Sujeewa Senasinghe Caught With Pants Down For Vehicle Permit Abuse: SC Refuses To Intervene

The Yahapalanaya Government which came to power pledging to rid abuse appears to be following in the footsteps of the former regime, with ministers in the current government being involved in various forms of misuse which has resulted in the country losing millions but the ministers earning in millions.

Deputy Minister of International Trade Sujeewa Senasinghe, who was a vociferous campaigner against the corruption of the Mahinda Rajapaksa led former regime has been accused of selling his duty free car permit.

On June 17, 2016, a Toyota Land Cruiser was imported by Senasinghe using his duty free car permit and was registered with the Commissioner of Motor Traffic on July 20, 2016 with the vehicle being transferred to the name of the vehicle permit buyer Ali Akbar Salehbhai on the same day.

This came to light when the Duty Free Vehicle Permit Abuse case was taken up at the Supreme Court recently. The case is filed by rights activist Nagananda Kodituwakku. According to Kodituwakku, the permits are sold at 25 million rupees or more in the open market by MPs, with buyers permitted to import any vehicle of their choice with no limitation of the engine capacity. Already over 34 units of Toyota Land Cruiser vehicles have been imported abusing these permits, with entire tax element exempted and only data entry fee of Rs 1750/- charged by Customs.

The case was taken up after Chief Justice K. Sripavan who took up the car permit abuse issue in late July, permitted Kodituwakku to make a written submission over the alleged car permit abuse by MPs.

When the case was taken up this month, Kodituwakku supported his argument with documentary evidence which showed how MPs were abusing the duty free vehicle permits. He requested the Supreme Court to provide a full bench hearing on the basis that it was a case of national importance.

After coming to power, the Maithripala Sirisena – Ranil Wickremesinghe led administration, having appraised the colossal losses sustained under the Mahinda Rajapaksa administration, in its first financial policy statement presented in the parliament on November 20, 2015 declared that government had incurred a heavy loss of over 40 billion rupees on tax free car permits, therefore the administration proposed to abolish all such permits altogether including the permits issued to MPs which was openly abused by them.

However, few months later, the same Finance Minister Ravi Karunanayake who presented the initial fiscal policy statement made a U turn and made an order (published in the Gazette (No 1965/2 of 02nd May 2016) under Sec 3C of Excise (Special Provisions) Act exempting levies on motor vehicles imported by MPs with CIF value up to US $ 62,500/. However, as required by the law to protect the government revenue, there was no condition whatsoever imposed against the abuse of such permits, allowing MPs to sell their permits in the open market.

The request for registration information of the vehicles already imported on these permits by the rights activist, presented to the Commissioner General of Motor Traffic, demonstrates that for each vehicle, the government had incurred a loss of over 33.5 million rupees and except one US made Hummer vehicle, all other 33 vehicles are Toyota Land Cruiser Diesel Jeeps, a very popular vehicle with a high demand in the high end domestic market.

The tax-free car permits have been issued to all MPs under Section 3C of Excise (Special Provisions) Law No 8 of 1994. This law empowers the Minister of Finance to exempt from charging of levies on any goods, having regard to the economic development of the country, with an Order in that regard published in the gazette, subject to such conditions as may be specified in that Order by the Minister.

The activist emphasized the importance of restoring the rule of law in the country where people have been ruthlessly betrayed by the MPs who had openly sold their tax-free permits for unjust enrichment and therefore action must be taken to deal with them appropriately.

The activist told the Court that the current regime promised people to abandon the Rajapaksa regime’s bad policies but instead they have surreptitiously abandoned their promises and now continue with the same policies causing colossal losses to the country’s revenue and tremendous hardship to the people.

Despite the evidence submitted by the rights activist, the Supreme Court declined to intervene against the tax-free permit abuse and grant leave to proceed to the activist’s right application on the basis that the permits have been issued with no condition specifically mentioning against selling such permits to 3rd parties.

    We need more men like Mr. Kodituwakku to keep our corrupt politicians
    in check. Irrespective of whether one is a UNP or SLFP man/woman/neutral the law must treat all crooks like they are. This is further proof our country and most Sri Lankans are utterly corrupt – our honourable political leaders taking the frontline. Whether they are born that way, I don’t know.

    It is only when some of these rogues are sent for long jail sentences with their stolen loot confiscated can the process of cleaning public life will begin.

    if anyone wants to sell their car Permit let them , go after the guys who are ruining the nation, without taking on a guy because he is pout spoken .

