving these permits out. It has been revealed that every foreign trip Rajapkshe makes around Rs400/= million to Rs500/= million is brought back to the country. He is using these trips to launder his money back into Sri Lanka. Why?

    Accountability for FINANCIAL CRIMES by politicians must be given same PRIORITY as investigation of WAR CRIMES of Sri Lanka politicians.

    Today poverty and INEQUALITY is growing once again. The Ranil-Sira govt. are doing same thing that Mahinda Jarapassa govt did with their Chinese backers of mega White Elephant Hamabantota development disaster projects while Namal, Basil, Weerawansa and other Mahinda Jarapassa cronies pocketed billions.

    Meanwhile, people are saddled with massive taxes and VATS to pay for the criminal politicians of the miracle of Modayas!

    The foreign donors are only interested in war crimes but turn a blind eye to financial crimes because the global financial system based on off shore banking and looting of global South by global north via networks of financial corruption and Panama Papers style rackets is corrupt.

    Sri Lankank politicians enjoy IUNITY AND IMPUNITY in Ranil-Sira Ayahapalanaya govt. Ranil wants to clip the wings of the judiciary by making the Corrupt Parliament of Morons supreme.     Did not these parliamentarians justify the requirement for these vehicles on the basis that they need to travel extensively visiting their electorates and hence needed rugged and comfortable vehicles to do the same?

    the question that comes to mind is… if these mp’s have gone and sold the vehicles they imported under this scheme, how are they going to travel to their electorates in comfort and perform duties?

    members of the present parliament (be it government or opposition) are all acting hand in glove to unjustly enrich themselves whilst the rest of this country is suffering…

    the whole lot of them should be taken to task and it is a shame that the judiciary does not want to intervene. Hats off to Kodituwakku for taking action on this.

    What do we ordinary people do now? Having been badly let down by the Rajapakses and his clan who bled us dry, we turned to Sirisena and Wickremasinghe with great hope and expectancy only to be kicked in the teeth, turned around and then kicked in the Butt, and we are floundering in the dirt with the dust still in our face, AND IT WILL CONTINUE IN LIKE MANNER till we are duped by another set of jokers.

    Other Countries had options and most of them are coming out of the grime with some hope for their people. But we Sri Lankans have no hope, no options, no nothing. What a sad miserable lot we are. Some would say it is the curse of KUVENI. Bottom line I SAY, we are to blame ourselves, we get the Governments we deserve.

    The concessions not available to any ordinary citizen should not be available to anyone else. How can the judiciary at many levels that has been given duty free concessions for motor vehicles and the permission to sell their permits , if desired, sit in judgement over such a fundamental issue?

    What is illegal and absolutely wrong has been enconsed in Sri Lanka quite blatently and needs to be reversed soon.

    However, the priority is to put the corrupt who have milked this country dry and misused power to an extent that yet cannot be comprehended by many, should be put behind bars, after due process. This exercise will be the bitter medicine required to jump strait this country.

    Thereafter, we have to work towards ideals in slow, steady and deliberate steps, assuming that everyone is corrupt and tainted to some extent.

    I agree.The submissions made by counsel[Nagananda] was on behalf of 20.96 Million [2015] of this country minus the very small fraction of the beneficiaries,the MPP!

    The Judges have quoted Lord Denning-the most celebrated English Judge of the 20th century;He was known as the Peoples Judge,for his willingness to override precedent to do what he saw as Justice.
    Merely quoting Lord Denning is not enough!

    When the yahapalanaya government tried to implement the VAT illegally the court DID intervene.

    that is how the law works.

    think logically. if the court was willing to act against a major tax policy, why should it be scared of duty free permits?

    sad to say but this shows our people don’t understand how a proper system is supposed to work. that is why they are howing and screaming for Rajapaksas to be thrown into jail. not understanding of due process or how a case is built.

    I think MR was probably the right ruler for sri lanka. our people are just uncivilized savages.

    Dilum: Good decision. Tell the others who voted for this type of vagabonds not to be deceived any more. Leave aside the Court decisions. It is time for all Political Parties to draw a “Code of Conduct” and get their nominated candidates to sign in agreement. In addition that must be a “Public Document” on which voter will rely and vote. Once elected, the party must impose such “code of conduct” very strictly and in any failure the public must have a right to take the Party and the Candidate they voted to task in a Court of Law.