      Please do not try to safeguard anyone who does corrupt deals. If he was an honest gentleman who he tried to show during the last election time, then, he should have forfeited the permit without selling it. These politicians in this country are the worst crooks. They cry about the corruption, abuse of power, and helping their kith and kin only until they are in the opposition. As soon as they get into power they do a complete 180 degree change and do the same as the ones that they were accusing earlier. The poor general public is always will be the losers.

    If I am not mistaken, the previous regime made it legal & Senasingha is not the only politician to sell the permit. I was a witness to 2 such incidents in March 2016 & I am sure every politician, apart from a very few, have profited by the sale of duty free cars at some time.

    It wouldn’t be too difficult to get a list of high profile Govt. Officials (forget the doctors & junior officers, the list would be endless) in the past decade with details of who imported what, when & what happened to the vehicle. It would make interesting reading & at least an opportunity to acknowledge & appreciate any body who played by the rules & ethics.

    Sujeeva Senasinghe talks like a honest man while been a Trinity College crook.He is supposed to be a lawyer too.The crux of the matter here is that this concession is given to MPs to facilitate their work and not to sell permits for a astronomical sum.If it is stated in the Circular that the Permit could be sold then the authorities are encouraging robbery under the guise of service to the people.

    The whole point that one draws from this story is the ENTIRE system is absolutely corrupt after the terrible Rajapaksa years.

    All the dishonest MPs who either elected or appointed through the National List after being rejected by the people at the general election have taken a constitutional oath to be faithful to the Constitution and the Law.

    All the tax-free permits have been issued to MPs under Section 3C of the Excise Special Provisions Act, however, surreptitiously dodging any condition against unlawful disposal of permits. The law allows MPs to import and use vehicles to discharge their office effectively. The law further specifies that if any person intends to sell any such vehicle should obtain prior approval from the Director General of Excise and pay all levies exempted at the time of importation.

    But what these dishonest politicians do is selling their permits to car dealers at a huge price. The dealers who purchase these permits import vehicles absolutely free from any tax, denying over 33.5 million rupees to government revenue. They are profited with a minimum of 8.5 million rupees as permits are purchased at 25 million rupees. The profit margin may defer according to value of the vehicle. For example for US made Hummer Jeep, the tax exemption is over 44 million rupees and the dealer gets a profit of minimum of 19 million rupees

    This is absolutely a day light robbery of government revenue, in a country where poor man pays over 2 million rupees on 600cc Indian made Maruti car.

    In my opinion Sri Lanka is a pseudo democracy. The Judiciary must act fearlessly to restore true democracy in this country and it cannot turn a blind eye to this gross abuse of people’s legislative and executive power by a group of corrupt MPs. It must respect its constitutional obligation to the people and use this opportunity to clean up the dirty politics.

      If this is true then why not make a complaint to the Director General of Excise who should file a case?

      Is this only for the MPs or all who sell their permits?

      My understanding has been that transferring the permits is totally legal since some years.

    How many his Sinhala Buddhist brothers and Sisters ( that is If Senasinghes’ call them as such ) can buy a house or even a little shed in the South, where the great majority of the Sinhala Buddhist are living due to unavoidable reasons?.

    How many other Sinhala Buddhist Politicians in the UNP have collected their lottery wins so far, besides the FM who bought a set of wheels worth LKR 70 Million to give inhabitants Yahapalanaya.?.

    Has Speaker Karu Jayasuriya , one time UNP Sinhala Buddhist Faction leader donated his winning lottery to the poor Sinhala Buddhists, who are supporting his apprentice who is now carrying on like a pork chop in Hambantota?.

    Do these Sinhala Buddhist Politicians know that the USD 70,000 in FX for the Toyota is paid by the Maids in the Middle East, whom the supporters of these UNP politicians denigrate as Prostitutes serving Arabs?.

    Who paid the LKR 34 Million 700 thousand to young Sujeeva for his Permit?.

    Sujeewa senasinghe has sold his car permit probably legal. That is not the issue it is the morality of this man who has made a handsome profit causing a loss of earnings for the government. This is whilst loading the poor with increased vat and increased cost of living. What is the Yahapalanaya regime got to say about this double talk and blatant immorality. What this country lacks is morals that cannot be overridden by law. Senasinhe should resign.

    The fault is in the system. This is a huge betrayal by the Yapalanaya government. After riling the previous government of corruption and nepotism, this government is guilty of the same crimes. It looks like you cannot change the colour of the crow however much you try.

    It is interesting to know whether Country’s Tax Authorities has a mechanism to find out the financial means of the person who purchased the permit from Senasinghe and as a person who has the capacity to use or re-sell such a valuable vehicle pays income tax to the Government.Nimal

    We had Politicians in the past who spent their own family wealth when in power. Then Sevala Banda opened the flood gates for the hoi polli also to enter parliament to do politics. Since this new breed of Politicians, some elected through hat collections for their deposit, did not have any personal wealth. In order to provide means to this new breed concessions were granted. They not only took advantage of the concessions but also robbed the State silly for generations to come, throwing only the bones for Public Welfare. Serves right for these Socialist minded Donkeys in the country.

We voted for a change of government expecting a change of attitude from our so called leaders. How can we call these rouges leaders??? No way. Sick of politicians.We should send them all to mars – from the UNP, SLFP, JO, JVP, NFF, SLMP, ETC ETC.

    Some people have been clmouring for ‘ EDUCATED ‘people with a ‘Good Social Background’ in politics. Senasinghe is one who belongs to this category. Has he behaved like a educated person with high integrity and morality ? If JVP MPs and their own Ranjan Ramanayaka could manage without luxury vehicles, being a person with some financial background why can’t Senasinghe set an example? Can these caliber of politicians ask people to make sacrifices for the good of the country ? What can the Civil Society activists who helped to form this government expect from these MP’s, especially to get progressive legislations such as Audit Act etc, passed, without diluting them?     The intention in giving MPs duty-free vehicle permits is so that they will use the vehicles for their work as elected representatives. People like Rajitha Senaratne another of those loud-mouth politicians said recently they needed good vehicles because of the poor condition of the roads and they had so many civic duties to perform.
    Given the purpose for which duty-free permits are issued, if Sujeeva Senasinghe had no need of such a vehicle for his official work, then he should have turned down the offer and showed that he was genuinely interested in saving money for the country which they claimed was in financial straits.
    How then can he justify selling the permit and making money for himself. Where is the morality and the public concern in that?
    Will Senasinghe provide a justification for his action which is nothing more than personal aggrandizement?
    Is this what his old school Trinity taught him or did he acquire this during his political journey? What is the difference between the UNP and SLFP when it comes to pecuniary thanha

      You are wrong. The cases receive attention in the media and might help to force the MPs change their manners. They need votes and if there is a big enough revolt they will stop using vehicle permits for easy money.

    This is not just for you but for most ignorant people, who knows nothing of their democratic rights that are being ransacked by the dishonest politicians

    Most self-centred lawyers practice law in the superior courts are fearful of disturbing the established system, as any such move could harm their practice. They are just nothing more than chicken. Some may disagree but this is the hard truth.

    In this country the whole system is absolutely corrupt including the judiciary. That is why CJ (appointed outside the due process by MS RW administration) ruled that the appointment of defeated candidates through the National List is not a matter of National opinion. And this is why CJ Mohan Peiris pleaded with Prime Minister not to remove him promising to give any judgment to please the government. This simply demonstrates the attitude of our judges who are exercising people’s judicial power.

    In this backdrop the role played by the British and Lankan Lawyer and rights activist Nagananda Kodituwakku for no fee and apparently upsetting the Judges in the Superior Court is a task probably no other lawyer can perform in this country.

    Any fool knows that abuse of office of MP to sell a tax-free car permit (issued to import and use a car to discharge the office of the MP more effectively) for 25 million rupees is a criminal offence as any such action would favor dishonest MPs and a car dealers who buy a permit for 25 million to defraud 33.5 millions of tax revenue. These Toyota Land Cruisers imported on MP permits are freely available for sale at car sale centers for 40 million rupees. The dealers who import vehicles on these permits get a clear profit of 8.5 million from the total of 33.5 million rupees tax evasion, after the rouge MP is paid 25 million rupees for the permit.

    This is why some argue that Sri Lanka is a pseudo democracy, where people are totally deceived by their representatives. These so-called representatives who engage in all forms of abuses also claim that not only people’s legislative power but they also exercise people’s judicial power and therefore the Judiciary should exercise judicial power for them.

    Very recently MP Wickramasinghe said in Parliament that only MPs have judicial power and Judiciary is trying to hijack MPs judicial power.