    Apart from legalities involved or not involved aren’t we expect ethical behavior from a MP who is a Lawyer and a Deputy Minister of the Government who campaigned vociferously against corruption and abuse of power under Rajapaksha regime. If Senasinghe does not need a vehicle for his own use he should not have applied for a permit and leaving in the hands of a rich third party, depriving the State the opportunity to earn proper import duty. The Finance Ministry made it public that the government’s tax revenue has dwindled over the years due to issue of vehicle permits and granting other concessions to sectors which do not deserve them. If parliamentarians who are voted by the people to run the country abuse such privileges and deprive the state coffers of duty import duty and tax, does that action not affect the fundamental rights of the people especially when they are asked to pay additional taxes by way of VAT etc to supplement lost revenue ?
    If Maithri-Ranil Government is really committed to Good Governance what prevented their Finance Minister from re-introducing the 5 year rule to transfer the vehicle* at the time of issuing new permits? ( * done away by Mahinda Rajapakse as the Finance Minister during the latter part of his second term)
    All these years these cheaters have been giving the massive expenditure they had to bear to contest general elections under the preferential voting system as an excuse, for availing vehicle permits for re-sale at a profit. When they had the opportunity under 100 day program to change the constitution and bring in a new election system doing away with preferential system they have failed to do that either.

    The original intention to give MP’s duty free vehicle allowances were to help the MP in their electoral efforts as they fund them selves. In other words, it was always known, the permits once issued would be sold, money earned would be used for political activity including hiring goons to hammer your opponents.

    The Supreme Court can’t intervene. For the law of the land allows MP’s to get and then expected to sell their permits.

    The law must be changed in Parliament. Good luck with that.

    This is a surprise in the sense I thought he was a “good guy” and was outspoken during his opposition days. But did you at least try to get his side of the story before running this article?

    When Hon Late JR allowed these, I think he knew a lot of people will make money by selling the permits. I think this was one way he thought corruption and bribery will reduce. If you recall, during the stifling Socialist days MPs were taking petty cash bribes. There were no mega private projects or investments. There were very few opportunities for entrepreneurs. So MPs were giving jobs and asking for bribes. So I think even though JR had the right idea, it never worked because commissions and bribes became bigger as the economy grew and also with inflation. I have no doubt there are corrupt people in this regime. They are in a hurry to catch up with previous crooks because UNP really has been out of power since 1994 except for that 3 year period under CBK where they did not wield real power. So of course culturally they have to “look after our people” and make money to save for dowries etc.

    But I am shocked (if this story is true) that a young Trinitian will do this. He was a brave man in the opposition. Can you verify facts please so there is no smear campaign? I am not a pandam kaaraya or sycophant but with stories where people are implicated is it not a good idea to get all sides of the story? I do have a class envious resentment everytime I go to SL to see sub-educated people riding high on the hog in fancy cars and SUVs at tax payer expense. Shit man, we cannot afford a Range Rover because it costs about $68,000 without taxes in the USA and we are supposed to be upper middle class. Being a politician in SL is like winning the lottery which is what I keep hoping to win so I can get my mid life crisis image building Fiat 500 to show off my boru shobaney. I feel sad because this guy was someone worthy of respect the way he spoke out.

    Senasinghe has graduated from the JRJ School of Corruptions with very impressive marks. His mentor is the Corruption Guru RW. So what do you guys expect from this fellow; he eats corruption, breath corruption and drinks corruption. What is the difference between this guy and NR graduated from SWRDB School of Corruption. Irony is, this guy is in the COPE too under his guru’s instructions.

      I think parliament should start a university of corruption in diyawanna oya.. RW can be the Vice Chancellor, Ravi the professor and senasinghe can be one of the senior lecturers. This is immorality at its height. They will not even have a place in hell. God only knows where the Patron JRJ is. I am sure he is hanging on in a corner of hell with his shorten curleys.

    Becoming a Member of Parliament in Sri Lanka is the shortest and quickest way to go from RAGS to RICHES. Parliamentary elections and other elections held are Glorified and well publicized schemes designed to facilitate this financial Scam in the country.

    These scams robs from the unsuspecting innocent poor tax payers; are not different from that of Lalith Kothalawala’ scam and Sakvithi’s scam.

    They all have debilitating effects on the economy and deny the basic needs of our POOR children.

    Perhaps you have made the wrong move, so many of us feel the same way. This game of robbing from people has been going on since 1953.Foundations for the corruption houses were laid only after 1953. Corruptions always breed corruption. Moreover, corruption is capable of concealing corruption.