    I think first and foremost before criticizing very rare character that fearlessly fights to restore true democratic rights of the people who have been conned by corrupt politicians, one should comprehend the true state of affairs in this country.

    I believe it unfair to single out Sujeewa Senasinghe here, True he has made a mistake, he should have asked the dealer who bought his permit not to allow transfer the vehicle in the name of buyer of vehicle but to use it under his name. This is a bit mistake on Sujeewa’s part, but it is too late now.

    According to Thalatha Athukorala, all MPs except her, speaker and PM have sold their permits.

    Do the MPs not receive an interest free loan from a state bank for importing these duty free vehicles? What happens to the loan after the MPs sell the vehicle?

    Do the MPs in practice receive cash for the permit AND keep the interest free money they borrowed to import the vehicle? If they keep the loan the “profit” from the deal doubles?

    Why would anybody repay an interest free loan unless they have to?

    Hope that you can provide details on the interest free loan.

    The “permit cash” and loans should appear on the declaration of assets.

    Where can I find information on the total remuneration package our MPs receive? Salary, allowances, health care and especially the interest free loans. I don’t care about their free food at all.

    Senasinghe fans ask why people single him out and attack in this manner whilst most of the MPs have sold their permits by now.

    Some of them say when “millions are being exchanged among the Raja and his goons now in the government and you guys are after peanuts”.

    This may be so, because Senasinghe and the UNP sold the words;”Good Governance” and “Corruption” to come back to power in the last general elections after long years in the wilderness, promising people restoration of Good Governance and eradication of corruption and misuse of power. UNP after suffering humiliating losses at all the local Govt./Pradeshiya Sabha elections except UVA Province elections was able to register some gains at the last General Election due to the Campaign launched by Late Ven Sobhitha and rest of Civil Society organisation for creation of a just society.

    In this backdrop people consider that Senasinghe and other MPs/Ministers who campaigned on the Good Governance Platform have betrayed the trust placed on them and have engaged in financial misadventure. Jayasinghe

    UNP or Senasinghe can not do a Thing . they are not incharge they are mere puppets on strings.

    As long as any government holds on to any form of executive powers , remember such a government can never exerciser good governance.

    Until This nation’s constitution is properly and sincerely returned to a peoples power, do not expect any good governance even from your own father .

    Executive powers have seen men go completely insane, not just in Sri Lanka , but else where too and some have been killed like dogs with rabbis, to-much power turns even the noblest of men to beast.

    Sri Lanka can only be saved by the people. and that is, they must lay down the rules through a public committee, which must be formed by the people even before going to polls.

    The public must take full control of the Police and give the policeman the dignity of being able to excise their duty without any political interference, pay them a very decent salary to encourage them to avoid corruption, to be able to take care of their families, send them overseas for training , we do not realize how important are our Policeman.

    Let them create real ,not fake , Public committees to take charge and run, Tender procedures , special perks like duty free for some of our deserving members among the citizens , Then all sorts of discrimination against all citizens , Monitoring of Religious affairs of all religions , Judicial systems, Elections , Environments , education ,Health , Immigration ,Customs and housing .and such committees should be vested with special powers to sack errand politicians and their cronies .

    Until then do not even dream of good governance , we need to move beyond Switzerland in our Constitution.

    mahinda has the strings of the PA members in the government as well as in The Joint opposition.

    maithree has only the UNP and Ranil’s string , with no choice left , when ever he needs to take action . Mahinda pulls the strings , and his puppets in The Government and opposition sing and dance t his tune , then Maithree pulls the strings of his Puppets to join the party to dance and sing to the same tune.

    If maithree takes one real action against Mahinda or any of his cronies , the entire membership of Maithree will cut off their strings and just crossover and leave him dry with only UNP and will be left with no their choice but to dissolve parliament.

    People need to take a chance and vote as much as possible( decent) UNP members into the Local government and then next election usher in a complete UNP government with Sajith Premadsa as the Pm and Ranil as the mentor Minister and reelect Maithree as a figurehead president.(not executive)

    And meanwhile Just bear with the Rajapakshe dramas , nothing anyone can do about it, its a part of the play ,so let it go on until next General election.

    People know that every MP spent a lot of money for their election campaign. The government is fully aware of it. Giving this facility did cost nothing for the government and it is always better than paying santhosam them from Treasury Funds.

    These MP permits on the other hand have been issued with an option either to import a vehicle or to sell permits. So what’s wrong in selling the permits that cost taxpayer nothing.
